The Meeting was called to order by Mayor Ticer and the City Clerk called the Roll; all Members of City Council were present except Vice Mayor Cleveland.

WHEREUPON, upon motion simultaneously made by Councilwoman Pepper and Council Member Rich, seconded by Councilman Speck and carried unanimously by all those present, City Council approved the consent calendar as presented. The City Manager's recommendations are as follows:

6. City Council received the following resignations with regret: (a) Lisa Johnson from the Alexandria-Caen Exchange Committee; (b) Dorothy U. Seyler from the Alexandria Commission for the Arts; (c) Linda H. Michael from the Alexandria Industrial Development Authority; (d) John W. 7. City Council (a) appointed George Lambert, Jr. as a Representative of a Private organization Whose Office is Located Within the City and Sonia Rosario-Manzano as a Parent Representative Who is Not an Employee of Any Public or Private Program Which Serves Children and Families to the Alexandria Community Policy and Management Team; (b) appointed Chris Daschbach as a Member of the Alexandria Jaycees to the Alexandria Convention and Visitors Bureau Board of Directors; (c) appointed Judith Goss as the Hospital Administration Member Designated by Alexandria Hospital and reappointed Dana Firth as a Member Nominated by the Alexandria Convention and Visitors Bureau to the Alexandria Emergency Medical Services Council; and (d) appointed Chester Avery as a Representative from the Alexandria Commission on Persons With Disabilities to the Alexandria Human Rights Commission.

8. City Council authorized the Mayor to file an application with the Virginia Department of Historic Resources and the National Park Service for Certified Local Government status for the City of Alexandria.

9. City Council received the Alexandria Sanitation Authority's Annual and Financial Reports.

10. City Council received the report and thanked the Commission members for their work on behalf of low-income residents of our community.

11. City Council deferred this item to February 8.

12. City Council authorized the City Manager to award a contract to the lowest responsible bidder and sign the necessary documents, upon approval by the developer and the deposit of the funds in a City account to pay for the developer's portion of the project.

REPORTS AND RECOMMENDATIONS OF THE CITY MANAGER (continued)

13. Consideration of Establishing a Pilot Program in the Office of the Commonwealth's Attorney for Collection of Court Fines and Costs Associated with this Program.

(General Discussion. Mr. Kloch, Commonwealth's Attorney, explained the program and answered questions asked by the Members of City Council.

Staff was requested to report back in a year with results and with recommendations with respect to in-house versus contracting out.)

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Donley and carried unanimously by all those present, City Council (1) authorized the establishment of a pilot program through June 30, 1995, in the Commonwealth's Attorney's Office for the collection of unpaid Court fines and costs, as authorized by legislation enacted by the 1993 General Assembly (Section 1-26 of Chapter 994 of the 1993 Acts of Assembly). Staff will report back to Council with an analysis of this program in the context of the FY 1996 budget cycle, including an analysis of the cost-effectiveness of continuing to perform this function in-house; (2) authorized the hiring of one additional full-time City position to staff and administer the pilot collections program; and (3) approved the transfer of $20,117 from general contingent reserves (account no. 103556-2707) to the Commonwealth's Attorney's Office to fund this pilot program in FY 1994, which includes the cost of the position ($14,620), the cost of a computer, printer and telephone installations ($4,435); and associated operating costs for printing, office supplies and postage ($1,062). (The cost to continue the program through FY 1995 will be addressed in the FY 1995 proposed budget.) The voting was as follows:

(General Discussion. Councilman Speck, Council Member Rich, and Councilman Donley participated in the discussion on this item. Mr. O'Kane, Director of ransportation and Environmental Services, and Mr. Gitajn, Director of Financial and Information Services, answered questions.)

(General Discussion. The City Attorney gave a brief report on what has been happening in the General Assembly.

Councilman Speck indicated that the newsbox issue will be coming forth in February.)

REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilwoman Pepper asked questions of Chief Samarra with respect to the article which appeared in The Alexandria Journal recently regarding crime in the City.

Chief Samarra will be providing Council a detailed report by Friday.

Mayor Ticer and Members of City Council participated in the discussion.

Mr. Neckel spoke to the new city stickers which self-destruct when removed.

(b) Councilman Speck spoke to a recent newspaper article which indicated that there was a teen missing from Alexandria and as you read further in the article the teen actually lived in Fairfax County. He expressed concern as to why it is so difficult for the media to distinguish Alexandria from Fairfax County.

The City Manager and Mr. Brannan spoke to this issue.

The City Manager was authorized to prepare a letter for the Mayor's signature to be sent to Congressman Moran expressing the City's concerns.

(c) Councilman Speck spoke to the upcoming election in May. He indicated that there has been a decline in the number of people who want to work the polls. He stated that the Electoral Board is interested in more volunteers to work and you get paid for working. If anybody is interested in working at the polls, you can call the Election Administrator at 838-4050. Jones Intercable was requested to do a public service announcement to recruit persons to work at the elections.

(d) Councilman Donley spoke to the proposal by the Alexandria Economic Development Program which proposes a build-to-suit exposition that will raise the profile of build-to-suit opportunities in Alexandria. This exposition is anticipated to be a half-day briefing and exhibit attended by 150 to 300 real estate professionals and business executives with relocation or expansion plans or needs.

Mayor Ticer, Members of City Council and Richard Flaherty, Executive Director of the Economic Development Program, participated in the discussion.

ORDINANCES AND RESOLUTIONS

16. Consideration of Resolution Establishing a Recognition Program for Smoke-free Businesses in Alexandria. (ROLL-CALL VOTE)

(General Discussion. Councilwoman Pepper spoke to this program. She requested that the Health Department consider providing a sticker to be placed on the door of businesses which are smoke-free.

Ari Sky, Member of the Alexandria Environmental Policy Commission, participated in the discussion.)

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Donley and carried on a ROLL-CALL vote of 6-to-0, City Council (1) adopted the resolution proposed by the Environmental Policy Commission establishing a recognition program for smoke-free Alexandria businesses; and (2) requested the Commission to evaluate the nominations for the Alexandria Smoke-Free Business Award and recommend the businesses to be recognized. The resolution reads as follows:

RESOLUTION NO. 1675

WHEREAS, the health hazards posed to nonsmokers by cigarette smoking have been established through numerous scientific studies; and

WHEREAS, the U.S. Environmental Protection Agency estimated in its December 1992 report "Respiratory Health Effects of Passive Smoking" that involuntary exposure to environmental, or "secondhand", tobacco smoke (ETS) causes 3,000 lung deaths in the U.S. each year; and

WHEREAS, the American Heart Association estimates that ETS causes between 35,000 and 40,000 deaths annually in the U.S. from cardiovascular disease; and

WHEREAS, the EPA also estimated in its December 1992 report that ETS exposure in the United States annually causes between 150,000 and 300,000 cases of lower respiratory tract infections in children up to 18 months of age; and

WHEREAS, the June 10, 1993 issue of the New England Journal of Medicine identified a strong association between exposure to secondhand smoke and asthma in children, and the December 1992 EPA report estimated that each year between 200,000 and 1,000,000 asthmatic children in the United States have their condition worsened by ETS; and

WHEREAS, the July 28, 1993 issue of the Journal of the American Medical Association reported that there may be a 50 percent increase in lung cancer risk among restaurant workers that is in part attributable to workplace exposure to tobacco smoke; and

WHEREAS, the Coalition for Smoking OR Health estimates that tobacco use costs the U.S. economy $72 billion annually in direct health care costs and lost productivity; and

WHEREAS, the City Council finds that mitigating the public's exposure to tobacco smoke would result in substantial savings to the community and an improvement in the quality of life for Alexandria's citizens; and

WHEREAS, in 1984 the City enacted the "Smoking Prohibitions Code of the City of Alexandria, Virginia," City Code § 11-10-1 et seq., to prohibit smoking in certain public places; and

WHEREAS, the "Virginia Clean Air Act," Va. Code § 15.1-291.1 et- seq., significantly limits the City's ability to impose further restrictions on public smoking; and

WHEREAS, on July 21, 1993, EPA Administrator Carol Browner urged decision makers to adopt nonregulatory initiatives to reduce exposure to secondhand tobacco smoke;

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Alexandria, Virginia, hereby establishes a "Smoke-Free Business Recognition Program," to encourage Alexandria businesses to eliminate tobacco smoke from their work environments voluntarily and to recognize eligible businesses with the Alexandria Smoke-Free Business Award, as follows:

Sec. 1. Purpose

A. The Smoke-Free Business Recognition Program shall serve as a vehicle for honoring Alexandria businesses that eliminate smoking from their premises. To become eligible for recognition under this program, a business must certify that:

(1) the smoking of tobacco products within buildings or portions thereof owned, leased, managed or otherwise controlled by the business and located within the City either will not be permitted; and

(2) the sale or free distribution of tobacco products within buildings or portions thereof owned, leased, managed or otherwise controlled by the business and located within the City will not be permitted.

B. A plan must be submitted that will enable the business to meet criteria (1) and (2) within ninety days of application.

Sec. 2. Eligibility

Any resident, or owner or employee of any business located within the City of Alexandria may nominate any business with facilities located in the City for the Alexandria Smoke-Free Business Award. Eligible businesses shall include any business, profit or non-profit; community organization; or government office within the City of Alexandria that declares itself "smoke-free" and agrees to administer its smoking policy in conformance with the criteria contained in Section 1.

Sec. 3. Administration

The City Manager, or her designee (which may include the Environmental Policy Commission), shall be responsible for evaluating nominations for the Alexandria Smoke-Free Business Award. The City Manager, or her designee (which may include the Environmental Policy Commission), shall make every effort to assist businesses in the development of smoking policies that maximize potential benefits (e.g. health care cost savings, improvements in productivity, and a more hospitable work environment), while minimizing initial costs.

Once the City Manager has certified a business as complying with Section 1, the City Council, directly or through the Environmental Policy Commission, shall promptly present that business with the Alexandria Smoke-Free Business Award. Recipient organizations shall be recognized at regular meetings of the City Council or other suitable public ceremonies, and provided with an award suitable for public display.

Sec. 4. Definition

For the purposes of this Resolution, "smoke" or "smoking" shall have the meaning provided in the Smoking Prohibitions Code of the City of Alexandria, City Code 11-10-2(f).

17. Consideration of a Resolution to the Virginia Department of Transportation (VDOT) which will authorize the Acceptance of Funds from VDOT for Upgrading of the City's Traffic Signal System. (ROLL-CALL VOTE)
