New Business Item No. 1: Mayor Ticer announced that on Sunday, November 20, 1994, at the Richmond Center in Richmond, Virginia, Alexandria City Councilman Bill Euille, president of William B. Euille and Associates, had been recognized as the "1994 African-American Entrepreneur of the Year" by the State NAACP. As the first recipient of this honor, Councilman Euille will be inducted into the State NAACP's Entrepreneur Hall of Fame.

Members of City Council congratulated Councilman Euille.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Vice Mayor Donley and carried unanimously, City Council approved the Consent Calendar as presented. The City Manager's recommendations are as follows:

5. City Council received the following resignations with regret: (a) Kathleen Baker from the Alexandria-Caen Exchange Committee; (b) Patrick J. Borders from the Alexandria Public Records Advisory Commission; and (c) Kathleen Baker from the Alexandria Sister Cities Committee. 6. WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilman Euille and carried unanimously, City Council adopted the legislative package with the exception of the heart/lung provision and tabled that particular item until such time as representatives of the Police and Fire unions, the City Attorney's office, and the Risk management representative meet and potentially report back an alternative for Council to consider. 11. Consideration of the Proposed Donation of a Lithograph and Sculpture to the City.

WHEREUPON, upon motion by Vice Mayor Donley, seconded by Council Member Walker and carried unanimously, City Council approved the recommendation of the Commission for the Arts and: (1) accepted the donation of the lithograph, "The Ship Fairfax Departing Alexandria for Rio de Janeiro in 1845," from Mr. Steven R. Saunders for display in the Franklin P. Backus Courthouse; and (2) declined the donation of the sculpture, "Columns," located at the King Street Metro Station, from Ms. Hester Nelson, a Washington, D.C. artist. The voting was as follows:

12. Consideration of the Approval of the Policy for the Cooperative Provision of Emergency Winter Shelter in Alexandria.

WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilwoman Pepper and carried on a vote of 6-to-0, City Council (1) authorized the implementation of the Emergency Winter Shelter Policy permanently; (2) requested the staff, as they do each year, to annually prepare a report to City Council that comes to Council in the spring regarding the results of the program, and that any changes that might be required to the policy which become evident then staff would bring it back to Council in the fall before the winter season; and (3) commended the homeless shelter operators in Alexandria for their continued commitment to this important program. 13. Consideration of Proposed Revisions to the City's Home Rehabilitation Loan Program.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Cleveland and carried on a vote of 6-to-0, City Council approved the following amendments to the Home Rehabilitation Loan Program: (1) established a new absolute maximum loan limit of $80,000 for the rehabilitation of owner-occupied and Blighting Influences properties. The current loan limit is $50,000 for all but two loans per year that may exceed that amount; (2) applied the new $80,000 loan limit only to loans funded with monies under the City's direct control (e.g., the Community Development Block Grant (CDBG) and Home Investment Partnerships Program (HOME) entitlement grant monies), including loans for properties on the Blighting Influences List; and (3) continued to exempt from the maximum loan limit of $80,000 any loans funded with monies that are not allocated to the City, but are made available directly to individuals to fund home rehabilitation loans approved by the City, such as state-funded loan programs. ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilwoman Pepper noted that thirty-one years ago, President Kennedy was assassinated.
(b) Councilwoman Pepper encouraged citizens during this holiday season to buy their gifts, decorations, food, etc. in Alexandria.

(c) Councilwoman Pepper spoke to a recent article in the press with respect to establishing a regional authority for the Woodrow Wilson Bridge.

Mayor Ticer explained that the article was very erroneous.

Councilman Cleveland stated that he has sent a letter to Governor Allen asking him to speak to Governor-elect Glendening about the possibility of the "eastern bypass."

Mayor Ticer stated that Governor-elect Glendening has a history of regional cooperation and participation and he is basically on record in support of the "eastern bypass".

Transportation and Environmental Services Director O'Kane also participated in the discussion.

(d) Council Member Rich requested a status report on the negotiation for the CET contract as to where we are as far as the performance standards for paying.

Financial and Information Director Gitajn responded to his concerns.

Councilman Cleveland, Deputy City Manager Steele and Human Services Director Cyphers also participated in the discussion of this issue.

(e) Council member Rich spoke to a letter dated November 11, 1994, signed by four former chairs of the Women's Commission, concerning a position being moved from the Office on Women to the City Manager's Office. On its face there appears to be some reasonable concerns, he requested a response to that. He stated that it seems like we are moving from a position of direct service up to an administrative position and he thinks that is going in the wrong direction. In this day and age, he stated, we are supposed to be going in the other direction.

Assistant City Manager Evans stated that she spoke this afternoon to the Chair of the Women's Commission who was not consulted about this letter which was signed by four former chairs. The current chair is writing a separate letter to Council providing it with her position. Unfortunately, the letter that you received includes some misinformation and the position that you described is not going to the City Manager's Office or even to the Special Assistant. It will still be a management analyst level position of about a grade 19 that will continue to do a variety of things including some of the things that were done before. Staff will provide Council with a detailed explanation early next week.

(f) Council Member Rich requested the status of lights in the Lynhaven area. Assistant City Manager Evans, Chief Samarra and Transportation and Environmental Services Director O'Kane participated in the discussion. Staff will report back to Council at its December 13, 1994, Council Meeting.

(g) Council Member Rich spoke to a follow-up item from the Retreat with respect to dealing with juveniles who are on probation and wanted an update on what the status is of the discussions with the Court and the Court Services Unit with regard to the Police being able to access information so that they are able to act promptly in all neighborhoods.

Chief Samarra participated in the discussion. He indicated that he has discussed this with Judge Rideout and he is willing to continue discussion of it. They will be meeting in the near future.

Council Member Rich would like to attend if possible. Chief Samarra felt that the Manager's Office will set up a meeting.

(h) Council Member Rich directed questions of day care systems to Human Services Director Cyphers.
(i) Council Member Rich congratulated the Alexandria Jaycees for being the #1 Chapter in the State for two consecutive years.

(j) Councilman Cleveland congratulated the Office of Historic Alexandria's sites which have been awarded $100,000 from grants. Those grants will go to Gadsby's Tavern and the Fort Ward Museum. The one that is really enlightening is the Alexandria Black History Resource Center. It is the only Black History Resource Center in the country that received a grant from the Institute of Museum Services. Eugene Thompson is really doing a super job.

(k) Council Member Walker announced the current vacancies on Boards and Commissions for which applications are due by 5:00 p.m., December 2. She encouraged persons to call the Office of Citizen Assistance at 838-4691 for applications.

(l) Council Member Walker announced that the Resident Police Officers and neighborhood officers, will host a neighborhood Christmas party at Police Headquarters. They need toys so that they can give them to the children from their associations. She encouraged persons to give toys to them. The phone number is 838-4520. Sergeant Guy Bishop is the coordinator for this program. Volunteers are needed to wrap gifts on December 3. December 10 is the party for the children. Invitations will be forthcoming.

Chief Samarra indicated that Police Headquarters is a drop-off center. The Mayor suggested that the City Clerk's Office could be a drop-off place in City Hall.

(m) Council Member Walker announced for those who need things to do other than to give toys, the Alexandria United Way has produced a catalogue. Alexandria artist Todd Healy donated the artwork for the cover and Bell Atlantic Virginia made the printing possible. Inside the catalogue are many ways that you can either give or volunteer during the holiday season. To obtain a copy of the catalogue, call 549-4447.

(n) Council Member Walker announced that the Del Ray Market is going to open for one day only on Saturday, December 10, for Christmas decorations.

(o) Vice Mayor Donley announced that the Potomac West Annual Christmas Tree lighting will be held on Wednesday, December 7, at Colasanto Park at 7:00 p.m.

(p) Vice Mayor Donley announced that on Thanksgiving Day there will be the 19th Annual Turkey Trot starting at 10:00 a.m., beginning and ending at Cora Kelly School. It is a five-mile race. The admission into the race is two cans of food and $5. ALIVE will receive most of the proceeds as well as all of the food.

(q) Mayor Ticer announced that on November 17 at the meeting of the Commonwealth Transportation Board in Richmond, Transportation Secretary Martinez presented the 1994 Outstanding Public Transportation System Achievement Award to the Alexandria Transit Company. This is the second year in a row that we have received this. She congratulated them on this recent award.

(r) Mayor Ticer stated that what Transportation and Environmental Services is doing with the business community on recycling is very interesting. They are assisting them in the ways that they can recycle.

Transportation and Environmental Services Director O'Kane participated in the discussion.

(s) Mayor Ticer announced that Santa comes to Market Square and the annual tree lighting for Market Square will be held on Friday, November 25, 1994, at 7:00 p.m.

ORDINANCES AND RESOLUTIONS

14. Consideration of Resolution Regarding the Virginia Retirement System (VRS). [ROLL-CALL VOTE]

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Council Member Rich and carried on a unanimous ROLL-CALL vote, City Council adopted the resolution which would extend a three percent retirement allowance to City and School employees participating in the Virginia Retirement System effective October 1, 1994. As part of the resolution of litigation brought by Federal retirees, the State has increased retirement benefits for State VRS retirees by three percent to offset the taxation of their benefits. Approval of the Resolution would also extend this three percent increase to City VRS retirees. (The Alexandria School Board passed a corresponding Resolution, extending the three percent increase to school employees, on November 3.) The voting was as follows:

RESOLUTION NO. 1715
Extending a Three Percent Benefit Increase to Current and Future City and School Retirees Participating in the Virginia Retirement System

WHEREAS, the Virginia Retirement System is the primary retirement plan for City and School employees, except sworn police officers and firefighters; and

WHEREAS, the Virginia Retirement System benefits formula was predicated on the assumption that pension benefits would be exempt from State tax; and

WHEREAS, as part of a settlement with Federal retirees, the Virginia General Assembly has approved a three percent increase in Virginia Retirement System pension benefits to compensate current and future state retirees for the taxation of their benefits; and

WHEREAS, participating localities like the City of Alexandria may, by passing a Resolution before January 1, 1995, extend the three percent increase in benefits to local employees participating in the Virginia Retirement System; and

WHEREAS, this action is required to compensate the City's current and future retirees participating in the Virginia Retirement System for the taxes they will pay; and

WHEREAS, on November 3, 1994, the Alexandria City School Board passed a Resolution extending the three percent benefit increase to Alexandria City Public School employees;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF ALEXANDRIA, VIRGINIA

1. Does hereby elect to provide a three percent retirement allowance increase as provided in the Code of Virginia, Section 51.1-130, 51.1-155, 55.1-157 as applicable for its eligible current and future City and Schools retirees under employer code 5-5200, and 5-5500.

2. Agrees to accept all liability for any current or future additional employer contributions and any increases in current or future employer contribution rates resulting from its election to provide the increase in benefits to its current and future retirees.

3. Elects to allow its eligible current and future retirees to receive the benefit increase effective October 1, 1994.

4. Authorizes and directs City Manager Vola Lawson and City Clerk Beverly I. Jett, in the name of the City of Alexandria, to execute any required contract in order that said eligible current and future retirees of the City of Alexandria and the Alexandria City Schools may participate in the benefit allowance increase as provided for in the Code of Virginia. In execution of any contract which may be required, the seal of the City of Alexandria shall be affixed and attested by the Clerk and said officers of the City of Alexandria are authorized and directed to pay over to the Treasurer of Virginia from time to time such sums as are due to be paid by the City of Alexandria for this purpose.

New Business Item No. 2: WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilman Cleveland and carried unanimously, at 10:35 p.m., City Council convened an Executive Session, under section 2.1-344(A)(6) of the Virginia Code, to discuss with legal counsel two lawsuits brought against the City by the RF&P Corporation which challenge the City's 1992 rezoning of the Potomac Yard and Potomac Greens properties, both of which suits are pending in the Alexandria Circuit Court. The voting was as follows:

New Business Item No. 3: THEREUPON, upon motion by Vice Mayor Donley, seconded by Council Member Walker and carried on a vote of 4-to-0, at 11:50 p.m., City Council reconvened the Meeting. The voting was as follows:

WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilman Euille and carried on a unanimous ROLL-CALL vote, City Council adopted the resolution pertaining to matters discussed in the Executive Session. The voting was as follows:

The resolution reads as follows:
RESOLUTION NO. 1716
WHEREAS, the Alexandria City Council has this 22nd day of November, 1994, recessed into executive session pursuant to a motion made and adopted in accordance with the Virginia Freedom of Information Act; and

WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by City Council that such executive session was conducted in accordance with Virginia law;

NOW, THEREFORE, BE IT RESOLVED that the city council does hereby certify that, to the best of each member's knowledge, only public business matters that were identified in the motion by which the executive session was convened, and that are lawfully exempted by the Freedom of Information Act from the Act's open meeting requirements, were heard, discussed or considered by Council during the executive session.

THERE BEING NO FURTHER BUSINESS TO BE CONSIDERED, upon motion by Vice Mayor Donley, seconded by Councilman Cleveland and carried unanimously, at 10:52 p.m., the Regular Meeting of Tuesday, November 22, 1994, was adjourned. The voting was as follows:
