It was noted that prior to the start of the Public Hearing Meeting, at 8:30 a.m., City Council visited the Charles Houston Recreation Center to view a display of artwork by the neighborhood children, the center staff, and two artists from Howard University.

OPENING

The Meeting was called to order by Mayor Ticer, and the City Clerk called the Roll; all Members of City Council were present except for Councilman Jackson who arrived at 10:00 a.m.

(It was noted that a Notice of this Special Meeting had been previously served upon each Member of Council pursuant to a provision of the City Charter, a copy of the Notice certified by each Member of Council being on file in the office of the City Clerk and Clerk of Council.)

2. Public Discussion Period. (No more than 30 minutes) (This period is
restricted to items not listed on the docket.)

(a) John Chapman Gager, representing Friends of Homeless Animals and Old Town Yacht Basin Associates, spoke during this period.

(b) Larry Campbell, 511 Colecroft Court, representing Colecroft Homeowners' Association, expressed thanks to the City Council, the City Manager and the Police Department, for providing additional assistance in the neighborhood. The City has been extremely responsive by providing additional visible patrols and some additional undercover work in the area. He expressed thanks also on behalf of the Del Ray Citizens Association, the Rosemont Civic Association and the Braddock Station Association, for this additional assistance.

(c) Bob Dempsey, 214 Prince Street, representing the Alexandria Federation of Civic Associations, spoke to the Feddration's proposals with respect to the upcoming Budget at the last public hearing. He stressed that the Federation was merely making procedural recommendations and asked the Council to look at them and then decide on the merits whether they were good or bad.

He requested that Council should look at the City Employee Pension System and henceforth, for all new employees, go back to the contributory system. He requested Council to ask the staff to see whether this might be a viable project. He stressed that the Federation is not asking the Council to make a substantive change, but merely asking the Council to look at it. If it is without merit, then abandon it.

The City Manager responded to Mr. Dempsey's statement. The City Manager indicated that staff will address two issues. One, staff will go back and compare and contrast if they had been given the COLA instead of the 5% pension contribution what the experience over the years would have been. Second, respond to Mr. Dempsey's suggestion that we look at it for new employees rather than for employees who are on board now.

Councilman Donley thanked Mr. Dempsey for clearing the air. He requested that the Pension Study Committee look at the issue maybe over the summer.

(d) Ken Williams, 409 Tennessee Avenue representing "Save the George Washington Parkway", stated that they strongly oppose the at-grade access that has been discussed in the Potomac Yard/Potomac Greens SAP. Secondly, they support the 7.2 million square feet Planning Commission-approved proposal for this site. Third, they express strong concerns over the closed process that is now taking place in the final deliberations. They urge the Council to reverse its decision and open the hearings to both the public and the press.

(e) John Patrick, 13A E. Oak Street, speaking on behalf of the Federation of Civic Associations, spoke in regard to a letter that Council received from the Federation on the closing of the process concerning the Potomac Yard and 2020. The Federation endorses the cap which the citizens' task force on the Potomac Yard came up with which was 6.4 to 7.2 million square feet for the entire Yard. The Federation hopes that closing of the process at this point will not set a precedent for developers.

Mayor Ticer explained reasons for the process. She stated that absolutely no decisions have been made nor would be made and hopes that there will be something to be put on the table for public discussion. At this point, there is not a whole lot to put on the table, but there will be a public hearing on it and at least one more work session on it.

Councilman Speck commented that there is an obvious need to have some discussions with a smaller group to try to work out whether there is a basis for agreement on some complicated issues. This is a City that has provided an opportunity for citizen participation at every possible level and there is no reason to think that it is not going to continue so now.

At 10:00 a.m., it was noted that Councilman Jackson arrived.

It was noted that the public hearing was concluded.

Mr. O'Kane, Director of Transportation and Environmental Services, went through recommendations.

The Members of City Council, the City Manager, Ms. Steele, Deputy City Manager, Ms. Evans, Assistant City Manager, Mr. Lynn, Director of Planning and Community Development, and Chief Samarra participated in the discussion.

Staff will come back with report in June with respect to no "net" new restaurants east of Henry Street.

Staff will bring back ordinance changing parking fines in May. The design of the signs will also come back in May.

Staff to report back in June with respect to Sunday and holiday metering requirement.)

28. Public Hearing, Second Reading and Final Passage of AN ORDINANCE to vacate utility easements and a portion of the public sidewalk right-of-way at 701 South Pitt Street. (#32 4/14/92)

WHEREUPON, upon motion by Councilman Donley, seconded by Councilwoman Pepper and carried on a unanimous ROLL-CALL vote, City Council finally passed the ordinance, as amended, upon its Second Reading. The voting was as follows:

The ordinance finally passed as amended reads as follows:
ORDINANCE NO. 3563
AN ORDINANCE to vacate a portion of a sidewalk and utility easement which encumbers the property at 701 South Pitt Street in the City of Alexandria, Virginia.

WHEREAS, Jerauld and Anne Gentry ("Applicant"), who own the property at 701 South Pitt Street in the City of Alexandria, Virginia, have applied for the vacation of a portion of a sidewalk and utility easement which encumbers said; and

WHEREAS, the sidewalk and utility easement ("Easement"), a portion of which the Applicant seeks to have vacated, was dedicated to the City of Alexandria, in 1981, by John L. Motley, III, then owner of the property at 701 South Pitt Street, and is shown on the plat, entitled "House Location & Street Vacation Plat, Lot 3, Resubdivision of Lot 802, Block 5, Yates Garden, City of Alexandria, Virginia," dated October 2, 1980, prepared by Payne Associates and recorded in deed book 1039, page 43 among the land records of the City of Alexandria ("Plat"); and

WHEREAS, the Easement, a portion of which the Applicant seeks to have vacated, lies on property which, prior to 1981, was part of the public right-of-way of Franklin Street and which, in 1981, along with another part of the Franklin Street right-of-way, was vacated by the City of Alexandria, by Ordinance No. 2549, and conveyed to John L. Motley, III, by the Deed of Bargain and Consolidation, recorded in deed book 1039, page 40 of the land records of the City of Alexandria; and

WHEREAS, the portion of the Easement which Applicant seeks to have vacated measures approximately three feet in width and 86.5 feet in length and is shown on the attached Plat as the cross-hatched area, which Plat is hereby incorporated into and made a part of this ordinance; and

WHEREAS, the area encumbered by the portion of the Easement which Applicant seeks to have vacated is currently occupied by a public sidewalk which extends beyond Applicant's property into the existing public right-of-way of Franklin Street, and Applicant has agreed to relocate this public sidewalk, including the portion which lies in the public right-of-way of Franklin Street, at Applicant's sole cost, to a location acceptable to the City of Alexandria; and

WHEREAS, the vacation of the portion of the Easement which Applicant seeks to have vacated has been approved by the Planning Commission of the City of Alexandria at one of its regular meetings; and

WHEREAS, the procedures required by law, including the publication of notice in a newspaper of general circulation in the City of Alexandria, have been followed in conjunction with this vacation; and

WHEREAS, viewers duly appointed by the Council of the City of Alexandria have made their report in conjunction with this vacation; and

WHEREAS, in consideration of the report of the viewers recommending the vacation, of other evidence relative thereto and of Applicant's agreement to comply with the conditions set forth below, including the condition that Applicant will bear the entire cost of relocating and reconstruction of the existing public sidewalk, the Council of the City of Alexandria has concluded that the portion of the Easement which Applicant seeks to have vacated is no longer needed for public use, and that it is in the public interest that it be vacated; therefore,
THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:

Section 1. That the portion of the Easement shown on the attached Plat as the cross-hatched area and measuring approximately three feet in width and 86.5 feet in length be and the same hereby is vacated.

Section 2. That this vacation shall be and is subject to the following conditions:

(a) The Applicant shall, at its own cost, construct a new public sidewalk at a location and in a manner acceptable to and approved by the Director of Transportation and Environmental Services.

(b) Prior to commencing construction of the new sidewalk referenced in subsection (a), the Applicant shall confirm in writing to the Director of Transportation and Environmental Services that no overhead or underground utilities are located within the portion of the Easement to be vacated by this ordinance and, if any such utilities are so situated, the Applicant shall convey all necessary and appropriate easements to the appropriate utility companies in a form acceptable to the companies.

Section 3. That no recordation of this ordinance shall have any force or effect unless and until the Applicant has satisfied the conditions set forth in section 2.

Section 4. That the city manager be and hereby is authorized to do on behalf of the City of Alexandria all things necessary or desirable to carry into effect this vacation, including the execution of documents.

Section 5. That the city clerk be and hereby is authorized to attest the execution by the city manager of all documents necessary or desirable to carry into effect this vacation, and to affix thereon the official seal of the City of Alexandria, Virginia.

Section 6. That this ordinance shall be deemed to be enacted on the date of its final passage, but shall not be effective until the conditions set forth in section 2 have been satisfied, and thereafter a copy of this ordinance has been certified by the city clerk and has been recorded among the city land records as deeds are recorded. Certification by the clerk shall constitute conclusive evidence that the conditions set forth in section 2 have been satisfied. Recordation shall be indexed in both the name of the CITY OF ALEXANDRIA and the names of JERAULD R. and ANNE GENTRY, and such recordation shall be done by the Applicant at its own expense.

General Discussion. The Members of City Council participated in the discussion. Mr. O'Kane, Director of Transportation and Environmental Services, answered questions.

Councilman Donley requested that since the curbside recycling is going to be expanded, he suggested that the City work with the Alexandria Condominium Association and interested Condominium Associations, and apartment management firms, to publicize and maybe educate them a little bit more thoroughly about the drop-off centers.)

WHEREUPON, upon motion by Councilman Jackson, seconded by Councilwoman Pepper and carried on a vote of 6-to-0, City Council adopted the City's Solid Waste Management Plan to be submitted to the Virginia Department of Waste Management, as required by the Virginia Solid Waste Management Planning Regulations, making it very clear that Council is not, in any way, making any decision on the user's fee. AN ORDINANCE making provision for the support of the government of the City of Alexandria, Virginia, and for the payment of municipal expenditures by providing supplemental appropriations of amounts required to defray certain expenditures and liabilities of the city for fiscal year 1992, which began on the first day of July 1991 and ends on the thirtieth day of June 1992.
THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:

Section 1. That the Council of the City of Alexandria, Virginia, does hereby make provision for and appropriate to the fund hereafter named the amounts hereafter stated that are required to defray the expenditures and liabilities of the city for fiscal year 1992, the source of such amount being proceeds of refunding bonds for which revenues were authorized but not appropriated by council, and further, that the council does hereby allot the amount so appropriated, as follows:

Passage on First Reading of AN ORDINANCE containing a proposed electric power franchise ordinance for the City of Alexandria and authorizing the city clerk to publish advertisements soliciting bids for the city's electric power franchise. Under the electric power franchise ordinance, the city proposes to grant a franchise, subject to specified terms and conditions, which would permit the franchisee to locate, construct, install, improve, maintain, repair and use poles, towers, wires, conductors, cables, conduits, lines, subways, duct banks, manholes, handholes and other equipment and appliances in, over, along, on and under the public streets, public alleys and other public places of the city for the purpose of distributing, transmitting, and selling electric current for light, heat and power within the boundaries of the city. (This is Not a Public Hearing Item.)

The resolution reads as follows:
RESOLUTION NO. 1595
WHEREAS, the Washington Metropolitan Area Transit Authority (WMATA) is an agency funded by the combined efforts of eight jurisdictions in the Washington Metropolitan area; and

WHEREAS, many regional agencies that are funded in this manner, including the Northern Virginia Transportation Commission and the Northern Virginia Regional Park Authority, grant cost-of-living adjustments (COLAs) to their employees based on the average of what is approved for employees of the localities that provide this funding; and

WHEREAS, WMATA employees who are not represented by unions (approximately 15 percent of the combined workforce of more than 8,800 employees) are also currently granted COLAs based on this method; and

WHEREAS, none of the localities that subsidize WMATA have budgeted COLAs for their employees in FY 1993; and

WHEREAS, WMATA is currently attempting to negotiate contracts with unions that represent approximately 77 percent of its total workforce; and

WHEREAS, WMATA's efforts to settle these contracts must take into consideration the fiscal constraints facing the localities;

NOW, THEREFORE, BE IT RESOLVED that City Council hereby recommends that the WMATA Board of Directors adopt a policy that COLAs for all of its employees should be based on the weighted average of the COLAs granted to the employees in WMATA's funding jurisdictions.

New Business Item No. 1: WITHOUT OBJECTION, City Council scheduled a Work Session on April 30, on Potomac Yard/Potomac Greens SAP in the Council Chamber at 7:30 p.m.
