8. City Council received the resignation of Sallie Eubank from the Alexandria Emergency Medical Services Council with regret; and requested the Executive Secretary to send the appropriate letter of appreciation and to advertise the vacancy in the usual manner.

12. Consideration of an Acceptance of Grant Funds from the Virginia Department of Rail and Public Transportation from the Alternative Transportation Program.

WHEREUPON, upon motion by Councilman Jackson, seconded by Vice Mayor Cleveland and carried unanimously, City Council (1) accepted the grant award in the amount of $199,600 (to be matched by $49,900 in in-kind services) for the purpose of establishing the Alternative Transportation Program (ATP) to implement traffic reduction and congestion management measures at sites that are not subject to the City's Transportation Management Plan Ordinance. The grant is anticipated to fund the ATP for two years; (2) exceeded its budget cap on the number of full-time City positions and approved this request which will increase the number of full-time grant-funded positions by one full-time (1 FTE) position that will be administering this grant program. This grant-funded position would terminate upon the expiration of this grant and the individual who is to fill this position would be notified of this condition of employment; and (3) authorized the City Manager to execute all documents that may be required under this program. 13. Consideration of an Allocation of Monies for the City of Alexandria's Share of the FY 1993 Metrorail Construction Payments.

WHEREUPON, upon motion by Councilman Jackson, seconded by Vice Mayor Cleveland and carried unanimously, City Council allocated $1,745,943 from Account 040006-9712 (Cash Capital) to Account 240010-2121 (Rail Rapid Transit - rail construction) for Alexandria's FY 1993 Metrorail construction payments to the Washington Metropolitan Area Transit Authority (WMATA). Funds for this project are currently available within the total cash capital monies approved for capital projects in FY 1993, in the amount of $6,903,140. The voting was as follows:

14. Consideration of the Transportation Service Agreement Between the City of Alexandria and the Washington Metropolitan Area Transit Authority (WMATA) for the Provision of Metrobus and Metrorail Service for FY 1993.

15. Consideration of the Continuation of the Policy for the Cooperative Provision of Emergency Winter Shelter in Alexandria.

WHEREUPON, upon motion by Councilman Donley, seconded by Councilwoman Pepper and carried unanimously, City Council (1) endorsed the continuation of the emergency winter shelter policy initially developed and implemented for the winter 1990-91 and continued for the winter 1991-92; and (2) commended the homeless shelter operators in Alexandria for their continuing commitment and invaluable services, as well as our own City staff in the operation of our homeless shelter. 16. Consideration of a Report on the Proposed Federal Grant for Renovation of Alexandria's Union Station.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Vice Mayor Cleveland and carried on a vote of 6-to-0, City Council (1) reconsidered its June 23 resolution supporting the City's participation with the Potomac and Rappahannock Transportation Commission (PRTC) for the renovation of historic railway stations and adopted the position that the City no longer supports the grant application in the proposed form; and, (2) authorized the City Manager to send the letter (Attachment 2 to the City Manager's memorandum) to the Secretary of Transportation to inform him of its decision. Councilwoman Pepper spoke to the issue of part-time workers not receiving retirement benefits. She understands that it would possibly take an amendment to the Virginia Code to allow part-time workers to become members of the Virginia Retirement System. She suggested that this issue be looked at as a "back-burner" issue, possibly as a study on the state level. She would like to see an account, not necessarily this moment, but of what we have done for our part-time workers. She would like to know if we have a policy statement that tells what the history is of what we have been doing for them lately, as well as what we might want to be doing in this area. Staff will get back to City Council with a memorandum.

Jack Powers will be the City's legislative liaison with the General Assembly this year.)

REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilman Donley announced that the 17th Annual Thanksgiving Day 5-Mile Turkey Trot, sponsored by the Potomac West Trade Association, will begin at 10:00 a.m. from Cora Kelly School grounds. Participants are encouraged to bring canned goods for ALIVE, Inc.

(b) Councilman Donley announced that an etched glass ornament has been commissioned by the Christmas in Alexandria Committee, which will use proceeds from the ornament sales to help underwrite holiday special events and the lights in many Old Town street trees. The ornament was designed by Torpedo Factory artist Sue Lynch and costs $15. It is available at the following locations: Alexandria Chamber of Commerce, Bank of Alexandria, BOAT US Marine Store, Carr's Antiques and Auction Service, Country Trotter, Goldworks, The Lyceum Museum Gift Shop, Perry House Galleries, Quimper Faience, Ramsay House Visitors Center, Random Harvest, Scriptorium, Torpedo Factory Art Center, and Unique.

(c) Vice Mayor Cleveland announced that the Tree lighting at City Hall will be on Friday, November 27, 1992, at 7:00 p.m. On December 5, 1992, is the Annual Christmas Walk and he asked that since there are going to be thousands of people in town on that day do we usually relax parking rules on that day? The City Manager stated that we do not. He warned everyone to find themselves a parking space.

(d) Council Member Rich asked the City Manager to give Council a brief report on the recent shooting that occurred this week in Old Town.

The City Manager gave Council a report and indicated that there has been an increased presence of police since the shooting.

(e) Councilman Speck spoke to something that has been very disturbing to him over the past few weeks, and that is the proposition that has been made by a number of people that unless we, as Members of Council, repudiate points of view that are considered to be unpopular or controversial that we, therefore, must support those points of view. He made reference to Council Member Rich's proposal. He feels, even though he may not agree with every different idea or thought that is presented to Council, that to have to repudiate them immediately or face the charge of supporting them, stifles creativity, the legislative process and the development of good ideas.

Council Member Rich spoke to Councilman Speck's comments. He indicated that there is not a single thing in his proposal that was intended to be set in concrete, certainly not from anybody else on Council, and not even himself. It was intended to be a proposal for a starting point for probably a long-term discussion.

(f) Mayor Ticer spoke to the odor from the District's wastewater treatment plant at Blue Plains. She has received a letter from Mayor Kelly indicating that on December 1, 1992, routing composting of sludge at Blue Plains will be suspended until additional odor control equipment can be installed. It is the District's intent to use state-of-the-art technology so that the impact on the District and the plant's neighbors is minimal.

(g) Mayor Ticer spoke to the marina located on the south waterfront. A letter was received from the Northern Virginia Regional Park Authority authorizing the awarding of a consulting contract to study the feasibility of developing and operating a small-scale, modest sailing marina.

Mr. Kauffman, Director, Recreation, Parks and Cultural Activities, explained the history of this issue.

(h) Mayor Ticer spoke regarding the Mayor's outreach program to businesses. She circulated a list to Members of Council to indicate which businesses that a Member of Council would be willing to go with Richard Flaherty or her to meet with the businesses and welcome them to the City and offer any assistance that we can.

(i) Mayor Ticer expressed interest in setting up a Task Force for Strategic Planning about the future vision of Alexandria.

Members of City Council and the City Manager participated in the discussion.

It was the consensus of Council to ask the City Manager to request information from other jurisdictions on what they have done in the area of futures studies; get information from national organizations with regard to exemplary reports and Mr. Beezel and other futurists. The City Manager will report back to Council.

ORDINANCES AND RESOLUTIONS

18. Public Hearing. Second Reading and Final Passage of AN ORDINANCE to amend the Potomac Yard/Potomac Greens Small Area Plan chapter of the 1992 Master Plan of the City of Alexandria, Virginia, by adopting revised CDD guidelines to provide for an increase in the amount of development permitted with a CDD special use permit from 2.75 to 3.75 million square feet of office space, from 3,500 to 4,500 residential units, and from 300,000 to 425,000 square feet of retail space. ORDINANCE NO. 3603

AN ORDINANCE to amend and reordain the Potomac Yards/Potomac Greens Small Area Plan chapter of the of the 1992 Master Plan of the City of Alexandria by adopting and incorporating therein revised CDD guidelines to provide for an increase in the amount of the development permitted with a CDD special use permit from 2.75 to 3.75 million square feet of office space, from 3,500 to 4,500 residential units, and from 300,000 to 425,000 square feet of retail space.

WHEREAS, the City Council of Alexandria finds and determines that:

1. On September 30, 1992, city council adopted Resolution No. 1617, referring to the planning commission certain amendments to the Potomac Yard/Potomac Greens chapter of the 1992 Master Plan of the City of Alexandria, Virginia, to increase the amount of development permitted with a CDD special use permit from 2.75 to 3.75 million square feet of office space, from 3,500 to 4,500 residential units, and from 300,000 to 425,000 square feet of retail space.

2. The planning commission conducted a public hearing on the proposed amendments on October 29, 1992, and, on November 5, 1992, by resolution, adopted and certified such amendments to the city council for adoption as amendments to the 1992 Master Plan of the City of Alexandria, Virginia, as evidenced by Exhibit A attached hereto.

3. City council has heretofore conducted an informational public hearing on the said small area plan amendments, as certified by the planning commission, and for the reasons stated in the record of such public hearing, and for the reasons stated in Resolution No. 1617, attached hereto as Exhibit B, has approved the said amendments.

4. Based upon the foregoing findings and all other facts and circumstances of which city council may properly take notice in its capacity as the legislative body of the City of Alexandria, adoption of this ordinance is necessary and desirable to protect the public health, safety and general welfare of the residents of the City of Alexandria; now, therefore,

THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:

Section 1. That the findings and conclusions expressed by the planning commission in its resolution adopting the aforesaid amendments to the Potomac Yard/Potomac Greens Small Area Plan chapter of the 1992 Master Plan of the City of Alexandria, and the findings and conclusions expressed by city council in Resolution No. 1617 are ratified, confirmed and adopted by the city council.

Section 2. That CDD Guideline No. 4, of the CDD guidelines for Potomac Yards/Potomac Greens, of the Potomac Yard/Potomac Greens Small Area Plan chapter of the 1992 Master Plan of the City of Alexandria, Virginia, be, and same hereby is, amended and reordained to read as follows:

4. The total amount of development allowed on this site shall be as follows:

1) 3.75 million square feet of office space;
2) 625 hotel rooms;
3) 425,000 square feet of retail space;
4) 4,500 residential units.

Section 3. That this ordinance shall become effective at such time as all of the following events have occurred: (1) city council shall have adopted, by ordinance, an amendment to Section 5-602(A), CDD No. 10, of the Zoning Ordinance of the City of Alexandria, Virginia, which implements the master plan amendments made by Section 2 of this ordinance; (2) the pending litigation with the RF&P Railroad Company and related parties over the city's 1987 decision to reject a site plan application for the development of Potomac Greens shall have been dismissed with prejudice, the district court's final order of April 3, 1991, shall have been vacated and the court's memorandum opinion of February 27, 1991, shall have been withdrawn; (3) all pending litigation with the RF&P Railroad Company and related parties over the city's 1992 decision to rezone the Potomac Yard and Potomac Greens shall have been dismissed with prejudice; and (4) the city attorney shall have certified the occurrence of events (2) and (3) to the city clerk.

Section 4. That, upon the occurrence of the events specified in Section 3, the city clerk shall transmit a duly certified copy of this ordinance to the Clerk of the Circuit Court of the City of Alexandria, Virginia, and that said Clerk of the Circuit Court shall file same among the court records.

19. Consideration of Resolution Expressing the Views of the City Council on the Proposed Commuter Tax. (Councilmen Donley and Speck) (ROLL-CALL VOTE)

WHEREUPON, upon motion by Councilman Speck, seconded by Councilman Donley and carried on a unanimous ROLL-CALL vote, City Council (1) adopted the resolution opposing the D.C. commuter tax; and (2) requested the Mayor to send the resolution to Congressman James P. The resolution reads as follows:
RESOLUTION NO. 1627

WHEREAS, District of Columbia Mayor Sharon Pratt Kelly has announced plans to ask Congress for authority to levy a commuter tax on suburban residents who work in the District of Columbia; and

WHEREAS, a D.C. commuter tax is estimated to bring at least $1 billion to the D.C. government at the expense of suburban jurisdictions; and

WHEREAS, all local governments are facing the dual pressures of stagnant revenue growth and increased expenditure demands from programs that provide for the direct care and well-being of residents; and

WHEREAS, the City's real property tax base has declined by almost $1 billion, from $12.2 billion in 1991 to $11.2 billion in 1992; and

WHEREAS, the City has had to make up over $6 million in lost State funding, particularly in the areas of education, law enforcement, health care services, and road maintenance; and

WHEREAS, the Alexandria City Council has limited expenditure growth for the last five audited fiscal years (from FY 1986 to FY 1991) to an average annual increase of 4.9 percent, which is one-tenth of one percent greater than the rate of inflation during this period, while District of Columbia expenditures have increased at an average annual rate of 6.6 percent during the same period; and

WHEREAS, the unemployment rate in Alexandria has increased by more than 27 percent over the last year, from 4.7 percent to 6.0 percent; and

WHEREAS, a D.C. commuter tax would create a severe financial hardship on residents of Alexandria and other suburban jurisdictions;

NOW, THEREFORE, BE IT RESOLVED that the Alexandria City Council call on Congressman James P. Moran, Senator Charles S. Robb, and Senator John Warner to help to defeat a D.C. commuter tax on Alexandria residents.

25. Consideration of Proposal to Request the BFAAC to Assist in Soliciting Recommendations on Standards for Analyzing the Staffing and Administrative Functions Associated with City Boards and Commissions. (Council Member Rich)

(General Discussion. Council Member Rich spoke to this issue. Mayor Ticer, the City Manager and Mr. Draper, Chairman of the Budget and Fiscal Affairs Advisory Committee, participated in the discussion of this item.

Chairman Draper stated that the Committee will discuss it at its meeting which will be December 15, and report back to Council with its decision and possibly some ideas that have not been thought of.)

It was the consensus of Council to request BFAAC to consider Council Member Rich's proposal at its next meeting asking for them to assist in soliciting recommendations on standards for analyzing the staffing and administrative functions associated with City Boards and Commissions.

New Business Item No. 1: WHEREUPON, upon motion by Councilman Donley, seconded by Councilman Jackson and carried on a vote of 6-to-0, at 9:50 p.m., City Council convened an executive session, at this time, for the purpose of: consulting with and receiving a briefing from legal counsel pertaining to the following pending litigation involving the City, pursuant to section 2.1-344(7) of the Virginia Code: Tauber Associates v. City of Alexandria, At Law No. CL911292, which is pending in the Circuit Court for the City of Alexandria and which involves the real estate tax assessments of the property located at 5100 Eisenhower Avenue. The voting was as follows:

New Business Item No. 2: Prior to going into executive session, the City Manager announced that Jefferson Hospital will close next month and become a long-term care facility according to Inova Health Systems officials.

Councilman Speck requested the staff to provide for Council's next legislative meeting a brief report on the various boards and commissions that have Jefferson representatives and advise Council as to what alterations it needs to make to those boards and commissions.

New Business Item No. 3: WHEREUPON, upon motion by Councilman Donley, seconded by Councilman Speck and carried on a vote of 6-to-0, at 10:12 p.m., City Council reconvened its meeting and the following transpired. The voting was as follows:

RESOLUTION NO. 1628

WHEREAS, the Alexandria City Council has this 24th day of November, 1992, recessed into executive session pursuant to a motion made and adopted in accordance with the Virginia Freedom of Information Act; and

WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by City Council that such executive session was conducted in accordance with Virginia law;

NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby certify that, to the best of each member's knowledge, only public business matters that were identified in the motion by which the executive session was convened, and that are lawfully exempted by the Freedom of Information Act from the Act's open meeting requirements, were heard, discussed or considered by Council during the executive session.
