WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Cleveland and carried unanimously by all those present, City Council approved the Consent Calendar as presented. The City Manager's recommendations are as follows:

8. City Council received the following resignations with regret: (a) Margaret Gaynor from the Alexandria Archaeological Commission; (b) Luis Baquedano from the Alexandria Economic Opportunities Commission; and (c) Sara Graham Peck from the Alexandria Historic Resources Commission; and requested the Executive Secretary to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

9. City Council (1) received the Financial Report for the period ending April 30, 1996; and (2) authorized the City Manager to award contracts to the lowest responsive and responsible bidders for the following public improvement projects: playground renovations at Jordan Street and Holmes Run; and the replacement of the Courthouse chiller.

11. City Council received the report of the Public Records Advisory Commission and thanked the Commission for its efforts on behalf of the City.

REPORTS AND RECOMMENDATIONS OF THE CITY MANAGER (continued)

12. Consideration of Adoption of a Resolution and the Submission of a Grant Application to the Virginia Department of Housing and Community Development for FY 1997 Continuation Funding Under the State Homeless Housing Assistance Resources Program. [ROLL-CALL VOTE]
WHEREUPON, upon motion by Councilman Cleveland, seconded by Vice Mayor Pepper and carried on a ROLL-CALL vote of 6-to-0, City Council (1) adopted the Governing Body Resolution to the Virginia Department of Housing and Community Development to accompany the application for continuation funding; and (2) authorized the City Manager to: (a) submit the grant application to the Virginia Department of Housing and Community Development for $24,102 in FY 1997 continuation funding from the Shelter Support Grant component of the State Homeless Housing Assistance Resources (SHARE) grant program to enhance services of the Alexandria Community Shelter and the Office on Women's Battered Women's Shelter; and (b) execute all necessary documents that may be required; and noted that there are no funds available in the City budget to continue these activities once the grant funds are expended. The resolution reads as follows:

RESOLUTION NO. 1790

WHEREAS, the Commonwealth of Virginia, Department of Housing and Community Development, has issued a Notice of Funding Availability and requested applications under the SHARE Shelter Support Grant Program; and

WHEREAS, assistance is needed to effectively and adequately address the shelter/housing needs of homeless persons in the City of Alexandria; and

WHEREAS, a SHARE Shelter Support Grant Application for a grant under this program has been prepared; and

WHEREAS, Vola Lawson, City Manager, can act on behalf of the City of Alexandria and will sign all necessary documents required to complete the grant transaction; and

WHEREAS, a dollar-for-dollar match, under the SHARE Shelter Support Grant guidelines, will be provided;

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Alexandria, Virginia, hereby authorizes Vola Lawson, City Manager, to apply for and accept the grant and enter into a Grant Agreement with the Department of Housing and Community Development and perform any and all actions and responsibilities in relation to such Agreement.

13. Consideration of the Submission of a Grant Application to the Federal Administration on Children and Families for Continuation of the Alexandria Head Start Program for FY 1997.

(General Discussion. Mayor Donley and Vice Mayor Pepper asked questions of Community Programs Director Powers.)

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Cleveland and carried unanimously by all those present, City Council authorized: (1) the City Manager to submit the school year 1996-1997 Alexandria Head Start grant application to the Federal Administration for Children and Families Head Start Bureau for $896,238 (including $877,967 for the basic grant: $6,608 for quality improvements; and $11,663 for Training and Technical Assistance) ; (2) the expenditure of up to $51,000 in FY 1996 and up to $43,100 in FY 1997, which will be absorbed in the Department of Human Services budget each year to cover the non-federal share of the program should the City be required to provide a cash match to replace disallowed in-kind match; and (3) the City Manager to execute all necessary documents that may be required. 14. Consideration of Request to Permit an Exception to the Major Events Policy to Allow the Addition of a Venue East of Washington Street for First Night Alexandria, a Non-alcoholic New Year's Eve Celebration.

Mayor Donley stated that this involves his employer and his place of employment. To his knowledge, there is no exchange of funds relative to the use by First Night and the Crestar Bank location at 515 King Street; however, given the fact that it is not only involving his employer, but actually where he works, and the fact that he manages this office, he turned over the gavel to Vice Mayor Pepper. He did not participate in the discussion of this item nor the vote on this item.

15. Consideration of Report on the Proposed Changes in the City's Taxicab Regulations.

(General Discussion. Members of City Council participated in the discussion.

Councilman Euille stated for the record that everyone needs to understand that this is just not something that the staff has taken an initiative to do on their own. This evolved after months and months of meetings and discussions with both the owners and the taxicab drivers, so this is not just a pie in the sky type of thing. A lot of work and time and effort have been employed in this.)

WHEREUPON, upon motion by Council Member Rich, seconded by Councilman Cleveland and carried unanimously by all those present, City Council referred this item to the Traffic and Parking Board, the Commission on Persons with Disabilities, the Commission on Aging, for comment, and to staff for review of the memorandum submitted by Mr. Werth, as well as others submitted by the Taxi Operators, and will hold a public hearing on it in September. 16. Consideration of Minor Revisions to the Community Development Block Grant and the Home Investment Partnerships Program Budgets and Funding Applications to Reflect Final Federal Grant Amounts.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Cleveland and carried on a vote of 5-to-0, City Council (1) approved the following revisions to the Federal Fiscal Year 1996 CDBG and HOME Program budgets (for use in the City's Fiscal Year 1997) and to the funding applications included in the City's One-Year Action Plan for the Consolidated Plan for Housing and Community Development in order to reflect final grant allocation figures: (a) the addition of $1,000 in CDBG monies to the Home Rehabilitation Loan Program budget; (b) the reduction of $7,000 in HOME monies as follows: $6,300 from the Home Preservation Program; and $700 from the HOME administration budget (which cannot exceed 10% of each grant); and (c) the redirection of $1,575 (25% of the $6,300 in HOME non-administrative monies) in General Fund monies previously required for HOME Program matching funds to be used for fees for professional services in connection with affordable housing activities; (2) authorized staff to make corresponding text changes in the approved One-Year Action Plan (July 1, 1996 - June 30, 1997) for the Consolidated Plan for Housing and Community Development for submission to the U.S. Department of Housing and Urban Development (HUD). 17. Consideration of Local Governing Body Support of the Applications by the Arlington-Alexandria Coalition and Carpenter's Lodgings, Inc. to the U.S. Department of Housing and Urban Development for Grant Funding Under the Supportive Housing Program.

WITHOUT OBJECTION, City Council noted the deferral of this item until the June 11, 1996 City Council meeting.

REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES

None.

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilman Cleveland apologized to the lady who wrote a letter to Council expressing her concern about Council eating its dinner at their seats during a Council meeting.

(b) Councilman Euille announced that this coming Saturday is the National Stand for Children's Day event at the Washington Monument and the Lincoln Memorial. In addition to that, the City of Alexandria will be sponsoring a rally preceding this Saturday's event. It will be held this Friday, May 31, 1996, at 4:00 p.m. on Market Square.

(c) Councilman Euille spoke to the rally on Market Square this past Saturday, May 25, 1996, sponsored by several of the local neighborhoods with regard to the Woodrow Wilson Crossing. There was some expression of concern by a number of speakers with regard to what City Council's stand would be. Councilman Euille and Mayor Donley spoke to the group indicating that the Council's position has not changed with respect to the all-tunnel proposal.

Further Discussion. Mayor Donley, Vice Mayor Pepper and Transportation and Environmental Services Director O'Kane participated in the discussion.

There will be a presentation about the financing of the new crossing on Thursday, May 30, 1996, at 7:00 p.m. at the Woodrow Wilson Design Center on North Union Street.

Staff will come back with a recommendation to Council with respect to a work session with staff.

(d) Mayor Donley spoke to the barbecue grill issue on which Council has been receiving a lot of phone calls and mail.

City Attorney Sunderland gave a report. Fire Chief Hawkins participated in the discussion.

City Attorney Sunderland stated that as of today it appears to the City that barbecuing on balconies, both by propane gas and by briquettes, is not prevented by the State-wide Fire Prevention Code. He stated that he needed to call the State Fire Marshal in the morning to confirm that the State agrees with the interpretation as it relates to propane gas.

Chief Hawkins stated that a letter will be sent to apartment complexes and condominium associations noting that the City is not enforcing, providing safety tips, and leaving it up to the individual management to decide whether or not to permit grilling on balconies.

(e) Council Member Rich requested a status report on the Karen Mitsoff murder. City Manager Lawson spoke to this and stated that a report will be docketed for the Regular Meeting on June 25, 1996.

(f) Mayor Donley spoke to an article which appeared recently in The Prince George's Post. The article stated that the National Black Chamber of Commerce has announced the best and worst cities in the nation for growth in black business development. In terms of sales growth from 1987-92, the five best were: Alexandria, VA, 434.27%; Los Angeles, CA, 364.14%, Portland, OR, 349.32%, Colorado Springs, CO, 328.13% and Huntsville, AL, 306.83%. The cities that are the best in terms of dollars per capita included: Los Angeles, CA, $5388; Alexandria, VA, $45467, San Francisco, CA, $2799; Denver, CO, $2030, and Indianapolis, IN, $1624.

ORDINANCE NO. 3868

AN ORDINANCE to rescind Resolution No. 1610, and to add a new Article M (ENVIRONMENTAL POLICY COMMISSION) to Chapter 4 (COMMITTEES, BOARDS AND COMMISSIONS), of Title 2 (GENERAL GOVERNMENT) of The Code of the City of Alexandria, Virginia, 1981, as amended.

THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:

Section 1. That Chapter 4 of Title 2 of The Code of the City of Alexandria, Virginia, 1981, as amended, be, and the same hereby is, amended by adding thereto a new Article M to read as follows:

ARTICLE M

Environmental Policy Commission

Sec. 2-4-110 Creation, composition and organization.

(a) There is hereby established a standing commission known as the Environmental Policy Commission.

(b) The commission shall consist of 15 members to be appointed by the city council. The composition of the commission shall be as follows:

(1) one lawyer with experience in federal or state environmental statutes, regulations and procedures,

(2) one member from the field of sanitary engineering;

(3) one member from the field of engineering;

(4) one member from the field of intergovernmental relations;

(5) one member from the field of urban planning;

(6) one member from the field of ecology;

(7) two members from the field of environmental sciences;

(8) one member designated by the Alexandria Chamber of Commerce;

(9) one student attending high school in the City of Alexandria; and

(10) five citizens-at-large.

(c) Members of the commission shall be appointed in the manner prescribed in title 2, chapter 4, article A of this code; provided, that a member who is the representative of an organization shall be nominated by the organization and confirmed by city council. The members shall serve for a term of two years; provided, (1) that a member who is the representative of an organization shall cease to be a member at such time as such member shall cease to be a member in good standing of the organization for which such member serves as representative; and (2) that the high school student member shall cease to be a member upon graduation.

Sec. 2-4-111 Functions; powers and duties.

(a) The functions of the commission shall be to advise and make recommendations to the city council and, where appropriate, to the planning commission and the city manager. The city manager shall distribute commission recommendations to appropriate city departments for their consideration. These recommendations shall relate to: clean air, land use, noise pollution and abatement, pesticides, herbicides and contaminants, solid waste, water quality and supply, other topics relating to conservation and protection of environmental conditions in the City of Alexandria, and such other matters as from time to time may be referred to the commission by the city council.

(b) The directors of the departments of health, transportation and environmental services, and planning and zoning shall be responsible for forwarding appropriate information, through the city manager, to the commission on all matters that impact on the areas of the commission's responsibility.

(c) It shall also be the responsibility of the commission to consult with and cooperate with federal, state, regional and local agencies charged with the protection of the environment, in accord with the provisions of section 2-4-5(d) of this code.

(d) The commission is empowered to adopt rules and regulations in regard to procedure and other matters so long as same are not inconsistent with the city code, including, but not limited to, the establishment of committees through which it may carry on its functions and purpose.

(e) A commission chair, vice-chair and secretary shall be elected annually by the commission members at the organizational meeting designed by the commission.

(f) The health department shall provide administrative and logistical support to the commission and its chair.

Section 2. That Resolution No. 1610 be, and the same hereby is, rescinded.

Section 3. The members of the Environmental Policy Commission in office as of the effective date of this ordinance shall continue to serve the unexpired portion of their term of office.

WHEREUPON, upon motion by Councilman Euille, seconded by Vice Mayor Pepper and carried on a vote of 5-to-0, City Council (1) noted that the annual award reception sponsored by the Alexandria Commission on Persons with Disabilities is scheduled for 7 p.m. in Room 2000 before the June 11 Council Meeting; and (2) scheduled a joint work session with the School Board to discuss the Demographic Study on Student Enrollment Projections on Monday, June 17, at 7:30 p.m., at Minnie Howard School. City Council noted that the United Way Awards Banquet is June 18, and Hopkins House Awards Banquet is June 19. The voting was as follows:

25. Convening of an Executive Session for the Purpose of Consulting with Legal Counsel Pertaining to Pending Litigation Involving the City, Pursuant to Virginia Code § 2.1-344(A)(7).

WHEREUPON, upon motion Councilman Speck, seconded by Vice Mayor Pepper and carried unanimously by all those present, at 9:12 p.m., City Council convened an executive session for the purpose of consulting with legal counsel and receiving a briefing by staff pertaining, first, to a workers' compensation claim pending against the City and, second, to another specific legal matter requiring the provision of legal advice, both pursuant to Virginia Code 2.1-344(A)(7). The voting was as follows:
