Mollie Abraham announced that the City Employee who brings in the most money for sponsorship for the Walk will receive two tickets to the Washington Redskins Game against the New York Giants on October 29. The staff of the Office on Women also qualify to receive the tickets. All you need to do is to take your sponsorship and money into the Office on Women on the Tuesday or Wednesday before the Walk so that the tickets can be given to you at the end of the Walk on Saturday, October 28.)

15. Consideration of Approval of Fiscal Year 1996 Plan for Aging Services and Submission of Grant Applications to the Virginia Department for the Aging, the Governor's Employment and Training Department and the U.S. Department of Agriculture.

16. Consideration of Submission of a Grant Application to the Department of Criminal Justice Services to Implement a Community Corrections Program Under the Comprehensive Community Corrections Act and the Pretrial Services Act.

WHEREUPON, upon motion by Council Member Rich, seconded by Councilman Cleveland and carried on a vote of 6-to-0, City Council approved the Consent Calendar as presented. The City Manager's recommendations are as follows:
11. City Council received the following resignations with regret: (a) Bert Cieslak from the Alexandria Cable Television Advisory Commission; (b) George A. Zitnay from the Alexandria Commission on Aging; (c) Pamela T. Oerth from the Alexandria Commission on Employment; (d) Rob Krupicka from the Alexandria Youth Services Commission; and (e) Stuart Clements, Jr. from the Historic Alexandria Resources Commission; requested the Executive Secretary to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.
12. City Council (a) reappointed J. Glenn Hopkins as a Citizen Member and Roberta Morris as a Representative of the Alexandria Chapter of the Northern Virginia Day Care Association to the Alexandria Early Childhood Commission; and (b) reappointed Deborah Bombard and appointed Margaret Clancy as Health Professionals and reappointed Helen Donovan and Michael Gemmell and appointed Teresa Cappuccilli as Non-Health Professionals to the Alexandria Public Health Advisory Commission.
15. City Council (1) approved the FY 1996 Spending Plan for Aging Services; (2) authorized the City Manager to: (a) submit the plan which includes application to the Virginia Department for the Aging for continuation funding for the Alexandria Agency on Aging in the amount of $185,551 for Title III Federal funds; and $76,284 for additional State Program funds; (b) sign contracts with the Governor's Employment and Training Department for: $29,206 for Title V (Seniors In Community Service Employment Program); and $13, 930 for the Job Training Partnership Act/Older Workers Program; (c) submit grant applications totaling $37,012 for the USDA for reimbursement for congregate, home-delivered and adult day care meals; (d) execute all necessary documents; and (3) approved the continuation of one full-time and four part-time grant-funded positions which administer and operate the Older Americans Act programs and associated services. The positions were established 11 years ago and the full-time position is included in the City's approved FY 1996 full-time position count. Continuation of the positions is contingent upon continuation of funding from the Virginia Department for the Aging.

16. City Council approved increasing the number of full-time grant-funded City positions by one (1 FTE), and will continue 4.5 positions previously funded under the phased-out Community Diversion Incentive program grant; and (1) approved the submission of the grant application to the Virginia Department of Criminal Justice Services in the amount of $248,368 to fund new grant-funded programs under the Comprehensive Community Corrections Act and the Pretrial Services Act; (2) contingent upon the award of the grant, approved the establishment of the full-time and part-time positions referenced in the memorandum. These grant-funded positions would terminate upon the expiration of the grant and the individuals who are to fill these positions would be notified of this condition of employment; and (3) authorized the City Manager to execute all documents that may be required.

(General Discussion. Councilman Euille asked questions of Management and Budget Director Godwin with respect to fire station 58.
Vice Mayor Donley requested an explanation of the change in reporting requirements. Financial and Information Services Director Gitajn explained this item.
Vice Mayor Donley requested that when City Council considers the budget that there be some further explanation in the budget document regarding its affect on fund balance as well as an explanation on this change in accounting.)
WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilman Euille and carried unanimously, City Council (1) received the Financial Report for the period ending August 31, 1995; and (2) authorized the City Manager to award contracts to the lowest responsive and responsible bidders for the following public improvement projects: the installation of canopied areas at the Municipal Pool and at Colasanto Pool and the reconstruction of a retaining wall at Warwick Pool; the initial specification and design analysis for the replacement of the City's Criminal Justice Information System; and the construction of a protective clothing cleaning and repair facility at fire station 58. WHEREUPON, upon motion by Councilman Euille, seconded by Councilwoman Pepper and carried on a vote of 6-to-0, City Council received the listing of delinquent 1990 through 1994 real estate taxes as of June 30, 1995. In accordance with State code § 58.1-3924, "the governing body shall cause the list[s] ... or such parts thereof as deemed advisable to be published once in a newspaper in the county, city or town ... having general circulation therein.... "Staff recommends that we publish the 1994 listing excluding any tax exemption appeals, real estate tax adjustments, or payments received prior to publication. The voting was as follows:

17. Acceptance of Federal Funding and Transmission of Grant Proposal by the Alexandria Community Services Board for Federal Substance Abuse Services Prevention and Treatment Block Grant Funds for Fiscal Year 1996.

(General Discussion. Councilman Euille stated that it was worthy to note that we are making an effort to educate abusers and to eradicate this terrible disease.)
WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilman Euille and carried on a vote of 6-to-0, City Council (1) approved receipt of a funding award of $56,184 and approved submission of a grant in the amount of $70,468, as discussed in the City Manager's memorandum dated September 14, 1995, to the Virginia Department of Mental Health, Mental Retardation and Substance Abuse Services; and (2) decided to exceed its budget cap on the number of part-time and full-time City positions by 2.00 FTE grant-funded positions. One additional full-time grant-funded position would be added, two part-time grant-funded positions would be increased to full-time (an increase of 0.80 FTE) , three part-time positions would be increased by 0.2 FTE. These grant-funded positions would terminate upon expiration of the grant and the individuals who are to fill the positions would be notified of this condition of employment. REPORTS AND RECOMMENDATIONS OF THE CITY MANAGER (continued)
18. Public Hearing and Consideration of the Rate Filing By Jones Intercable of Alexandria, Inc. and Consideration of Request to Extend the Time for City Review of the Rate Filing. [ROLL-CALL VOTE]

It was noted that there were no speakers on this item; therefore, the public hearing was concluded.
WHEREUPON, upon motion by Councilwoman Pepper, seconded by Council Member Walker and carried on a unanimous ROLL-CALL vote, City Council (1) held the public hearing on the matter of the rate filing submitted on July 31 by Jones Intercable; and (2) following the public hearing, issued a tolling order by approving, on a roll-call vote, the resolution which will allow staff 90 additional days, under the FCC's regulations and Section 9-3-208 of the City Code, to review the Jones rate filing and determine whether the proposed rate increase is excessive. The tolling order (which extends the staff review period from 30 days to 120 days), recognizes the fact that the rate increase for basic cable service went into effect on September 1, subject to a refund should Council determine that it is excessive in accordance with the FCC regulations. The voting was as follows:

The resolution reads as follows:
WHEREAS, the City Council has received and preliminarily reviewed: (1) the rate filing of Jones Intercable of Alexandria, Inc. ("Jones") , submitted pursuant to section 9-3-201 et seq. of the Alexandria City Code, in which Jones seeks the City of Alexandria's approval to increase the rate it is currently charging its Alexandria residents for basic cable television service from $9.79 to $10.42 (an increase of $.63); (2) comments submitted by members of the public on the rate filing; (3) the recommendation of the City Manager; and (4) Jones' response to the public comments and the recommendation of the City Manager; and
WHEREAS, in light of the brief time that the City Council, the City staff and the public have had to review Jones' rate filing and to evaluate matters relevant to determining whether Jones' basic cable rate increase proposal is justified and complies with the Federal Communications Commission's rate standard; and
WHEREAS, the City Council finds and determines that it needs additional time and information in order for it to review Jones' rate filing and to determine whether Jones' increase in the basic cable rate complies with the Federal Communications Commission's rate standard;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF ALEXANDRIA, VIRGINIA
1. That the deadline for the City's review of Jones' rate filing shall be tolled for an additional 90 days, as provided in section 9-3-208 of the Alexandria City Code.

2 That the $.63 increase in the rate that Jones implemented effective September 1, 1995 for Alexandria's basic cable television Service without the prior approval of the City Council is subject to refund.
3. That the current rates that Jones charges Alexandria residents for basic cable television service and for the use of related equipment shall be collected by Jones in accordance with applicable law, and that Jones shall maintain adequate records to enable it to refund to subscribers any amounts later determined to be unreasonable, plus interest.
4. That nothing in this resolution shall be construed as approving or endorsing the current rate that Jones charges Alexandria residents for basic cable television service and for the use of related equipment, and that the Council may subsequently order a reduction in those rates to the extent they are found to violate any FCC regulation or other applicable laws, regulations or contracts.
5. That this resolution is the order required by 47 C.F.R. 76.933.
6. That the City Manager shall see that public notice is given of the adoption by Council of this resolution and of its availability for review by the public.
7. That this resolution shall be effective upon adoption.
New Business Item No. 1: Jeff Spiegleman, General Manager, Jones Intercable, spoke to the opening of the Central Processing Facility located on Wheeler Avenue. He indicated that Jones will be activating the first nodes of what will be the most advanced fiber-optic coaxial network in the United States.
It was noted that this item was deferred until a meeting in October.

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL
(a) Mayor Ticer spoke to the recent party held by the Foxchase community. They raised $3000 for the smoke detector program of the Fire Department. They also raised $3000 for the Police Boys and Girls Camp.
(b) Mayor Ticer stated that she has been writing letters and talking to the National Park Service about the state of the Belle Haven Marina.
She indicated that Alexandria is playing a role because there are a lot of people in Alexandria who use that marina. She indicated that this issue is basically working its way through the system.
(c) Mayor Ticer was glad to learn that newspapers will be recycled every week.
(d) Mayor Ticer announced that Penney's is going to be in the Woodies at Landmark Shopping Center. They have indicated that they were not going to open until April 1996. She stated that the City has expressed great concern to the Mall management and to the Penney's management about the fact that we do not want those stores to be totally dark during Christmas. The City is working with Penney's to find a good temporary use until Penney's is opened.
Vice Mayor Donley also participated in the discussion.
(e) Councilman Cleveland spoke to information that he received from the Allen administration with respect to the downsizing of the Federal Government by approximately 60,000 employees. The report indicates that 48 percent of the people affected by these layoffs will be Northern Virginians. There will probably be three major reemployment centers located in the Metropolitan area, i.e., one in Virginia, one in Maryland and one in D.C. Councilman Cleveland suggested that Alexandria should seek to get a Virginia federal retraining center located in the City.
Vice Mayor Donley spoke to the Potomac Conference which he attended. This was sponsored by the Washington Board of Trade. The subject of the conference was the affect of decreased Federal spending, i.e., the furlough of Federal employees and its affect on the Washington region. He stated that in order to provide employment we are going to have to have an expanding and diverse economy locally. He indicated that it is going to be in our long-term best interest to look at job creation and an expanding revenue base in order for us to shoulder these increased responsibilities due to the Federal government layoffs and the new Welfare Reform program.
(f) Councilwoman Pepper stated with respect to Welfare Reform that Councilman Euille and she have met three times this month with a group which is looking for ways to expand the job market.
(g) Councilwoman Pepper announced that last Wednesday was the debut of "Ask Alex" which was presented by the Onyx Group. It is an information kiosk located at the King Street Metro Station on Diagonal Road. This is the first of three to be located in Alexandria.

(h) Councilwoman Pepper spoke to Council's participation in the Habitat for Humanity house located at 1114 Princess Street. This is the first project in the City of Alexandria. She announced that Habitat for Humanity is always looking for volunteers. Please call 521-9890 if you are interested in volunteering.
(i) Council Member Walker stated that also at the opening of the "Ask Alex" kiosk which is sponsored by the King Street Metro Enterprise Team, the Opera Americana had a little show demonstrating its 1995-96 season. She announced its season starts will "El Capitan" which will be held at the Ernst Theater on October 21 at 8 p.m. and October 22 at 2 p.m. The Ernst Theater is located on the Northern Virginia Community College Annandale Campus.
(j) Vice Mayor Donley announced that the Mount Vernon Avenue Block Party will be held on Saturday, September 30.
(k) Councilman Euille announced that the Northern Virginia Urban League is sponsoring its Fifth Annual Career Fair on Friday, October 13, from 10 a.m. to 3 p.m. at the Springfield Hilton Hotel.
(l) Councilman Euille spoke to the graffiti problem in the city.
(m) Council Member Rich announced that he will not be present at the City Council Public Hearing Meeting in November. He and Marcia Call are getting married in New Castle, New Hampshire.
(n) Councilman Cleveland announced that on Saturday, September 30, 1995, from 12 to 3 p.m. at the Hunter/Miller Park there will be a Public Safety Day.

WHEREUPON, upon motion by Council Member Rich, seconded by Council Member Pepper and carried unanimously, City Council (1) scheduled a work session with the Alexandria Budget and Fiscal Affairs Advisory Commission (BFAAC) at 6 p.m. in the Council Workroom before the Tuesday, November 14, 1995 Council meeting to discuss BFAAC's FY 1996 work program; (2) noted that the City Employee Service Awards Program is scheduled from 5:30 p.m. to 7:30 p.m. on Monday, November 20 at the Torpedo Factory Art Center; (3) and deferred consideration of the schedule for the FY 1997 City budget until October 10, 1995. New Business No. 2: WHEREUPON, upon motion by Vice Mayor Donley, seconded by Council Member Walker and carried unanimously, at 9:40 p.m., City Council convened an executive session at this time for the purpose of consulting with legal counsel pertaining to the following litigation involving the City, pursuant to Virginia Code § 2.1-344 (A) (7) : U.S. Patent Model Foundation v. City of Alexandria Human Rights Commission, Nos. 941372 and 950306, a case pending in the Circuit Court for the City of Alexandria, involving complaints of employment discrimination filed with the City's Human Rights Commission against the U.S. Patent Model Foundation. The voting was as follows:

The resolution reads as follows:RESOLUTION NO. 1755
WHEREAS, the Alexandria City Council has this 26th day of September, 1995, recessed into executive session pursuant to a motion made and adopted in accordance with the Virginia Freedom of Information Act; and
WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by City Council that such executive session was conducted in accordance with Virginia law;
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby certify that, to the best of each member's knowledge, only public business matters that were identified in the motion by which the executive session was convened, and that are lawfully exempted by the Freedom of Information Act from the Act's open meeting requirements, were heard, discussed or considered by Council during the executive session.
