The Meeting was called to Order by Mayor Donley and the City Clerk called the Roll; all Members of City Council were present.

Councilman Euille stated that he would like a work session on Health Department issues raised in the Cardiovascular Risk Reduction Program Community Needs Assessment which Council received recently. He also was amazed at the large percentage of Alexandrians who lack insurance.)

21. Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE to establish the real and personal property tax rates for calendar year 1996.

WHEREUPON, upon motion by Council Member Rich, seconded by Councilman Cleveland and carried unanimously, City Council approved the consent calendar, as presented. The City Manager's recommendations are as follows:

7. (a) City Council received the resignation of J. Chapman Petersen from the Alexandria Social Services Advisory Board.

8. (a) City Council reappointed Daniel Abramson as a Builder to the Alexandria Affordable Housing Advisory Committee; (b) reappointed Helen Bertot, Benjamin Justesen, II, Daniel Maljanian, William Morgan, Margaret Pickering, and Tatyana Schriempf as Citizen Members to the Alexandria-Gyumri Sister City Committee; (c) appointed Paul Smedberg as a Representative of State Senator Patricia S. Ticer to the Alexandria Economic Opportunities Commission; and (d) reappointed C. Peter Schumaier as a Citizen Member to the Alexandria Traffic and Parking Board.

9. City Council authorized the City Manager to (1) submit a grant application in the amount of $5,000 to the Virginia Commission for the Arts' Local Government Challenge Grant Program; and (2) execute all necessary documents that may be required.

10. City Council authorized the City Manager to (1) submit a grant application for federal and State Community Services Block Grant continuation funding, in the amount of $172,473, to the Virginia Department of Social Services; (2) approved the continuation of the four grant-funded positions covered by the Community Services Block Grant. Grant-funded positions terminate upon expiration of the grant and the individuals filling these positions are notified of this condition of employment; and (3) execute all necessary documents that may be required.

11. City Council authorized the City Manager to submit a renewal contract to the EEOC for funding, in the amount of $60,500, for the Alexandria Office of Human Rights to continue as a Fair Employment Practice Agency (FEPA).

12. City Council deferred this item until the May 14, 1996 City Council meeting.

13. City Council received the Financial Report for the period ending February 29, 1996, and authorized the City Manager to issue an invitation to bid and award a contract to the lowest responsive and responsible bidder for the replacement of the HVAC system at the Charles Barrett Recreation Center.

21. City Council introduced and passed the ordinance on its First Reading; set it for Public Hearing on April 15, 1996; and for Second Reading and Final Passage on May 7, 1996, following the adoption of the FY 1996 Budget.

14. Consideration of Request to Permit an Exception to the Major Events Policy for the War Between the States Chili Cook-off. (Vice Mayor Pepper)

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Euille and carried unanimously, City Council permitted an exception to the Major Events Policy to allow the 1996 War Between the States Chili Cookoff to occur at Oronoco Bay Park on the fourth Saturday in September (September 28, 1996) instead of the third Saturday in September (September 21, 1996) as currently scheduled. 15. Consideration of a Change in the Docking Operations Plan to Provide for the Leasing of Ten Additional Pleasure Boat Slips at the City Marina on a Monthly or Yearly Basis.

WHEREUPON, upon motion by Council Member Walker, seconded by Councilman Cleveland and carried unanimously, City Council approved the leasing of ten additional pleasure boat slips at the City Marina, and authorized the City Dockmaster, in conjunction with the Director of Recreation, Parks and Cultural Activities, to determine, based on demand, if these slips should be leased on a monthly or yearly basis. 16. Consideration of Application to the Virginia Department of Social Services for Funding for the Office on Women's Sexual Assault Response and Awareness Program.

WHEREUPON, upon motion by Councilman Euille, seconded by Vice Mayor Pepper and carried unanimously, City Council increased a .50 FTE, grant-funded, Outreach Prevention Specialist position to a full-time (1.0) position. This grant-funded position would terminate upon the expiration of the grant and the individual who is to fill this position would be notified of this condition of employment. City Council (1) approved the submission of the grant application to the Virginia Department of Social Services for funding, in the amount of $22,473; (2) contingent upon the award of the grant, approved the increase of a part-time (.50 FTE), grant-funded position to the full-time position reflected above; and (3) authorized the City Manager to execute all documents that may be required. 17. Consideration of Request to the Virginia Department of Transportation for Changes in Lane Mileage Eligible for Street Maintenance Payments. [ROLL-CALL VOTE]

WHEREUPON, upon motion by Council Member Rich, seconded by Councilman Cleveland and carried on a unanimous ROLL-CALL vote, City Council (1) adopted the resolution listing (a) the various new roadways and lanes to be added to the State Highway road inventory; and (2) authorized the Director of Transportation and Environmental Services to forward the information to the Virginia Department of Transportation. RESOLUTION NO. 1780
WHEREAS, the 1985 Virginia General Assembly passed House Bill 1269 providing for a change in that municipal streets eligible for maintenance payments be divided into two categories based on functional classification; and

WHEREAS, these categories are Primary/Minor arterial roads and Collector/Local streets and they replaced the past administrative classifications of Primary Extensions and Other streets, respectively; and

WHEREAS, the code, as set forth is Sec. 33.1-41.1 provided for a process in which municipalities may request additions, deletions or changes to the functional classification of Urban Roads or Streets eligible for maintenance payments on an annual basis; and

WHEREAS, the City of Alexandria contains additional new roadways which meet the State Highway road inventory criteria; and

WHEREAS, the City Council wishes to add various new roadways and lanes as Primary/Minor Arterials and Collector/Local streets and delete various vacated roadways; and

WHEREAS, the City Council wishes to make these changes to the Virginia Department of Transportation's road inventory in order to qualify for maintenance payments under the new quarterly payment rates per lane mile for Primary/Minor Arterial and Collector/Local streets respectively, starting as of July 1, 1996; and

NOW, THEREFORE, BE IT RESOLVED THAT, the Alexandria City Council requests that the following new roadways and lanes be added to the Virginia Department of Transportation's road inventory:

18. Consideration of the Human Services Study Committee Report. (WS 3/19/96; #10 2/27/96)

Council Member Walker requested a study on services for seniors throughout the Community.

WHEREUPON, upon motion by Council Member Rich, seconded by Councilman Euille and carried unanimously, City Council directed staff and the designated Commissions and Boards to proceed with the following study recommendations from the Human Services Committee Report: (1) Review and evaluation of the homeless and emergency services consolidation (Recommendation #4); (2) Comparison and analysis of the cost effectiveness of Alexandria Community Shelter and Carpenter's Shelter (Recommendation #6); (3) City-wide Youth Services Study (Recommendation #7); (4) Study of child care issues (Recommendation #8); (5) Review and comment on ARCH alternatives (Recommendation #11); (6) Review of alternatives for reducing the companion aide budget (Recommendation #12); and (7) Study alternatives for the senior transportation program (Recommendation #13). 20. Consideration of Establishment of an Ad Hoc Planning Commission Committee to Determine How to Reduce Impediments to Commercial Development.

WHEREUPON, a motion was made by made by Council Member Walker, seconded by Councilman Cleveland that City Council approve the proposal for the establishment of an Ad Hoc Planning Commission Committee to examine ways to reduce impediments to commercial development with any amendments Council wishes to add. This program was developed by Planning Commission Chairman Bill Hurd and concurred with by the individual members of the Planning Commission.

THEREUPON, a substitute motion was made by Council Member Rich, seconded by Vice Mayor Pepper to create an Ad Hoc committee doing basically what has been recommended by the Planning Commission, but that the membership be made up of 11 members, 3 appointed by the Council from the Planning Commission, 4 citizens at-large and 4 from the development community; which motion FAILED on vote of 2 "ayes" to 4 "nos. The voting was as follows:

(a) Vice Mayor Pepper congratulated Council Member Rich and wife, Marcia, for the impending birth of their first child, October 2.

(b) Vice Mayor Pepper reminded everyone that the American Heart Association will be holding its "Celebrity Waiter" fundraiser, Thursday night, March 28, at 6:00 p.m. at the Ramada Inn Old Town.

(c) Vice Mayor Pepper thanked the Chamber of Commerce for continuing to honor our Police Officers and Firefighters.

(d) Council Member Rich spoke to the recent murder/suicide in his neighborhood. He questioned the response rendered by the system.

City Manager Lawson stated that staff will be setting up a committee of the Commonwealth's Attorney, Office on Women, Police Department and others to review the issues and legislation with respect to domestic violence. The committee will report back with appropriate recommendations.

(e) Councilman Cleveland spoke to the successful dance sponsored by the Police Association for the Alexandria Youth Camp. The dance was held on March 23 at the Holiday Inn North. A good time was had by all.

(f) Councilman Euille spoke to the Second Annual Homeownership Fair to be held on April 20, from 9:30 a.m. to 1:00 p.m. at T.C. Williams.

(g) Councilman Euille spoke to the recent decision of ARHA to redevelop the Berg. He suggested that the task force suggested by Mayor Donley be established and should include representatives from the Alexandria Tenant Council and lay citizens. He stressed that we need to insure that Resolution No. 830 is strictly adhered to and those who are displaced by this decision will be able to remain in Alexandria and some return to this site.

Mayor Donley stated that the ARHA Task Force should be convened. It should be broadened to include the Resident Council and possibly a representative from the ministerial alliance.

(h) Mayor Donley spoke to a letter he received from Jim Hunter, Chairman, Arlington County Board, requesting that the appointment of a resident of Fairlington be added to serve as a member of the Beauregard Street Corridor Study Task Force. He requested that we amend the enabling legislation setting up the Task Force by adding a representative from Fairlington designated by the Arlington County Board. The City Clerk was requested to advise Chairman Hunter of Council's decision.

ORDINANCE NO. 3854

AN ORDINANCE adopting supplemental pages for the Zoning Ordinance of the City of Alexandria, Virginia, 1992, as amended, and providing for the repeal of ordinances not included therein, except those saved from repeal by this ordinance, and for other purposes.
THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:

Section 1. That the sections of the Zoning Ordinance of the City of Alexandria, Virginia, 1992, as amended ("Zoning Ordinance"), and the portions thereof, set forth in the supplemental and replacement pages for the Zoning Ordinance, each of which pages is identified in the lower left-hand corner by the notation "Supp. No. 8," are hereby adopted as and shall constitute "The Eighth Supplement to the Zoning Ordinance of the City of Alexandria, Virginia, 1992."

Section 2. That the sections of the Zoning Ordinance, and the portions thereof, set forth in "The Eighth Supplement to the Zoning Ordinance of the City of Alexandria, Virginia, 1992," shall be in force and effect on and after the effective date of this ordinance, and all ordinances amending the text of the Zoning Ordinance which were adopted between June 18, 1995, and January 20, 1996, inclusive, and which are not included in such supplement or in the Zoning Ordinance are hereby repealed, except as otherwise provided in section 3 of this ordinance.

Section 3. That the repeal provided for in section 2 of this ordinance shall not affect any offense or act committed or done, or any penalty or forfeiture incurred, or any contract established or accruing prior to the effective date of this ordinance; nor shall it affect any prosecution, suit or proceeding pending or any judgment rendered prior to said date; nor shall it affect any provision of any ordinance amending the Zoning Ordinance which was adopted between June 18, 1995, and January 20, 1996, inclusive, and which is inadvertently omitted from or erroneously incorporated into "The Eighth Supplement to The Zoning Ordinance of the City of Alexandria, Virginia, 1992; nor shall

it affect any ordinance adopted after January 20, 1996.

Section 4. That one complete set of pages comprising "The Eighth Supplement to the Zoning Ordinance of the City of Alexandria, Virginia, 1992," shall be stapled or otherwise permanently fastened together, shall be manually signed on the front sheet by the mayor and the city clerk, and shall be filed in the office of the city clerk and made available to any person desiring to inspect the same. In addition, one complete set of the pages comprising such supplement shall be properly inserted into the copy of the Zoning Ordinance of the City of Alexandria, Virginia, 1992, which bears the manual signatures of the mayor and the city clerk, and such code, as amended and supplemented, shall be kept on file in the office of the city clerk and be made available to any person desiring to inspect the same.

Section 5. That this ordinance shall become effective upon the date and at the time of its final passage.

23. Consideration of a Resolution Supporting the National League of Cities' Efforts to Lobby the President and Congress to Achieve a Fair and Balanced Budget without Shutting the Government Down Again. (Mayor Donley and Council Member Rich) [ROLL-CALL VOTE]

WHEREUPON, upon motion by Council Member Rich, seconded by Vice Mayor Pepper and carried on a ROLL-CALL vote of 5-to-0-to-1, City Council adopted the resolution. The voting was as follows:

WHEREAS, the United States Congress and the President have not agreed on permanent spending legislation for the operation of the federal government for the remainder of the federal fiscal year; and

WHEREAS, achieving a fair and balanced budget without once again closing down the federal government is a matter of the highest priority at all levels of government; and

WHEREAS, all Americans must share in the sacrifice if a balanced budget is to be achieved; and

W WHEREAS, at its meeting on November 29, 1995 the Board of Directors of the National League of Cities adopted a set of principles to ensure enactment of a balanced budget; and

W WHEREAS, the Alexandria City Council wishes to support this effort by the National League of Cities;

NOW THEREFORE BE IT RESOLVED that the City Council of the City of Alexandria supports the principles adopted by the National League of Cities in their effort to urge the United States Congress to enact a balanced budget:

Hooff and others v. City of Alexandria, which is a case pending in the Alexandria Circuit Court involving four real estate parcels located in Eisenhower Valley. The voting was as follows:
