City Council received the following resignations with regret: (a) Kathy Price from the Alexandria Economic Opportunities Commission; (b) Evan Smith from the Alexandria Environmental Policy Commission; and (c) Carl Dutzman and David Sussman from the Alexandria Local Emergency Planning Committee; and requested the Executive Secretary to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

12. City Council reallocated $2,500 from Account 245324-2121 (Monroe Avenue Bridge) to Account 235390-2121 (Traffic Control Facilities) to install pedestrian walk lights at Seminary Road and North Pickett Street intersection.

13. City Council reallocated $2,500 from Account 245324-2121 (Monroe Avenue Bridge) to Account 235390-2121 (Traffic Control Facilities) to pay for the installation of the flashing traffic signal at the intersection of North Payne and Cameron Streets.

WHEREUPON, upon motion by Councilman Donley, seconded simultaneously by Vice Mayor Cleveland and Councilman Speck and carried unanimously, City Council received the report and requested that the City move to erect a fence and remove the rubble as soon as possible after the expiration deadline should the owner not reply and that we apply a lien for any expenses incurred by the City in relation to the upkeep of this property, plus accrued interest. 17. Consideration of the Washington Metropolitan Council of Governments' Telephone Book Recycling Agreement.

WHEREUPON, upon motion by Councilman Jackson, seconded simultaneously by Councilman Donley and Councilwoman Pepper and carried unanimously, City Council (1) approved the City's participation in this interjurisdictional effort; (2) authorized the City Manager to execute the Memorandum of Understanding; and (3) requested staff to proceed with discussions with Bell Atlantic to implement a recycling program for outdated telephone directories. 18. (a) Consideration of Update Report from the City Attorney on Items before the 1992 Virginia General Assembly.

WITHOUT OBJECTION, City Council gave its consensus to the following items:

It was the consensus of City Council to amend the legislative package with respect to the fortified wine issue to seek a regulatory change in the ABC regulations rather than a legislative change.

It was the consensus of City Council with respect to derelict motor vehicles to seek the same statutory change as Arlington and Fairfax have so that inoperative vehicles in order to be properly shielded have to be shielded by plants and shrubbery.

It was the consensus of City Council with respect to recreation programs to support clarification of legislative language to take the traditional government-sponsored recreation programs and to make it clear that they are not to be encompassed with the new state regulations for day care centers and providers.

(b) Consideration of Adding to the City's Legislative Package a Surtax on Off-premises Sale of Beer and Fortified Wine. (Councilman Speck)

Members of City Council, the City Attorney, and Mr. Gitajn, Director of Financial and Information Services, participated in the discussion of this item.

WITHOUT OBJECTION, Joseph Guiffre, president of Guiffre Distributing Company, addressed City Council on this issue and urged Council not to pursue this tax.

20. (a) Text Amendment #91-011 - Environmental Management Chesapeake Bay Preservation Act.

Public Hearing and Consideration of possible amendment to Title 7, Chapter 6, of The Code of the City of Alexandria, Virginia, 1981, as amended, to adopt a new article (Article S, Environmental Management) implementing the local regulations required by the Chesapeake Bay Preservation Act and the regulations adopted by the Chesapeake Bay Local Assistance Board.

Duncan W. Blair, P. 0. Box 820, Alexandria, representing Dominion Lands Inc. and other Alexandria property owners, spoke in favor of this item with amendments with respect to the appeal provision and vested property rights;

Agnes Palmer, 33 W. Myrtle Street, representing Alexandria Building Industry Association, expressed concerns about vesting provisions;

Bob Richards, 121 Duke Street, representing the Alexandria Chamber of Commerce, expressed concerns about vested property rights and a grandfathering provision;

Donald F. Simpson, 608 W. Braddock Road, representing Alexandria Tech Center Associates, spoke to vesting rights and a grandfathering provision; and

Engin Artemel, 33 W. Myrtle Street, spoke against the ordinance as drafted and expressed concern about vesting procedures and felt that approved site plans should be grandfathered.

Members of City Council and the City Attorney participated in the discussion of this item.

Staff was requested to meet with the principals to try to work out something before the continued public hearing.)

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Mayor Ticer appointed Councilman Donley to the Economic Development Task Force and Councilman Speck to the Waterfront Committee.

(b) The City Manager stated that at the November 16, 1991 meeting, City Council requested that the city staff come back to Council with a proposal concerning the issue of parking in the Old Town area. She had hoped to get back to Council in February. Staff has been doing extensive surveying in December and this month of the parking lots; cars on the street; how many are residents of that particular district; how many of them have Old Town parking residential district stickers even if it is from another district; how many of the cars are from the city and how many are out-of-city cars. We have been surveying the garages also to see what the capacity for additional cars would be. Staff will not be able to get back to Council in February. She hopes to get a report to Council in March for receipt and comment and then to refer to, if Council would like, the TPB and the Planning Commission.

WHEREAS, the Alexandria City Council has this 14th day of January 1992, adjourned into executive session pursuant to a motion made and adopted in accordance with the Virginia Freedom of Information Act; and

WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by City Council that such executive session was conducted in accordance with Virginia law;

NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby certify that, to the best of each member's knowledge, only public business matters which were identified in the motion by which the executive session was convened, and which are lawfully exempted by the Freedom of Information Act from the Act's open meeting requirements, were heard, discussed or considered by Council during the executive session.
