(Councilwoman Pepper stated that she had tried to get a clear understanding as to whether or not she does or does not have a conflict of interest in this situation. It has not been clearly defined in her mind if she does or not. According to the Commonwealth's Attorney and the City Attorney, she does but that it would be appropriate for her to only declare that the conflict exists, but that if she can be objective she could go ahead and vote and this would not be inappropriate and would not be unlawful. However, because this is just not clear in her mind and because there are some details that she is uncertain about, she is not going to be voting on this matter. She would not even want the appearance of there to be a conflict of interest, so she will neither discuss this nor will she be voting for it.
Councilwoman Pepper left the bench for the discussion of this item.)
WITHOUT OBJECTION, City Council gave the opponents and proponents five minutes each to speak to this issue.
(The following persons spoke in opposition to the present policy:
Hugh McClees, 3305 Elmore Drive, a citizen representative of the EMS Council;
Barbara P. Beach, 128 N. Pitt Street, attorney representing Jefferson Hospital;
Councilman Jackson asked questions of Ms. Beach.

Councilman Donley asked questions of Dr. Shuster.
Thom Mayer, Fairfax County Emergency Services Council, Gallows Road, Fairfax, doctor who chairs the National Trauma Committee for the American College of Emergency Physicians.
Steve Meyerson, 5417 Barrister Place, Vice President of Alexandria Hospital, spoke in support of the present policy.
There was considerable discussion of this item. The Members of City Council; Mr. Whitmore, Director of Emergency Medical Services; and Ms. Evans, Assistant City Manager, participated in the discussion.
8
Councilman Speck spoke regarding the issue raised about his participation in the vote of this item. He stated for the record that he resigned as Chairman of the Corporate Board of the Alexandria Hospital concurrent with being sworn in on City Council. As far as he is aware there has never been a standard applied to any Member of Council to disqualify themselves from a vote based on past community service. If that standard were applied, he suspected that probably all of them would find themselves in a series of conflicts. He dismissed that suggestion as out of hand and as being a deflection of the issue.
He also spoke to the voting of the Emergency Services Council on this issue.
Councilman Jackson requested staff to continue to take a look at this issue and, in particular, other factors which may not be geographically related factors such as emergency room waits and so forth might require decisions to be made perhaps by medical practitioners along the lines of the triage operation that are used in army medicine.
Councilman Speck requested staff to give City Council an informational piece sometime in the near future, that explains the waiting period for express care at Alexandria Hospital.)
WHEREUPON, upon motion by Councilman Speck, seconded by Vice Mayor Cleveland and carried on a vote of 5-to-1, City Council reaffirmed the Manager's Administrative Regulations on transportation of emergency patients.
The current policy on emergency medical services transports which is included in Administrative Regulation 9-10 is as follows:
"All patients will be questioned as to the hospital of their choice within the City of Alexandria, except when the patient is in need of Advanced Life Support care, (i.e. monitoring, drugs or I.V. therapy, etc.). Advanced Life Support patients will be taken to the Alexandria Hospital. If the Advanced Life Support patient requests to go to another hospital in the City, permission must be obtained from the on-line physician at the Alexandria Hospital."
