7. Presentation to the Alexandria Police Association for the Residential Police Officer's Program. (Councilman Speck)
(Councilman Speck recognized the Residential Police Officers, the Program, and thanked those who made it all possible. Councilman Speck presented, through the cooperation of the Police Association, a check to Earl Walts. The Police Association has agreed to be the keeper of the funds to provide a source of emergency assistance to the people that the RPOs and the community officers support and help, so that they have a way of knowing that there are funds that are accessible to them as they are trying to deal with the day-to-day activities that they face.
Chief Samarra thanked Councilman Speck for the donation and bringing forth this idea.)

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Vice Mayor Cleveland and carried on a vote of 6-to-0, City Council approved the Consent Calendar as presented. The City Manager's recommendations are as follows:
8. City Council received the following resignations of (a) Albert Angulo from the Alexandria Budget and Fiscal Affairs Advisory Committee; (b) Susan E. Reis from the Alexandria Commission on Employment; and (c) Vice Mayor William Cleveland from the Fair Housing Testing Advisory Committee, with regret; and requested the Executive Secretary to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

9. City Council (a) reappointed Kristin Kappmeyer as an Architect to the Alexandria Board of Architectural Review - Parker-Gray District; (b) appointed Henry Fenlon as a Member Designated by Vice Mayor Cleveland to the Alexandria Budget and Fiscal Affairs Advisory Committee; (c) appointed Richard Ryan as a Physician to the Alexandria Community Services Board; (d) reappointed A. Marie Buckley as a Citizen Member and appointed James Stevenson as a Member from a Veterans Organization Other than the American Legion and the VFW to the Alexandria George Washington Birthday Celebration Committee; (e) reappointed William Bryant as a Provider Member to the Health Systems Agency of Northern Virginia; and (f) reappointed John Hughes as a Citizen Member to the Northern Virginia Planning District Commission.
10. City Council authorized the City Manager to (1) submit a grant application to the Virginia Department of U.S. Environmental Quality for funding as a pass-through from the Environmental Protection Agency, for $40,874, for the Office of Environmental Quality; and (b) execute all necessary documents that may be required.
11. City Council approved the recommendation of the Alexandria Early Childhood Commission that (1) $45,000 in local matching funds be committed to the West End Children's Center Hispanic Family Support Project to provide a half-day learning experience for 30 at-risk three- and four-year-old children with limited English proficiency in the West End and to provide outreach services to their families, including referrals for health, education, housing and employment; and (2) the deadline for this project to obtain matching funds be set as September 30, 1994.
12. City Council authorized the City Manager to: (1) enter into a renewal contract with The Salvation Army for the operation of the Alexandria Community Shelter for the three-year period from July 1, 1994 through June 30, 1997; and (2) execute all necessary documents that may be required.
13. City Council approved the transfer of $5,413 from FY 1994 contingent reserves (Account No. 103556-2707) to the FY 1994 Police Department budget (155077-2313) to purchase noise meters and calibrators to enforce the city's noise ordinance, as amended on June 14, 1994.
14. City Council approved the Community Development Plan for the City of Alexandria, Virginia, July 1, 1994 - June 30, 1997.
15. City Council approved the proclamation.

17. Consideration of Staff Review and Forthcoming Recommendations Regarding Issues Raised by the Lynhaven Citizens Association. (Vice Mayor Cleveland and Councilman Donley)

(Councilman Donley stated with respect to the issue of a large concentration of Section 8 housing in the Lynhaven area, the Association has asked and the City Manager has agreed to explore in conjunction with the Alexandria Redevelopment and Housing Authority and HUD, possible solutions towards eliminating or alleviating over-concentration in this particular neighborhood.
Councilman Donley indicated that City Council was presented tonight with a letter from ARHA, which also contains a letter from HUD, acknowledging the inquiries of ARHA regarding this particular matter and they have pledged to work with the City over the summer. He stated that he believes that the City Manager is contemplating a report back to Council on this particular issue in the fall.
Councilman Donley also spoke to photos depicting some of the problems in the area. He spoke to graffiti problems in the area.
Councilman Donley spoke, with reservations, regarding a curfew ordinance that was adopted by South Boston, VA. The City Attorney has been asked to comment on it and report back. Councilman Donley has requested incoming Judge Nolan Dawkins, Juvenile and Domestic Relations Court, to consider and comment on the ordinance.

Vice Mayor Cleveland concurred with Councilman Donley's remarks and stated that he was in support of a curfew ordinance. He would like the issue of responsibility addressed at the federal level with respect to who is responsible for maintaining the section 8 units.
Councilwoman Pepper requested that the concerned parties talk about extending to the Section 8 recipients, the teaching process that the scattered-site residents receive.
Council Member Rich spoke to similar problems in Mt. Jefferson a few years ago. He suggested that the problems be addressed as soon as possible.
The City Manager stated that staff is going to meet with the concerned parties very soon to see what can be done to address the problems.
Mayor Ticer explained that some of the corrective action to be taken may not require Council action so it can actually be implemented if the City can get as much authorization for oversight over contractual agreements as the City can get from HUD.)
WHEREUPON, upon motion by Councilman Donley, seconded by Vice Mayor Cleveland and carried unanimously, City Council received the report and directed the staff to work with the affected civic associations over the summer and implement whatever solutions that would require immediate attention; any subsequent actions either through the Department of Housing and Urban Development or through ARHA or through the Alexandria City Council would be reported back in the fall. 19. Consideration of Report on Methods of Enforcement of Traffic Violations and Use of Citizen Volunteers to Assist the Police Department. (Councilman Speck)

(General Discussion. Chief Samarra explained the report on this item. Councilman Speck and Council Member Rich directed questions to Chief Samarra. Staff will report back in the fall on the issue of handicapped parking enforcement and the use of volunteers.)

20. Consideration of Requesting the City Attorney to Prepare an Ordinance to amend the Fine for Parking in Violation of an Official Sign at Metro Stations. (Vice Mayor Cleveland)

WHEREUPON, a motion was made by Vice Mayor Cleveland to reduce the parking fine from $35 to $20; which motion FAILED for lack of a second.

22. Consideration of an Application to the Alexandria Health Department for Funds from a Grant Received from the Virginia Department of Public Health for the Office on Women's Project STEPOUT and Project MANHOOD.

WHEREUPON, upon motion Councilwoman Pepper, seconded simultaneously by Vice Mayor Cleveland and Council Member Rich and carried unanimously, City Council decided to exceed its budget cap on the number of part-time City positions and approved this request which will increase the number of part-time grant-funded City positions by one ten-hour-per-week Volunteer Developer position. This person would be working with the Office on Women to provide services under this grant proposal. This grant-funded position would terminate upon the expiration of the grant and the individual who is to fill this position would be

notified of this condition of employment. City Council (1) approved the submission of the grant application in the amount of $9,800; (2) contingent upon the award of the grant, approved the establishment of the part-time position reflected above; and (3) authorized the City Manager to execute all documents that may be required. Councilwoman Pepper abstained from the discussion of this item and removed herself from the bench.

27. Consideration of Local Governing Body Support of Alexandria Redevelopment and Housing Authority's (ARHA) Application to the U.S. Department of Housing and Urban Development for Section 8 Vouchers/Certificates.

(General Discussion. Councilman Donley directed questions to Ms. Davis, Director of Housing. Councilman Donley stated that the City should have a plan from ARHA about how these particular certificates are used. He indicated that this also relates to the item that was discussed earlier and that is how new certificates would be used in the City given the fact that we do have a number of areas that are, in his opinion, over-concentrated. He requested that one of the aspects that he would be interested in when Council meets with the Housing Authority in the fall will be the potential impacts that this might have with the overall Section 8 program in the City, particularly as it relates to neighborhoods that have a high concentration of Section 8 housing.
The City Manager stated that she agrees with Councilman Donley's comments. She indicated that the City's preference is that the Section 8 additional units in the future should be project directed rather than the more conventional existing Section 8 program that concerns were raised about tonight with regard to both Lynhaven and Hume Springs. She stated what this would do is to say to HUD, hold on to this reservation subject to the City working out a plan which really meets the needs and desires of this community.

WHEREUPON, upon motion by Councilman Donley, seconded simultaneously by Councilwoman Pepper and Council Member Rich and carried on a vote of 6-to-0, City Council authorized the City Manager to send a letter of support for ARHA's application to HUD for up to 100 Section 8 vouchers/certificates with the condition that ARHA will not use these vouchers and/or certificates until City Council has approved their use as part of an overall plan presented by ARHA and discussed with City Council at a work session. ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL
(a) Councilman Jackson noted that Tony Hassell, former Journal reporter, died recently at a very young age He stated that he was a person of great integrity. Memorial services will be held at 10:00 a.m., Friday, July 1, 1994, at the pavilion at Fort Hunt Park.
(b) Councilman Donley noted that this is the final meeting of Councilman Jackson and Councilman Speck. He thanked them both for their dedication, service and sacrifice to this City.
Members of Council also made comments and wished them well.

(c) Vice Mayor Cleveland gave three cheers to the Alexandria Police Department and also Parking Enforcement Officers in assisting in the search for a five-year old kid. The story had a happy ending and the child returned home safely from a field trip.
(d) Councilman Jackson spoke to his tenure on City Council. He thanked everyone for all their hard work, support and wonderful times. He stated that it has been a real pleasure to work and serve with everyone.
(e) Councilman Speck announced that Gayle Reuter has been named the new Executive Director for Christmas in April.
He stated that the comments that have been made have been very thoughtful and very gracious. He indicated that his father is retiring this week also at age 83 after 53 years of practicing medicine in Alexandria.

(a) In every zone, the maximum floor area ratio and maximum density specified for the zone shall be determined on the basis of the gross area of the lot or tract of land involved, which shall include:
(1) Areas to be dedicated for street purposes that are in excess of:

(a) 30 feet from the center line in the instance of property located in the R-20 through R-2-5 zones, inclusive.
(b) 33 feet from the center line in the instance of property located in each of the other zones.
(2) Areas located within fire, emergency vehicle, buffer, scenic, channel, bicycle, utility, park or sewer easements.
(b) Except as provided in subparagraph (c) below, compliance with floor area ratio and density requirements shall be determined separately for each individual lot of record.
(c) An applicant for a special use permit for a CDD pursuant to section 5-602(D), for development in a CRMU zone or for a cluster development may request that the land covered by the application be treated as a "tract" for purposes of calculating floor area ratio and density so as to achieve an overall figure that meets the requirements of the zone without regard to compliance on a lot by lot basis.
Section 2. That Article II of the City of Alexandria Zoning Ordinance be, and the same hereby is, amended by adding thereto a new Section 2-146.1, to read as follows:
Section 2-146.1 Food court.
A food court is a restaurant use distinguished by common seating, more than one vendor and a common entrance. A food court shall contain at least three vendors, of which at least two shall be vendors of quick, carry-out type foods. A food court may include one or more full service restaurants, provided that the number of seats set aside for exclusive seating for full service restaurants shall not exceed 50% of the food court's total seating. Except as otherwise expressly provided by special use permit condition, not more than one full service restaurant shall be permitted within a food court and not more than two-thirds of the food court vendors (including any full service restaurants) may offer alcoholic beverages for consumption on the premises. For purposes of this section, a full service restaurant is a restaurant use with any of the following characteristics: exclusive seating, distinct bar area or areas, host/hostess seating of patrons, waiter/waitress service at table, menu cards for individual ordering at table, or table settings of silverware, glassware and/or table linens. For purposes of this section, exclusive seating means seating attended by waiters/waitresses employed by or under the control of a full service restaurant. This definition shall apply to any existing uses specifically approved by special use permit as a food court or food court restaurant prior to June 28, 1994, and, as to past and future food court approvals, shall preempt any descriptions in applications or representations but shall not preempt express conditions of the approval therefor.
Section 3. That Section 1-400, and Article II, of the City of Alexandria Zoning Ordinance, as amended by this ordinance, be, and the same hereby are, reordained as part of the City of Alexandria Zoning Ordinance.

Section 4. That this ordinance shall become effective upon the date at the time of its final passage, and shall apply to all applications for land use or land development approval provided for under the City of Alexandria Zoning Ordinance which on such date are pending before any city department, agency or board, or before city council, or on judicial review, shall apply to all such applications which may be filed after such date, and shall apply to all other facts and circumstances subject to the provisions of the City of Alexandria Zoning Ordinance, except as may be provided in Article XII of said ordinance; and, further that Section 2 of this ordinance shall apply to the food court restaurant, located at 5 Cameron Street/201 North Union Street, approved by Special Use Permit No. 1945, by city council on October 18, 1986, as subsequently amended by city council, and shall operate legislatively to reverse the decision of the Board of Zoning Appeals of the City of Alexandria, in Appeal of Bruce E. WHEREAS, the City of Alexandria's efforts to reduce traffic congestion and improve air quality, include tire development of one or more transit stores to provide a convenient place for residents, employers, employees, and tourists to purchase transit fare media and obtain transit and ridesharing information; and
WHEREAS, the City of Alexandria has created the Transit Store Project to develop one or more transit stores to increase transit and ridesharing use; and
WHEREAS, the Commonwealth of Virginia, Department of Rail and Public Transportation, hereafter referred to as THE DEPARTMENT, administers the Transportation Efficiency Improvement Fund to provide financial support to such projects; and

WHEREAS, the Commonwealth Transportation Board has allocated $160,000 in Transportation Efficiency Improvement Funds in the Tentative Allocation of Funds for Fiscal Year 1994-95 for the development of the Transit Store Project;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alexandria, Virginia, that the City Council supports the Transit Store Project and hereby authorizes the City Manager, for and on behalf of the City of Alexandria, to execute an agreement with THE DEPARTMENT, for a grant of financial assistance in the amount of $160,000 to defray the costs borne by the City of Alexandria for the Transportation Efficiency Improvement Fund Transit Store Project, and to accept from THE DEPARTMENT grants in such amount as may be awarded, and to authorize the City Manager to furnish to THE DEPARTMENT such documents and other information as may be required for processing the grant receipt.
BE IT FURTHER RESOLVED, that the City Council certifies that the funds shall be used in accordance with the requirements of Section 58.1-2425.E of the Code of Virginia, that the City of Alexandria will provide matching funds as required in such Act, that the records of receipts of expenditures of funds granted the City of Alexandria may be subject to audit by THE DEPARTMENT and by the State Auditor of Public Accounts, and that funds granted to the City of Alexandria for defraying the expenses of the Transit Store Project shall be used only for such purposes as authorized in the Code of Virginia.

WHEREAS, the Alexandria City Council deems it appropriate to appoint an alternate member to the Board of the A.P. Hill Regional Jail Authority to provide representation in the event that the City Manager, the City Council's regular member, is unable to attend a meeting of the Board;
NOW, THEREFORE, BE IT RESOLVED by the Alexandria City Council that Assistant City Manager Michele Evans is appointed as the City of Alexandria alternate member of the A.P. Hill Regional Jail Authority Board, to serve until action is taken ending such appointment or appointing a new alternate.

An emergency ordinance to amend and reordain subsection (v) of Section 2-2-10 (ESTABLISHMENT OF ELECTION DISTRICTS AND VOTING PLACES), of Chapter 2 (ELECTIONS), Title 2 (GENERAL GOVERNMENT) of The Code of the City of Alexandria, Virginia, 1981, as amended, by temporarily changing the voting place of the John Tyler Building Election District from the John Tyler Building, 3101 North Beauregard Street, to the Hermitage Building, 5000 Fairbanks Avenue, Alexandria, Virginia.
WHEREAS, the City Council of the City of Alexandria finds and determines that:
1. The voting place established by law within the John Tyler Building Election District, i.e. the John Tyler Building, 3101 North Beauregard Street, Alexandria, Virginia, is under renovation and has been closed to the public for an indeterminate period of time; and
2. It is necessary to designate, in the manner provided by law, a new voting place for temporary use within the John Tyler Building Election District, and obtain preclearance from the Attorney General of the United States under Section 5 of the Voting Rights Act, in order to implement such change in time for the November 8, 1994, general election; and
3. The June 28, 1994, meeting is the last regular meeting of City Council at which an ordinance implementing such change can be finally passed, in time to forward the change for preclearance; and
4. An emergency exists, as contemplated by Section 3.12 of the City Charter; now, therefore
THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:
Section 1. That subsection (v) of Section 2-2-10 of The Code of the City of Alexandria, Virginia, 1981, as amended, be, and the same hereby is, amended and reordained to read as follows:

(v) The John Tyler Building Election District shall be bounded and described as follows:
Beginning at the point of intersection of the centerline of Seminary Road with the centerline of North Beauregard Street; thence northward along the centerline of North Beauregard Street to the centerline of Braddock Road; thence south along the centerline of Braddock Road to the centerline of the Henry G. Shirley Memorial Highway; thence northward along the centerline of the Henry G. Shirley Memorial Highway to the Arlington County line; thence westward along the Arlington County line to the western boundary of the city; thence southward along the western boundary of the city to the centerline of Seminary Road; thence eastward along the centerline of Seminary Road to the point of beginning.
The voting place within the John Tyler Building Election District shall be the Hermitage Building, located at 5000 Fairbanks Avenue.
Section 2. That this ordinance shall become effective upon the date and at the time of its final passage.
