The Meeting was called to order by Vice Mayor Donley, and the City Clerk called the Roll; all Members of Council were present except Mayor Ticer and Council Member Rich.

25 . Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE to enable taxpayers aggrieved by the levy of city taxes to petition the appropriate city official for a reduction in taxes, and to authorize the director of finance, following a determination that excessive city taxes have been levied, to refund to taxpayers the amount of excessive taxes paid.

WHEREUPON, upon motion by Council Member Walker, seconded by Councilman Cleveland and carried unanimously by all those present, City Council approved the consent calendar as presented with the exception of Docket Item Nos. 12, 13, and 17 which were considered under separate motions, and included Docket Item No. 25. The City Manager's recommendations are as follows:

10. City Council received the following resignations with regret: (a) Brian J. Moran from the Alexandria Budget and Fiscal Affairs Advisory Committee; (b) Tara Hardiman from the Alexandria Commission for Women; (c) Bertrand E. Hawkins from the Alexandria Commission on Employment; (d) Regina Brown from the Alexandria Economic Opportunities Commission; (e) Robert W. Dempsey from the Alexandria Environmental Policy Commission; and (f) Tara Hardiman from the Alexandria Human Rights Commission; and requested the Executive Secretary to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

11. City Council (a) appointed Ardith Collins as a Representative from the Religious Community to the Alexandria Affordable Housing Advisory Committee; (b) appointed Jeffrey Shrimpton as a Citizen Member to the Alexandria Board of Architectural Review -- Parker-Gray District; (c) appointed Patrick O'Brien as the representative from the Alexandria Library System, and Royce Lucille Dickens and Johnny Johnson as Citizen Members to the Alexandria Cable Television Advisory Commission; (d) appointed Paul Smedberg as a Citizen Member to the Alexandria Commission on Aging; (e) appointed Arthur Mosley as a Member from the Alexandria Economic Opportunities Commission to the Alexandria Early Childhood Commission; and (f) appointed June Gilbert as a Representative of the Alexandria Condominium Association to the Alexandria Emergency Medical Services Council.

14. City Council received Jones Intercable's 1995 Annual Report and Plant Survey and concurred with the Cable Television Advisory Commission's recommendation that Jones make a greater effort to minimize service interruptions in the future.

15. City Council received the 1995 Annual Opinion Survey Report from Jones Intercable, Inc.

16. City Council received the report from the Alexandria Volunteer Fire Department, Inc. and recognized the volunteers for their outstanding service and generous contribution to the City.

25. City Council introduced and passed the ordinance on First Reading and set it for Public Hearing, Second Reading and Final Passage on Saturday, December 16, 1995.

18. Consideration of the Small and Minority Business Task Force Report.

(WITHOUT OBJECTION, Emmitt Carlton and Betsy Lewis, Co-chairs of Task Force, made comments to City Council.

WHEREUPON, upon motion by Councilman Euille, seconded by Councilwoman Pepper and carried unanimously, City Council (1) received the Task Force Report; (2) requested the staff to work with the Alexandria Chamber of Commerce and the Small and Minority Business Task Force to implement the recommendations in the Report; and (3) receive progress reports on the implementation of the recommendations six months (June 1996) and one year (December 1996) after the presentation of this report to City Council. 19. Consideration of New Homeownership Assistance Program for Moderate-Income Families Using Housing Trust Fund Monies.

WHEREUPON, upon motion by Councilman Euille, seconded by Councilman Cleveland and carried unanimously by all those present, City Council approved the City Manager's recommendation, as amended, and approved the establishment of a new program, with a FY 1996 budget of $300,000 (instead of $150,000) in Housing Trust Fund monies, for homeownership assistance to households with incomes between the Federal Section 8 low-income limits and the Virginia Housing Development Authority (VHDA) single family mortgage program limits, with the following provisions: (1) purchasers assisted with Housing Trust Fund monies must live or work in the City of Alexandria and be first-time homebuyers except as set forth in the VHDA lending criteria and detailed herein; (2) the maximum allowed sales prices will be those used in the VHDA regular single family mortgage program for existing and newly constructed units; (3) eligible households must have incomes between the Federal Section 8 Low Income limits and the VHDA income limits, by family size; (4) purchasers will be required to contribute a minimum of

$3,000 towards the downpayment and/or closing costs; (5) the maximum homeownership assistance loan will be $15,000 to be used for downpayment and/or closing cost assistance; and (6) loans will be due upon resale, or in 99 years, whichever comes first. For resales which occur during the first five years of the loan, the loan recipient will pay an anti-speculation surcharge of 25% of the loan value upon sale in the first year, decreasing by 5% upon sale in each of the next four years. The City reserves the right to waive the anti-speculation surcharge in cases where speculation is not a factor as determined by the City. The voting was as follows:

REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilman Euille gave a report on his attendance at the recent NLC Annual Conference in Phoenix, AZ.

(b) Councilman Euille gave a report on the near completion of the Habitat for Humanity house located at 1114 Princess Street. He stated a family has been selected to participate in the completion of the construction of the home. They are required to put in 500 hours at which time they will take over the deed and the loan. He congratulated Mrs. Carl Skates and her family for being the new homeowners.

(c) Councilman Euille complimented Police Chief Samarra and Members of the Police Department for a job well done in solving a series of major crime cases.

Councilman Euille stated that in support of the Alexandria Community Police Officers' Program and their working with the disadvantaged young children and families in the various housing communities throughout Alexandria, he would like to present his check to be used for providing and meeting the needs during the Holiday season for the youngsters and their families. He gave his annual pledge of $1000 to Chief Samarra to the Police Association to assist with the youth services programs that they do throughout the year.

Councilman Euille presented City Manager Lawson with a check for $5,000 for the Summer Youth Jobs Program.

City Manager Lawson thanked Councilman Euille for his generosity throughout the year.

Vice Mayor Donley, on behalf of the Council, thanked Councilman Euille for his commitment to these programs.

(d) Council Member Walker spoke to her presentation she gave on the World Wide Web and Alexandria's Home Page at the recent NLC Conference in Phoenix, AZ. She presented each Member of Council with a copy of the map produced by the NLC which shows Alexandria's position on the World Wide Web page.

(e) Councilwoman Pepper noted the passing of two residents of our City, namely, Adrienne Hall who was a recreation leader at William Ramsay Center and hall monitor at Hammond, and William Glasgow, a very active citizen in the City. She expressed the City's deep sympathy to the two families.

(f) Councilwoman Pepper requested an update on our homeless shelters during our recent cold wave.

(g) Councilman Cleveland also spoke to the passing of Ms. Hall and Mr. Glasgow, as well as former Councilman Speck's stepmother.

(h) Councilman Cleveland spoke to inquiries that he has been receiving from residents of Oakwood Apartments with respect to its transit bus not being able to use the "Kiss and Ride" at the Van Dorn Metro Station or the Metro.

Transportation and Environmental Services Director O'Kane spoke to this issue. He indicated that the best place to take this issue is to the Metro Board.

(i) Vice Mayor Donley spoke to the action taken by the Northern Virginia Transportation Commission regarding the allocation of Metrobus fixed costs.

ORDINANCES AND RESOLUTIONS

20. Consideration of a Resolution to Request the Virginia Department of Transportation to Fund the Realignment and Signalizaticn of Mill Road. (ROLL-CALL VOTE)

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Cleveland and carried on a ROLL-CALL vote of 5-to-0, City Council adopted the resolution (1) requesting that the Virginia Department of Transportation establish an Urban System Highway Project for the completion of the realignment and signalization improvements to Mill Road; and (2) agreeing to pay 2% of the total cost for the preliminary engineering, right-of-way and construction of the project. MILL ROAD

REALIGNMENT AND SIGNALIZATION PROGRAM

WHEREAS, in accordance with the Virginia Department of Transportation's construction allocation procedures, it is necessary at a request by City Council resolution be made in order for the Virginia Department of Transportation to program an urban highway project in the City of Alexandria;

NOW, THEREFORE, BE IT RESOLVED, that the Alexandria City Council requests the Virginia Department of Transportation to establish an urban highway system project for the completion of realignment and signalization improvements of Mill Road between old Roberts Lane and Telegraph Road, which is to include a portion of Stovall Street.

BE IT FURTHER RESOLVED, that the Alexandria City Council hereby agrees to pay its share (2%) of the total cost for preliminary engineering, right-of-way and construction of this project in accordance with Section 33.1-44 of the Code of Virginia, and that, if the City of Alexandria elects to cancel this project, the City of Alexandria hereby agrees to reimburse the Virginia Department of Transportation for the total amount of the monies expended by the Virginia Department of Transportation through the date the Virginia Department of Transportation is notified of such cancellation.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Council Member Walker and carried unanimously by all those present, City Council (1) noted the following changes that have been made to the calendar since the November 28 City Council meeting: the work session with the City's delegation to the General Assembly to discuss the City's 1996 legislative package has been changed from Tuesday, December 12 to the lunch break at the December 16 Council public hearing meeting. All three members of the delegation are able to attend the December 16 work session; and Thursday, December 21, 6:30 p.m. , Hanukkah Program at the Alexandria Hospital has been added to the calendar; and (2) scheduled the Economic Development Summit recommended by Vice Mayor Donley and the Alexandria Development Partnership on Saturday, February 10. EXECUTIVE SESSION

24. Convening of an Executive Session for the Purpose of Consulting with Legal Counsel Pertaining to Pending Litigation Involving the City, Pursuant to Virginia Code § 2.1-344(A)(7).

WHEREUPON, upon motion by Councilman Euille, seconded by Councilman Cleveland and carried unanimously by all those present, at 9:55 P.M., City Council convened an executive session for the purpose of consulting with legal counsel pertaining to the following litigation involving the city, pursuant to Virginia Code § 2.1-344 (A) 7) : G&E Corporation v. City Council of Alexandria, a case pending in the Circuit Court for the City of Alexandria, No. CL950716, which involves a challenge to the 1991 and 1992 real estate tax assessments for the property known as the Oakville Industrial Park, which is located at 2400, 2500 and 2600 Jefferson Davis Highway; and Water Environment Federation v. City of Alexandria, a case pending in the Circuit Court for the City of Alexandria, No. CL941063, which involves a challenge to the business personal property tax assessments of the personal property owned by the petitioning taxpayer, for tax years 1989 through 1995. The voting was as follows:

THEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Cleveland and carried unanimously by all those present, at 10: 20 p.m., City Council reconvened the meeting. The voting was as follows:

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Cleveland and carried unanimously by all those present, City Council approved the settlement of the suits as recommended by the City Attorney in Executive Session. The voting was as follows:

THEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Cleveland and carried on a ROLL-CALL vote of 5-to-0, City Council adopted the resolution pertaining to the Executive Session. The voting was as follows:

The resolution reads as follows:
RESOLUTION NO. 1764
WHEREAS, the Alexandria City Council has this 12th day of December, 1995, recessed into executive session pursuant to a motion made and adopted in accordance with the Virginia Freedom of Information act; and

WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by City Council that such executive session was conducted in accordance with Virginia law;

NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby certify that, to the best of each member's knowledge, only public business matters that were identified in the motion by which the executive session was convened, and that are lawfully exempted by the Freedom of Information Act from the Act's open meeting requirements, were heard, discussed or considered by Council during the executive session.
