12. Consideration of the Fiscal Year 1995 Plan for Aging Services and Submission of Applications to the Virginia Department for the Aging, the Governor's Employment and Training Department, and the U.S. Department of Agriculture.

WHEREUPON, upon motion by Vice Mayor Donley, seconded simultaneously by Councilwoman Pepper and Council Member Walker and carried unanimously, City Council approved the Consent Calendar as presented except for Item Nos. 10(e) and 13 which were considered under separate motions. The City Manager's recommendations are as follows:

9. City Council received the following resignations with regret: (a) Elizabeth Anderson from the Alexandria Commission on Persons with Disabilities; and (b) Nancy O. Jenkins from the Alexandria-Gyumri Exchange Committee; and requested the Executive Secretary for Boards and Commissions to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

10. City Council (a) reappointed Gant Redmon as a Member Designated by the Alexandria Chamber of Commerce to the Alexandria Budget and Fiscal Affairs Advisory Committee; (b) appointed Steven Kral as a Member from the Field of Intergovernmental Relations to the Alexandria Environmental Policy Commission; (c) reappointed Sara Masterson as a Representative from Planning District I and reappointed Philip Brooks, Jr. and Stuart Clements, Jr. as Representatives from Planning District III to the Historic Alexandria Resources Commission; and (d) appointed Tara Hardiman as a Representative from the Alexandria Commission for Women to the Alexandria Human Rights Commission.

11. City Council authorized the City Manager to: (1) submit a grant application to the Virginia Department of Environmental Quality, Litter Prevention and Recycling, for funding in the amount of $6,138 for the Adopt-a-Park Program; and (2) execute all necessary documents that may be required.

12. City Council (1) approved the FY 1995 Spending Plan for Aging Services; (2) authorized the City Manager to: (a) submit the plan which includes application to the Virginia Department for the Aging for continuation funding for the Alexandria Agency on Aging in the amount of: $180,947 for Title III Federal funds; $9,293 for State funds required to match the federal funds; and $63,374 for additional State Program funds; (b) sign contracts with the Governor's Employment and Training Department for: $27,686 for Title V (Seniors In Community Service Employment Program); and $9,965 for the Job Training Partnership Act/Older Workers Program; (c) submit grant applications totaling $47,201 to the U.S. Department of Agriculture for

reimbursement for congregate, home-delivered and adult day care meals; (d) execute all necessary documents; and (3) approved the continuation of one full-time and four part-time grant-funded positions which administer and operate the Older Americans Act programs and associated services. The positions were established approximately 10 years ago and the full-time position is included in the City's approved FY 1995 full-time position count. Continuation of the positions is contingent upon continuation of funding from the Virginia Department for the Aging.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Cleveland and carried on a vote of 6-to-0, City Council received the listing of delinquent 1989 through 1993 real estate taxes as of June 30, 1994. In accordance with State code § 58.13924, "the governing body shall cause the list[s] ... or such parts thereof as deemed advisable to be published once in a newspaper in the county, city or town, ... having general circulation therein ...."; and that we publish the 1993 listing excluding any tax exemption appeals, real estate tax adjustments, or payments received prior to publication. 16. Consideration of Approval of the Recommendations of the Early Childhood Commission Regarding the Use of Unexpended FY 1994 Children's Fund Monies and the Extension of the Deadline for Raising Matching Funds for the Special Caring Respite Project.

WHEREUPON, a motion was made by Councilman Euille, and seconded by Councilman Cleveland, to approve the City Manager's recommendation.

THEREUPON, an amendment to the motion was offered by Council Member Rich, seconded by Councilwoman Pepper, to approve the City Manager's recommendation, with the addition of the approval of the matching funds for the Elbert Avenue Early Childhood Collaborative Project. This amendment was accepted by both the maker and the seconder of the original motion.
WITHOUT OBJECTION, Barbara Mason and Mary Ellen Hoy, of the Elbert Avenue Early Childhood Project, responded to questions.)

WHEREUPON, Council returned to the main motion, as amended, made by Councilman Euille, seconded by Councilman Cleveland and carried unanimously, City Council approved the City Manager's recommendation and approved the recommendations of the Early Childhood Commission that: (1) $78,603 in unexpended Children's Fund monies from FY 1994 be designated to provide: (a) $36,800 in a local match for the Alexandria Even Start Consortium Project in FY 1996; (b) $37,716 in local match funds to continue existing FY 1995 programs through FY 1996; (c) $4,087 for one-time contributions to existing projects already funded in FY 1995 ($3,735 for the Salary and Benefits Survey and Plan based on the actual bids for this study received by the Commission and $352 for the Crisis Aid Child Care Fund); and, as amended, by the addition of (d) the approval of $36,800 in matching funds for the Elbert Avenue Early Childhood Collaborative Project; and (3) The Danny Chitwood Early Learning Institute Special Caring Respite Project deadline for raising the remainder of the matching funds for their project be extended from September 30 to December 31. 17. Consideration of Service Agreement for the A.P. Hill Regional Jail.

18. Consideration of Proposal to Add a Community-Based Juvenile Probation Officer as Part of the Neighborhood Community Action Plan Discussed at the City Council Retreat.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Vice Mayor Donley and carried unanimously, City Council (1) approved the establishment of one full-time juvenile probation counselor position for the Court Service Unit; and (2) transferred $52,357 from contingent reserves (account 103556-2707) to the Court Service Unit (account 102350-1101) for the additional juvenile probation counselor and associated administrative costs. REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES
ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Mayor Ticer reported on the special contest and exhibit in the City Hall Lobby until October 8, on the diversity of women's lives entitled, "Picture What Women Do," and invited everyone to stop by and see this joint effort.

(b) Councilwoman Pepper reported that she and Council Member Walker had taken a tour of Police Headquarters to see the new computer technology being used in law enforcement. She left feeling impressed about what we have in the Police Department.

Council Member Walker reiterated Councilwoman Pepper's comments about the Police Department tour.

(c) Council Member Walker announced some items still for sale from Saturday's Del Ray Centennial Parade: a booklet for $1 which is a walking tour of Del Ray showing all the houses in Del Ray and a video for $10 which shows Del Ray from the earliest race track days until today. She also reminded everyone that the Del Ray Farmers' Market opens on Saturday, October 1, at 8 a.m., with an official grand opening at 10 a.m., and invited everyone to attend.

(d) Councilman Cleveland announced that the Untouchables will be holding their Second Annual boat ride fund raiser on October 24, from 7 to 10 p.m. on the Cherry Blossom, and encouraged everyone to come out.

(e) Councilman Cleveland read in the newspaper that City Council had agreed to do the Retreat at Airlie, Virginia, from now on. He explained that this was not a unanimous decision, and that he believes the retreat should be held in Alexandria.

(f) Vice Mayor Donley explained his understanding that Council will continue some of the past practices of the initial retreat for a newly elected Council most typically being held out of town, and that Council's retreats during years two and three are typically in-town. Council did discuss the possibility of a second retreat about some other subjects.

(g) Councilman Euille stated there was an article in the Washington Post on September 16 about a program for nuisance abatement that's been successful in Prince George's County. He would like the City Manager and staff to report back to Council at some future time about whether a similar program is feasible in Alexandria.

(h) Councilman Euille brought up an article in the Alexandria Gazette-Packet about the "Berg" housing project being unsafe. He requested the City Manager to express to ARHA and its staff the concern that the City Council and City government would like for all the public housing to be up to code and safe. If there's some assistance that needs to be rendered on the part of the City to help them in that endeavor, we should explore that.

(i) Councilman Euille would like for something to be done about King Street Park which is becoming an eyesore. The temporary fencing appears unsafe and should be removed.

(j) Council Member Rich apologized to Katy Cannady, of the Alexandria League of Women Voters, for not acknowledging and thanking the several members of the League of Women Voters who were here at the last meeting in support of the motor voter resolution. This was an oversight on his part.

(k) Vice Mayor Donley announced the dedication of Northern Virginia CORE, a group of non-profits including the Alexandria Volunteer Bureau, the Alexandria Community Network Preschool, HO HO HO, Carpenter's Lodging, Inc., the Chitwood Institute, the Empowerment Network, the Rapid Action Food Team and the Magazine Publishers' Literacy Project, pooling their resources by sharing space in the 2200 block of Mount Vernon Avenue. The dedication will be on Wednesday, October 19, at 5:30 p.m. He commended the group for a job well done. Their efforts will lead to more direct service to the recipients of their respective programs.

(l) Mayor Ticer reported her surprise at receiving a phone call from the press today asking what she thought about former Mayor Barry's comments at his political meeting with 300 to 500 business people this morning when he said that he thought Virginia and Maryland ought to pick up more of the Metro cost so that the District could save $130 million. The Mayor stressed the Metro compact and agreements, and that this was a very successful regional effort in the past. If everyone doesn't carry his weight the thing falls apart. She also stated it was totally inappropriate to be responding to an idea that was put forward at a political forum from someone who is a candidate. She, as COG's chair, would not receive this agenda item, and that if this person is elected Mayor of the District of Columbia he needs to balance his budget another way.

ORDINANCE NO. 3752

AN EMERGENCY ORDINANCE to amend and reordain subsection (k) of Section 2-2-10 (ESTABLISHMENT OF ELECTION DISTRICTS AND VOTING PLACES), of Chapter 2 (ELECTIONS), Title 2 (GENERAL GOVERNMENT) of The Code of the City of Alexandria, Virginia, 1981, as amended.

WHEREAS, the City Council of the City of Alexandria finds and determines that:

1. The voting place established by law within the Agudas Achim Congregation Election District (i.e. the Agudas Achim Congregation, 2908 Valley Drive, Alexandria, Virginia) is under renovation and has been closed to the public for an indeterminate period of time;

2. It is necessary to designate, in the manner provided by law, a new voting place for temporary use within the Agudas Achim Congregation Election District, and to obtain preclearance from the Attorney General of the United States under Section 5 of the Voting Rights Act, in order to implement such change in time for the November 8, 1994, general election;

3. The September 27, 1994, meeting is the next available meeting of City Council at which an ordinance implementing such change can be finally passed, and forwarded for expedited pre-clearance; and

4. An emergency exists, as contemplated by Section 3.12 of the City Charter; now, therefore,
THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:
Section 1. That subsection (k) of Section 2-2-10 of The Code of the City of Alexandria, Virginia, 1981, as amended, be, and the same hereby is, amended and reordained to read as follows:

(k) The Agudas Achim Congregation Election District shall be bounded and described as follows:

THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:

Section 1. That Sections 4-103, 4-203, 4-303, 4-403, 4-503, 4-603, 4-803, 4-903, 4-1003, 4-1103, 5-103, 5-203, 5-303, 5-403, 5-503, 6-105, and 6-203 of the City of Alexandria Zoning Ordinance be, and the same hereby are, amended to add thereto the following special use permit use, the appropriate subsection designation thereof to be determined by the city attorney in the codification of this ordinance:

( ) Outdoor food and crafts market. Section 2. That Sections 4-200, 4-300, 4-400, 4-500, 4-600, 4-800, 4-900, 4-1000, 4-1100, 5-100, 5-200, 5-300, 5-400, 5- 500, 6-100 and 6-200 of the City of Alexandria Zoning Ordinance, as amended by section 1, be, and the same hereby are, reordained as part of the City of Alexandria Zoning Ordinance.

Section 3. This ordinance shall become effective upon the date and at the time of its final passage.

21. Consideration of July 1994 Resolution from the Landlord-Tenant Relations Board Regarding the Voluntary Rent Guidelines. [ROLL-CALL VOTE]

WHEREUPON, upon motion by Councilman Cleveland, seconded by Council Member Walker and carried on a unanimous ROLL-CALL vote, City Council (1) adopted the resolution; and (2) approved the Landlord-Tenant Relations Board's recommendation that the Board report back to City Council on the adequacy of the guidelines in March 1995. The voting was as follows:

RESOLUTION NO. 1707
WHEREAS, more than half of the dwelling units in the City of Alexandria are renter-occupied; and

WHEREAS, the Alexandria City Council has continually expressed its concern for the well-being of the City's tenants and landlords

through proposed charter changes, legislation, and establishment of the Landlord-Tenant Relations Board; and

WHEREAS, the Alexandria Landlord-Tenant Relations Board has previously expressed its concern to the City Council regarding excessive rent increases.

NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Alexandria, Virginia, calls upon the Alexandria Landlord-Tenant Relations Board to monitor and investigate complaints of rent increases in excess of the following guidelines and to conduct a review of the guidelines every six months:
-- If tenants pay all utilities, not more than four and one-percent cumulatively per year;

--If all utilities are included in the rental amount, not more than seven percent cumulatively per year.

PROVIDED, however, that Board investigators will recognize and take into account any unusual costs, capital improvements and major repairs to the property (which should be substantiated by the owner), and extraordinary increases (more than 50%) in assessments;

PROVIDED, further, that the landlord may apportion increased real estate taxes in an equitable manner;

PROVIDED, further, that when a landlord converts utilities to a sub-metered or individually metered system, the amount of monthly rent, plus annualized utility costs, shall remain within these guidelines;

BE IT FURTHER RESOLVED that the Landlord-Tenant Relations Board will report to City Council on the adequacy of the above guidelines in March 1995.

22. Consideration of a Resolution to Designate City Council as the Local Redevelopment Authority for Properties Affected by the Base Closure and Realignment Act. [ROLL-CALL VOTE]

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Vice Mayor Donley and carried on a unanimous ROLL-CALL vote, City Council (1) adopted the resolution; and (2) requested the City Manager to forward the resolution to the Director of the Federal Office of Economic Assistance, United States Department of Defense. RESOLUTION NO. 1708
WHEREAS, in 1989, the City Council appointed a task force co-chaired by two members of Council to monitor the closing of Cameron Station, a military installation located in the City of Alexandria;

WHEREAS, in 1990, the City Council approved a reuse plan for the Cameron Station installation that provided for the private and public development of the installation following its closure;

WHEREAS, federal law provides that the City may designate a Local Redevelopment Authority which would be responsible for the submission and implementation of a Reuse Plan for Cameron Station pursuant to the Base Realignment and Closure Act, 10 U.S.C. 2687 note, or the Defense Base Closure and Realignment Act of 1990, 10 U.S.C. 2687 note;

WHEREAS, the City Council has determined that it is in the best interests of the citizens of the City of Alexandria that a Local Redevelopment Authority be designated to facilitate the proper redevelopment of Cameron Station pursuant to the Base Realignment and Closure Act, 10 U.S.C. 2687 note, or the Defense Base Closure and Realignment Act of 1990, 10 U.S.C. 2687 note;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF ALEXANDRIA

1. That, the City Council of the City of Alexandria shall be, and hereby is, designated as the Local Redevelopment Authority for Alexandria, Virginia, for the purpose of exercising the powers and responsibilities provided local redevelopment authorities by the Base Realignment and Closure act, 10 U.S.C. 2687 note, and the Defense Base Closure and Realignment Act of 1990, 10 U.S.C. 2687 note;

2. That the city manager shall, by forwarding a copy of this resolution, inform the Secretary of the United States Department of Defense, or his appropriate designee, the City Council of the City of Alexandria has been designated as the Local Redevelopment Authority for Alexandria, Virginia, for the purpose of exercising the powers and responsibilities provided local redevelopment authorities by the Base Realignment and Closure Act, 10 U.S.C. 2687 note, and the Defense Base Closure and Realignment Act of 1990, 10 U.S.C. 2687 note; and

3. That this resolution shall be effective upon the date and at the time of its adoption.

WHEREUPON, upon motion by Council Member Walker, seconded by Councilman Cleveland and carried unanimously, City Council adopted the City Council Schedule, as amended, (1) by scheduling a reception for the Alexandria Historical Society History Award at 7:00 p.m. before the November 9, 1994, meeting; (2) because the School Board cannot make the proposed October 16 Work Session date because of a conflict with college night at T.C. Williams, the City Manager will have an alternative suggested date at the next Council meeting; and (3) by adding a Work Session to receive a briefing by St. Stephens/St. Agnes of their building plans on the three campuses on October 25, 1994, from 6:00 to 6:30 p.m. The voting was as follows:

WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilman Cleveland and carried on a vote of 6-to-1, City Council: (1) approved Carpenter's Lodgings' proposal that the rents of all 28 units at 3908/3912/3916 Elbert Avenue (excluding one unit used for nonresidential purposes) be affordable to persons with incomes not to exceed 60 percent of the median income for the Washington metropolitan area, or $37,620 for a four-person household; and (2) in keeping with the City's emphasis on homeownership, adopt a policy that future projects in Arlandria should focus primarily on homeownership to balance the predominantly rental nature of the area and provide a mix of income levels.
