There was a City Council Work Session with the Budget and Fiscal Affairs Advisory Committee, at 6:00 p.m. in the City Council Workroom. Mayor Ticer and City Manager Lawson made introductory remarks.

Brian Moran, Chaiman of BFAAC, made opening remarks. Reginald Foster, Vice Chair of BFAAC, went through the 1995-96 proposed work plan for the Budget and Fiscal Affairs Advisory Committee. Members of City Council and City Manager Lawson participated in the discussion.

Passage on First Reading of AN ORDINANCE to revise the city's regulations governing pawnbrokers and dealers in second-hand articles by (1) restricting the number of pawnshops that may operate in the city to a maximum of four, (2) requiring separate licenses for pawnshop businesses and pawnshop employees, (3) broadening the list of grounds for refusing to issue a permit or license, (4) establishing a formal license and permit revocation process, 5) extending the mandatory holding period for pawned items from 15 to 30 days, and (6) incorporating various provisions required by the Virginia Code.

16. Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE to (1) amend the Potomac Yard/Potomac Greens Small Area Plan section of the 1992 Master Plan to change the use permitted on a portion of property in the Potomac Yard without a Coordinated Development District Special Use Permit, from I to UT, to accommodate the relocation of the mainline rail tracks, and (2) to amend the Potomac Yard/Potomac Greens Small Area Plan section of the 1992 Master Plan to change the development permitted on the Piggyback Yard portion of Potomac Yard at Slater's Lane without a Coordinated Development District Special Use Permit, from RB/Townhouse to CRMU-L/Commercial Residential Mixed Use, Low, with limitations.

17. Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE to (1) rezone the property within the Potomac Yard over which the relocated mainline rail tracks will run by changing the underlying CDD zoning of the property from I to UT, and (2) to rezone the property in the Piggyback Yard portion of the Potomac Yard at Slater's Lane by changing its underlying CDD zoning from RB to CRMU-L, with restrictions.

WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilman Cleveland and carried unanimously, City Council approved the Consent Calendar as presented with the exception of Docket Item No. 7 (d) which was considered under separate motion. The City Manager's recommendations are as follows:

6. City Council received the following resignations with regret: (a) Susan Feller from the Alexandria Beautification Commission; (b) Merritt R. Blakeslee, Timothy Brown, and Rosemarie Wojcik from the Alexandria Commission for the Arts; (c) James A. Lapsley from the Alexandria Commission on Employment; and (d) Ruth Ann Zuniga from the Alexandria Early Childhood Commission; and requested the Executive Secretary for Boards and Commissions to send the appropriate letters of recognition and to advertise the vacancies in the usual manner.

7. City Council (a) appointed Lois Kebe as a Tenant from an Affordable Housing Complex to the Alexandria Affordable Housing Advisory Committee; (b) appointed Marianne Weitz as a Member from the Historic Alexandria Foundation to the Alexandria Archaeological Commission; (c) appointed Lindalyn Hutter as a Business Representative to the Alexandria Commission on Employment; (e) reappointed Clark Eaton as a Member from Planning District II to the Alexandria Park and Recreation Commission; (f) reappointed John Klousia as a Representative of the Alexandria Medical Society to the Alexandria Public Health Advisory Commission; (g) reappointed Janet Hawkins as a Citizen Member to the Alexandria Public Records Advisory Commission; and (h) reappointed Linda Bridgman as a Representative from the Old Town Civic Association to the Alexandria Waterfront Committee.

8. City Council deferred this item until the December 12, 1995 City Council meeting.

9. City Council approved Addendum I of the Job Training Consortium Agreement between Alexandria and Arlington.

10. City Council received the report and thanked the Alexandria Public Health Advisory Commission for its efforts on behalf of the public health and the City.

WITHOUT OBJECTION, City Council received the report and thanked the
Members of the Eisenhower Partnership for their efforts to promote the development and redevelopment of the Eisenhower Valley. City Council has scheduled a work session with the representatives of the Partnership before the Tuesday, January 23 Council meeting.

12. Consideration of the Alexandria Community Services Board FY 1996 Plan of Services

WHEREUPON, upon motion by Councilman Euille, seconded by Councilwoman Pepper and carried unanimously, City Council (1) approved the FY 1996 Alexandria Community Services Board's Plan of Services (Attachment 1 to the City Manager's Memorandum dated November 8, 1995); and (2) authorized the City Manager to execute all documents that may be required. 13. Consideration of Submission of Grant Application to the U.S. Department of Justice for a Community Policing Grant to Combat Domestic Violence.

WHEREUPON, upon motion by Council Member Rich, seconded by Councilwoman Pepper and carried unanimously, City Council authorized the City Manager to (1) submit a grant application for the Domestic Violence program; and (2) increase the Police Department's sworn strength by 2 positions to a total of 267 sworn positions if the grant is approved. REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilman Euille introduced Brenda Shaw who works with a group in public housing called "Just Kicking It". Ms. Shaw announced that there is a need for children and adult clothing and coats, shoes (all sizes) and household items including towels, sheets, pots and pans. They will accept anything that is in good condition. A drop-off point is: Hopkins House, 1224 Princess Street, or Ms. Shaw's house, 1308 Madison Street.

Recreation, Parks and Cultural Activities Director Robinson gave a progress report. City Manager Lawson participated in the discussion.

(c) Councilman Euille directed questions to Recreation, Parks and Cultural Activities Director Robinson, Landscape Architect Brownstein, and Deputy Director of General Services McMahon about the status of the renovation of the Durant Recreation Center. Staff will report back to City Council.

(d) Councilman Euille asked staff to provide Council with an impact analysis in terms of the current Federal Government furlough program and the budget crisis.

City Manager Lawson gave a brief report. Staff will report back on Saturday, November 18.

(e) Vice Mayor Donley congratulated Council Member Rich and Marcia Call on their impending marriage and wished them the best of luck.

(f) Councilman Cleveland alerted every one that this is the season for fires. He spoke to prevention.

(g) Councilman Cleveland stated that the Police Chief has put out a bulletin with respect to security awareness during the holiday season.

(h) Councilwoman Pepper congratulated Mayor Ticer on her victory on Tuesday, November 7, and in becoming Alexandria's State Senator. She requested the City Attorney to give Council an overview of the procedure for filling the mayor's position.

City Attorney Sunderland stated that once the Mayor resigns, the clock starts ticking. The election would be held not less than forty and not more than sixty days after Mayor Ticer resigns. Once the Mayor resigns, Council will then adopt a resolution declaring a vacancy.

(i) Council Member Walker reported that she had a meeting at Founder's Park with a group from the City, consisting of representatives from Transportation and Environmental Services, Recreation, Parks and Cultural Activities, member of the Founder's Park Community Group, Robert Roland who is Chairman of the Alexandria Waterfront Committee, and Ann Haynes, who is Chairperson of the Park and Recreation Commission. They discussed at the site whether to build a fishing jetty or even a jetty of any kind at that location. She stated that they came to the conclusion that the dredging will begin, but a jetty of any kind, fishing or non-fishing, will not be until probably the end of 1996, if at all. It would only be done after extensive research, extensive public input, so that everyone would know what was going on and when.

(j) Council Member Rich congratulated the Office of Historic Alexandria on its Halloween Program.

(k) Council Member Rich complimented the Commission on the Arts for its newsletter.

(l) Council Member Rich thanked Gil Zimmerman and his wife publicly for what they have done for the City and its citizens over the years. They have recently moved from the City to Williamsburg.

(m) Mayor Ticer spoke to a resolution which was recently adopted by the Fairfax County Board, concerning the Easter Seal Society for Disabled Children and Adults, Inc. request to regionalize. She recommended that City Council adopt a similar resolution which does not endorse the ESSDCA proposal to regionalize the Metropolitan Washington area to include Northern Virginia, Berkeley and Jefferson Counties, West Virginia.

RESOLUTION NO. 1761

WHEREAS, the counties and cities of Fairfax, Loudoun, Clarke, Warren, Fauquier, Prince William, Arlington, Falls Church, Alexandria, Manassas, Manassas Park, Stafford, Culpepper, Spotsylvania, King George, under direction of the Easter Seal Society of Virginia, Incorporated (ESSV), are distinct in the region for their economic and demographic base. While Easter Seals' regionalization efforts began in the Washington metropolitan area over 45 years ago, during that time, these Northern Virginia jurisdictions have distinguished themselves as independent communities. No longer are these bedroom communities serving job sites and seeking financial incentives within the District, but rather, they have become job centers in themselves, attracting entirely new industries from a national and international market.

WHEREAS, the inherent differences of workforce, education base, tax structure, low unemployment and high quality of public services between Virginia and the District illustrate the differences between the two markets and the structural problems created by artificially combining the two.

WHEREAS, Northern Virginia has built a strong and diverse fundraising base. These vital and expanding economic centers have formed their own market distinct from that in the District. Given that only 20.3% of Fairfax County residents commute to Washington, D.C. and over half stay within the County, it is wrong to characterize businesses in the D.C. metropolitan area, particularly those in Northern Virginia, as considering D.C. their primary market. Rather, these corporations have a sense of community within the Northern Virginia area, from which they draw their employment base and historically provide charitable support.

WHEREAS, Northern Virginia's needs are currently being met with ongoing programs and established camps. This does not preclude continuing collaboration with Easter Seal Society for Disabled Children and Adults, Incorporated (ESSDCA) on programs such as Family Friends, KARS, and Accessing American's Hot New Market. ESSV staff and volunteers live in the Northern Virginia area and are responsive and aware of their local community, but are also willing to collaborate with the ESSDCA volunteers when there are mutual interests to be served.

WHEREAS, competition between the two Societies will not be generated because Northern Virginia is clearly drawing from a distinctly different market and serving a wholly separate population. Lack of regionalization does not doom these groups to inequality, but rather allows them to target their particular market and serve their population with human and financial resources from their communities.

WHEREAS, encompassing a territory as large and incompatible as the entire Washington-Baltimore Consolidated Metropolitan Statistical Area and counties as distant and diverse as Berkeley and Jefferson Counties in West Virginia, creates problems that do not currently exist. Logistical, administrative, marketing and programming efforts will be hampered by implementation of this proposal.

THEREFORE, BE IT RESOLVED, that the Alexandria City Council does not endorse the ESSDCA proposal to regionalize the Metropolitan Washington area to include Northern Virginia, Berkeley and Jefferson Counties, West Virginia; and

BE IT FURTHER RESOLVED, that the Alexandria City Council commends the ESSV for their responsive and compassionate service to the communities of Northern Virginia, and the entire Commonwealth of Virginia, and does hereby request the National Easter Seal Board reject the ESSDCA proposal.

(n) Mayor Ticer spoke to a letter from Alexandria Commission on Aging Chair Sheehy requesting the City to endorse the Commission's position in opposition to the U.S. House of Representatives Bill No. 1058 and Senate Bill No. 240.

(o) Mayor Ticer requested Transportation and Environmental Services Director O'Kane to give a status report with respect to the signs on 395 for Landmark Shopping Center.

(p) Councilwoman Pepper asked for an update on Penney's to be located at Landmark Shopping Center.

City Manager Lawson gave an update and will keep Council informed if anything new should develop.

18. Introduction and First Reading. Consideration. Passage on First and Second Readings of AN ORDINANCE to adopt Supplement 47 of The Code of the City of Alexandria, Virginia, 1981, as amended. [ROLL-CALL VOTE]

ORDINANCE NO. 3833

AN ORDINANCE adopting supplemental pages for The Code of the City of Alexandria, Virginia, 1981, as amended, and providing for the repeal of ordinances not included therein, except those saved from repeal by this ordinance, and for other purposes.
THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:

Section 1. That the sections and portions thereof set forth in the supplemental and replacement pages for The Code of the City of Alexandria, Virginia, 1981, each of which pages is identified in the lower left-hand corner by the notation "Supp. No. 47," are hereby adopted as and shall constitute "The Forty-Seventh Supplement to The Code of the City of Alexandria, Virginia, 1981."

Section 2. That the sections and portions thereof set forth in "The Forty-Seventh Supplement to The Code of the City of Alexandria, Virginia, 1981," shall be in force and effect on and after the effective date of this ordinance, and all ordinances of a general and permanent nature which were adopted between June 18, 1995 and September 16, 1995, and which are not included in such supplement or in The Code of the City of Alexandria, Virginia,

1981, as amended are hereby repealed, except as otherwise provided in section 3 of this ordinance.

Section 3. That the repeal provided for in section 2 of this ordinance shall not affect any offense or act committed or done, or any penalty or forfeiture incurred, or any contract established or accruing prior to the effective date of this ordinance; nor shall it affect any prosecution, suit or proceeding pending or any judgment rendered prior to said date; nor shall it affect any ordinance adopted after June 25, 1992, which amends the Zoning Ordinance of the City of Alexandria, Virginia, 1992, as amended; nor shall it affect any ordinance saved from repeal by Ordinance No. 1250; nor shall it affect any ordinance listed in appendices A through J, both inclusive, of The Code of the City of Alexandria, Virginia, 1981, or any pages supplemental to such appendices; nor shall it affect any provision of any ordinance adopted between June 18, 1995 and September 16, 1995, which is inadvertently omitted from or erroneously incorporated into The "Forty-Seventh Supplement to The Code of the City of Alexandria, Virginia, 1981," or any other supplement to the code; nor shall it affect any ordinance adopted after the effective date of this ordinance.

Section 4. That one complete set of pages comprising "The Forty-Seventh Supplement to The Code of the City of Alexandria, Virginia, 1981," shall be stapled or otherwise permanently fastened together, shall be manually signed on the front sheet by the mayor and the city clerk, and shall be filed in the office of the city clerk and made available to any person desiring to inspect the same. In addition, one complete set of the supplemental and replacement pages of such supplement shall be properly inserted into the copy of The Code of the City of Alexandria, Virginia, 1981, which bears the manual signatures of the mayor and the city clerk, and such code, as amended and supplemented, shall be kept on file in the office of the city clerk and be made available to any person desiring to inspect the same.

Section 5. This ordinance shall become effective upon the date and at the time of its final passage.

25. Receipt of the City of Alexandria's Proposed Legislative Package for the 1996 Session of the Virginia General Assembly, and Setting a Public Hearing on the Proposed Package for November 18, 1995, and a Public Hearing on the Proposed City Charter Bill on December 16, 1995.

WHEREUPON, upon motion by Council Member Rich, seconded by Councilwoman Pepper and carried unanimously, City Council: (1) received the proposals for the City's 1996 legislative package; (2) scheduled the proposed legislative package for public hearing on Saturday, November 18, and adoption on Tuesday, December 12; and (3) scheduled public hearing on and adoption of the proposed Charter amendment for Saturday, December 16. We are proposing that Council's work session with the General Assembly delegation be held before the Tuesday, December 12 City Council meeting. The scheduling of the work session is addressed under the Council schedule item. The voting was as follows:
