29. Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE to amend the ordinance establishing the Commission on the Status of Women to change the name of the commission to the Commission for Women.

WHEREUPON, upon motion by Council Member Rich, seconded by Vice Mayor Cleveland and carried unanimously, City Council approved the Consent Calendar as presented with the exception of Item Nos. 13 and 28 which were considered under separate motions. The City Manager's recommendations are as follows:

City Council received the following resignations with regret: (a) Jean Brereton from the Alexandria-Leninakan Exchange Committee; (b) Ann Mulligan from the Alexandria Commission on the Status of Women; (c) Jonathan P. Rak from the Alexandria Environmental Policy Commission; (d) Patty Fensterwald from the Historic Alexandria Resources Commission; (e) Kathleen Megivern from the Alexandria Human Rights Commission; and (f) Christina Forbes from the Alexandria Waterfront Committee.

10. City Council (a) appointed Kenneth Foran as a Citizen Member to the Alexandria Clermont Interchange Task Force; (b) appointed Edward Sheehy as a Member with Leadership Experience in a Volunteer Organization and Jane Ottman as a Citizen Member Who Is 60 Years of Age or Older to the Alexandria Commission on Aging; (c) reappointed E. Duane Howard and A. Kelsey Marshall as Citizen Members to the Alexandria Commission on Persons with Disabilities; (d) reappointed Edward Semonian as a Citizen Member to the Alexandria Sanitation Authority; (e) appointed Barbara Lopez as a Representative from Alexandria Hospital to the Alexandria Task Force on Aids; and (f) appointed James Matheson as a Representative from the Alexandria Environmental Policy Commission to the Alexandria Waterfront Committee.

11. City Council referred the provision of additional on-street parking on Powhatan Street and the replacement of the traffic signal controls with four-way stop signs to the Traffic and Parking Board for public hearing and recommendation.

12. City Council declared the position vacant and authorized the Executive Secretary for Boards and Commissions to advertise the vacancy.

Consideration of Resolution Approving the Issuance of Industrial Development Authority Refund Revenue Bonds in an Amount Not to Exceed $38,300,000 to Assist Pepco in Refunding the Authority's $38,300,000 Pollution Control Revenue Bonds (Pepco Potomac River Plant Project) Series 1977, issued in July, 1977 to Finance the Acquisition, Construction and Installation of Pollution Control Facilities at Pepco's Potomac River Plant Located at 1400 North Royal Street. WHEREUPON, upon motion simultaneously made by Councilmen Speck and Donley, seconded by Councilwoman Pepper and carried on a unanimous ROLL-CALL vote, City Council adopted the resolution. The voting was as follows:

The resolution reads as follows:

WHEREAS, the Industrial Development Authority of the City of Alexandria, Virginia ("Authority"), has considered the application of Potomac Electric Power Company ("Pepco") requesting the issuance of the Authority's refunding revenue bonds in an amount not to exceed $38,300,000 ("Bonds") to assist Pepco in refunding the Authority's $38,300,000 Pollution Control Revenue Bonds (Pepco Potomac River Plant Project) Series 1977, issued in July 1977 (the "1977 Bonds") to finance the acquisition, construction and installation of pollution control facilities at Pepco's Potomac River Plant located at 1400 North Royal Street in the City of Alexandria, Virginia, and has held a public hearing thereon on December 15, 1993;

WHEREAS, Section 147(f) of the Internal Revenue Code of 1986, as amended (the "Code"), provides that the governmental unit having jurisdiction over the issuer of private activity bonds and over the area in which any facility financed with the proceeds of private activity bonds is located must approve the issuance of the bonds;

WHEREAS, the Authority issued its bonds on behalf of the City of Alexandria, Virginia ("City") and the City Council of the City of Alexandria, Virginia ("Council") constitutes the highest elected governmental unit of the City;

WHEREAS, the Authority has recommended that the Council approve the issuance of the Bonds; and

WHEREAS, a copy of the Authority's resolution approving the issuance of the Bonds, subject to the terms to be agreed upon, a certificate of the public hearing and a Fiscal Impact Statement have been filed with the Council.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ALEXANDRIA, VIRGINIA:

1. The Council approves the issuance of the Bonds by the Authority for the benefit of Pepco, as required by Section 147(f) of the Code and Section 15.1-1378.1 of the Code of Virginia of 1950, as amended ("Virginia Code") to permit the Authority to assist in the refunding.

2. The approval of the issuance of the Bonds does not constitute an endorsement to a prospective purchaser of the Bonds of the creditworthiness of the Bonds or Pepco.

3. Pursuant to the limitations contained in Temporary Income Tax Regulations Section 5f. 103-2 (f) (1), this resolution shall remain in effect for a period of one year from the date of its adoption.

4. This resolution shall take effect immediately upon its adoption.

Adopted by the City Council of the City of Alexandria, Virginia, this 11th day of January, 1994.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Vice Mayor Cleveland and carried on a vote of 5-to-2, City Council transferred $10,000 from contingent reserves to fund the cablecasting of School Board meetings on a delayed basis beginning in January. The Superintendent indicated that the schools for the last several years had underexpended the City appropriation, and he was certain that the City appropriation would be underexpended by more than $10,000 in FY 1994. 17. Consideration of City Staff Comments on the Report from the State Task Force on Social Detoxification Services. (Councilman Speck)

WHEREUPON, upon motion by Councilman Speck, seconded by Vice Mayor Cleveland and carried unanimously, City Council requested the City's legislative delegation to support the following items relating to the Report on the Impact of Public Inebriates on the Community and Criminal Justice Service Systems: (1) Inclusion of a definition of Habitual Public Inebriate in the State Code; (2) Establishment of five as the number of public inebriation convictions in a one-year period as the definition of Habitual Public Inebriation (instead of the 12 convictions recommended in the Task Force Report); (3) Institution of additional penalty options for Habitual Public Inebriation, including sentencing to jail and sentencing to treatment, as proposed in the report (if additional State funds are provided for jail-based treatment, expansion and substance abuse treatment), as well as imposing curfews, loitering penalties, and fines; (4) Provision of additional State funding for community- and jail-based treatment as well as jail capacity expansion to ensure that community substance abuse and criminal justice service systems are able to address the needs of individuals convicted of Habitual Public Inebriation; (5) Conviction of public inebriates in absentia, when warranted; (6) Clarification of the terms "habitual" and "inebriate" as proposed in the report; (7) Clarification and expansion of the existing interdiction order for Habitual Public Inebriates, as proposed in the report, with the addition of "constructive possession" as an offense in the interdiction order; (8) Incorporation of clarifying language regarding the study of civil commitment, recommended in the report; and (9) Provision of increased and equitable State funding for development of social detoxification and public inebriate centers in high impact areas as well as for jail and other treatment options. 18. Consideration of Authorizing an Alexandria Library Facilities Study. (Councilman Speck)

WHEREUPON, upon motion by Councilman Speck, seconded simultaneously by Councilmen Donley and Jackson and carried unanimously, City Council (1) authorized the City Manager to conduct a facilities feasibility study of the Alexandria Library System and to perform preliminary architectural programming for the proposed Central Library; and (2) authorized the reallocation of $50,000 from account 215004 (the Cora Kelly Recreation Center project) to account 205054 (New Central Library) to cover the costs of the study. These monies are available within the existing capital budget. The voting was as follows:

WHEREUPON, upon motion by Council Member Rich, seconded simultaneously by Councilmen Donley and Speck and carried unanimously, City Council approved the recommendations of the Alexandria Early Childhood Development Commission that the $717,000 for FY 1994 and the $83,886 in uncommitted FY 1993 funds for the Comprehensive Services for At-Risk Children's Fund be used to: (1) continue funding for the Danny Chitwood Early Learning Institute Special Caring Respite Project through September 1994, for a local grant match of $14,874; (2) continue funding for the 19-month demonstration projects through June 1995, at a cost of $556,283; and (3) fund the projects and programs recommended by the Commission starting in FY 1995, at a cost of $229,729. 20. Consideration of a Grant Application to the Institute for Museum Services for Funding for the Alexandria Black History Resource Center.

WHEREUPON, upon motion by Councilman Donley, seconded by Vice Mayor Cleveland and carried on a vote of 6-to-0, City Council decided to exceed its budget cap on the number of part-time City positions and approved this request which increases the number of part-time grant-funded City positions by one 0.49 FTE (less than 20 hours per week) position (Museum Aide I). This position would be established within the Office of Historic Alexandria to provide the services outlined in the grant proposal which include the development of educational programs for the local school system and the preparation of programs and activities at the Center. This grant-funded position would terminate upon the expiration of the grant, and the individual who is to fill this position would be notified of this condition of employment. City Council (1) approved the submission of the grant application in the amount of $22,424; (2) contingent upon the award of the grant, approved the establishment of the part-time position reflected above; and (3) authorized the City Manager to execute all documents that may be required. These grant-funded positions would terminate upon the expiration of the grant, and the individuals who are to fill these positions would be notified of this condition of employment. These positions would be established within the Office of Historic Alexandria to provide the services outlined in the grant proposal which include collections care and management and the preparation and administration of educational programs. The grant application also requests $9,492 for materials, fees for professional services for fabrication of exhibitions, programs and publications for a two-year period at The Lyceum. REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilman Donley spoke about a communication Council received from three members of the Gypsy Moth Suppression Committee regarding the disbanding of the Committee. He requested that staff consider disbanding the Task Force and contact the remaining members to get their input regarding the disbanding.

The City Manager stated that staff will look into it and give Council a report. She indicated that one advantage of keeping them intact is that it gives staff a chance to have all of the interested parties there. All of them receiving the same information.

Mr. Kauffman, Director of Recreation, Parks and Cultural Activities, indicated that it is important to bring this committee together to disseminate information, and that staff will work with Citizen Assistance to try to get a viable committee together.

(b) Councilman Donley pointed out that eight of Alexandria's restaurants were named in the top one hundred Washington restaurants listed in The Washingtonian magazine. He indicated that the restaurant community has sort of been under siege for a lot of reasons but it is also important to point out significant accomplishments. To make this list, the restaurants are evaluated on food, service, price, etc. He requested unanimous consent of Council to ask the City Clerk to send a letter to those restaurants indicating that Council has noted their accomplishments. This list includes the following restaurants: La Bergerie, RT's, Le Gaulois, Union Street Public House, Le Refuge, South Austin Grill, Blue Point Grill and Terrazza. He indicated that it points to really a quality of life aspect that we do have such fine restaurants in Alexandria and that they are recognized as some of the best in the Washington area.

(c) Vice Mayor Cleveland presented roses to Mayor Ticer in honor of her birthday. The City Manager presented her with the famous Shuman's jelly cake.

(d) Mayor Ticer announced that Governor Wilder has designated the Mt. Vernon Avenue Corridor as the first enterprise zone in Northern Virginia which took effect January 1, 1994.

Vice Mayor Cleveland made comments and thanked Richard Flaherty for his efforts.

(e) Mayor Ticer highlighted the notice received from the Health Department about the decline in teen pregnancy in Alexandria. From 1991 to 1992, there was a 16% decline and for girls from ages 15 to 17 the decline was actually 21%.

(f) Mayor Ticer spoke to the increased boot activity that is taking place. It is a very successful program for collecting fines. She indicated that she just wants to make sure that in our zeal for revenue that we don't over do it and become draconian in our enforcement.

The City Manager and Mr. Neckel, Director of Finance, made comments and explained the process with regard to this issue.

The City Manager indicated that staff will do a brief memorandum to Council explaining the process and give an example of all of the correspondence that is going out.
