The Meeting was called to Order by Mayor Donley, and the City Clerk called the Roll; all Members of City Council were present except Councilman Euille.

Passage on First Reading of AN ORDINANCE to revise the City's regulations governing pawnbrokers and precious metals dealers by (1) restricting the number of pawnshops that may operate in the City to a maximum of four, (2) instituting a new and separate licensing system for employees of pawnshops and precious metals dealers, (3) broadening the list of grounds for refusing to issue a permit or license to pawnbrokers and precious metals dealers, (4 )establishing a formal license and permit revocation process, (5) extending the mandatory holding period from 15 to 30 days for all pawned items and for all precious metals and gems acquired in one-on-one transactions with members of the public, and (6) adopting various regulations set out in the Virginia Code. 23 Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE to amend the city's business license tax, also known as the Business Professional and Occupational License Tax, to expand the exemption from this tax to businesses with less than $100,000 in gross receipts and to impose an annual fee of $50 on all businesses exempted from the tax which have gross receipts in excess of $10,000.

24. Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE to amend the provisions of the City Code regarding City motor vehicle decals and residential parking district permits in the following manner: (1) effective July 1, 1997, to change the date by which City residents must purchase vehicle decals and residential parking district permits from May 1 to October 5, in order to bring the City's due date into conformity with the date used in other Northern Virginia jurisdictions; (2) to provide that all motor vehicle decals issued for the period starting May 1, 1997, shall run only until November 15, 1997, and that the fee for such decals shall be $12.50; (3) to provide that all residential parking district permits issued for the period starting May 1, 1997, shall run only until November 15, 1997, and that the fee for such permits shall be $7.50 for the first car, $10 for a second car and $25 for each additional car; (4) in accord with Northern Virginia regional compact, to impose a $5 transfer fee when an individual moves from one participating Northern Virginia jurisdiction to the City, and to discontinue the practice of reducing, on a pro-rata basis, the motor vehicle decal fee when a vehicle is sold, traded in or permanently removed from City; (5) to eliminate the $1 service fee imposed on non-resident military personnel for issuance of a motor vehicle decal, in order to bring the City's treatment of non-resident military personnel into conformity with the practice of other Northern Virginia jurisdictions; and (6) to alter the manner in which the decal fee for leased passenger vehicles is calculated so that the fee matches the decal fee charged for non-leased passenger vehicles.

Passage on First Reading of AN ORDINANCE to rescind the City Code requirement that City Council adopt each year a resolution setting forth the amount of the City's annual trash fee, and to provide instead that the trash fee, once set by council resolution, shall remain the same until amended by subsequent council resolution.

WHEREUPON, upon motion by Council Member Walker, seconded by Vice Mayor Pepper and carried unanimously by all those present, City Council approved the Consent Calendar as presented with the exception of Docket Item No. 15 which was considered under separate motion, and noted the deferral of Docket Item No. 21. The City Manager's recommendations were as follows:

7. City Council received the following resignations with regret: (a) Jean S. Moore from the Alexandria Archaeological Commission; (b) Barbara Greenfield from the Alexandria Commission for the Arts; and (c) Anthony M. Patire from the Alexandria Early Childhood Commission; and requested the Executive Secretary to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

8. City Council (a) appointed C. Peter Schumaier and Gerald Tamanini as Citizen Members to the Alexandria Ad Hoc Towing Services Contract Advisory Board; (b) appointed Diane Crawford-Batt as an Employer Representative to the Alexandria Affordable Housing Advisory Committee; (c) appointed Michele Ross as a Representative from the Alexandria Public Schools to the Alexandria Task Force on AIDS; and (d) appointed Joseph Bernabucci and David Sachs as Youth Members to the Alexandria Youth Services Commission.

9. City Council declared the citizen position vacant and authorized the Executive Secretary for Boards and Commissions to advertise the vacancy.

10. City Council authorized the City Manager to: (1) submit a grant application to the Virginia Department of Environmental Quality for funding as a pass-through from EPA, in the amount of $40,870, for the OEQ, and; (2) execute all necessary documents that may be required. It was noted that there are no additional monies available in the City's budget to continue these activities once the grant funds have been expended.

11. City Council authorized the City Manager to: (1) submit a grant application to the Institute for Museums Services for funding, in the amount of $20,590, for a Museum Leadership Initiatives grant to the Office of Historic Alexandria; and (2) execute all necessary documents. It was noted that there are no funds in the City budget to continue the program once the grant funds are expended.

12. City Council authorized the City Manager to: (1) submit the grant application to the Virginia Department of Rehabilitative Services for $7,070; and (2) execute all necessary documents that may be required.

13. City Council authorized the City Manager to: (1) submit the application for two-year continuation funding from the Virginia Department of Housing and Community Development, in the amount of $222,289 for FY 1997, and $222,289 for FY 1998, for the State Homeless Housing Assistance Resources-Homeless Intervention Program (SHARE-HIP); it was noted that there are no monies available in the City budget to continue the program once the grant funds are expended; and (2) execute all necessary documents that may be required.

14. City Council: (1) authorized the City Manager to submit a grant application to the Virginia Department of Youth and Family Services for funding, in the amount of $57,692, for the continuation of services under the Delinquency Prevention and Youth Development Act; (2) approved the continuation of two full-time grant-funded positions, Youth Services Program Specialist and Secretary I, to continue to administer these on-going services. Continuation of these positions is contingent upon continuation of funding from the Virginia Department of Youth and Family Services or other non-City sources. These grant-funded positions would terminate upon the expiration of the grant and the individuals in these positions have been notified of this condition of employment; and (3) authorized the City Manager to execute all necessary documents that may be required. It was noted that there are no additional monies available in the City's budget to continue this activity once the grant funds have been expended.

15. Consideration of Proposal to Convey Two Surplus V.H.F. Radio Repeaters to Alexandria Amateur Emergency Services.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Cleveland and carried on a ROLL-CALL vote of 6-to-0, City Council adopted the resolution conveying two radio repeaters and ancillary equipment to A.R.E.S. The voting was as follows:

The resolution reads as follows:
RESOLUTION NO. 1792
WHEREAS, Amateur Radio Emergency Services (A.R.E.S.) is a group of volunteer radio operators that provides backup communications services during disasters and public events; and

WHEREAS, the Alexandria City Council recognizes the important roles A.R.E.S. has played, such as providing backup radio communications services following the Air Florida crash in 1980 and during a telephone system failure in 1994 and, over the past year, assisting at the Alexandria Red Cross Waterfront Festival, City parades and foot races; and

WHEREAS, A.R.E.S. has requested that the City convey a surplus V.H.F. radio repeater system, which will enhance amateur radio coverage in Alexandria; and

WHEREAS, the conveyance of the repeater system to A.R.E.S. will allow this equipment to continue serving citizens in Alexandria; and

WHEREAS, the Fire Chief has recommended that the repeater system be conveyed to A.R.E.S. and that a license be granted for A.R.E.S. to service and maintain the repeater at Fire Station 56 (4609 Seminary Road);

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Alexandria, Virginia, hereby authorizes the City Manager to convey the attached listing of radio equipment to A.R.E.S. and grant a license to A.R.E.S. to service and maintain the repeater at Fire Station 56.

16. Consideration of Acceptance of Continuation Grant Funds and Submission of Application to the Virginia Department of Health for Funding for the Office on Women's Sexual Assault Response and Awareness Program.

WHEREUPON, upon motion by Councilman Cleveland, seconded by Councilman Speck and carried unanimously by all those present, City Council increased the number of grant-funded City positions by three, one of which will be a 1.00 FTE position (Human Services Project Coordinator) and the other a 1.00 FTE position (Volunteer Coordinator) and one .40 position (Outreach/Prevention Specialist) . These positions would be established within the Office on Women. These grant-funded positions would terminate upon the expiration of the grant for the period of July 1, 1996 - June 30, 1997, and the individuals who are to fill these positions would be notified of this condition of employment. City Council (1) approved acceptance of continuation grant funding for FY 1997 through the Virginia Department of Health in the amount of $61,265, the same amount of funding received by the City for FY 1996; (2) approved the continuation of a 1.00 FTE grant-funded position of a Human Services Project Coordinator to administer the on-going Sexual Assault Response and Awareness Program; (3) approved the continuation of a 16 hour-per-week Outreach/Prevention Specialist (.40 FTE) position. This person would be working with the Office on Women to provide services to adolescents under this grant; (4) approved the submission of a grant application for additional grant funding under this program in the amount of $15,316 through the Virginia Department of Health; (5) approved the increase of a City funded position, presently 30 hours-per-week, as a Volunteer Coordinator position to a 40 hour-per-week (1.00 FTE) position, in the event of approval of the $15,316 grant proposal; and (6) authorized the City Manager to: (a) submit the grant application to the Virginia Department of Health for $15,316 for funding in FY 1997 under the Office on Women's Sexual Assault Response and Awareness Program; and (b) execute all necessary documents that may be required. It was noted that no monies are available in the City budget to continue these activities once the grant funds are expended. The voting was as follows:

(a) WHEREUPON, upon motion by Councilman Cleveland, seconded by Vice Mayor Pepper and carried on a vote of 5-to-1, City Council (1) approved the transfer of up to $125,000 (out of $236,750) in outstanding indebtedness owed to the City from Community Lodgings, Inc. to be repaid by the purchasers of five of its townhouses, subject to the following conditions: (a) the loans will be provided in the form of five individual homeownership assistance loans of up to $25,000 each; and (b) the guidelines, terms and conditions of the City's existing Homeownership Assistance Program (HAP) will apply to these loans, with the exception of the $2,000 purchaser contribution requirement, which shall be reduced by $1,000; (2) authorized the City Manager to execute the necessary legal documents to implement the transfer of the City indebtedness; (3) approved the request from Community Lodgings, Inc. for the City Manager to sign a Certification of Consistency with the City's Consolidated Plan for Housing and Community Development for an application to HUD under the Supportive Housing Program for 12 additional transitional housing units at 607 and 612 Notabene Drive, which the organization already owns;

and (4) approved an amendment to existing City loan documents for 607 and 612 Notabene Drive to allow the 12 permanent low-income housing units at these properties to become transitional housing units. The voting was as follows:

REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilman Speck spoke to an action which Council took at the May 18 Public Hearing Meeting regarding a BAR appeal at 225 South West Street. City Council was asked to overturn a decision of the Board of Architectural Review that prohibited the demolition of a single-detached home which was acquired by the purchaser/developer for $75,000. Approximately one week after Council approved the demolition, the property is now being offered for sale for $135,000 with a demolition permit attached. He indicated that he doesn't think the Council would have approved it, had they known that it was going to be offered for sale. Future requests for demolition requests will entail a lot more scrutiny.

(b) Councilman Speck spoke to a recent press release regarding a task force on auto theft. In future press releases regarding auto theft, he suggested that a reference be made to the Combat Auto Theft Sticker Program.

Mayor Donley also suggested that it be highlighted in the annual report, in areas of high incidence of auto theft, and possibly a flyer be distributed similar to what T&ES does during the Hazardous Waste campaign.

(c) Councilman Speck spoke to the enforcement issue of running red lights. He spoke to the new technology with respect to cameras at intersections. He requested an informational item on this issue in the fall.

(d) Councilman Speck spoke to the policy of how you handle information that is presented to a neighborhood prior to the actual establishment of a group home. He suggested that over the course of the summer that a small group, at the discretion of the Mayor, be established to talk about whether there might not be some procedures and operating ground rules that can exist to talk about how the establishment of these particular facilities can be communicated to a neighborhood other than on an ad hoc basis. He suggested a more organized process or format that insures that the community is informed, that we don't violate any laws that govern, both at the federal and local levels, the establishment of a group home, that don't jeopardize the ability to create or acquire a home in a proper setting, but also insures that the neighborhood is respected in concerns of its concerns. He suggested that the group should include representation from the Chapter 10 Board, and it might also include representatives from a couple of neighborhoods that seem to be most affected by this to talk about their role and how you can balance both the issue of the proper structure for establishing a facility and the community's concerns. This suggestion is left at the Mayor's discretion.

Mayor Donley suggested that the City Manager and he get together after the last legislative meeting.

Council Member Walker suggested that this also might prove as a model for scattered-site housing as we get more into moving out of the projects and into the community. This might give some guidelines for moving in that direction.

(e) Vice Mayor Pepper congratulated the T.C. Williams students who will be graduating this Thursday.

(f) Vice Mayor Pepper congratulated the Goodwin House on its recent groundbreaking for its residential addition. She also congratulated the Society for Human Resource Management for its relocation to Duke Street at the Carlyle project.

(g) Council Member Walker spoke to the Fayette Court condominium conversion. She invited any Members of Council who are interested in seeing the prototype unit which has been finished by the condominium converter to make an appointment with Housing Director Davis or Council Member Walker to see the unit before Saturday. This is an item on the docket for Saturday's public hearing.

(h) Council Member Walker announced that the Virginia Railway Express is going to take her and other people who would like to come on a train ride leaving at 3:45 p.m. on Wednesday, June 12. You will ride the train to Fredricksburg and back. You will be returning to Alexandria a little after 6:00 p.m. She invited Members of Council and City staff to join her.

(i) Councilman Cleveland announced that the Duke Street bridge project is now complete. Transportation and Environmental Services Director O'Kane stated that the signs regarding a "no left turn" restriction onto South West Street during peak hours have been erected.

(j) Council Member Rich thanked those who contributed to his church's yard sale. Proceeds raised from the sale will be going to the City's Homeless Shelter.

(k) Council Member Rich asked for an update on the Karen Mitsoff task force. City Manager responded that the draft has been circulated among the task force members and will be docketed for Council's June 25 meeting.

30. Consideration of a Resolution to Request that the Virginia Department of Transportation Fund Preliminary Engineering for the Construction of High Occupancy Vehicle Access at Interstate 395 and Seminary Road. [ROLL-CALL VOTE]

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Alexandria, Virginia, requests the Virginia Department of Transportation establish a project for the preliminary engineering for High Occupancy Vehicle access to Seminary Road at Interstate 395 from points south of Alexandria; and

BE IT FURTHER RESOLVED, that the Council of the City of Alexandria is not required to provide local match for this project in accordance with Section 33.1-44 of the Code of Virginia. If the City of Alexandria subsequently elects to cancel this project, the City of Alexandria hereby agrees to reimburse the Virginia Department of Transportation for the total amount of the costs expended by the Department through the date the Department is notified of such cancellation.

Consideration of a Resolution Providing Local Governing Body Approval of Alexandria Redevelopment and Housing Authority (ARHA) Issuance of Tax-Exempt Bonds to Finance the Renovation and Expansion of the Goodwin House and to Refund Outstanding 1986 ARHA Bonds for Goodwin House West in Falls Church. WHEREAS, Goodwin House, Inc. (the "Borrower") has requested the Alexandria Redevelopment and Housing Authority (the "Authority") to issue bonds in the form of revenue bonds (the "1996 Bonds") in an amount not to exceed $60,000,000 to (1) finance the cost of constructing and equipping an expansion and renovation (the "Project") of a facility for the residence and care of the aged known as Goodwin House, located at 4800 Fillmore Avenue, Alexandria, Virginia, and (2) refund $7,285,000 in outstanding principal amount of the Authority's Residential Care Facility First Mortgage Revenue Bonds (Goodwin House West), Series 1986 (the "1986 Bonds"); and

WHEREAS, the 1986 Bonds were issued to refund the Fairfax County Economic Development Authority's $32,000,000 Residential Care Facility First Mortgage Revenue Bonds (Goodwin House West), Series 1985, which bonds were issued to finance certain costs of acquiring, constructing and equipping the Borrower's facility for residence and care for the elderly known as Goodwin House West, located at 3440 South Jefferson Street, Falls Church, in Fairfax County, Virginia; and

WHEREAS, the Authority has held a public hearing on the issuance of the 1996 Bonds and the financing of the Project on May 20, 1996; and

WHEREAS, the Authority has requested the City Council (the "Council") of the City of Alexandria, Virginia (the "City"), to approve the issuance of the 1996 Bonds and the financing of the Project to comply with Section 15.1-1378.1 of the Code of Virginia of 1950, as amended (the "Act"), which is applicable because of the provisions of Chapter 514 of the Virginia Acts of Assembly of 1983, and Section 147 (f) of the Internal Revenue Code of 1986, as amended (the "Code"); and

WHEREAS, a copy of the Authority's resolution adopted on May 20, 1996, approving the issuance of the 1996 Bonds, a fiscal impact statement and a reasonably detailed summary of the comments made at the public hearing, have been filed with the City Council;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF ALEXANDRIA, VIRGINIA:

1. The City Council of the City of Alexandria, Virginia, hereby approves the issuance of the 1996 Bonds by the authority for the benefit of the Borrower and the financing of the Project to the extent required by Section 15.1-1378.1 of the Act and Section 147(f) of the Code, to permit the Authority to assist in the financing of the Project and the refunding of the 1986 Bonds.

2. The approval of the issuance of the 1996 Bonds does not constitute an endorsement of the 1996 Bonds or the creditworthiness of the Borrower, and, as required by Section 36-29 of the Virginia Housing Authorities Law, the 1996 Bonds shall provide that the 1996 Bond shall not be a debt of the City, the Commonwealth of Virginia or any political subdivision thereof (other than a limited obligation of the Authority) and neither the City nor the Commonwealth or any political subdivision thereof (other than the Authority to the extent of its limited obligation) shall be liable thereon, nor in any event shall the 1996 Bonds be payable out of any funds or properties other than those of the Authority pledged specifically therefor.

3. This resolution shall take effect immediately upon its adoption.
