Passage on First Reading of AN ORDINANCE (i) to provide that travel in certain HOV lanes for the purpose of making a left, as well as a right, turn is permissible, (ii) to clarify that the loading or unloading of motor vehicles in HOV lanes is prohibited, and (iii) to bring the city code sections that address driving without a valid license and driving on a suspended or revoked license more closely in line with the state code.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Vice Mayor Cleveland. and carried unanimously by all those present, City Council approved the Consent Calendar as presented with the exception of Item Nos. 7 and 8 which were considered under separate motions. The City Manager's recommendations are as follows:

City Council received the following resignations with regret: (a) Sharon Webster from the Alexandria Ad Hoc Committee on Electromagnetic Fields in Old Town; (b) Rose Marie Cummins from the Alexandria Beautification Commission; (c) Janet Maguire and Victor Naturi from the Alexandria Commission on Aging; (d) Gloria Gardner from the Alexandria Commission on Disabled Persons; (e) Sallie Craft and Janet E. City Council (a) appointed Stephen Dujack as a Member Designated by the Dowden Terrace Civic Association to the Alexandria Beauregard Street Corridor Task Force; (b) appointed Joel Geisner as a Representative Designated by Councilwoman Redella S. Pepper; Stephen Kenealy as a Representative Designated by Council Member Lonnie C. Rich; and V. Rodger Digilio as a Representative Designated by Councilman David G. Speck to the Alexandria Budget and Fiscal Affairs Advisory Committee; (c) appointed Aline Fader as a High School Student Member to the Alexandria Environmental Policy Commission; (d) reappointed Ruth Kaye as a Representative Designated by the Alexandria Public Records Advisory Commission to the Historic Alexandria Resources Commission; (e) reappointed William Gregory Vogt as a Representative Designated by the Alexandria Environmental Policy Commission to the Alexandria Recycling Study Subcommittee of the Waste-to-Energy Task Force; and (f) reappointed James Sharf as a Representative Designated by the Old Town Civic Association to the Alexandria Waterfront Committee.

9. City Council approved the request of the Director of the Campagna Center to change the starting time of the 1991 Scottish Christmas Walk from 10:00 a.m. to 10:30 a.m.

11. City Council (a) allocated $22,149 from Account 040006-9712 (Cash Capital) to Account 220400-3202 (Health Center) to purchase the two modular office structures that house the existing Adolescent Health Clinic (the remaining $7,497 is available in the operating budget from rental fees for the Adolescent Health Clinic); (b) awarded a purchase contract to Williams Mobile Offices for $29,646; and (c) authorized the City Manager to sign the necessary acquisition documents.

12. City Council approved receipt of the funds from the Adult Probation & Parole Office for the Virginia CARES program to continue sponsorship and operation of a support group for ex-offenders.

13. City Council authorized the City Manager to submit the grant application and to execute all necessary documents and contracts.

14. City Council (1) approved the cancellation of a previous reservation of $200,000 FY 1990 CDBG funds for the Alexandria Square condominium project, releasing these funds for general use in the City's Homeownership Assistance Program (HAP); (2) approved the temporary reservation of $500,000 in State Urban Homeownership Opportunity Program (UHOP) funds for use in a possible homeownership project in the Arlandria area. This reservation will expire on January 15, 1992, if the City Manager determines at that time that the project cannot meet State commitment and disbursement deadlines for the UHOP funds, and that continuing the reservation would likely lead to State recapture of the reserved funds.

15. City Council allocated up to $4,000 from contingent reserves (Account 103556-2707) for a contribution to Carpenter's Lodgings, Inc., in lieu of waiving the building permit fees for the renovation of 612 and 607 Notabene Drive.

16. City Council (1) approved Mr. Digilio’s request for an exception to the Mt. Vernon Avenue Commercial Revitalization Program Guidelines which would allow him to receive reimbursement for work completed prior to loan settlement; and (2) required that Mr. Digilio complete the remaining sign work and satisfy the conditions outlined in Attachment I of the City Manager's memorandum.

17. City Council approved the FY 1992 Plan and grant funding for Aging Services and authorized the City Manager to execute and submit all necessary documents pertaining to this program.

18. Consideration of the Alexandria Division of Social Services Plan to Ensure that Food Stamp Applications are Processed within Federally Mandated Time Frames.

(General Discussion. Mr. Cyphers, Director of Human Services, gave a synopsis of this item.)

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Vice Mayor Cleveland and carried unanimously by all those present, City Council approved the following emergency actions taken by the City Manager on August 26, 1991, (Attachment I to the City Manager's memorandum): (1) acceptance of State funding in the amount of $186,001 to enable DSS to comply with the Food Stamp court order; (2) provision of a 20 percent City match of $46,500 transferred from other monies available in the Department FY 1992 approved budget, for a total of $232,501 available for the Food Stamp compliance budget; and (3) the temporary overhire of three eligibility intake worker II positions and four clerk typist II positions through May 31, 1992, funded by the additional State monies and the 20 percent City match, to assist DSS in complying with the court order. 19. Consideration of Application to the State Department of Social Services for Funding for the Virginia Refugee Resettlement Program (VRRP) in the City of Alexandria.

(General Discussion. Councilwoman Pepper asked questions of the City Manager. Councilman Donley participated in the discussion of this item.)

WHEREUPON, upon motion by Councilman Donley, seconded by Councilwoman Pepper and carried unanimously by all those present, City Council (1) authorized the City Manager to execute all documentation that may be required; and (2) contingent upon the award of the grant:, approved the establishment of one (FTE) grant-funded full- -time position shown as an Employment and Training Specialist. This position is required to provide the services proposed under this grant, and will end when grant funds are expended. The expected grant period will be October 1, 1991, to June 30, 1992, or later depending on the availability of further funding from this grant source. The voting was as follows:

20. Consideration of Application to the Virginia State University (Pass Through Funds from U.S. Department of Agriculture) for Funds for Project HOME (Housing Opportunities Met by Extension) to Operate a Multicultural Parenting Program in the Upper Potomac Community.

WHEREUPON, a motion was made by Vice Mayor Cleveland, seconded by Councilman Donley for purposes of discussion, to accept the manager’s recommendation with the amendment to include all of Potomac West.

Councilwoman Pepper seconded the motion to amend.

That was acceptable to the maker and seconder of the amended motion.

WHEREUPON, upon motion by Council Member Rich, seconded by Councilwoman Pepper and carried unanimously by all those present, City Council approved the grant application and authorized the City Manager to execute the necessary documents with two amendments: (1)) to include all of Potomac West and (2) to require that the City Manager, to the extent that bilingual support is going to be needed in connection with the program, that the funding or the resources be provided out of other existing resources in the city and that it not be taken out of the program director's hours, whoever the program director may be and that any such program has to have a coordinating component. 21. Consideration of the Age Plan Prepared by the Alexandria Commission on Aging.

(WITHOUT OBJECTION, Ethel Underwood, a member of the Commission on Aging, made comments on the Plan.)

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Donley and carried unanimously by all those present, City Council (1) received the Age Plan and commended the Commission on Aging for its excellent leadership and effort in the development of the plan; and (2) requested that the Commission on Aging disseminate the Age Plan broadly to relevant City and community organizations to begin discussion about implementation of the highest priority recommendations that can be accomplished within existing resources. ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Vice Mayor Cleveland would like for everyone, if they have a chance on Saturday, 9/14, between 12:00 p.m. and 6:00 p.m., to come to the ARHA Resident Council Community Day to be held at the Charles Houston Recreation Center.

(b) Vice Mayor Cleveland gave a report that on 8/13, 8/14 and 8/15, The Untouchables went to Atlanta, Georgia to see the Martin Luther King Center and Six Flags. The Atlanta City Council presented a special Proclamation to them proclaiming August 25 as "Untouchables Day" in the City of Atlanta. They received a tour of the Council Chambers and the Municipal League which is not normal practice. He thanked the Alexandria Chamber of Commerce who helped them with contributions for their trip. He thanked everyone involved for helping The Untouchables.

(c) Councilwoman Pepper spoke regarding a briefing at the Old Colony Inn releasing the Woodrow Wilson Bridge Improvement Study, the draft Environmental Impact Statement. There will be an informational meeting on Monday, September 23, 4 p.m. to 9 p.m. at the Old Colony Inn. The following day, September 24, there is a public hearing at the same place at 4:00 p.m. She urged everyone to speak out.

(d) Councilman Donley reported on the success of our recent recycling centers. He requested that staff put up signs at the City's recycling centers listing where other centers are located throughout the City.

(e) Councilman Speck noted the third murder of the year in Alexandria last week-end and indicated that it was enough to bring to our attention tonight and is one of the challenges that the City must face.

(f) Mayor Ticer reported on a recent meeting that the City Manager and she had with members of the staff last week at the request of Denton Kent who is working on the 2020 Project. He brought the new owners of the yard, VRS. They will share their assumptions with the staff first and then go from there. The reason for this is that the staff was responsible for the Small Area Plan and it is the Small Area Plan that they say is unviable. They have set the stage for future such meetings. The City would not circumvent any normal processes that we go through which include the public hearing processes and the processes with the meetings with the citizens.

Councilwoman Pepper, Council Member Rich and Councilman Speck also spoke to this issue.

THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:

Section 1. That the sections and portions thereof set forth in the supplemental and replacement pages for The Code of the City of Alexandria, Virginia, 1981, each of which pages is identified in the lower left-hand corner by the notation "Supp. No. 32," are hereby adopted as and shall constitute "The Thirty-Second Supplement to The Code of the City of Alexandria, Virginia, 1981."

Section 2. That the sections and portions thereof set forth in "The Thirty-Second Supplement to The Code of the City of Alexandria, Virginia 1981," shall be in force and effect on and after the effective date of this ordinance, and all ordinances of a general and permanent nature which were adopted between December 15, 1990, and May 18, 1991, and which are not included in such supplement or in The Code of the City of Alexandria, Virginia, 1981, are hereby repealed, except as otherwise provided in section 3 of this ordinance.

That the repeal provided for in section 2 of this ordinance shall not affect any offense or act committed or done, or any penalty or forfeiture incurred, or any contract established or accruing prior to the effective date of this ordinance; nor shall it affect any prosecution, suit or proceeding pending or any judgment rendered prior to said date; nor shall it affect any ordinance saved from repeal by Ordinance No. 1250; nor shall it affect any ordinance listed in appendices A through J, both inclusive, of The Code of the City of Alexandria, Virginia, 1981, or any pages supplemental to such appendices; nor shall it affect any provision of any ordinance adopted between December 15, 1990, and May 18, 1991, which is inadvertently omitted from or erroneously incorporated into The "Thirty-Second Supplement to The Code of the City of Alexandria, Virginia, 1981" or any other supplement to the code; nor shall it affect any ordinance adopted after the effective date of this ordinance.

Section 4. That one complete set of pages comprising "The Thirty-Second Supplement to The Code of the City of Alexandria, Virginia, 1981," shall be stapled or otherwise permanently fastened together, shall be manually signed on the front sheet by the mayor and the city clerk, and shall be filed in the office of the city clerk and made available to any person desiring to inspect the same. In addition, one complete set of the supplemental and replacement pages of such supplement shall be properly inserted into the copy of The Code of the City of Alexandria, Virginia, 1981, which bears the manual signatures of the mayor and the city clerk, and such code, as amended and supplemented, shall be kept on file in the office of the city clerk and be made available to any person desiring to inspect the same.

WHEREAS, safe, decent and affordable housing is a major need for low- and moderate-income Virginians; and

WHEREAS, affordable housing is critical to the economic stability and development of Virginia; and

WHEREAS, approximately 50,000 Virginia households are without indoor plumbing; and

WHEREAS, approximately 250,000 Virginians live in substandard and/or severely cost-burdened housing for which they pay over 50 percent of their income; and

WHEREAS, persons with disabilities and frail elderly Virginians are in need of congregate and assisted housing in order to avoid costly institutionalization and to remain in their communities; and

WHEREAS, thousands of low-income elderly Virginians need home repairs, improvements and adaptation to continue living independently in their communities; and

WHEREAS, over 83,000 homeless Virginians are in need of emergency shelter, transitional housing and/or single room occupancy (SRO) housing in order to attain and maintain self-sufficiency; and

WHEREAS, homeownership is beyond the reach of thousands of low- and moderate-income households in Virginia due to the lack of resources for down payments and closing costs and to high housing costs and mortgage interest rates which they cannot afford; and

WHEREAS, from 1980-1990, the average assessed values of single family homes and condominiums in Alexandria have far outpaced the increase in median income for the Washington, D.C. metropolitan area, as well as for Alexandria and Northern Virginia, thereby making homeownership an unobtainable goal for many City residents; and

WHEREAS, the Virginia Housing Partnership Fund is designed to address the statewide need for safe, decent and affordable rental housing; homeownership assistance; congregate and assisted housing; homeless prevention, intervention, emergency shelter and transitional and permanent housing for the homeless; and housing preservation and development; and

WHEREAS, the City of Alexandria has benefited greatly from the Virginia Housing Partnership Fund's Single and Multi-family Rehabilitation programs, Homeownership Assistance Program, the Homeless Intervention Program, Expansion Grant/Loan Program, Congregate Housing, and the State Shelter Grant program; and

WHEREAS, the Virginia Housing Partnership Fund programs have assisted more than 70,000 low- and moderate-income persons throughout the Commonwealth; and

WHEREAS, over $3,650,000 in Virginia Housing Partnership Fund monies have been reserved or allocated for housing programs and projects in Alexandria; and

WHEREAS, the Virginia Housing Partnership Fund has leveraged over $100 million in private, corporate, foundation, local and federal funds to address the overwhelming need for housing for which federal and local resources are inadequate; and

WHEREAS, the Virginia Housing Partnership Fund provides rural and urban communities with a flexible source of funding to enable them to design local programs that meet the unique housing needs of their areas; and

WHEREAS, the Virginia Housing Partnership Fund was originally designed to become a self-replenishing source of funds to enhance public and private efforts to address the need for decent and affordable housing for Virginians in all regions of the Commonwealth;

NOW, THEREFORE, BE IT RESOLVED that the City of Alexandria supports the restoration of the Virginia Housing Partnership Fund to the General Fund Budget of the Commonwealth of Virginia at the level of $50 million for the 1992-94 Biennium; and

BE IT FURTHER RESOLVED that the City petitions the Governor of Virginia to include such funding in his 1992-94 Biennial General Fund Budget to be presented to the 1992 General Assembly; and

BE IT FURTHER RESOLVED that the City petition members of the General Assembly of Virginia to allocate $50 million for the Virginia Housing Partnership Fund in the 1992-94 Biennial General Fund Budget adopted for the Commonwealth of Virginia.

NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF ALEXANDRIA, VIRGINIA:

1. That the Washington Metropolitan Council of Governments, Transportation Planning Board, be requested to defer the inclusion of the Woodrow Wilson Bridge Improvement Project in the Transportation Improvement Plan on September 18, 1991.

2. It is anticipated that the public hearings and selection of an alternative and the adoption of the environmental impact statement will be completed by November 1991. It is requested that the Woodrow Wilson Improvement project be included in the Transportation Improvement Plan by amending the Plan at the appropriate time after January 1, 1993.

3. The City Council represents the citizens of the City of Alexandria, Virginia, and the alternative selection process of the Woodrow Wilson Bridge Project affects the historic City. We therefore submit this request to defer the inclusion of the Woodrow Wilson Bridge Improvement Project at the September 18, 1991, meeting of the Washington Metropolitan Area, Council of Governments Transportation Planning Board.
