The Meeting was called to order by Mayor Ticer, and the City Clerk called the Roll; all Members of City Council were present.

END OF CONSENT CALENDAR

WHEREUPON, upon motion simultaneously made by Councilwoman Pepper and Councilman Speck, seconded by Vice Mayor Cleveland and carried unanimously, City Council approved the Consent Calendar as presented with the exception of Docket Item No. 11; which was considered under separate motion. The City Manager's recommendations are as follows:

7. City Council received the following resignations with regret: (a) Larina Luzzi from the Alexandria Commission on Employment and (b) Patricia Harris from the Alexandria Early Childhood Development Commission; and requested the Executive Secretary to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

8. City Council (a) reappointed Kathleen Baker and Henry Brooks as Representatives from the Alexandria Sister Cities Committee and appointed L. Billie Witte as a Representative from the Arts with Expertise in Music to the Alexandria-Caen Exchange Committee; (b) appointed Deborah Parker as a Business Representative to the Alexandria Commission on Employment; (c) appointed Amanda Biles as the High School Youth Member on the Alexandria Park and Recreation Commission; (d) appointed Carlos Retureta as an Apartment Renter Representative to the Recycling Study Subcommittee of the Alexandria/Arlington Waste-to-Energy Task Force; and (e) appointed John Hyder as a Parent Member to the Alexandria Social Services Advisory Board.

9. City Council received the report and thanked the Commission Members for their work.

10. City Council (1) authorized continuation of the Emergency Winter Shelter Policy developed and implemented for the winter of 1990-91 and continued each successive winter; and (2) commended the homeless shelter operators in Alexandria for their continued commitment to this important program.

11. Consideration of Proposal for Regional Enforcement of Personal Property Taxes.

(General Discussion. The Members of City Council and the City Manager participated in the discussion of this issue.)

WHEREUPON, upon motion by Vice Mayor Cleveland, seconded by Councilman Jackson and carried unanimously, City Council referred this item back to staff for other alternatives and possibly, after the research with the other jurisdictions in terms of implementation of some program like this, have a short work session before the Council meeting at which time Council considers it. REPORTS AND RECOMMENDATIONS OF THE CITY MANAGER (continued)

12. Consideration of the Status of Local Match Projects Funded Through the Comprehensive Services for At-Risk Children Fund and Initial Recommendations for FY 1994 Funds.

(General Discussion. Council Member Rich directed questions to Mr. Cyphers, Director of Human Services. Mayor Ticer made comments and stated that the figure in the second recommendation should be corrected to read $299,083.

Staff will come back with an analysis, to the extent possible, of how many kids are not being served by a good program or bad program. A report by the Early Childhood Development Commission will be at the December 7, 1993 City Council Special Meeting.)

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Council Member Rich and carried unanimously, City Council received the status report and approved, as amended*, the recommendations of the Early Childhood Development Commission: (1) that the deadline for the Northern Virginia Community College Alexandria Teen Parent Child Care Project be extended to December 31, 1993, to allow time for the decisions to be made on pending proposals; and (2) that the six local match projects which have already been funded be commended for their efforts in attracting, to date, a total of $299,083 in state, federal and foundation monies to the City. 13. Consideration of Authorizing the Issuance of a Request for Proposals for Housing Administration Services.

(General Discussion. Councilwoman Pepper stated that the City Council does not have the right to determine who the recipient of an RFP is, but she asked the City Attorney if the City Council has the right to determine whether or not one gets issued, we have in the past, but do we for something like this?

The City Attorney stated that when the City is dealing in a situation like this which he understands is non-professional services in order to go the RFP route, you need to make the determination that the RFP, which is called the competitive negotiation route, is fiscally better, fiscally more advantageous than going the sealed bid route. That is

a determination up front that Council makes that authorizes the issuance of the RFP. That is the end of it for City Council. The final decision is not to be made by the governing body, but by staff. But, which route you go, sealed bidding or competitive negotiation in the non-professional services context, is to be made by the governing body.

The Members of City Council and the City Manager participated in the discussion of this item.

Councilman Donley requested the City Manager to report back regarding her actions under this authorization and the responsiveness of the bidders in terms of our own evaluative process regarding the quality of service and the ultimate cost effectiveness.)

14. Report on the Necessary Actions to Proceed with the Issuance of General Obligation Bonds to Finance Public Improvements and to Refund Outstanding General Obligation Debt:

(a) Consideration of a Resolution to File an Application with the State Council on Local Debt for Authorization to Refund the City's 1986 General Obligation Bonds. (ROLL-CALL VOTE) (ATTACHMENT IV)

(b) Consideration of a Resolution to Declare the Intent of City Council to Reimburse Certain Project Expenditures from Bond Proceeds. (ROLL-CALL VOTE) (ATTACHMENT VI)

(c) Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE Authorizing and Empowering the Issuance, Sale, and Delivery of General Obligation Bonds not to Exceed Twenty-Four Million Dollars to Finance Various Public Improvements and to Refund General Obligation Bonds. Councilman Speck stated for the record that his firm participated in the previous refinancing and is quite likely to participate in this refinancing. If this is approved, he stated that he derives no direct or indirect financial benefit from such a transaction and he does not participate in the decision by his firm as to its role in underwriting. As a result, he stated as he did previously, he will participate in the discussion and the vote.

Councilman Donley stated for the record as his employer likewise participated in the last bond issuance and he does not have any input into the decision. He stated that the potential for Crestar to participate in this bond issue is out there; however, it does not have anything to do with the action that is on the table tonight. He stated he will participate in voting on this matter. Should Crestar be involved in the ultimate issuance of the bonds when the City goes to marketing in February, he stated that he will abstain at that time, but he will participate tonight.

(General Discussion. Councilman Donley explained the process with respect to the proposed bond sale procedures.)

(a) WHEREUPON, upon motion by Councilman Donley, seconded simultaneously by Councilwoman Pepper and Councilman Speck and carried on a unanimous ROLL-CALL vote, City Council (a) adopted the resolution to file an application with the State Council on Local Debt to refund the City's 1986 General Obligation bonds and (b) authorized the City Manager to sign and to transmit the City's application to the State Council on Local Debt and to obtain necessary services related to the sale of securities. The resolution reads as follows:

RESOLUTION NO. 1668

RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION WITH THE STATE COUNCIL ON LOCAL DEBT AS TO THE ISSUANCE AND SALE OF PUBLIC IMPROVEMENT GENERAL OBLIGATION REFUNDING BONDS OF THE CITY OF ALEXANDRIA, VIRGINIA

WHEREAS, the City of Alexandria, Virginia (the "City"), issued Public Improvement and School Bonds of 1986, dated February 1, 1986, originally issued in the aggregate principal amount of $22,000,000 (the "Prior Bonds"); and

WHEREAS, the City, in conjunction with its financial advisor, has determined that it is in the best interest of the City to obtain the necessary and appropriate authorization to refund all of the Prior Bonds that are outstanding, to take advantage of favorable market conditions; and

WHEREAS, prior to refunding the Prior Bonds, the City must obtain the approval of the State Council on Local Debt as to such refunding;

BE IT RESOLVED BY THE CITY COUNCIL OF ALEXANDRIA, VIRGINIA:

1. The City Manager and the Director of Finance are hereby authorized to pursue the necessary requirements for the issuance of bonds (the "Bonds") to refund the Prior Bonds, provided that the City by resolution may decide that it is in the best interest of the City to refund only a portion of the Prior Bonds that are outstanding.

2. The City Manager and the Director of Finance are hereby authorized and directed to apply to the State Council on Local Debt for approval for the issuance of the Bonds. The Bonds shall not be issued until their issuance shall have been approved by the State Council on Local Debt, as required by Section 15.1-227.46 of the Code of Virginia of 1950, as amended.

3. This Resolution shall take effect immediately.

RESOLUTION NO. 1669

A RESOLUTION DECLARING THE OFFICIAL INTENT OF CITY COUNCIL OF THE CITY OF ALEXANDRIA, VIRGINIA TO REIMBURSE EXPENDITURES TO BE INCURRED WITH RESPECT TO CERTAIN PROJECTS WITH THE PROCEEDS OF DEBT TO BE ISSUED BY THE CITY OF ALEXANDRIA

WHEREAS, to facilitate an efficient borrowing program, City of Alexandria, Virginia (the "City") intends to expend money on certain projects prior to the issuance of debt by the City for such projects; and

WHEREAS, the City intends to reimburse such expenditures from the proceeds of debt to be issued by the City; and

WHEREAS, to comply with applicable provisions of the Internal Revenue Code of 1986, as amended, and Section 1.150-2 of the Income Tax Regulations, it is necessary, in order to reimburse such expenditures with the proceeds of tax-exempt debt, that the City Council of the City of Alexandria declare the official intent of the City to make such a reimbursement of expenditures;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alexandria (the "City"), that, as evidenced by this Resolution, the City intends to expend money on the acquisition, construction, renovation, expansion, enlargement, improvement and equipping of public library facilities prior to the issuance of bonds or other debt obligations to reimburse such expenditures. With respect to such projects, the City reasonably expects to issue debt obligations for these projects in the amounts not to exceed $3,200,000.

This Resolution shall take effect immediately.

(c) (General Discussion. Councilman Donley explained the ordinance regarding the actual issuance of the bonds. He stated that Council would go ahead and schedule the public hearing in December and for Second Reading and Final Passage. The staff recommendation is to pass on First Reading and set for public hearing in December the particular bond issue for an amount not to exceed twenty-four million dollars. However, one of the issues that will be discussed and heard at that public hearing will be the potential use of funds for land acquisition regarding the

West End Central Library. He stated that Council has discussed in the past at the Retreat and at other Council Meetings, the possible inclusion of 2.7 million dollars for land acquisition costs. He stated that he does not believe that that 2.7 million is included in the twenty-four million that is before Council tonight. He stated that he thought it would be appropriate for Council at least at this point even though Council has not made a final decision, to increase the twenty-four million to twenty-seven million or you could say 26.7 million if you wanted to be precise in order to potentially lay that particular item on the agenda for the bond issue which would be the land acquisition costs. He asked staff if that is something Council needs to do at First Reading in order to keep that option open in the process we would want to do that now.

Mr. Gitajn, Director of Financial and Information Services, stated that he had asked bond counsel that same question. He indicated that Council may amend the ordinance up as well as down at the final reading. He stated that Paul Shelton, bond counsel from Piper Marbury, recommended advertising it in such a way so that it is clear to people attending the public hearing in December that Council will be considering the issue of amending the ordinance to include 2.7 million dollars for land acquisition.)

(c) WHEREUPON, a motion was made by Councilman Donley, seconded by Councilwoman Pepper that City Council introduce and pass the ordinance on First Reading, as amended; set it for Public Hearing, Second Reading and Final Passage at the December Public Hearing, December 11, 1993, an Ordinance authorizing and empowering the issuance, sale and delivery of bonds not to exceed twenty-seven million dollars to finance various public improvements and to refund outstanding general obligation bonds.

(Further Discussion. Councilman Donley explained that this will allow us to appropriately advertise the gross amount, or the higher amount, and should Council decide at the December public hearing after the public hearing, to not include those funds, Council could reduce the bond issue accordingly. He would rather see Council in a position where we have advertised a larger amount and if Council so deems it necessary reduce that amount rather than advertise a smaller amount and bump it upward.)

NOTE: The approval of the two resolutions at this time and the passage of the bond ordinance on first reading are required to comply with a schedule that would permit the issuance of bonds as early as the last week in February 1994 to take advantage of current low interest rates. (There was considerable dialogue on this item between the Members of City Council and Mr. O'Brien, Director of Libraries. Mrs. Godwin, Director of Management and Budget and the City Manager also participated in the discussion.

Councilman Speck suggested a work session very quickly to take a look at what exactly the City needs to do with respect to a plan.

The City Manager suggested that the BFAAC West End Subcommittee take a look at this as well as the Library Board so that Council will have something to react to at a work session.)

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilwoman Pepper noted that City Manager Vola Lawson was honored by the Alexandria Washington Lodge No. 22. She was given the Community Builders Award for 1993. This is an award that is given to a non-Mason for outstanding service to the City.

(b) Councilman Donley brought to Council's attention the accomplishment of the T.C. Williams Junior ROTC Program. Last April, they participated in their first annual formal inspection and out of 1000 possible points that are awarded, they received 993 which placed them twelfth out of 156 schools that were inspected as part of the formal inspection program. They were rewarded with the Honor Unit With Distinction Award. City Council requested the City Clerk to send them a letter of congratulations acknowledging their accomplishment.

(c) Councilman Donley noted that the Members of Council recently received a copy of the Union News. It contained a short biographical sketch of himself and some colleagues. He stated that the content was not very factual. He wanted to mention the fact that he has received calls and a number of City employees have stopped him on the street indicating that they did not want to be associated with that particular publication nor its content. The same was true and said about an op ed piece that appeared in the Gazette Packet.

(d) Council Member Rich stated that in the election last week it was evident that the City overwhelmingly wants elected school board members. He announced that a meeting has been set up for Monday, November 22, at 7:30 p.m. at Westminster Presbyterian Church. Its goal is to pull together a broad cross section of Alexandrians, racially, ethnically and geographically to help pull together a platform of what we think ought to be done. A second part is to solicit again a broad cross section of Alexandrians to run on that platform. There are other issues that need to be decided including the manner in which an elected school board will take place. He indicated that he does not think that the entire public should be distracted from the process issue to what he feels is the more substantive issue as to what it is that we want done to produce a better result in our school system.

(e) Council Member Rich announced that Project New Course is having a fundraising dinner on Friday night, November 19. It will be at the Commonwealth Court Restaurant at the corner of King and Henry Streets. Will Marshall will be the speaker who is president of the Democratic Leadership Council's "Think Tank" and co-author for "Mandate for Change" which is President Clinton's blueprint for his administration. He will be talking about urban decay, education and welfare reform. If anybody is interested, please contact him about getting a ticket.

(f) Council Member Rich spoke to the legislative history of the jobs program with respect to welfare reform. At the retreat, Council referred the subject to staff to look at what would be required for us to either seek waivers from the federal government or to seek special legislation to infuse some sort of work requirement and work component or community service component to our welfare benefit programs. It was brought to his attention that there is a community service component to the jobs programs. The City cannot participate in it because the state does not include it in the state plan.

Council Member Rich suggested that staff be asked to request the state to include it in its plan so that the City can look at participating in it. He felt that that would be an easier process than either trying to get waivers or special legislation.

Mr. Cyphers responded to this issue and indicated that this will be docketed to provide Council with a comprehensive view of what is occurring, the options, and recommend a work session on December 7.

(g) Council Member Rich requested the status of the meeting that is being held in Congressman Moran's Office on Friday regarding the RF&P. He indicated that he thought he read something in the paper about the City approving a right-in, right-out access.

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL (continued)

Mayor Ticer stated that she thought that was misspoken by the representative of the RF&P whom they quoted. It was not valid. We have not done that. She indicated that the meeting is generally about the position that the bureaucratic, ridiculous position that's been taken by the Park Service and the Department of Interior regarding the grade-separated interchange that supports the notion that once it's good, it's always good. She stated that basically the Park Service has required the RF&P to either build this interchange which no one wants or to come up with twelve million dollars. They do not wish to do either but they are in the process of designing the said interchange because they do not care to pay the money more than they do not care to build the interchange. We have not had any luck so far with our interventions with the Park Service. Congressman Moran has written and finally has set up this meeting. It will basically be a meeting to try to make some sense out of an issue so that everybody can be winners.

(h) Councilman Speck mentioned the Police Department's Toy Give-away Program for the holidays on December 11 where they are inviting citizens to contribute new or functional used toys to help those who will be in need during the holiday season. If anyone wants to make a contribution, please call the Police Department. They will arrange to pick it up or you can drop it off at the Police Department. They will welcome it very much.

(i) Councilman Speck spoke to some concerns that were experienced about voter access and waiting times during the recent election held on November 2, 1993. City Council requested a report from the Electoral Board addressing the issues.

(j) Councilman Speck would like to have the issue of having volunteers issuing tickets for violation of handicapped parking spaces be made part of the City's legislative package.

(k) Vice Mayor Cleveland announced that at the Untouchables function held on October 27, Principal John Porter won the Redskins tickets. It was a guaranteed win and the Redskins did win. Councilman Speck gave up the winning tickets.

(l) Council Member Rich clarified a statement in the Union Newsletter. He never was for the stadium.

New Business Item No. 1: The City Attorney made comments about the process for the election of school board members. There will be a public hearing by City Council on Monday, November 29, at 7:30 p.m. to hear suggestions from the public with respect to how this should be handled (districts, at-large, etc.).

That the sections and portions thereof set forth in "The Thirty-Eighth Supplement to The Code of the City of Alexandria, Virginia, 1981," shall be in force and effect on and after the effective date of this ordinance, and all ordinances of a general and permanent nature which were adopted between May 15, 1993 and June 22, 1993, and which are not included in such supplement or in The Code of the City of Alexandria, Virginia, 1981, are hereby repealed, except as otherwise provided in section 3 of this ordinance.

Section 3. That the repeal provided for in section 2 of this ordinance shall not affect any offense or act committed or done, or any penalty or forfeiture incurred, or any contract established or accruing prior to the effective date of this ordinance; nor shall it affect any prosecution, suit or proceeding pending or any judgment rendered prior to said date; nor shall it affect any ordinance saved from repeal by Ordinance No. 1250; nor shall it affect any ordinance listed in appendices A through J, both inclusive, of The Code of the City of Alexandria, Virginia, 1981, or any pages supplemental to such appendices; nor shall it affect any provision of any ordinance adopted between May 15, 1993, and June 22, 1993, which is inadvertently omitted from or erroneously incorporated into The "Thirty-Eighth Supplement to The Code of the City of Alexandria, Virginia, 1981" or any other supplement to the code; nor shall it affect any ordinance adopted after the effective date of this ordinance.

NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby certify that, to the best of each member's knowledge, only public business matters that were identified in the motion by which the executive session was convened, and that are lawfully exempted by the Freedom of Information Act from the Act's open meeting requirements, were heard, discussed or considered by Council during the executive session.

New Business Item No. 4: WHEREUPON, upon motion by Vice Mayor Cleveland, seconded by Councilman Jackson and carried on a vote of 6-to-0, City Council authorized the settlement of Al-Sabah v. City of Alexandria, et al., as discussed in the executive session. The voting was as follows:

Cleveland "aye" Donley "aye"
Jackson "aye" Pepper "aye"
Ticer "aye" Rich out of room
Speck "aye"

THERE BEING NO FURTHER BUSINESS TO BE CONSIDERED, upon motion by Vice Mayor Cleveland, seconded by Councilman Jackson and carried on a vote of 6-to-0, at 10:44 p.m., the Regular Meeting of November 9, 1993, was adjourned. The voting was as follows:
