Passage on First Reading of AN ORDINANCE to amend section 10-1-19 of the city code to make violations of title 10 of the code, which regulates the operation and parking of motor vehicles, a traffic infraction rather than a misdemeanor, except in those instances where the city code or a provision of the state motor vehicle law that has been incorporated into the city code expressly provides another classification or penalty for the offense.

END OF CONSENT CALENDAR

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Vice Mayor Donley and carried unanimously, City Council approved the Consent Calendar with the exception of Docket Item Nos. 8 and 10, which were considered under separate motions. The City Manager's recommendations are as follows:

6. City council received the following resignations with regret: (a) James W. Cisco from the Alexandria Affordable Housing Advisory Committee; (b) Mark A. Knight from the Alexandria Economic Opportunities Commission; and (c) Mark A. Knight from the Alexandria Human Rights Commission; and requested the Executive Secretary to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

9. City Council authorized the City Manager to: (1) submit a grant application to the Virginia Council on Child Day Care and Early Childhood Programs, in the amount of $5,200, for technical assistance monies for Alexandria's comprehensive preschool program for at-risk four-year-old children. As part of this grant application, the City will certify its intent to apply for an additional State grant of $106,920 in May 1995 to fund the continuation of existing programs for at-risk four-year-olds into FY 1996; and (2) execute all necessary documents that may be required.

11. City Council received the 1994 Annual Opinion Survey Report from Jones Intercable, Inc.

12. City Council received Jones Intercable's 1994 Annual Report and Plant Survey.

13. City Council received the Comprehensive Annual Financial Report for the Fiscal Year ended June 30, 1994.

14. City Council received the report and thanked the Alexandria Public Health Advisory Commission for its efforts on behalf of public health and the City.

10. Consideration of Application to the Virginia Employment Commission for Funds Under Title III of the Job Training Partnership Act for FY 1995 for the Dislocated Workers Program at Cameron Station.

(General Discussion. Councilman Euille directed questions to Human Services Director Cyphers and City Manager Lawson with respect to the number of employees involved and the Fair Share Resolution recently adopted.)

WHEREUPON, upon motion by Councilman Euille, seconded simultaneously by Councilman Cleveland and Councilwoman Pepper and carried unanimously, City Council authorized the City Manager to: (1) submit a grant application to the Virginia Employment Commission for funding, in the amount of $240,000, for dislocated workers services at Cameron Station under Title III of the Job Training Partnership Act; (2) approve the establishment of three full-time grant-funded positions (two Employment Training Specialists and one Clerk Typist III) to provide dislocated workers services at Cameron Station. Persons in the grant-funded positions would be working for the Office of Employment Training to provide the services stipulated in the grant application, and they would be terminated upon the expiration of the grant. All persons who fill these positions will be notified of this condition of employment; and (3) execute all necessary documents that may be required. The voting was as follows:

The resolution reads as follows:
RESOLUTION NO. 1717

WHEREAS, the City Council of the City of Alexandria has received information from public and private sources that the United States Patent and Trademark Office is seeking a new location in the Washington Metropolitan Area within which to consolidate its facilities and operations; and

WHEREAS, there are various site locations situated within the City of Alexandria which possess requisite criteria necessary to successfully provide for the needs of the United States Patent and Trademark office; and

WHEREAS, the City of Alexandria recognizes the United States Patent and Trademark Office as a flagship federal agency which has the ability to generate significant job growth for the City of Alexandria and stimulate beneficial commercial and residential development in the City of Alexandria; and

WHEREAS, the City of Alexandria believes that the possible relocation and consolidation of the United States Patent and Trademark Office in the City of Alexandria represents an outstanding opportunity for the City of Alexandria to secure a stable source of growth and prosperity for the City's economic future; and

WHEREAS, the City Council for the City of Alexandria, upon due consideration, finds and determines that the relocation of the United States Patent and Trademark Office to the City of Alexandria would be of important economic benefit for the City of Alexandria, its citizens, landowners and business owners;

NOW, THEREFORE BE IT RESOLVED, that the City of Alexandria shall lend its full efforts and support towards securing the relocation and consolidation of the United States Patent and Trademark Office in the City of Alexandria.

WHEREUPON, upon motion by Councilman Euille, seconded by Vice Mayor Donley and carried unanimously, City Council approved the creation of a Task Force Committee, to discuss, develop and formulate a three (3) or five (5) point program to eradicate nuisance crimes and activities through a new awareness, new approach, commitment and total community involvement, to improving the quality of life in our neighborhoods. The Task Force will hold at least three (3) meetings and forward its report for Council's action and approval by March 1, 1995, at which time its status will expire, and the follow-up and review process will rest with the Manager's Anti-Drug Committee. The Committee will be composed of the following seven individuals: (2) City Council Members, Councilman Euille and Vice Mayor Donley; (2) Staff Members designated by the City Manager; (1) Public Safety Official; (1) Representative from the Inner-City Civic Association; and (1) Representative from the Lynhaven Civic Association, for a total of seven. The voting was as follows:

17. Consideration of a Report Concerning confidentiality of Juvenile Records. (Council Member Rich)

WHEREUPON, a motion was made by Council Member Rich, seconded by Councilman Cleveland to quietly support a modification of ShowCap so that at least the Police Officers can get a hold of information regarding juvenile offenses.

Vice Mayor Donley offered an amendment to the motion if it is acceptable to the maker and seconder, "that we also look at expanding the exceptions to confidentiality as those laws exist today, specifically relating to Section 16.1-309.1 of the Virginia Code which contains exceptions for confidentiality regarding Class I, II, and III felonies when committed by a juvenile, also forcible rape, robbery or burglary related offenses; we potentially might want to consider requesting the Legislative Delegation to expand those classifications to all felonies, so that the exceptions to confidentiality by a Judge once adjudicated if a Judge were to view this in the public's interest can, under current law, make that information available to the public; we ought to consider potentially expanding that to all felonies if committed by a juvenile and adjudicated by the Juvenile and

Domestic Court, but also potentially add to that repeat offenders, and that might get to some of Council Member Rich's concerns, but it also works under the confines and the parameters which presently exist in the Virginia Code." If acceptable to the maker and the seconder, Vice Mayor Donley would like to make this as an alternative as well.

This was agreeable to the maker and seconder of the motion and the rest the City Council.)

WITHOUT OBJECTION, City Council deferred this until Saturday, December 17, 1994. The City Attorney will give a verbal report on Saturday regarding possible amendments to Virginia Code § 16.1-309.1 which addresses the disclosure, to the public, of certain information pertaining to juveniles who have been adjudicated delinquents.

18. Consideration of Receipt of the Deferred Social Services Advisory Board's Report on Welfare and Work and the Recommendations of the Alexandria Commission on Employment's Recommendations pertaining to the Center for Employment Training; and Initiation of the Center for Employment Training Replication Project.

WHEREUPON, upon motion simultaneously made by Council Member Rich and Councilman Euille, seconded by Vice Mayor Donley and carried on a vote of 6-to-1, City Council (1) received the report on "Welfare and Work" contained in the docket memorandum deferred from the October 25 City Council Meeting and commended the members of the SSAB for their work; (2) Approved re-directing the City's Level IV Supplemental Payments to Aid to Families with Dependent Children (AFDC), as recommended by the SSAB, beginning July 1, 1995, to the operation of a short-term, job-targeted employment training program; (3) Approved the SSAB's proposal to

proceed with the design and cost analysis of the community work experience and volunteer service recommendations in the SSAB report. We will report back to City Council in the spring after the SSAB and Human Services staff have had an opportunity to develop these recommendations; (4) Received the recommendations of the Alexandria Commission on Employment and thanked the members of the Commission for their input. Staff has reviewed the ACE recommendations and has incorporated them into the negotiations with CET in the following manner: (a) "any contract with CET be performance-based." The City staff concur and already have agreement with CET that the contract will be performance-based; (b) "CET establish and maintain a formal support group after initial lob placement." City staff has reached agreement with CET staff that, during the first six months of the program, before CET students have obtained jobs, staff from the City and CET will review and analyze the best approach to take for supporting graduates, especially those who are AFDC recipients. CET already offers an impressive array of supports for their graduates, so the staffs will determine whether the addition of a formal support group approach will be beneficial once they have had a chance to meet with the students and study their needs; (c) "the ACE be represented in the selection process of hiring the Executive Director." The City staff has reached agreement with CET staff that a panel including one SSAB and one ACE member and City staff will interview applicants and recommend three candidates to CET for the final hiring; and (d) "citizen input be part of the site selection process." CET staff have agreed and are already using a number of local resources, including those recommended by the ACE, and Richard Flaherty, Executive Director of the Economic Development program, for site location and selection; (5) Authorized participation in the Technical Assistance and Training grant from the U. S. Department of Labor that pays the expenses for CET staff to replicate the CET program in Alexandria. The Department of Labor granted $900,000 to CET to open seven new sites throughout the nation. The grant to CET requires that it conduct both on- and off-site training to local entity and CET personnel, select and develop a facility in Alexandria, perform a market analysis and select skills to be trained, develop curricular materials for the selected skill areas, replicate management information systems and reports for the Alexandria site, and monitor site personnel through the period of the agreement. (6) Authorized the City Manager to enter into an agreement with CET that includes the following terms: (a) CET will establish and operate a CET center in Alexandria for Alexandria Job opportunities and Basic Skills (JOBS) and Job Training Partnership Act (JTPA) clients. The initial contract will be for a three-and-a-half year period, including the start-up phase, (beginning January 1, 1995, and ending June 30, 1998), subject to the City's standard clauses for non-appropriation (i.e., if the City Council does not appropriate monies for this program, the contract is terminated), availability of Federal Funds, and a provision to terminate the contract for cause. In addition, either the City or CET may terminate this agreement with 180 days written notice. As discussed below, staff estimates that contract performance payments for FY 1996, the first full year of operations, will total approximately $1 million. (b) Payments to CET will be based on performance. The first of three equal payments of $2,660 (for the average 30 week course) will be due after 10 days of assessment and enrollment (i.e., there is no payment due for students who drop out during the first 10 days of enrollment), a second payment will be due after completion of training, and a final payment will be due when the student has been employed for at least 90 consecutive days after placement. (c) CET agrees: (1) to qualify to receive Pell grant revenues at the earliest possible time (staff estimates that Pell grants, which provide federal assistance, based on need, to students in paying for post-secondary education, will average approximately $1,600 per eligible student); and (2) to actively pursue such grant revenues on behalf of its eligible students. The City's second performance payment will be reduced by an amount equal to 50% of Pell grant revenues

for each eligible student (the remaining 50% will be used by the student to defray transportation and other training-related expenses). (d) The City's first payment to CET will be in the amount of $300,000 to fund necessary start-up costs, including equipment acquisition, building lease payments, and staff salaries during the initial start-up period (from January 1, 1995, through June 30, 1995). This $300,000 payment will be offset by crediting this advance by $500 for each of the first 600 students referred by the City, who complete the initial assessment and enrollment period. In the event that the entire advance has not been credited by July 1, 1998, any remaining unreduced balance shall be due from CET at that time (except that the unreduced balance shall not be due in the event that Federal funding is terminated or City Council does not appropriate monies for this program). In the event that this $300,000 advance cannot be entirely accommodated within the Human Services budget, we will return to City Council in the fourth quarter of the fiscal year to recommend an additional appropriation from General Fund balance; (e) CET agrees to provide reports at times and in a manner prescribed by the City. Reports will include: (1) data sufficient to evaluate CET performance in training and placing students (e.g., client demographic data, client progress in training, job placement and retention and follow-up data) ; and (2) documentation to support monthly invoices (e.g., Pell grant receipts and number of students meeting performance payment thresholds); (7) Approved the reallocation of up to $100,000 in budgeted Job Training Partnership Act (JTPA) monies in FY 1995 to fund performance payments for students who may be enrolled before the end of the current fiscal year; (8) Approved the following plan to fund CET operations in FY 1996 (the fiscal year beginning July 1, 1995, and ending June 30, 1996), which are estimated to total approximately $1 million: (a) $100,000 in federal Job Training Partnership Act (JTPA) monies currently budgeted in the Department of Human Services, which may be reallocated to purchase training for economically disadvantaged clients; (b) $450,000 in federal Job Opportunities and Basic Skills (JOBS) monies,, which the City must match on a one-to-one basis; and (c) $450,000 in Level IV Supplemental AFDC monies, which would be reallocated, in accordance with the recommendation of the SSAB, to provide the City's local match for federal JOBS monies. Funding for future years is anticipated to be at comparable levels with a standard inflation adjustment in FY 1997 and FY 1998. Full funding of this program is contingent on continued federal aid; and (9) Authorized the City Manager to execute all appropriate documents that may be required. The voting was as follows:

19. WHEREUPON, upon motion by Councilman Cleveland, seconded by Council Member Walker and carried on a vote of 5-to-0, City Council (1) approved a refund of $1,253 in licensing fees paid to the City to compensate Polak Steamboat, Incorporated for berthing space not used at the City Marina for three months for The Matthew Hayes; and (2) amended the license agreement between the City and Polak Steamboat, Incorporated and Potomac Riverboat, Incorporated and Potomac Riverboat Company to allow for the reduction in the monthly payments to the City in the event that The Matthew Hayes cannot operate for eight or more consecutive days due to mechanical failure. 20. Consideration of an Award of Contract for the Construction Repairs and Rehabilitation of the Duke Street Bridge and for Engineering Inspection Services During Construction.

Staff is to see that the public is made aware of this pending construction.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Vice Mayor Donley and carried unanimously, City Council authorized the City Manager to: (1) award the construction repair and rehabilitation contract for the Duke Street Bridge project to the lowest responsive and responsible bidder, Corman Construction Company, in the amount of $3,702,102; (2) authorize a 10% construction contingency budget for the project, in the amount of $387,218; (3) approve the extension of the existing professional services agreement with URS Consultants, Inc., (the current engineers for this project) for engineering inspection services during construction of the project, in the amount of $170,075; and (4) execute all agreements and contract documents associated with this project, once the project is considered and approved by the Commonwealth Transportation Board at its meeting on December 15, 1994.

It is important to note that the total cost of this essential bridge repair project will be split between the State, which pays a 98% share of the cost, and the City, which pays a 2% share of the cost. The City's 2% share, in the amount of $93,834, has already been paid during the pre-engineering and design phase, and all remaining project costs will be reimbursed by the State. 21. Consideration of City-wide Lighting Report.

WHEREUPON, upon motion by Councilwoman Pepper, seconded simultaneously by Council Member Walker and Councilman Cleveland and carried unanimously, City Council approved the revised recommendation of the City Manager and (I) took the following actions regarding the street lighting in Lynhaven: (a) approved in concept the plan for upgrading and enhancing the street lighting in Lynhaven to make the neighborhood safer for citizens and police officers as outlined below: (b) referred the lighting plan to the Lynhaven Civic Association for comment at its January 9 meeting; (c) requested Virginia Power to begin preparing its cost estimate for the lighting changes; and (d) requested staff to return to Council with a final report on the Lynhaven lighting proposal at the January 24 legislative session.

The lighting plan that was developed by staff for the Lynhaven neighborhood has been amended as a result of input from the leadership of the civic association. Several locations for new lights and upgrading lights have been added, and the number of blocks that would have lighting increased from 8,000 to 14,000 lumens has been reduced. Since the members of the civic association have not had the opportunity to review the details of either proposal, I am recommending that Council refer this plan to the civic association for their comments at their January meeting.

The revised plan is as follows: (1) trimming of trees that are interfering with the illumination by existing street lights as identified by City staff (The list of trees to be trimmed will be shared with the civic association at its January 9 meeting.); (2) requesting Virginia Power to prepare a street light relamping schedule for the Lynhaven neighborhood in order to insure that the existing street light luminaries (the light components of the fixtures) are replaced before they reach the end of their useful life, so that each street light is operating at its full output. (Included in this relamping will be the 100 and 200 blocks of Lynhaven Drive, the 200 and 300 blocks of Wesmond Drive and the 3500 block of Wilson Avenue, where the existing 8,000 lumen sodium vapor lights would be relamped but the lights would continue to be 8,000 lumens); and (3) replacing the existing 5,000 and 8,000 lumen street light fixtures with 14,000 lumen light fixtures of the same design in the blocks and at the intersections listed below to provide better lighting in locations where Police have had to address nuisance and criminal activity: Intersections: Montrose Avenue and Wesmond Drive; Evans Lane and Montrose Avenue; and Evans Lane and Lynhaven Drive. Blocks: unit and 100 block of East Reed Avenue; and l00 block of Evans Lane; (4) requesting the civic association for input on the most desirable location for adding a light fixture to an existing pole to provide light at Lynhaven Park, where the tot lot is located at the intersection of Wilson Avenue and East Reed Avenue. (There was a light near the park that was removed a number of years ago, and additional neighborhood input will assist staff in determining the best location for a light.); (5) adding lighting in the small parking lot located adjacent to City land at the end of the 200 block of Lynhaven Drive; (6) extending the street light pole arm and increasing the level of lighting on the pole located in the alley between Lynhaven Drive and Montrose; (7) considering increasing the level of lighting in the other alleys in cases where the current lights are 5,500 lumens; and (8) adding a light to the existing pole in the 3300 block of Montrose.

(II) Received the Street Lighting Report from Chief Samarra and referred it to the affected civic associations and City staff for review. Staff will return to Council with the fiscal impact of these proposed improvements during the FY 1996 budget discussions. The voting was as follows:

(b) Council Member Walker made comments about the Christmas trees in City Hall. They were decorated by the Elder Crafters. The mittens and hats on one of the trees will be delivered by Ho Ho Ho to Alexandria public school children. Needlepoint items were created by special education students at Frances Hammond Middle School in an Elder Crafter Outreach Program. The other tree was decorated by Elder Crafters from Japan with Japanese traditional handicrafts.

(c) Mayor Ticer spoke to the 1994 Alexandria Holiday Ornament which was designed by Sue Lynch. It is available in the Finance Department, Citizen Assistance, The Lyceum and other places in the City. It is $15.

(d) Council Member Rich spoke to the Virginia Chamber of Commerce Urban Summit held this past week.

Mayor Ticer, Deputy City Manager Steele and City Manager Lawson participated in the discussion.

(e) Councilwoman Pepper commended the Police Department and those who worked so hard to make the Holiday Party for Children a success. It was held on December 10.

Councilman Euille commented that he really enjoyed playing Santa Claus. He would be willing to do it for the rest of his life. (f) Councilwoman Pepper congratulated Registrar Beverly Beidler upon receiving the status of Certified Professional General Registrar.

(g) Mayor Ticer announced that the public hearing on the State budget will be held at Noon on December 29 at T.C. Williams High School.

(h) Mayor Ticer spoke to the City Manager's memorandum dated December 9, 1994, with respect to the Police in Residence Homeownership Program.

Housing Director Davis answered questions of Members of Council.

WITH UNANIMOUS CONSENT, Council authorized staff to move forward with this.

(i) Councilman Euille announced that the City has been notified from the Virginia Department of Housing and Community Development, that $75,000 has been reserved under a program called Urban Rehabilitation. The program will provide funding for rehab loans at 4% for 15 years. These monies will be used in combination with no interest deferred payment loans funded with the Community Development Block Grant or Home Investment Partnership monies in the City's Home Rehab Loan Program. People should contact the City's Office on Housing.

(j) Vice Mayor Donley requested that staff come up with a way to warn motorists coming off of the Wilson Bridge exit about slowing down at the intersection of Church and South Columbus Streets.

(k) Vice Mayor Donley announced that the City of Alexandria exceeded its goal for the United Way Campaign which was a 10% increase. He thanked the City employees. The overall City campaign is projected to be about a 5% increase. He recognized the departments that showed a real dramatic increase as follows: Office of Citizen Assistance had a 48% increase over last year; City Attorney's Office had a 22% increase; City Manager's Office had an 8% increase; Commonwealth's Attorney Office had a 42%; the Police Department had a 25% increase; the Public Library had a 20% increase; Real Estate Assessments had an 8% increase; Office of Historic Alexandria had a 16% increase; Fire Department had a 45% increase; and just as an aside, the City Clerk and the Members of Council had a 74% increase over last year.

(l) Vice Mayor Donley, with respect to the recent difficulties which Orange County, California has encountered regarding some of its investment philosophies and the fact that they had to file for bankruptcy protection and recently missed a payment on a bond obligation, requested Financial and Information Services Director Gitajn to explain the City's financial position.

New Business Item No. 1: WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilman Cleveland and carried unanimously, at 11:55 p.m., City Council convened an executive session at this time for the purpose of consulting with legal counsel and receiving a briefing by staff members, consultants or attorneys, pertaining to probable litigation or other specific legal matters requiring the provision of legal advice by counsel, and pertaining to the following litigation involving the city, pursuant to Virginia Code § 2.1-344 (A) (7): Snyder v. City of Alexandria, et al, a case pending in the United States District Court for the Eastern District of Virginia, which involves claims arising from the arrest and conviction of the plaintiff Walter Snyder. The voting was as follows:

New Business Item No. 2: WHEREUPON, upon motion by Councilman Cleveland, seconded by Council Member Walker and carried unanimously, City Council authorized the City Attorney to settle the Kutosh claim in accordance with the discussion in the Executive Session. The voting was as follows:

New Business Item No. 3: THEREUPON, upon motion by Vice Mayor Donley, seconded by Councilman Cleveland and carried on a unanimous ROLL-CALL vote, City Council adopted the Resolution pertaining to the Executive Session. The voting was as follows:

The resolution reads as follows:
RESOLUTION NO. 1718
WHEREAS, the Alexandria City Council has this 13th day of December, 1994, recessed into executive session pursuant to a motion made and adopted in accordance with the Virginia Freedom of Information Act; and

WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by City Council that such executive session was conducted in accordance with Virginia law;

NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby certify that, to the best of each member's knowledge, only public business matters that were identified in the motion by which the executive session was convened, and that are lawfully exempted by the Freedom of Information Act from the Act's open meeting requirements, were heard, discussed or considered by Council during the executive session.
