There was a City Council Work Session with the Members of the Alexandria Redevelopment and Housing Authority Board of Directors, at 6:00 p.m. in the City Council Workroom.

Vice Mayor Donley, ARHA Chairman Cisco, and City Manager Lawson made opening remarks. ARHA Executive Director McNamara gave an overview of the state of the Housing Authority. ARHA Program Administration of Smirniotopoulos and EDAW Project Manager Harwood gave an overview of the Feasibility Study of Samuel Madden Homes.

Members of City Council, Members of the ARHA Board of Directors, City Manager Lawson, Executive Director McNamara, and EDAW Project Manager Harwood participated in a discussion of this item.

At approximately 7:50 p.m., the Work Session was concluded.

The Meeting was called to order by Vice Mayor Donley, and the City Clerk called the Roll; all Members of City Council were present.

3. THERE BEING NO DISCUSSION, upon motion by Councilman Euille, seconded by Councilwoman Pepper and carried on a vote of 4-to-0, City Council approved the Minutes for the following Meetings of City Council: (a) the Regular Meeting of December 12, 1995; and (b) the Public Hearing Meeting of December 16, 1995, as submitted.

20. Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE to amend Section 2-100 and Sections 4-103, 4-203, 4-303, 4-403, 4-503, 4-603, 4-703, 4-803, 4-903, 4-1003, 4-1103 and 4-1203 of the Zoning Ordinance to add garden centers as a new use allowed in various zones with special use permit approval, and to amend Section 9-302(E) of the Zoning Ordinance to allow freestanding signs in the historic districts with approval of the Board of Architectural Review.

WHEREUPON, upon motion by Council Member Rich, seconded by Councilwoman Pepper and carried unanimously, City Council approved the consent calendar as presented with the exception of 11 (c). The City Manager's recommendations are as follows:

11. City Council received the following resignations with regret: (a) Susan T. MacKay from the Alexandria Commission for Women; (b) Stephen P. Murphy from the Alexandria Commission on Persons With Disabilities; (d) Nancy N. Brown from the Alexandria Historical Restoration and Preservation Commission; and (e) Claire Eberwein and Margaret Paul from the Alexandria Youth Services Commission; requested the Executive Secretary to send the appropriate Letters of appreciation and to advertise the vacancies in the usual manner.

City Council (a) reappointed Marianne Weitz as a Member from the Historic Alexandria Foundation to the Alexandria Archaeological Commission; (b) appointed Tara Hardiman as a Representative of Council Member Lois L. Walker to the Alexandria Budget and Fiscal Affairs Advisory Committee; (c) appointed Carlisle Bean and reappointed E. Duane Howard and James Moorehead as Citizen Members to the Alexandria Commission on Persons With Disabilities; (d) appointed Susan Quatannens as a Representative of the Alexandria Community Services Board to the Alexandria Community Criminal Justice Board; (e) reappointed Annette Duff as a Local Consumer Action Organization Member to the Alexandria Consumer Affairs Commission; (f) reappointed William Hranicky as a Member from the Alexandria Archaeological Commission to the Historic Alexandria Resources Commission; (g) appointed Carol Van Horn as a Representative from the Alexandria Commission for Women to the Alexandria Human Rights Commission; and (h) appointed Mary Danforth as a Member from a Group Concerned with the Development of Educational Policy to the Alexandria Youth Services Commission.

He originally was scheduled to go to Bosnia for military service; however, that never came to fruition, thus it was his desire to remain on the Commission. The voting was as follows:

13. Consideration of Supplemental Funding for the Alexandria Economic Development Partnership. [Vice Mayor Donley]

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Cleveland and carried unanimously, City Council approved the recommendation of the Alexandria Economic Development and Tourism Board of Directors to transfer $39,000 budgeted within the City's contingent reserves contingent account (account #103556-2707) to the Alexandria Economic Development Partnership (account #105403-2624). 14. Consideration of Grant Application to the Institute of Museum Services for Funding for the Black History Resource Center.

WHEREUPON, upon motion by Council Member Rich, seconded by Councilman Cleveland and carried unanimously, City Council decided to exceed its budget cap on the number of part-time City positions and approved the request which will increase the number of grant-funded City positions by one 0.60 FTE position (Museum Aide I) . This grant-funded position would terminate upon the expiration of the grant, and the individual who is to fill this position would be notified of this condition of employment. City Council (1) approved the submission of the grant application in the amount of $29,508; (2) contingent upon the award of the grant, approved the establishment of the part-time position reflected in the memorandum; and (3) authorized the City Manager to execute all documents that may be required. The voting was as follows:

WHEREUPON, upon motion by Council Member Rich, seconded by Councilwoman Pepper and carried unanimously, City Council decided to exceed its budget cap on the number of full-time and part-time City positions. Approval of this request will increase the number of grant-funded City positions by one 1.00 FTE position (Museum Aide I) and one .60 FTE position (Museum Aide I) . These grant-funded positions would terminate upon the expiration of the grant, and the individuals who are to fill these positions would be notified of this condition of employment. City Council (1) approved the submission of the grant application in the amount of $81,898; (2) contingent upon the award of the grant, approved the establishment of the full-time and the part-time position reflected in the memorandum; and (3) authorized the City Manager to execute all document that may be required. WHEREUPON, upon motion by Council Member Rich, seconded by Councilman Cleveland and carried unanimously, City Council decided to exceed its budget cap on the number of part-time City positions. Approval of this request will increase the number of grant-funded City positions by one .60 FTE position and two .20 FTE positions (Museum Aide I) These grant-funded positions would terminate upon the expiration of the grant, and the individuals who are to fill these positions would be notified of this condition of employment. ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilwoman Pepper commended Transportation and Environmental Services Director O'Kane and his staff for the Herculean job done in removing the snow from the City streets.

Members of City Council, City Manager Lawson and Transportation and Environmental Services Director O'Kane participated in the discussion.

Councilman Euille encouraged businesses and citizens to clean their walkways and sidewalks. He indicated that the City has an ordinance that requires the sidewalks to be cleaned within twenty-four hours after a snowfall.

(b) Councilwoman Pepper spoke to the success of First Night Alexandria again this year.

(c) Council Member Walker announced that Vice Mayor Donley has been elected Vice Chair of the Northern Virginia Transportation Commission.

(d) Vice Mayor Donley briefed Council on the Potomac Conference which he and City Manager Lawson attended last weekend. The sole issue of the conference was that of Federal spending and Federal downsizing. There will be a definite impact on the area jurisdictions.

WHEREUPON, upon motion by Council Member Rich, seconded by Council Member Walker and carried unanimously, City Council approved the Council calendar, as amended, and (1) scheduled a work session to discuss the alternatives for the Woodrow Wilson Bridge project at 7:00 p.m. on Wednesday, February 7 in the Council Chambers; (2) received the draft agenda for Council's January 30 Community meeting in the West End at the Patrick Henry Elementary School; (3) noted that the winning entries from the Alexandria Public Schools Elementary School Art Contest will be displayed in the Cameron Street Lobby at City Hall during February with a reception for the winners and their families at 7:00 p.m. before the Tuesday, February 13 Council Meeting; and (4) changed the January 23, 1996 Legislative Meeting to Wednesday, January 24, 1996. EXECUTIVE SESSION

32. Convening of an Executive Session for the Purpose of Consulting with Legal Counsel Pertaining to Pending Litigation Involving the City, Pursuant to Virginia Code § 2.1-344(A)(7).

WHEREUPON, upon motion by Councilman Euille, seconded by Councilman Cleveland and carried unanimously, at 9:35 p. m., City Council convened an executive session under Virginia Code § 2.1-344 (A) (7) to discuss two pending lawsuits against the city as follows: 1) The American Trucking Association v. City of Alexandria, and (2) Woodward and Lothrop v. City of Alexandria, both pending in the Circuit Court for the City of Alexandria. The voting was as follows:

RESOLUTION NO. 1767

WHEREAS, on this 11th day of January, 1996, the Alexandria City Council did recess into executive session pursuant to a motion made and adopted in accordance with the Virginia Freedom of Information Act; and

WHEREAS, § 2.1-344.1 of the Code of Virginia requires a certification by City Council that such executive session was conducted in accordance with Virginia law;

NOW, THEREFORE, BE IT RESOLVED that city council does hereby certify that, to the best of each member's knowledge, only public business matters that were identified in the motion by which the executive session was convened, and that are lawfully exempted by the Freedom of Information Act from the Act's open meeting requirements, were heard, discussed or considered by council during the executive session.
