Passage on First Reading of AN ORDINANCE approving the officer training agreement by and among the Northern Virginia Criminal Justice Academy, the City of Alexandria, the County of Arlington and the County of Loudoun which has been prepared in conjunction with the acquisition, financing and relocation of the Northern Virginia Criminal Justice Academy's police training facilities, and authorizing the city manager to execute the officer training agreement on behalf of the city.

WHEREUPON, upon motion by Councilman Jackson, seconded by Councilwoman Pepper and carried unanimously, City Council approved the consent calendar as presented with the exception of Docket Item Nos. 13 and 17 which were considered under separate motions. The City Manager's recommendations are as follows:
11. City Council received the following resignations with regret: (a) Matt Korot from the Alexandria Environmental Policy Commission; (b) John McGinley from the Alexandria Local Emergency Planning Committee; (c) Kecia Doyle from the Recycling Study Subcommittee of the Alexandria/Arlington Waste-to-Energy Task Force; and (d) Jay Fisette from the Alexandria Task Force on AIDS; and requested the Executive Secretary to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

12. City Council (a) appointed Joan Bondareff as a Representative from the Alexandria Environmental Policy Commission to the Alexandria Ad Hoc Committee on Electromagnetic Fields in Old Town; (b) appointed Kristin Kappmeyer as a Representative from the Alexandria Board of Architectural Review - Parker-Gray District to the Alexandria Ad Hoc Historic Design Guidelines Advisory Committee; (c) appointed Jonathan Amy as a Health Care Professional to the Alexandria-Caen Exchange Committee; (d) appointed Richard Adams as a Citizen Member to the Alexandria Commission on Aging; (e) appointed Mary McDonald as a Representative from the Business Community to the Alexandria Commission on Persons with Disabilities; (f) appointed James Matheson as a Senior Citizen Member to the Alexandria Environmental Policy Commission; (g) reappointed Robert Klausing as a Member Nominated by the Veterans of Foreign Wars to the Alexandria George Washington Birthday Celebration Committee; (h) appointed Eleanor Denegre as a Representative from the Historic Alexandria Foundation and reappointed Florence King as a Business Representative to the Historic Alexandria Resources Commission, and (i) appointed Paulette Hamilton as a Parent Member to the Alexandria Youth Services Commission.
14. City Council (a) allocated $249,246 from Account 040006-9712 (Cash Capital) to Account 220863-2121 (Fire Department Apparatus) for the purchase and installation of eight exhaust removal systems and one diesel filtration system; (b) awarded a contract to Air Cleaning Technology, Inc., in amount of $228,874, for the exhaust removal systems; (c) authorized a contingency allowance of $11,444 included in the allocation request; (d) authorized the purchase of a diesel filtration system in the amount of $8,928; and (e) authorized the City Manager to sign the necessary contract documents.
15. City Council approved the commitment of supplemental funds in the amount of $3,307 for the Danny Chitwood Early Learning Institute Special Caring Respite Project, for a total local grant match of $4,507.
The approval of supplemental funds is recommended by the Early Childhood Development Commission.
16. City Council approved the commitment of $40,000 in local matching funds during FY 1994 for the proposal submitted by Mount Vernon Elementary School to continue operation of the Program for Four-Year Olds, a school-based early childhood education program serving 16 at-risk children and their families (Attachment I to the City Manager's memorandum).
This proposal is recommended by the Early Childhood Development Commission, which further recommends that if Mount Vernon Elementary School does not obtain a significant portion of the matching funds by June 30, 1993, the City's local matching funds be released to another project.

13. Consideration of a Proposal to Name the Boxing Facility at the Charles Houston Recreation Center the Fred Smith Center.

(Vice Mayor Cleveland spoke to this item since Fred Smith was such an inspiration to young men. He gave the young men direction, structure, and a sense of self-discipline and self-respect.

WHEREUPON, upon motion by Council Member Rich, seconded by Councilman Donley and carried unanimously, City Council approved the commitment of $36,800 in local matching funds for a proposal submitted by the Alexandria Even Start Consortium to establish an Even Start Program to provide a family literacy program that concentrates on the role of the whole family in the education of the children (Attachment I to the City Manager's memorandum).
This proposal is recommended by the Early Childhood Development Commission, which further recommends that if the Alexandria Even Start Consortium does not obtain matching funding by June 30, 1993, the City's local matching funds be released to another project.

20. Consideration of an application for $280,000 from ALIVE, Inc. to Renovate and Expand the ALIVE House Emergency Shelter.

(General Discussion. Members of City Council participated in the discussion of this item.
Ms. Davis, Director of Housing, indicated that staff would put language with respect to the repayment of the loan in the loan documents something to the effect that as long as it operates as a shelter or some other use that's approved by the City Council in the future it need not be repaid.
The oversight of similar requests would include financial evaluation as to the feasibility of these requests. Ms. Davis indicated that each request would be looked at on an individual basis and a determination made as to whether they were able to repay or not. Whomever it is who may be applying for funds should apply directly to the Office on Housing. Other sources of funding are available besides the Housing Trust Fund. These organizations may also be eligible for funding under the HOME Program or the CDBG program.)
WHEREUPON, upon motion by Councilman Donley, seconded by Councilwoman Pepper and carried unanimously, City Council (1) approved a no-interest loan of $213,000 to ALIVE, Inc., consisting of $162,825 in Housing Trust Fund monies and $50,175 in General Fund monies from the Low- and Moderate-Income Housing Assistance Fund, to be repaid if the facility ceases to be used as a shelter; and (2) approved the following budget transfers:

21. Consideration of Approval to Use City Facilities and Personnel for the Alexandria Red Cross Waterfront Festival on June 11, 12 and 13, 1993.

(General Discussion. The Mayor and Members of City Council participated in the discussion of this item.

WHEREUPON, upon motion by Vice Mayor Cleveland, seconded by Councilwoman Pepper and carried unanimously, City Council approved the use of the following City facilities and personnel for the Twelfth Annual Alexandria Red Cross Waterfront Festival on June 11, 12, and 13 and set conditions for their use. All City costs associated with the festival are paid for by the Red Cross, and include permits and license fees, facilities and equipment rental fees, and staff fees at the appropriate overtime rates. These fees are estimated to total $37,411 this year, and are not to be waived. The Red Cross made a net total of $220,585 on the festival last year.
A. Use of parks, equipment and public facilities (Attachment 1 to the City Manager's memorandum):
1. The use of Oronoco Bay Park from 12:00 p.m. - 10:00 p.m. on Friday, June 11; 11:00 a.m. - 10:00 p.m. on Saturday, June 12; and from 11:00 a.m. - 7:00 p.m. on Sunday, June 13. Red Cross personnel and City staff will start placing equipment in the park on Tuesday, June 8 and clean the area on Monday, June 14.
2. The use of Founders Park (east side along cinder track) during festival hours for passive displays and activities as agreed upon by Founders Park Citizens' Association.
3. The use of the Torpedo Factory Piers (north and south) and the Founders Park Piers (north and south) at the City marina for berthing and servicing of visiting ships during festival hours.
4. The use of the City's stage, five tents, water buffalo (a large container for cold water) and additional picnic tables.
5. The closing of the following streets and a section of the bicycle path to vehicular traffic (except Festival and emergency vehicles) from 12 noon Friday, June 11, through 9:00 p.m. Sunday, June 13:

- Bicycle path between Montgomery and Oronoco Streets
- Madison Street east of Fairfax Street to the school rowing facility;
- Pendleton Street east of Fairfax Street to Union Street;
- Oronoco Street east of Union Street to the river;
- Union Street north of Oronoco Street to Pendleton Street;
- Montgomery Street east of bike path to the river.
6. A ban on parking on the following streets from 8:00 a.m. Friday, June 11, until 9:00 p.m. on Sunday, June 13:
- Madison Street east of Fairfax Street to the river;
- Pendleton Street east of Fairfax Street to Union Street;
- Oronoco Street east of Union Street to the river;
- Union Street north of Oronoco Street to Pendleton Street;
- Fairfax Street from Oronoco Street to Montgomery Street.
B. Permits:
1. To allow the temporary occupancy of public spaces for displays, exhibits, events, demonstrations, sales, trash removal, toilet facilities, amusement rides and other like activities (Attachment 2 to the City Manager's memorandum);
2. To allow the on-site sale of food, beer and wine/wine coolers during festival hours;
3. To allow the performance of staged musical events in Oronoco Bay Park on Friday, June 11, 5:30 p.m. - 10:00 p.m.; Saturday, June 12, 11:00 a.m. - 10:00 p.m.; and Sunday, June 13, 11:00 a.m. - 7:00 p.m.;
4. To allow a fireworks display to be conducted on the waterfront on June 11 and 12 at 9:15 p.m.;
5. To allow a 10K footrace on Sunday, June 13, at 8:00 a.m., beginning and ending on North Fairfax Street between Madison and Montgomery streets. A new course has been proposed to help reduce congestion on the bike path south of Hunting Towers Apartments (Attachment 1 to the City Manager's memorandum); and
6. To allow the placement of Red Cross flags on utility poles from June 9 - 14, from the 100 block of North Union Street to the 500 block of North Union Street, Oronoco Bay Park, and the City marina.

C. Set Conditions For Use:
1. No permits or license fees, facilities or equipment, rental fees, or staff costs required for the Festival shall be waived since the Red Cross raises a substantial amount of money from this festival.
a. Rental and staff fees shall be billed by the City on or before June 30, 1993, with payment due on or before July 30, 1993 (Attachment 3 to the City Manager's memorandum), and
b. All permit fees shall be paid in advance; all insurance requirements shall be met and the park bond shall be posted in advance (Attachment 4 to the City Manager's memorandum).
2. The Red Cross shall be responsible for the restoration of landscaping, grass, sprinkler systems, light poles, and other park amenities at Oronoco Bay Park, and the City marina area, and all other public rights-of-way as requested by the City. A $2,500 bond shall be posted. Additionally, the Red Cross will be assessed a restoration fee to aerate, seed and fertilize the park after the festival where necessary (Attachment 4 to the City Manager's memorandum).
3. Beer and wine sales will be limited as follows: On June 11, 5:00 p.m. - 9:00 p.m.; on June 12, 12:00 noon - 9:00 p.m. with the exception of 4:00 p.m. - 6:00 p.m. which will be a two hour dry period for all alcoholic beverages; and on Sunday, June 13, 12:00 noon - 6:00 p.m. No beer or wine/wine coolers are to be taken from the Festival grounds. No wine/wine coolers shall be sold by the bottle and all beverages sold must be served in plastic cups, including non-alcoholic beverages. No more than two alcoholic beverages may be purchased at any one time by a customer.
Other requirements pertaining to beer and wine sales are as follows:
a. Obtain and produce a Virginia ABC License and City Banquet License.
b. The Red Cross will provide T.I.P.S. training, (Training for Intervention Procedures for Servers of Alcohol), for volunteers who will be selling alcoholic beverages during the festival. These volunteers will not be permitted to consume these beverages while they serve them.
4. Where necessary, the Red Cross shall obtain permission from Federal, State and D.C. Government agencies and provide the City with copies of approvals and permits.
5. The Red Cross shall provide the City with copies of Certificates of Insurance for public liability and property damage of $1,000,000 with the City of Alexandria named as co-insured. The certificates shall cover waterfront docks, fireworks displays, Oronoco Bay Park, beer sales, and rights-of-way approved in this request (Attachment 4 to the City Manager's memorandum).

6. In addition, the Red Cross shall obtain and provide the City with a copy of a Certificate of Insurance for public liability and property damage of $1,000,000 per person and $10,000,000 per occurrence aggregate, with the City of Alexandria named as co-insured, to cover amusement rides. The City Attorney may agree to a lesser amount of insurance according to the quantity or type of rides.
7. The Traffic Division of Transportation and Environmental Services will supply barricades to be set up on Friday, Saturday and Sunday morning. The Red Cross will provide personnel to control each gate and barricade the area to prevent motor vehicles from entering the closed streets.
8. The Red Cross will provide the personnel necessary to keep the parks, streets and sidewalks clean at all times. The City will provide a trash truck and personnel for removal and dumping of bagged trash from the Festival site. The Red Cross shall pay all dumping and personnel fees connected with this service (Attachment 3 to the City Manager's memorandum).
9. The Red Cross shall notify and obtain, where possible, letters confirming participation and/or cooperation from the following organizations and groups that will be affected by the Festival and submit such documents to the City for review before this permit is processed:
a. United Way of America
b. Sheet Metal Workers' Association
c. D.R.I. (Dalton Wharf)
d. Gates Hudson Associates
e. Norfolk Southern Railway System
f. Robinson Terminal
g. Alexandria Chamber of Commerce
h. Founders Park Citizens' Association
i. Old Town Citizens' Association
j. The Alexandria House Tenants' Association
k. Tobacco Quay Residents
9. The Health Department must approve all food and beverage concessions prior to their arrival at the site. Adequate toilet facilities must also be provided.
10. The Red Cross shall provide and pay for night security of the festival grounds and along the waterfront.
11. The Red Cross shall be responsible for all docking fees incurred by visiting ships berthing at the City marina. It is also the responsibility of the Red Cross to inform the captains of all visiting ships of the time frame during which the Red Cross intends to pay docking fees, and advise them of City rates for all other times.

12. The Red Cross shall obtain a three-day banquet license and a three day business license from the City's Finance Department (Attachment 4 to the City Manager's memorandum).
13. All food sales will be conducted under tents or from booths and wagons located throughout the Festival site. Concessionaires include several Alexandria restaurants and clubs. The Health and Fire Departments will monitor these activities to ensure that all codes are met.

22. Consideration of the City's FY 1993 Contribution for the Alexandria Seaport Foundation.

(General Discussion. City Council stated that the FY 1994 contribution by the City to the Seaport Foundation will be discussed at a budget work session when it can be discussed and given its full merit.)
WHEREUPON, upon motion by Councilman Jackson, seconded simultaneously by Vice Mayor Cleveland and Councilwoman Pepper and carried unanimously, City Council approved the transfer of $32,269 from Contingent Reserves (103556-2751) to Other Recreation Activities (121905-2751) to provide for the remaining one-half of the City's FY 1993 contribution to the Alexandria Seaport Foundation. REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES
ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL
(a) Councilwoman Pepper noted that today is the 250th birthday of Thomas Jefferson.
(b) Councilwoman Pepper expressed concern about an article she read in the newspaper about Delta Airlines which is interested in using noisier airplanes at National Airport as well as increasing the number of flights and slots. Staff was requested to report back.
The City Manager indicated that Mr. Wilding at the Airports Authority is opposed to it, as is the Council of Governments staff. She indicated staff will contact both staffs to see if they feel that it would be necessary or important for the City Council to have a resolution.16
(c) Council Member Rich recognized the efforts by ARHA and in working with the City staff in their efforts in coming up with a surplus in their operating account this year, since just eighteen months ago they were on the verge of bankruptcy.
(d) Council Member Rich announced that Councilman Speck will be talking to the group known as Project New Course about the management audit that the City completed. The meeting is going to be at Baptist Temple Church on Commonwealth Avenue at 8:00 p.m. on April 14.
(e) Councilman Speck expressed concern about identifying the City of Alexandria in contrast to the County of Fairfax with an Alexandria mailing address. He requested that the City Manager direct Assistant City Manager Brannan to communicate to the media the difference between the City of Alexandria and Fairfax County section with an Alexandria address.
The City Manager stated that staff will explore changing name of Alexandria addresses not in the City with the postal service, Congressman Moran and will report back to Council of the results.
(f) Councilman Speck expressed concern regarding the recent closing of a couple of restaurants. He spoke specifically to the inaccuracies in a letter posted on the door of Henry Africa by its owner.
Ms. Steele, Deputy City Manager, and Mr. O'Kane, Director of Transportation and Environmental Services, participated in the discussion of this item with regard to valet parking.
Staff will advise the owner of the errors in the letter.
(g) Councilman Speck congratulated the staff involved in establishing the employee productivity suggestion incentive program. He stated that it looks like a really excellent program and requested the City Manager to keep Council informed on what kind of feedback there is.
(h) Councilman Speck announced that on April 15 at 8:00 a.m. there is going to be a field trip walking down the Parkway starting at the northeast corner of Slater's Lane and Abingdon and walking towards the airport and back. He indicated they are going to try to look as closely and as unfiltered as they can at a lot of the issues that seem to be percolating on the matter of Parkway access as it relates to development of Potomac Greens. Anyone interested in joining is welcomed.
(i) Councilman Speck announced the Celebrity Bake off to be held on Saturday in the Council Workroom during the public hearing meeting. Members of Council are encouraged to bring their specialty so that it can be judged. Proceeds from this "judging" will be donated to the "Christmas in April" project.
(i) Councilman Donley reported on meeting with officials regarding the City's interest in attracting the UVa / VPI Northern Virginia Graduate Center to Alexandria.
Mayor Ticer participated in the discussion.
(k) Vice Mayor Cleveland stated that he had the pleasure of going to George Mason Elementary School to see a group of students from the area high schools from Virginia, Maryland, and D.C. who put together a play called "City of Peace". He recommended that everyone should see it.17
(l) Mayor Ticer announced that she attended a breakfast recently at which time the Golden Rule Awards were given by J. C. Penney. The recipients of the group award this year was ALIVE. The following individuals were finalists: Dr. Kanajian who has worked at the Arlington Men's Shelter which is an Alexandria/Arlington Consortium; John Morrison who is president of Residential Youth Services; and Robert Pollard who volunteered a large portion of the building materials and the labor for the construction of This Way House. It was a very nice event.
(m) The City Attorney briefed Council regarding Alexandria and Arlington participation as amicus curiae in Supreme Court "Waste-to-Energy Ash" case.
Members of City Council participated in the discussion of this issue.
