OPENING

Vice Mayor Donley called the Meeting to Order, and the City Clerk called the Roll; all Members of Council were present except Mayor Ticer and Council Member Rich. Council Member Rich arrived at 7:40 p.m., and Mayor Ticer arrived at 9:00 p.m.

The Invocation was pronounced by Reverend Betty Jo Middleton, Unitarian-Universalist Minister.

10. Presentation of Special Greetings to Youngsters from Northern Ireland Who are Working on the Habitat for Humanity Home at 1114 Princess Street. (Vice Mayor Donley)

(Vice Mayor Donley brought special greetings and presented the youngsters with a memento.

Councilman Euille challenged the youngsters to complete their work two days ahead of time, and if they do, Councilman Euille will take each one of them to a Washington Bullets basketball game as well as a Washington Pistons hockey game.)

WITHOUT OBJECTION, City Council deferred consideration of Docket Item No. 11 until Mayor Ticer arrives.

END OF CONSENT CALENDAR

WHEREUPON, upon motion by Council Member Rich, seconded by Councilwoman Pepper and carried unanimously by all those present, City Council approved the Consent Calendar as presented, with the exception of Docket Item Nos. 12, 14, 20 and 30 which were considered under separate motions. The City Manager's recommendations are as follows:

13. City Council (a) appointed John Lewis as a Citizen Member to the Alexandria Cable Television Advisory Commission; (b) reappointed Lois Valkenburgh as a Citizen Member to the Alexandria Commission on Aging; (c) appointed Mary Ann Cusack as a Citizen Member to the Alexandria Emergency Medical Services Council; (d) appointed William Hranicky as a Representative from the Alexandria Archaeological Commission to the Historic Alexandria Resources Commission; (e) appointed Andrew MacDonald as a Representative from the Alexandria Environmental Policy Commission to the Alexandria Waterfront Committee; and (f) reappointed Gregory Steele as a Youth Member to the Alexandria Youth Services Commission.

15. City Council (1) accepted the gifts/donations shown in the memorandum; and (2) requested the individuals listed in the memorandum to send a letter to the donor expressing City Council's appreciation for the gifts/donations.

16. City Council authorized the City Manager to: (1) accept the grant from the Summit Fund of Washington for Project STEPOUT and Project MANHOOD; (2) approve an extension of one part-time grant-funded Volunteer Developer position for a period of six months. Continuation of this position is contingent upon funding from other non-City sources; (3) approve a temporary (less than one year) increase of 10 hours-per-week in an existing 30 hours-per-week Employment and Mentoring Services Coordinator position; and (4) execute all necessary documents that may be required.

17. City Council authorized the City Manager to: (1) submit a grant application to the Virginia Department of Environmental Quality, Litter Prevention and Recycling Program, for funding in the amount of $10,093 for the Adopt-a-Park Program; and (2) execute all necessary documents that may be required.

20. Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE to amend the city's business license tax, also known as the business professional and occupational license (or BPOL) tax, to exempt from the tax all businesses with less than $10, 000 in gross receipts, to provide for a flat tax of $30 on all businesses with gross receipts of between $10,000 and $50,000, to conform with a model BPOL ordinance developed by the Virginia Municipal League and Virginia Association of Counties that is being adopted by numerous jurisdictions throughout the Commonwealth, to eliminate numerous archaic terms and classifications in the current ordinance, to provide for fair allocation of receipts when a business operates both within and outside the city, to establish a mechanism for audits and administrative appeals and a system by which the director of finance can issue local tax rulings, to establish a mechanism for interjurisdictional agreements, to facilitate administration of and compliance with the BPOL tax, and to more precisely define certain terms used in the administration of the tax.

(General Discussion. Vice Mayor Donley spoke to a seminar he attended at the Virginia Municipal League with respect to this particular model ordinance. He pointed out that Arlington indicated that its due date is going to be in March. He indicated that ours is not due in March and this is an item staff needs to check. He stated that one of the driving elements in the reform of the BPOL legislation is to make it consistent throughout the State of Virginia. He requested staff to look into, not only the due date of other jurisdictions, but any other potential areas of conflict so that we can have the same ordinance as in other jurisdictions, especially in the Washington region.)

(General Discussion. Councilman Euille complimented City staff for its approach and commitment to amenable affordable housing in the City of Alexandria. He directed questions to staff with respect to the waiting period once a property is placed on the blighting influences list. Councilman Euille suggested that the issue of trying to shorten the waiting period might be made part of our legislative package.

19. Consideration of Partial Waiver of Projected Interest on Construction Loan to Robert Johnson for Stevenson Court Condominiums.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Council Member Walker and carried on a vote of 5-to-0, City Council agreed to waive up to $68,458 of the projected interest amount ($72,600) on the City's construction loan to the Robert Pierre Johnson Housing Development Corporation for Stevenson Court to cover $36,008 in projected additional construction expenses and one-half ($32,450) of the five percent contingency amount ($64, 900). This action will require the Robert Pierre Johnson Housing Development Corporation to provide the remaining $32,450. The voting was as follows:

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilwoman Pepper noted the passing of Jim Mulligan, former Chair of the Parks and Recreation Commission. In lieu of flowers, it has been suggested that persons who would like to could contribute to the living landscape program, Golden Books. Funeral service is private. She noted that when he was well he used to take care of Ewald Park.

(b) Councilwoman Pepper spoke to the closing of Cameron Station on September 29. She indicated as the flag came down she felt that it was only fitting that it be given to the City; however, the Post Commander stated that there was already a place for this flag. She understands that there has been an agreement made that when the new development is completed, a flag will be raised and it will be that flag that the City will receive. Councilwoman Pepper stated that the new development, at this point, is also going to be called Cameron Station.

(c) Councilwoman Pepper gave Mayor Ticer a gift which was received by everyone at the Virginia Municipal League conference.

(d) Councilman Cleveland announced that he had a meeting, along with the City Manager and City staff members, with the Director of the Governor's Employment Training and Development Office, with respect to the recent federal layoffs and work force preparedness. The Director informed them on the impending federal grant that will come to the Commonwealth. They are in the process of securing the grant to create a transition center. Councilman Cleveland stated that a notice of a meeting for October 17, at the Ramada Inn Hotel, at 9:30 a.m. to 11:30 p.m. He thought it would be a good idea for the City to think about trying to get this work center for the City of Alexandria. He asked that the City Council have a work session with the Director of Employment Training on November 28, before the City Council meeting. Council set this work session.

WHEREUPON, upon motion by Councilman Cleveland, seconded by Council Member Walker and carried unanimously by all those present, City Council requested staff to send a letter of intent to the Deputy Director for Employment Training in Richmond, about the possibility of locating a training center in Alexandria to deal with the impending federal layoffs. It was noted that Mayor Ticer arrived at 9:00 p.m.

(e) Councilman Euille gave Council, on behalf of the Alexandria Scholarship Fund of Alexandria, its 1995 Annual Report. He noted that in the scholarship program this past year, 1994-95, the number of awards made to T.C. Williams students increased. Councilman Euille stated that they would like a work session with the City Council and City staff to discuss various aspects of the Foundation. He will discuss this with the Manager and try to coordinate it at a later date.

(f) Councilman Euille informed Council that on behalf of the City, this past Saturday he greeted and presented the key to the City to a 22-member delegation from the German parliament. He gave them a tour of City Hall. On behalf of the German parliament, they presented to the City of Alexandria a token of their appreciation. It is a silver platter with their national emblem on the inside.

Mayor Ticer announced that the platter could be placed in the Sister City room.

(g) Councilman Euille suggested that a joint work session be held with the Alexandria Redevelopment and Housing Authority prior to January 20, 1996.

City Manager Lawson stated that she would talk with the Housing Authority to come up with a date that is suitable for both bodies.

31. Consideration of Grant Submission and Resolution Endorsing the City of Alexandria's Local Plan for the Expenditure of Funds Under the Virginia Juvenile Community Crime Control Act. [ROLL-CALL VOTE]

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Cleveland and carried on a ROLL-CALL vote of 6-to-0, City Council (1) approved the submission of a grant application to the Virginia Department of Youth and Family Services in the amount of $170,808 for Virginia Juvenile Community Crime Control Act funds; (2) adopted the resolution endorsing the City's local plan for the expenditure of funds under the Virginia Juvenile Community Crime Control Act; and (3) authorized the City Manager to execute all documents that may be required. RESOLUTION NO. 1756
WHEREAS, the 1995 Virginia General Assembly enacted the Virginia Juvenile Community Crime Control Act with an effective date of January 1, 1996, to replace the block grant system for all community-based juvenile programs and services, except secure detention homes; and

WHEREAS, the purpose of the Virginia Juvenile Community Crime Control Act is to establish balanced, community-based systems of sanctions, programs, and services for juvenile offenders that will: promote an adequate level of services to be available to every juvenile and domestic relations court; ensure local autonomy and flexibility in addressing juvenile crime; encourage a public and private partnership in the design and delivery of services for juveniles who come before the court on child in need of services, child in need of supervision, and delinquent charges; emphasize parental responsibility and provide community-based services for juveniles and their families which hold them accountable for their behavior; establish a locally driven statewide planning process for

the allocation of state resources; promote the development of an adequate service capacity for juveniles before the court on petitions alleging status or delinquent offenses; and

WHEREAS, a locality wishing to use the Act's funds for the maintenance, development, implementation and operation of programs and services must submit a local plan for the expenditure of these funds biennially to the State Board of Youth and Family Services; and

WHEREAS, the City of Alexandria's local plan for the expenditure of funds under the Act was developed by City staff and the Court Service Unit Director, and reviewed by the Juvenile and Domestic Relations Court Judges;

NOW, THEREFORE, BE IT RESOLVED, that the Alexandria City Council endorses the City of Alexandria's local plan for the expenditure of funds under the Virginia Juvenile Community Crime Control Act.

32. Consideration of Submission of an Application and Resolution to the Virginia Department of Transportation for Funds to Partially Pay for Compressed Natural Gas Powered Vehicles and Fueling Station. [ROLL-CALL VOTE]

WHEREUPON, upon motion by Councilman Cleveland, seconded by Vice Mayor Donley and carried on a ROLL-CALL vote of 6-to-0, City Council adopted the resolution and authorized the City Manager to: (1) approve the grant application and the resolution to the Virginia Department of Transportation for $252,300 that will be used to partially pay the cost of eight compressed natural gas vehicles and a fuel station; and (2) execute all documents that may be required. RESOLUTION NO. 1757

WHEREAS, the 1992 General Assembly enacted legislation creating the Virginia Alternative Fuels Revolving Fund to encourage the use of alternative fuels in vehicles owned by the State and local governments; and

WHEREAS, the City Council on February 12, 1991, established the Alternative Fuels Task Force for the purpose of recommending air quality improvement options to be accomplished by replacing gasoline as a motor fuel in City vehicles; and

WHEREAS, the Alternative Fuels Task Force has recommended that compressed natural gas is an alternative fuel that can produce 90% reductions in ozone producing compounds, exceed other air quality standards, is usable within available technology, and can be supplied locally;

NOW, THEREFORE, BE IT RESOLVED, that the Alexandria City Council does hereby apply for a grant for the purchase of eight natural gas-fueled vehicles and the establishment of a natural gas fueling station; and, that the Alexandria City Council accepts the financial and other requirements of the Virginia Alternative Fuels Revolving Fund program.

33. Consideration of Resolution Regarding Federal Safe Drinking Water Act. (Mayor Ticer) (ROLL-CALL VOTE]

RESOLUTION No. 1758
WHEREAS, Congress is expected to consider amendments to the federal Safe Drinking Water Act in the near future; and

WHEREAS, at present, the Safe Drinking Water Act provides for testing standards and reporting requirements for eighty-three contaminants, and does not provide testing standards or reporting requirements for known hazardous contaminants such as Cryptosporidium and many disinfection by-products; and

WHEREAS, many federal "Maximum Contaminant Levels" (MCL's) and testing standards in the Safe Drinking Water Act as implemented by the U.S. Environmental Protection Agency are presently not based on those people who are most at risk; and

WHEREAS, it is of crucial importance that drinking water be kept clean and safe by protecting it at its source; and

WHEREAS, members of the public have a right to know what contaminants are in their drinking water and the compliance status of their water supplier; and

WHEREAS, present rules may, in many cases, have failed to ensure that the public has this information; and

WHEREAS, there are presently inadequate funds for cleaning up polluted drinking water sources and modernizing old and unsafe water systems.

NOW, THEREFORE, BE IT RESOLVED by the Alexandria City Council that it supports a strong Safe Drinking Water Act and opposes all attempts to weaken its testing, standards and reporting requirements; and

BE IT FURTHER RESOLVED that 1) appropriate legislation should be enacted to ensure that major polluters pay for the cost of cleaning up polluted drinking water sources; 2) the Safe Drinking Water Act should be amended to ensure that the public is meaningfully informed, in lay person's language, of the presence of contaminants in drinking water, the known anticipated health effects of such contaminants, and of any violations of standards that must be met by water systems; 3) a "State Revolving Fund" loan program for drinking water be established, to provide financial assistance so that old and unsafe water systems can be modernized and install appropriate technology; 4) drinking water standards should protect the health of all citizens, including vulnerable people, such as those suffering from immune system disorders, infants and other children, pregnant women and senior citizens; and 5) contamination of drinking water at its source should be prevented by protecting and preserving watershed areas and groundwater; and

BE IT FURTHER RESOLVED that the Alexandria City Council request the City Clerk to communicate this Resolution to its Congressional delegation and to the Senate Committee on Environment and Public Works.
