WHEREUPON, upon motion by Councilman Jackson, seconded by Councilwoman Pepper and carried unanimously, City Council approved the consent calendar as presented with the exception of Item Nos. 18, 23 and 24 which were considered under separate motions. The City Manager's recommendations are as follows:
10. City Council received the following resignations with regret: (a) Linda M. Guillard from the Alexandria-Caen Exchange Committee; (b) Mary McDonald from the Alexandria Commission on Persons with Disabilities; and (c) Joseph Shandor from the Alexandria Landlord-Tenant Relations Board; and requested the Executive Secretary to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.
11. City Council (a) appointed Cameron Barron as a Tenant Representative to the Alexandria Affordable Housing Advisory Committee; and (b) appointed Magalys Perez as a Representative from the Whitman-Walker Clinic to the Alexandria Task Force on AIDS.
12. City Council allocated $150,000 from Account 040006-9712 (Cash Capital) to Account 200709-2121 (Cora Kelly Magnet School) for Phase I of the window replacement project at Cora Kelly Magnet School. Funds for this project are available in the FY 1993 cash capital monies designated for the Schools Capital Improvement Program.
13. City Council allocated $240,000 from Account 040006-9712 (Cash Capital) to Account 200766-2121 (Maury Elementary School) for the window replacement project at Maury Elementary School. Funds for this project are available in the FY 1993 cash capital monies designated for the Schools Capital Improvement Program.
14. City Council allocated $640,000 from Account 040006-9712 (Cash Capital) to Account 200634-2121 (F.C. Hammond Junior High School) for construction services for the installation of air conditioning and the replacement of the facility windows at F.C. Hammond Junior High School. Funds for this project are available in the FY 1993 cash capital monies designated for the School Capital Improvement Program.
15. City Council allocated $185,000 from Account 040006-9712 (Cash Capital) to Account 200733-2121 (Lyles-Crouch Elementary School) for the window replacement project at Lyles-Crouch Elementary School. Funds for this project are available in the FY 1993 cash capital monies designated for the Schools Capital Improvement Program.
16. City Council allocated $410,000 from Account 040006-9712 (Cash Capital) to Account 200618-2121 (William Ramsay Elementary School) for the installation of classroom air conditioning systems at William Ramsay Elementary School. Funds for this project are available in the FY 1993 cash capital monies designated for the Schools Capital Improvement Program.
17. City Council (1) allocated $68,190 from Account 040006-9712 (Cash Capital) to Account 220970-2121 (Preservation - Fort Ward) to provide for the replacement of the heating and air conditioning system ($63,690) and the interior painting of the Fort Ward Museum ($4,500); (2) awarded a contract to Whitener & Jackson, Inc., the lowest responsive bidder, in the amount of $57,900, for the replacement of the heating and air conditioning system; (3) authorized a contract contingency allowance of $5,790; and (4) authorized the City Manager or her designee to sign the necessary contract documents. Funds for the replacement of the heating and air conditioning system and interior painting at Fort Ward are available in the FY 1993 cash capital designated for the overall project of Acquisition and Preservation of Historic Buildings.

19. City Council authorized the City Manager to (1) submit a grant application to the Virginia Department of Social Services for funding, in the amount of $21,000 for continuation of services to the homeless under the Emergency Community Homeless Grant Program; and (2) execute all necessary documents that may be required.
20. City Council authorized the City Manager to: (1) submit a grant application to the U.S. Department of Agriculture for funding, in the amount of $66,000, for the Summer Food Service Program for Children; and (2) execute all necessary documents that may be required.
21. City Council authorized the City Manager to: (1) submit a grant application to the Virginia Department of Criminal Justice Services for funding, in the amount of $55,000, for continued funding of the Victim/Witness Assistance Program; and (2) execute all necessary documents that may be required.
22. City Council approved the allocation and transfer of up to $5,000 in non-federal program income monies from the Office of Housing (account no. 772998) to the City's Battered Women's Shelter (account no. to be established).

18. Consideration of an Allocation of Monies for Paint Restoration at The Lyceum.

(General Discussion. City Council discussed the proposed color for painting The Lyceum, and Ms. Federico, Director of Historic Alexandria, responded to questions.)
WHEREUPON, upon motion by Councilman Donley, seconded by Councilman Jackson and carried on a vote of 6-to-1, City Council (1) allocated $50,000 from Account 040006-9712 (Cash Capital) to Account 220079-2121 (Preservation - Lyceum) to paint the exterior wood and stucco surfaces of the Lyceum the color endorsed by the Historic Alexandria Resources Commission; and (2) authorized the City Manager to award a contract within the allocated amount to the lowest responsive bidder and sign the necessary contract documents. Funds for this project are available in the FY 1993 cash capital monies designated for the Acquisition and Preservation of Historic Buildings. The voting was as follows:

23. Consideration of Award of Contract for General Architectural Services.

24. Consideration of City-sponsored Mile-long Market and Music Festival on Friday and Saturday, May 7-8, 1993, in Conjunction with National Tourism Week.

(General Discussion. Councilman Speck commended Councilman Donley's memorandum as a catalyst for a number of constructive business-supportive ideas, and that it has been a very effective and positive tool.
Councilman Speck brought up the question of sidewalk blockage with all the vending machines. The continued clutter is really a problem. The City Attorney explained the most current proposal for the regulation of newsracks which is in draft and must still be run by the newspapers to work out a plan acceptable to all. There is a fair amount of staff work to be done but he should be able to bring it to Council in the fall. Mr. O'Kane, Director of Transportation and Environmental Services, participated in the discussion.
The City Manager will contact the League of Cities over the summer as there is at least one city that has gone to a uniform system of one large box throughout the downtown area and bring back a report in the fall.
Further Discussion. City Council participated in the discussion. The City Manager will come back to Council with an updated analysis of the one done by DASH about 2-1/2 years ago on what the cost would be to offer reduced rates for special activities.

WHEREUPON, upon motion by Vice Mayor Cleveland, seconded by Council Member Rich and carried on a unanimous ROLL-CALL vote, City Council: (1) endorsed the substitute resolution prepared by the Social Services Advisory Board (Attachment I to the City Manager's memorandum); (2) requested the Division of Social Services and the Office of Employment Training to involve the City's business community and the Empowerment Network Foundation, the Alexandria Resident Council, the We Care Organization, the Economic Opportunities Commission, the Alexandria Commission on Employment and Project New Course in the Welfare Demonstration Reform Project; and (3) requested the Social Services Advisory Board to continue its assessment of welfare reform initiatives and to monitor the development and implementation of Virginia's Welfare Reform Demonstration Project. The resolution reads as follows:
RESOLUTION NO. 1641
WHEREAS, on March 31, 1993, Governor L. Douglas Wilder signed into law, Virginia's Welfare Reform Demonstration Project, that has the dual goals of promoting self-sufficiency and freedom from State subsidies; and
WHEREAS, community organizations in the City of Alexandria have expressed their support and interest in helping to shape a welfare reform initiative in the City, including the Social Services Advisory Board, Alexandria Commission on Employment, Economic Opportunity Commission, Empowerment Network Foundations, We Care Organization, Alexandria Resident Council, and Project New Course; and
WHEREAS, the Statewide Project targets 600 welfare recipients across the Commonwealth in jobs that will pay enough to end the need for welfare; and
WHEREAS, client participation in the Project is dependent on having employers willing and able to commit jobs to the Project; and
WHEREAS, the Governor has appointed Lieutenant Governor Donald Beyer to chair a Welfare Reform Advisory Panel charged with overseeing implementation of the Project and fostering business participation;

NOW, THEREFORE, BE IT RESOLVED that the Alexandria City Council endorse the community's expression of support for the Virginia Welfare Reform Demonstration Project and ask the Alexandria Division of Social Services and the Office of Employment and Training to provide leadership in seeking out and fostering business participation with the assistance of the citizen groups identified earlier; and
FURTHER RESOLVED, that the Mayor forward to the Governor this resolution indicating the City's support and interest in implementing welfare reform.
26. Consideration of a Request for Local Matching Funds from the Alexandria Network Preschool Parent Classroom Assistant Project.

(General Discussion. WITHOUT OBJECTION, Ms. Mason, Director of Network Preschool, explained the proposal and responded to questions from Council. City Council, the City Manager, Mr. Cyphers, Director of Human Services, and Ms. Mason participated in the discussion.
It was the consensus of Council that the issue of a full-day program is an excellent model but in reality that that model is not possible right now. We feel it is better to serve more of the children part of the time than fewer of the children more of the time in this case.)
WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Jackson and carried unanimously, City Council sent this back to the Early Childhood Development Commission to see if they'd be willing to take another look at it in view of the fact that there really is this time line all set up and Angie Godfrey seems to have things structured so that there is a little direction. That is something that's new since this was first out, and just see if they'd kind of give it another once over. The Commission is to return to Council by the second legislative meeting in May. WHEREUPON, upon motion by Councilman Jackson, seconded by Councilman Speck and carried unanimously, City Council (1) approved the continuation of a 1.0 FTE granted-funded position of a Rape Victim Companion Program Volunteer Developer to administer the ongoing Rape Victim Companion Program. Continuation of this position is contingent upon the continuation of funding from the Virginia Department of Health or other non-City sources; (2) decided to exceed its budget cap on the number of part-time City positions. Approval of this request will increase the number of part-time grant-funded City positions by one 0.50 (20 hours per week) FTE position (Social Worker I). This person would be working with the office on Women to provide services under this grant proposal. This grant-funded position would terminate upon the expiration of the grant and the individual who is to fill this position would be notified of this condition of employment; (3) authorized the City Manager to submit the grant application to the Virginia Department of Health for funding, in the amount of $65,000, for the Office on Women's Rape Victim Companion Program; (4) contingent upon the award of the grant, approved the establishment of the part-time position reflected above; and (5) authorized the City Manager to execute all documents that may be required. 29. Consideration of Transition of DOT Service to Meet Requirements of the Americans With Disabilities Act for Complementary Paratransit Service.

WHEREUPON, upon motion by Councilman Jackson, seconded by Councilman Donley and carried on a vote of 6-to-0, City Council took the following actions to revise the DOT program, as discussed at the April 1, 1993, budget work session and in Budget Memo #11 (Attachment I to the City Manager's memorandum): (1) endorsed the new process for certifying the eligibility of persons with disabilities who now apply for the DOT program (this process is based on the same process that has been approved by the Washington Metropolitan Area Transit Authority (WMATA) Board of Directors for the regional paratransit service) and endorsed the recertification of existing DOT riders so that trip-by-trip eligibility can be determined for these persons; (2) expanded the service area of the current DOT program from within the City's boundaries to include Fairfax and Arlington Counties and the Cities of Fairfax and Falls Church. The expansion of DOT service is required by ADA and is consistent with the regional paratransit service area, which encompasses the entire WMATA service area. The City's cost for trips to destinations in the expanded service area is based on the difference between the fare paid by the DOT rider and the service provider's charge for the trip. The cost of providing the expanded DOT service can be accommodated within the proposed budget if the revised fare structure is approved (see Recommendation #4 to the City Manager's memorandum); (3) implemented the regional paratransit system's service hours, which will require the expansion of DOT hours of operation from: (i) 6:00 a.m.-11:30 p.m. to 5:30 a.m.-midnight on weekdays, (ii) 6:30 a.m.-11:45 p.m. to 6:30 a.m.-midnight on Saturday, and (iii) 8:00 a.m.-9:30 p.m. to 8:00 a.m.-midnight on Sunday; implemented the regional paratransit system's fare structure, which is based on the distance traveled and the cost of fixed-route alternatives. The revised fare structure will result in increases for trips taken outside the City's boundaries from the current one-way DOT fare of $1.50 to a range of fares, depending on the destination of the trip. For example, a one-way trip from Alexandria to Tysons Corner would increase from $1.50 to approximately $3.00. Fares for travel within the City's boundaries would remain at $1.50 one way; and (5) implemented the regional paratransit system's requirement for one-day advance reservations. Currently, DOT riders may call in a trip request on the day that they wish to travel. Under the proposed change, same-day, or "on call," reservations will continue to be accepted on an emergency basis. The voting was as follows:

30. Consideration of the Recommendations in the City's Comprehensive Fee Study.

(General Discussion. Members of City Council addressed questions to Ms. Marczak, Deputy Director of Management and Budget; Mr. Pritchett, Chief of Environmental Health; Mr. Kauffman, Director of Recreation, Parks and Cultural Activities; and Mr. Gitajn, Director of Financial and Information Services. The City Manager participated in the discussion on this item.
Further Discussion. Council Member Rich, Mr. Kauffman, and the City Attorney participated in the discussion. The City Attorney will take another look at the legal issue of whether the City can charge more than its costs where it gives proprietary services, such as at Chinquapin and other areas where the City gives proprietary services.)
WHEREUPON, upon motion by Councilman Speck, seconded simultaneously by Councilman Donley and Councilwoman Pepper and carried unanimously, City Council: (A) approved the following proposed general policy guidelines for use in setting City fees: (1) generally, the City's user fees and charges shall be set in consideration of the City's ability to (a) recover the cost of providing the service except in cases where the City's economic development goals or the income levels of affected residents or other market considerations have a bearing on fee setting, and (b) to maintain comparability with fees and charges in neighboring jurisdictions; (2) publications offered for sale to the public (for example, BOCA Code volumes), shall be sold at cost plus an administrative and handling fee of 10 percent of the item's cost; and (3) whenever practicable under State code, all City user fees shall be reviewed and set annually, by resolution, as part of the budget process. (B) proceeded with the following actions as discussed at the April 1, 1993, budget work session: (1) approved in concept the fee increases and new fees as listed on pages 3 through 5, with an estimated fiscal impact of $240,200 in FY 1994; (2) referred the proposed new fees to the relevant City boards and commissions for comment; (3) requested the City Attorney to prepare the necessary ordinances and resolutions to implement the fees and docket them for the first legislative session in June, public hearing and final passage on June 12 for implementation on July 1, 1993, so that the adopted fees can be in effect in FY 1994; and (4) requested that staff circulate the comprehensive development fee package among the building and development community during the late spring and summer so that their comments can be incorporated into a report for Council's consideration in the fall prior to proceeding with any recommended changes (see discussion beginning on page 17 of the City Manager's memorandum). ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL
(a) Councilman Speck reported on Saturday's Christmas-in-April project in which City Council and many others participated. He specifically mentioned Diane Charles, Councilman Donley's aide, and Gayle Reuter, his aide, who served as coordinators and Tracy Schaller in the Clerk's office who served as team captain. He wanted to single out the three of them, and most particularly Tracy for her help. It was the consensus of Council that the City Clerk communicate the appreciation of the Council to Tracy for her effort.
(b) Councilman Speck announced that Council received the report from the Ad Hoc Elections Committee which Council had asked to look at local elections, and they have commented on a number of recommendations and suggested that the proper place for a public hearing would be at Council level. They did collect public comments but did not have a hearing. It was the consensus of Council that the City Manager determine with Mr. Hurd, Chairman of the Ad Hoc Elections Committee, which public hearing meeting he can attend, and schedule the hearing for May or June.
(c) Vice Mayor Cleveland thanked everyone who participated in Christmas-in-April, especially the City Clerk who helped with the picnic as well as Richard Kauffman, Director of Recreation, Parks and Cultural Activities.
(d) Vice Mayor Cleveland announced that Councilman Donley's wife had a baby girl and presented Councilman Donley with a baby gift from Mrs. Cleveland. Councilman Donley gave his thanks and announced their daughter Kelsey Erin was born on Friday afternoon, April 23, at 4:09 p.m. She weighed 7 pounds 11 ounces, and was 19-3/4 inches long. The mother and baby are doing well.
(e) Councilman Donley reported a problem of people parking in the fire lane at Seminary Plaza who should be ticketed. They park there all the time blocking the fire lane and causing traffic congestion. He has brought this up with the Police Chief before and would like Chief Samarra to instruct his officers to ticket these violators without any degree of latitude.

The notice of the meetings of May 6 and May 13 with Ms. Steele, Deputy City Manager, and Mr. Looney, Division Chief, Landlord-Tenant, and the Fair Housing Committee, relates to the Fair Housing Testing Program and is for Council's information. Ms. Steele will provide a brief report following the meeting about what is going forward.)
