WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Cleveland and carried unanimously, City Council approved the Consent Calendar, with the exception of Docket Item Nos. 9 and 10, which were considered under separate motions. The City Manager's recommendations are as follows:

7. City Council received the following resignations with regret: (a) Richard Indelicato from the Alexandria Commission on Aging; (b) Stefanie M. O'Rourke from the Alexandria Commission on Employment; (c) Ines Pinto Alicea from the Alexandria Human Rights Commission; and (d) Tania Walker from the Alexandria Task Force on AIDS; and requested the Executive Secretary to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

8. City Council (a) reappointed Edward Sheehy as a Member with Leadership Experience in a Volunteer Organization to the Alexandria Commission on Aging; (b) appointed Michael Maves as a Member from the Field of Medicine to the Alexandria Environmental Policy Commission; (c) Carolyn Winters as the Representative from the Alexandria Chapter of the American Red Cross to the Alexandria Task Force on AIDS; and (d) Claude Convisser as a Business Representative to the Alexandria Youth Services Commission.

9. Consideration of Rent Subsidy Grant in Housing Trust Fund Monies for Carpenter's Shelter.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Cleveland and carried on a vote of 5-to-1, City Council approved a grant of $50,000 from the Housing Trust Fund to assist Carpenter's Shelter with rent payments during calendar year 1996, with the stipulation that the monies will be disbursed directly to the shelter's landlord. 11. Consideration of Resolution Establishing City Council Position Regarding High occupancy Vehicles on I-66 Inside the Capital Beltway. [Vice Mayor Donley] [ROLL-CALL VOTE]

WHEREUPON, upon motion by Council Member Walker, seconded by Councilwoman Pepper and carried on a unanimous ROLL-CALL vote, City Council adopted the Resolution and authorized the City Manager to forward the resolution to the National Capital Region Transportation Planning Board at the Council of Governments. The resolution reads as follows:
RESOLUTION NO. 1771
WHEREAS, Interstate 66 inside the Capital Beltway was opened to traffic in December, 1982, as an HOV4 facility; and

WHEREAS, the HOV restriction was changed to HOV3 in August, 1986, as a result of a Congressional mandate; and

WHEREAS, the HOV2 Demonstration Project was initiated on March 1, 1995, as a result of Public Law 103-331, and is scheduled to end on March 1, 1996, if no action is taken by the United States Secretary of Transportation; and

WHEREAS, during the demonstration period, Metrorail experienced significant ridership losses on the Orange Line at stations between Ballston and Vienna; and

WHEREAS, these ridership losses were higher than those experienced on other Metrorail segments in the Washington metropolitan area; and

WHEREAS, the HOV2 demonstration appears to have taken riders away from transit, which has resulted in annual revenue losses of $1.1 million for Metrorail; and

WHEREAS, making HOV2 a permanent change might result in further negative impacts in both noise and air quality, and the region may be required to implement additional transportation control measures to offset the negative environmental impacts;

NOW, THEREFORE, BE IT RESOLVED, that the Council of the City of Alexandria supports the reestablishment of HOV3 on I-66 inside the capital Beltway; and

BE IT FURTHER RESOLVED, if the region votes to retain HOV2 at the end of the demonstration period, then the Virginia Department of Transportation should take the following actions to continue promoting public transportation in the I-66 corridor, including:

BE IT FINALLY RESOLVED, if HOV2 is retained, and the mechanisms to promote public transit in the I-66 corridor are implemented, VDOT should ensure that these mechanisms are funded from monies set aside for the discretionary use of the Commonwealth Transportation Board.

REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) With much sadness, Councilwoman Pepper noted the recent death of Peter Muirhead. Mr. Muirhead had served on the Alexandria Library Board since September 1982.

(b) Councilwoman Pepper spoke to the reopening of our YMCA on Monroe Avenue.

(c) Councilwoman Pepper announced the recent opening of the ESL Center at the Hamlets.

(d) Councilman Cleveland invited everyone to come to City Hall to view the artwork of many City students.

(e) Councilman Cleveland announced that during Black History Month, the Black History Resource Center is doing reflections of African American women and their contributions in the United States, as well as what is going on in the City of Alexandria during the month of February.

(f) Council Member Walker reminded that City Council Chamber will be the home for Opera Americana's presentation of the 18th Century hit, Thomas and Sally, which will be at 3 and 5 PM on Saturday, February 17.

(g) Councilman Euille reminded the citizens that this Saturday, February 17, the first session of the Community Political Leadership Institute will be held at Charles Houston Recreation Center, beginning at 9:30 a.m. He encouraged citizens who are interested in developing and obtaining additional leadership skills to attend. It is free.

(h) Councilman Euille announced that the George Washington Birthday Parade will be held on Monday, February 19, 1996.

(i) Vice Mayor Donley announced that COG has approved the reorganization of its Environmental Policy Committee. He indicated that Councilman Cleveland would like to be appointed to the new committee that will replace the Environmental Policy Committee of COG, since he is the current member.

WITHOUT OBJECTION, City Council agreed to Councilman Cleveland's request.

(j) Vice Mayor Donley updated Council on the recent COG Board of Directors' meeting. He indicated that COG is going to study a Snow Response Plan for the region. He spoke to cooperation agreements, enforcement of parking on snow emergency routes, notice about cleaning of sidewalks and the purchase of snow removal equipment.

(k) Vice Mayor Donley thanked his colleagues, City staff and the Economic Development staff for a valuable Economic Development Summit which was held this past weekend. He felt that it was a real success and has received a lot of positive feedback.

Reconsideration to Make Technical Amendments to Previous Local Governing Body Approval of Alexandria Redevelopment and Housing Authority (ARHA) Issuance of Tax-Exempt Bonds to Finance the Acquisition and Rehabilitation of Buckingham Village Apartments (Villages 8, 9, 10, 11 and a Portion of 12) in Arlington County, Virginia. [ROLL-CALL VOTE]

WHEREUPON, upon motion by Councilman Cleveland, seconded by Councilwoman Pepper and carried on a vote of 5-to-0, City Council adopted the resolution by a roll-call vote approving the Alexandria Redevelopment and Housing Authority (ARHA) issuance of up to $34.1 million in tax-exempt bonds for the acquisition and rehabilitation of 512 rental apartment units at Buckingham Village Apartments (Villages 8, 9, 10, 11 and a portion of 12) by Pershing Drive Associates, L.P. [Note: This recommendation was previously approved by Council on May 9, 1995.] The voting was as follows:

RESOLUTION NO. 1772
WHEREAS, Pershing Drive Associates Limited Partnership, a Virginia limited partnership (the "Borrower"), has requested the Alexandria Redevelopment and Housing Authority (the "Issuer"), to undertake the financing of the acquisition, rehabilitation and equipping of a 512-unit multi-family housing project located in Arlington County, Virginia, and occupied in part by low- or moderate-income persons or families (the "Project"), constituting a project for residential rental property meeting the requirements of Section 142(d) of the Internal Revenue Code of 1986, as amended, through the issuance of its Multi-Family Housing Mortgage Revenue Bonds (the "Bonds"); and

WHEREAS, the Issuer has held a public hearing on the issue of the Bonds on February 13, 1996, in accordance with Section 15.1-1378.1 of the Code of Virginia of 1950, as amended, (the "Virginia Code"), under the Industrial Development and Revenue Bond Act, Section 15.1-1373, et seq. of the Virginia Code (the "Act"); and

WHEREAS, the Issuer has requested the City Council (the "City Council") of the City of Alexandria, Virginia (the "City"), to approve the issuance of the Bonds to comply with Section 15.1-1378.1 of the Virginia Code under the Act; and

WHEREAS, a copy of the Issuer's February 13, 1996, resolution approving the issuance of the Bonds, a fiscal impact statement and a reasonably detailed summary of the comments made at the February 13, 1996, public hearing, have been presented to the City Council;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COUNCIL OF THE CITY OF ALEXANDRIA, VIRGINIA:

1. The City Council hereby approves the issuance of the Bonds by the Issuer for the benefit of the Borrower, to the extent required by Section 15.1-1378.1 of the Virginia Code under the Act, and to permit the Issuer to assist in the financing of the Project.

2. This resolution shall take effect immediately upon its adoption.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Council Member Walker and carried unanimously, City Council approved the Council calendar as follows: (1) scheduled a work session at 6:00 p.m. in the Council Workroom before the Tuesday, March 12 City Council Meeting with Edgehill, L.C., the contract purchaser of Cameron Station, (formerly known as Greenvest) to discuss the Community Development Authority proposed for Cameron Station; (2) scheduled a public hearing on the Woodrow Wilson Bridge Improvement Study on Wednesday, March 13, at 7:30 p.m. in the Council Chamber; (3) noted that the St. Patrick's Day Parade is March 9, instead of March 16, but kept the Public Hearing Meeting as March 23; (4) scheduled a work session at 6:00 p.m. in the Council Workroom before the Tuesday, March 26 Council Meeting with the Early Childhood Commission to discuss child care issues; (5) rescheduled the Thursday, April 18 Budget Work Session to Wednesday, April 17 and (6) noted that the following changes and additions have been made to the Council Schedule since the January 24 Council Meeting: Deletion of the April 20 dedication of King Street Gardens Park. 27. Consideration of Update Report on Items Before the 1996 General Assembly.

WHEREUPON, upon motion by Councilman Euille, seconded by Council Member Walker and carried unanimously, City Council (1) adopted the positions on legislation that have been introduced in the 1996 General Assembly Session as noted in the chart. The voting was as follows:

WITHOUT OBJECTION, City Council supported efforts to include sufficient funding in the state budget to ensure that no locality receives less HB 599 (law enforcement) funding in FY 1997 or 1998 than it did in FY 1996.

EXECUTIVE SESSION

26. Convening of an Executive Session for the Purpose of Consulting with Legal Counsel Pertaining to Pending Litigation Involving the City, Pursuant to Virginia Code § 2.1-344(A)(7).

WHEREUPON, upon motion by Councilman Euille, seconded by Councilman Cleveland and carried unanimously, at 10:00 p.m., City Council convened an executive session for the purpose of consulting with legal counsel pertaining to the following litigation involving the City, pursuant to Virginia Code § 2. 1-344 (A) (7) : National Society of Professional Engineers v. City of Alexandria, a case pending in the Circuit Court for the City of Alexandria, which involves a challenge to the business property tax levied in tax years 1989 through 1995 on computer equipment owned by plaintiff taxpayer; and Alexandria Hotel v. City of Alexandria, a case pending in the Circuit Court for the City of Alexandria, which involves a challenge to the business property tax levied in tax years 1991 through 1994 on hotel furniture and other personal property owned by the plaintiff taxpayer. The voting was as follows:

The resolution reads as follows:
RESOLUTION NO. 1773
WHEREAS, on this 13th day of February, 1996, the Alexandria City Council did recess into executive session pursuant to a motion made and adopted in accordance with the Virginia Freedom of Information Act; and

WHEREAS, 2.1-344.1 of the Code of Virginia requires a certification by City Council that such executive session was conducted in accordance with Virginia law;

NOW, THEREFORE, BE IT RESOLVED that city council does hereby certify that, to the best of each member's knowledge, only public business matters that were identified in the motion by which the executive session was convened, and that are lawfully exempted by the Freedom of Information Act from the Act's open meeting requirements, were heard, discussed or considered by council during the executive session.

THERE BEING NO FURTHER BUSINESS TO BE CONSIDERED, upon motion by Councilwoman Pepper, seconded by Council Member Walker and carried on a vote of 4-to-0, at 10:22 p.m., the Regular Meeting of Tuesday, February 13, 1996, was adjourned. The voting was as follows:
