The Meeting was called to order by Mayor Ticer, and the City Clerk called the Roll; all Members of City Council were present except Councilman Jackson who arrived during the discussion of Docket Item No. 5.

24. Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE (a) to create a new residential permit parking district bounded by the east side of Washington Street, the south side of Wolfe Street, the north side of Princess Street and the Potomac River, in which parking by nonresidents of the district will be limited to two consecutive hours between 8 a.m. and 2 a.m. Monday through Saturday, and on Sunday between 11 a.m.- and 2 a.m., (b) to establish a $50 fine for parking in the new district beyond the two-consecutive-hour maximum, and for parking in the 200 and 300 blocks of Columbus and Alfred Streets, the 900 block of Cameron Street and the 700 block of Queen Street in violation of the parking restrictions currently in effect in these blocks, and (c) to extend to 11 p.m. the period in which the restrictions currently applicable to metered and other nonresidential restricted parking spaces in the new district will remain in effect.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Vice Mayor Cleveland and carried unanimously, City Council approved the Consent Calendar as presented. The City Manager's recommendations are as follows:

6. City Council received the following resignations with regret: (a) Larry A. Jenkins and James F. O'Sullivan from the Alexandria Commission on Employment; and (b) Claire M. Eberwein from the Alexandria Economic Opportunities Commission; and requested the Executive Secretary to send the appropriate letter of appreciation and to advertise the vacancies in the usual manner.

7. City Council reappointed Francis Slate as a Representative from the Board of Directors of the Alexandria Convention and Visitors Bureau to the Alexandria Sister Cities Committee.

8. City Council authorized the City Manager to execute the required documentation to submit the renewal funding application to the Department of Youth and Family Services.

9. City Council authorized the City Manager to submit the application and to execute all necessary documents and contracts.

10. City Council authorized the City Manager to apply for the grant and execute any necessary documents.

11. City Council authorized the City Manager to submit this grant application and to execute all necessary documentation.

12. City Council allocated $70,000 from Account 235390-9212 (Developer's Contribution) to Account 235390-2121 (Traffic Control Facilities) to install a new traffic signal on Stevenson Avenue at the main entrance to B.J.'s Wholesale Club building site, approximately 300 feet west of Van Dorn Street. These monies have been received from the developer as required under Special Use Permit (S.U.P.) #2553.

13. City Council allocated $60,000 from Account 235390-9212 (Developer's Contribution) to Account 235390-2121 (Traffic Control Facilities) to install a new traffic signal on S. Pickett Street at the main entrance to The Home Depot building site, approximately 700 feet north of Edsall Road. These monies have been received from the developer as required under Special Use Permit (S.U.P.) #2505.

14. City Council noted the withdrawal.

15. City Council (1) authorized the Purchasing Agent to issue a Request For Proposals for parking management services for City facilities; (2) authorized the City Manager to return to Council with staff recommendations with regard to the award of a contract to the firm that provides the best financial return and parking management services; and (3) authorized the City Manager to sign the necessary contract documents.

16. Discussion and Consideration of Maintaining the Current Language in the Old Town Small Area Plan Regarding New Restaurants. (Councilman Speck)

(General Discussion. The Members of City Council, the City Attorney, the City Manager, and Mr. Lynn, Director of Planning and Community Development, participated in considerable debate on this issue.)

WHEREUPON, upon motion by Councilman Donley, seconded by Councilwoman Pepper and carried unanimously, City Council reworded the City Manager's recommendation to say that staff will use the following criteria when considering and receiving an application for a restaurant in the Old Town area:

City Council (1) supports the Old Town Small Area Plan, as does the Old Town Civic Association, which prohibits new restaurants east of Fairfax Street and few, if any, between Fairfax and Washington Streets until City Council receives the results of the Old Town Parking Study in April 1993. [Staff interprets this not to apply to the replacement of existing restaurants, provided that they do not increase the number of bar seats or the size of the bar.] (2) that in the case of applications for 1) new restaurants in the area between Fairfax and Washington Streets, or 2) intensifications of existing restaurants between Fairfax and Washington Streets, there shall be no ABC service at other than dining tables (i.e., no bar seats). (3) that in the case of replacements of existing restaurants between Washington Street and the Potomac River: (A) if there are no existing bar seats, there shall be no new bar seats; (B) if there are existing bar seats, there shall be no additional bar seats; (4) required that an analysis of the predicted traffic and parking impact of any restaurants listed above shall be prepared before the application is considered; and (5) directed the City Manager to analyze the issues with respect to restaurants west of Washington Street and to report back to Council next spring when staff presents its report on the parking program east of Washington Street. 17. Consideration of a Questionnaire for School Board Applicants. (Council Member Rich)

18. Consideration of a Local Funding Agreement Between Alexandria and the Washington Metropolitan Transit Authority (WMATA) for the Metrorail Construction Program.

19. Consideration of Setting the Selection of a Developer for the Cameron/Columbus Street Parking Lot for Public Hearing on June 13, 1992.

(General Discussion. Members of City Council and Mr. O'Kane, Director of Transportation and Environmental Services, participated in the discussion on this item.)

Councilman Speck stated that his office for his personal business is a tenant in one of the buildings that is owned and operated by one of the two developer/builders. His office is part of a Richmond-based firm and they deal with the rent and dealt with all of the negotiations. He consulted with the City Attorney some time ago and it is his opinion that he will not be directly affected nor benefit nor be harmed by any decisions that are made. He intends to participate fully in this decision.

WHEREUPON, upon motion by Councilman Donley, seconded by Councilwoman Pepper and carried unanimously, City Council set a public hearing to select a preferred developer on Saturday, June 13, and that once the preferred developer is selected, staff will negotiate the terms of the agreement. (Under consideration of the Council Calendar, City Council set a work session for a presentation by the two developers on Tuesday, May 26, 1992, at 6:30 p.m. in the City Council Chamber.] The voting was as follows:

REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilman Speck brought up the letter he received from John Travis concerning his application for the School Board. His issue is that he did not know that there was a deadline for the application and he wants Council to make an exception. Councilman Speck spoke to Ms. Boyd and sees that he was not mislead and he sees no need for a special exception.

Councilman Jackson indicated that he has an appointment with Mr. Travis to discuss this and he would like to have an opportunity to talk to him before making a decision. The question has been presented to Council before when an applicant missed a deadline and Council decided that there was no basis for extending the deadline and going on past experience that might very well be Council's decision.

WITHOUT OBJECTION, City Council took no action on this item.

(b) Councilman Speck has had telephone calls from people concerned about the library and asking exactly what Council did. Council approved the capital budget and explicitly acknowledged that there is need for substantial improvements to that facility. Councilman Speck requested staff to move as quickly as possible towards getting the architectural equivalent of a second opinion.

Council Member Rich requested that staff focus on how close to the $2.4 million can we extend that mezzanine to make it larger so that we can recapture some of the stack space. There should be something that can be done.

Councilman Speck requested that the City get a second opinion that among other things confirms the question that you cannot stay within that shell, bring it up to code and not lose stack space. That is a matter Council has been told that is absolute and if Council is going to make that kind of capital commitment, he would like to have one more opinion.

Mr. Gitajn, Director of Financial and Information Services, stated that the City can ask another architect that the City has on retainer to review the architectural efforts as opposed to coming with brand new architectural specs. Council stated that is fine and staff will come back with a report as soon as possible.

(c) Councilman Speck requested that over the summer that staff gather information that tells Council how other Councils and other governing bodies, not only in this area but some of the national statistics that are gathered, whether we are on the right track in the things that we do, less or more, and allow us to make some decisions about the issues that we have discussed for some time now. Specifically referring to the issues of meals, parking, compensation, retirement, health insurance, cost-of-living increases. Whatever, there is a lot of data out there on what governing boards do, and he thinks that rather than just make decisions that we deserve it or we don't, we ought to study it enough to have some sense of what the universe of governing boards do in these matters. Information to be provided for discussion at fall retreat.

(d) Councilwoman Pepper stated that with the beginning of the user fee there will be no more need for the Trash Rebate Formula Committee. She would like staff to consider the possibility of having perhaps the same people or different people on a committee which would be talking in terms of the condominiums and City services. Staff to get back with a report.

26. Consideration of City Council Schedule.

WHEREUPON, upon motion by Councilman Donley, seconded by Councilman Jackson and carried unanimously, City Council adopted the City Council Schedule as amended as follows: (1) set a work session with the two developers for 20-minute presentations for the Cameron/Columbus Street Parking Lot in the Council Chamber on May 26, 1992, at 6:30 p.m.; (2) Councilman Donley stated that a primary objective of the Council is to adopt the Zoning Code by July 1; and (3) set the School Board applicant interviews for Monday, June 8, at 7:00 p.m., not to exceed 30 minutes. New Business Item No. 1: WITH UNANIMOUS CONSENT OF COUNCIL, staff was requested to request that the School Board applicants not come into the room while other applicants are being interviewed.

New Business Item No. 2: Councilman Speck requested staff to give Council a very quick synopsis of how everyone else in the area run their meetings and provide some information as to whether Council might want to consider its schedule.

Councilman Jackson stated that one of the reasons why we hold meetings in the evening after working hours and on Saturdays is because of public participation and that has to be taken into account regardless what other jurisdictions may be doing.

THERE BEING NO FURTHER BUSINESS TO BE CONSIDERED, upon motion by Councilwoman Pepper, seconded simultaneously by Council Member Rich and Councilman Jackson and carried unanimously, at 5:40 p.m., the Special Meeting of May 12, 1992, held at 4:00 p.m., was adjourned. The voting was as follows:
