Absent: None.

OPENING

The Meeting was called to Order by Vice Mayor Donley, and the City Clerk called the Roll; all Members of City Council were present.

(It was noted that a Notice of this Special Meeting had been previously served upon each Member of Council, pursuant to a provision of the City Charter, a copy of the Notice certified by each Member of Council being on file in the office of the City Clerk and Clerk of Council.)

The Invocation was pronounced by Father Steve Leva of Saint Ann's Catholic Church.

3. Receipt by Council of Mayor-Elect Kerry J. Donley's Letter of Resignation as Vice Mayor/Council Member.

WHEREUPON, upon motion by Councilman Euille, seconded by Councilwoman Pepper and carried unanimously, City Council received the resignation. The voting was as follows:

Julie Lineberry, Chair of the Alexandria Electoral Board, certified to the election results for the Office of the Mayor.

Clerk of Court Semonian administered the Oath of office to Mayor-Elect Donley.

6. Consideration of a Resolution Declaring a Vacancy on the Alexandria City Council. [ROLL-CALL VOTE]

(A copy of a memorandum from the City Attorney dated February 21, 1996, is on file in the office of the City Clerk and Clerk of Council, marked Exhibit No. 1 of Item No. 6; 2/27/96, SM, and is incorporated herewith as part of this record by reference.)

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Cleveland and carried unanimously, City Council adopted the Resolution declaring a vacancy on the Alexandria City Council. The voting was as follows:

The resolution reads as follows:
RESOLUTION NO. 1774
WHEREAS, Kerry J. Donley was elected Mayor of the City of Alexandria, at a special election held on February 20, 1996, and has assumed the office of the mayor; and

WHEREAS, prior to his election as mayor, Kerry J. Donley was a member of the Council of the City of Alexandria, serving as the Vice Mayor; and

WHEREAS, a vacancy on the Council of the City of Alexandria now exists as a result of Mr. Donley's election as mayor; and

WHEREAS, said vacancy has occurred more than 180 days prior to the next regular election for the Council of the City of Alexandria which is to take place in May 1997; and

WHEREAS, in these circumstances, § 10.02 of the Charter of the City of Alexandria provides for the Circuit Court of the City of Alexandria, upon being informed by the City Council of a vacancy on the Council, to order a special election to fill the vacancy to be held no fewer than 40, and no more than 60, days following the filing of a Council resolution informing the Court of the vacancy; and

WHEREAS, it is the desire of the Council of the City of Alexandria that the special election to fill the current vacancy on the Council be held as soon as practicable;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF ALEXANDRIA, VIRGINIA:

1. That the City Council hereby certifies to the Circuit Court of the City of Alexandria that there exists a vacancy on the City Council, and that such vacancy has occurred more than 180 days prior to the next ensuing regular election for the Council which is to take place in May 1997.

2. That the City Council requests the Circuit Court of the City of Alexandria, acting pursuant to § 10.02 of the Charter of the City of Alexandria, to order a special election to be held to fill the vacancy on the Council.

3. That a copy of this resolution, signed by the Mayor and attested by the Clerk of the Council, be delivered to the Chief Judge of the Circuit Court of the City of Alexandria, so that the vacancy on the City Council may be filled in the manner provided by law.

WHEREUPON, upon motion Councilwoman Walker, seconded by Councilman Cleveland and carried unanimously, City Council elected Councilwoman Pepper to be the new Vice Mayor. The voting was as follows:

THERE BEING NO FURTHER BUSINESS TO BE CONSIDERED, upon motion by Council Member Walker, seconded by Councilman Cleveland and carried unanimously, at 7:50 p.m., the Special Meeting of February 27, 1996, was adjourned, and City Council went immediately to the Regular Meeting. The voting was as follows:
