10. Presentation of Gadsby's Tavern Root Beer to the Mayor and Members of City Council.

City Council sampled the root beer which is bottled in Virginia by the Old Dominion Brewing Company and is being distributed locally by the Guiffre Distributing Company of Alexandria for the Office of Historic Alexandria. The public can purchase the root beer at Gadsby's Tavern Restaurant, the Ramsay House Visitors Center, The Lyceum Museum Shop and other Office of Historic Alexandria museums, as well as from local delis and restaurants.

WHEREUPON, upon motion by Council Member Rich, seconded by Council Member Walker and carried unanimously, City Council approved the Consent Calendar as presented with the exception of Docket Item No. 19 which was considered under separate motion. The City Manager's recommendations are as follows:

11. With regret, City Council received the following resignations from Members of Boards, Commissions and Committees as follows: (a) Edward W. Nidever from the Alexandria Affordable Housing Advisory Committee; (b) Antoine P. Cobb from the Alexandria Commission on Employment; (c) Gregory M. Giammittorio from the Alexandria Industrial Development Authority; (d) Edgar A. Rivera from the Alexandria Landlord-Tenant Relations Board; (e) Michael Brown from the Alexandria Task Force on Information and Communication Technologies; (f) Wilbert Olin Thomas, III, from the Alexandria Task Force on AIDS; and (g) Robin G. Hayutin from the Alexandria Youth Services Commission; and requested the Executive Secretary to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

12. City Council (a) reappointed Kimberly Koch as a Representative from the Alexandria Social Services Advisory Board to the Alexandria Early Childhood Commission; (b) reappointed Kathleen Kelly and appointed Jane Fox-Barke and Elizabeth Kenny as Citizen Members to the Alexandria George Washington Birthday Celebration Committee; (c) reappointed Richard Reno as a Representative from the Alexandria Human Rights Commission to the Alexandria Task Force on AIDS; and (d) reappointed Paul Cassedy and Anthony Norward as Members of the Traffic and Parking Board to the Alexandria Transportation Safety Commission.

13. City Council received the three annual reports of the Alexandria Archaeological Commission and thanked the Commission members for their efforts on behalf of the City.

14. City Council received the report and thanked the Committee members for their work on behalf of the City.

15. City Council approved the following recommendations: (1) that $141,649 be designated for the Child Day Care Fee System to be used between now and June 30 as follows: (a) $92,000 to assist families currently in the program and (b) $49,649 to serve up to 20 families (30 new children) from the waiting list; (2) that $45,191 be designated for a full-time Social Worker I position in the Office for Early Childhood Development (OECD) to: provide additional training for prospective family child care providers; increase the monitoring of the levels of quality of care in family child care homes; and increase the availability of supportive services to help providers reach and maintain high levels of quality; and (3) that up to $2,000 be designated to increase the hours of a part-time child psychologist in the Mental Health Center from thirty to forty hours per week through June 30, 1996, to: provide additional screening, assessment and treatment services to at-risk children; work with parents; train center staff in the identification of children with psychological problems; and consult with staff in the management of serious behavior problems in the classroom.

19. Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE to revise the City's regulations governing pawnbrokers and dealers in second-hand articles by (1) restricting the number of pawnshops that may operate in the City to a maximum of four, (2) requiring separate licenses for pawnshop businesses and pawnshop employees, (3) broadening the list of grounds for refusing to issue a permit or license to pawnbrokers and dealers in second-hand articles, (4) establishing a formal license and permit revocation process, (5) extending the mandatory holding period for pawned items from 15 to 30 days, and (6) adopting various regulations set out in the Virginia Code.

16. Consideration of Approval to Use City Facilities and Personnel for the Alexandria Red Cross Waterfront Festival on June 7, 8, and 9, 1996.

WHEREUPON, upon motion by Councilman Cleveland, seconded by Vice Mayor Pepper and carried unanimously, City Council approved the use of the following City facilities and personnel for the 15th Annual Alexandria Red Cross Waterfront Festival on June 7, 8, and 9, and set conditions for their use. All City costs associated with the festival are paid for by the Red Cross, and include permits and license fees, facilities and equipment rental fees, and staff fees at the appropriate overtime rates. These fees are estimated to total $43,170 this year, and are not to be waived. The Red Cross made a net total of $128,403 on the festival last year after paying $40,707.96 in City fees and costs.

B. Permits:

1. To allow the temporary occupancy of public spaces for displays, exhibits, events, demonstrations, sales, trash removal, toilet facilities, amusement rides and other similar activities (Attachment 2);

2. To allow the on-site sale of food and beer during festival hours for the hours outlined on the next page;

3. To allow the performance of staged musical events in Oronoco Bay Park on Friday, June 7, 6:00 p.m. -11:00 p.m.; Saturday, June 8, 10:00 a.m. - 10:00 p.m.; and Sunday, June 9, 10:00 a.m. - 7:00 p.m.;

4. To support a fireworks display to be conducted from a barge in the Potomac River on Friday, June 7 at 10:30 p.m. and Saturday, June 8 at 9:30 p.m. (this support is contingent upon the Alexandria Red Cross obtaining permission to shoot fireworks from the District of Columbia); and,

5. To allow the placement of Red Cross flags on utility poles from June 5 to June 10 from the 100 block of North Union Street to the 500 block of North Union Street, Oronoco Bay Park, and at the City Marina.

C. Set Conditions For Use:

1. No permits or license fees, facilities or equipment, rental fees, or staff costs required for the Festival shall be waived since the Red Cross raises a substantial amount of money from this festival.

Other requirements pertaining to beer sales are as follows:

10. The Health Department must approve all food and beverage concessions prior to their arrival at the site. Adequate toilet facilities must also be provided.

11. The Red Cross shall provide and pay for night security of the Festival grounds and along the waterfront.

12. The Red Cross shall be responsible for all docking fees incurred by visiting ships berthing at the City Marina. It is also the responsibility of the Red Cross to inform the captains of all visiting ships of the time frame uring which the Red Cross intends to pay docking fees, and advise them of City rates for all other times.

13. The Red Cross shall obtain a three-day banquet license and a three-day business license from the City's Finance Department (Attachment 4).

14. All food sales will be conducted under tents or from booths and wagons located throughout the Festival site. Concessionaires include several Alexandria restaurants and clubs. The Health and Fire Departments will monitor these activities to ensure that all codes are met.

17. Consideration of Studies and Reports on Aging Issues, and Presentation of the Commission on Aging's Senior Study Report.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Cleveland and carried unanimously, City Council (1) received the Senior Center Study Group Report and requested staff to report back to City Council in the fall with recommendations for implementing the recommendations in the Report and for developing a long-range plan for senior recreation programming; (2) accepted the Commission on Aging's recommendation not to proceed with any further studies to examine senior services with the exception of the senior center long-range plan; and (3) thanked the Commission on Aging for its work. REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilman Euille announced that the Joy of Sports Foundation is having a fundraising event called "Smash to Serve Tennis Party" to raise money for the Foundation to provide its summer program for the youth in the City of Alexandria. This event will be held on Saturday, June 8, from 7:00 p.m. to 11:00 p.m., at the Skyline Club. He invited Members of City Council and City staff to come and enjoy the evening.

(b) Councilman Euille spoke to a disturbing article on the Op-Ed page of the Alexandria Journal regarding the recently adopted and approved budget. The author of the article spoke to the City's donations to non-profit groups in the City. Councilman Euille has requested a meeting with the author of the article.

(c) Vice Mayor Pepper complimented and thanked Ralph Thompson for getting a pilot project started regarding the Senior Computer Center located at Charles Houston.

(d) Mayor Donley gave a report on the recent retreat he attended on the Woodrow Wilson Bridge.

Staff is to provide Council with a copy of the minutes of the proceedings at the retreat. Staff is to examine the results of the retreat, look at the cost elements procedurally with the environmental process, try to give Council an assessment of where the City stands, and set up a work session to discuss the pros and cons of how the City might proceed. The report should be circulated to the civic activists.

(e) Councilman Speck spoke to the week-long activities to recognize police officers, specifically those who have died in the line of duty. In 1994, Congress passed a Bill requiring that the American flag be lowered at half staff on May 15 as a special tribute to the law enforcement officers who have died in the line of duty. There will be a memorial service on May 16, 1996 at 7:30 p.m. at Baptist Temple Church, 700 Commonwealth Avenue. Councilman Speck encouraged everyone to attend.

(f) Council Member Rich spoke to the fence issue that is scheduled for public hearing on Saturday. Members of the Board of Zoning Appeals have contacted Council requesting that the item be deferred until the BZA can consider it.

(g) Council Member Rich recognized the Finance staff for their outstanding work during the City decal season.

23. Consideration of Resolution Authorizing the Refunding of a Portion of the Alexandria Industrial Development Authority's Educational Facilities Revenue Bond for Episcopal High School Issued in 1991. [ROLL-CALL VOTE]

Councilman Speck stated for the record that his firm was an underwriter of these bonds previously, and he suspects that they will be a financial participant in the future. He stated that he had voted on this matter previously because he is neither a direct nor indirect beneficiary of this transaction. He wanted to disclose that his firm is involved but that he will be voting because he does not believe that he has a conflict.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Cleveland and carried on a unanimous ROLL-CALL vote, City Council adopted the resolution as recommended by the Alexandria Industrial Development Authority at its meeting on May 2, 1996. The refunding of these revenue bonds is intended to reduce debt service costs for Episcopal High School. The voting was as follows:

RESOLUTION NO. 1788
WHEREAS, the Industrial Development Authority of the City of Alexandria, Virginia ("Authority"), has considered the application of Protestant Episcopal High School in Virginia ("School") requesting the issuance of the Authority's revenue refunding bonds in an amount not to exceed $7,500,000 ("Bonds") to assist in refunding a portion of the Authority's $13,625,000 Educational Facilities Revenue Bonds (Episcopal High School), Series 1991, issued on January 9, 1991 to finance the acquisition, construction, equipping and renovation of various improvements to the campus at the School, located at 1200 North Quaker Lane in the City of Alexandria, Virginia ("School Facility"), including, without limitation, improvements to dormitory rooms, sports facilities, classrooms, library and security systems, and has held a public hearing on April 24, 1996; and

WHEREAS, Section 147(f) of the Internal Revenue Code of 1986, as amended (the "Code"), provides that the governmental unit having jurisdiction over the issuer of private activity bonds and over the area in which any facility financed with the proceeds of private activity bonds is located must approve the issuance of the bonds; and

WHEREAS, the Authority issues its bonds on behalf of the City of Alexandria, Virginia ("City"); the School Facility is located in the City and the City Council of the City of Alexandria, Virginia ("Council") constitutes the highest elected governmental unit of the City; and

WHEREAS, the Authority has recommended that the Council approve the issuance of the Bonds; and

WHEREAS, a copy of the Authority's resolution approving the issuance of the Bonds, subject to the terms to be agreed upon, a certificate of the public hearing and a Fiscal Impact Statement have been filed with the Council;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF ALEXANDRIA, VIRGINIA:

1. The Council approves the issuance of the Bonds by the Authority for the benefit of the School, as required by Section 147(f) of the Code and Section 15.1-1378.1 of the Code of Virginia of 1950, as amended ("Virginia Code") to permit the Authority to assist in the refunding.

2. The approval of the issuance of the Bonds does not constitute an endorsement to a prospective purchaser of the Bonds of the creditworthiness of the School Facility or the School.

3. Pursuant to the limitations contained in Temporary Income Tax Regulations Section 5f.103 -2 (f) (1), this resolution shall remain in effect for a period of one year from the date of its adoption.

4. This resolution shall take effect immediately upon its adoption.

City of Alexandria, a case pending in the Circuit Court for the City of Alexandria, which involves the real estate tax assessments of the Foxchase apartments for tax years 1990 through 1993; Institute for Defense Analysis v.City of Alexandria, a case pending in the Circuit Court for the City of Alexandria, which involves the business personal property assessments of computer and related property owned by plaintiff for tax year 1991; and Fields v. Baxter, a case pending in the Circuit Court for the City of Alexandria, which asserts a claim for personal injury damages arising from an automobile accident involving a city employee.
