OPENING

The Meeting was called to order by Mayor Donley, and the City Clerk called the Roll; all Members of City Council were present with Council Member Rich arriving at 7:50 p.m.

The Invocation was pronounced by Councilman Cleveland.

New Business Item No. 1: Mayor Donley introduced representatives from our Sister City, Helsingborg, Sweden, and presented them with a gift.

45. Presentation of an Award to Councilman William D. Euille by the Alexandria YMCA for Serving as Chairman of the 1997 Partner With Youth Campaign, and Presentation to the mayor and the Members of City Council by YMCA Executive Director Barbara F. Wesley.

Ms. Wesley presented Councilman Euille with the Award and a tee shirt. Members of Council will receive their tee shirts at a later time.

Councilman Euille volunteered to be the Chairman for the next campaign.

END OF CONSENT CALENDAR

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Speck and carried unanimously, City Council approved the Consent Calendar as presented with the exception of Docket Item Nos. 22 and 24. Mayor Donley noted that the public hearing on Docket Item No. 32 would be Tuesday, June 24. The City Manager's recommendations are as follows:

7. City Council received the following resignations with regret: (a) Sean Kelly from the Alexandria Archaeological Commission; (b) Michael Lavanga from the Alexandria Community Services Board; and (c) Mark Eaton from the Alexandria Park and Recreation Commission; and requested the Executive Secretary to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

8. City Council (a) appointed Kathleen Cummings as a Member Designated by the Alexandria Convention and Visitors Association Board of Governors to the Ad Hoc City of Alexandria 250th Anniversary Commission; (b) appointed J. Lawrence Robinson as a Member From the Alexandria Planning Commission to the Ad Hoc Old and Historic Alexandria District Newsrack Committee; (c) noted the withdrawal of Richard Cunningham's application on June 5, 1997, and requested the Executive Secretary for Boards and Commissions to readvertise the vacancy; (d) appointed Marvin Skolnick as a Licensed Physician to the Alexandria Community Services Board; (e) appointed R. Scott Kline as a Representative of Councilman William Cleveland to the Alexandria Economic Opportunities Commission; (f) appointed Charlene Neu as a Citizen Member to the Alexandria Industrial Development Authority; (g) appointed William Miller as a Representative From the Potomac West Business Association to the Alexandria Potomac West Alliance Board of Directors; (h) appointed James McIlhenny as a Representative From the Alexandria Seaport Foundation to the Alexandria Waterfront Committee; and (i) reappointed David Sachs as a Youth Member to the Alexandria Youth Services Commission.

9. City Council declared as vacant the position for one representative of a supportive service provider on the Commission on Aging and authorized the Executive Secretary for Boards and Commissions to advertise the vacancy.

10. City Council (1) approved the submission of the grant application to the Virginia Department of Health for funding, in the amount of $81,436; and (2) authorized the City Manager to execute all documents that may be required.

City Council approval of this request will continue funding for the existing grant-funded positions of: (1) a full-time Program Coordinator to administer the program; (2) a part-time (.50 FTE) Outreach/Prevention Specialist who provides services to adolescents; and (3) an increase of 10 hours-per-week to make the part-time, City-funded, Volunteer Developer position full-time to recruit and train volunteers and provide direct services to victims of sexual assault and their families. It was noted that there are no monies available in the City budget to continue these activities once the grant funds are expended. The continuation of these positions beyond the grant year is contingent upon the continuation of funding from the Virginia Department of Health or other non-city sources, and the individuals who fill these positions are notified of this condition of employment.

11. City Council received the report of the Public Records Advisory Commission and thanked the Commission for its efforts on behalf of the City.

22. Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE to amend the city code provisions relating to parking in spaces designated for the handicapped (i) by changing the penalty for unauthorized parking in such spaces from a fixed penalty of $100 to a penalty ranging from $100 to $500, and (ii) by imposing penalties for the unauthorized or fraudulent use of a handicapped parking permit.

Human Services Acting Director Chis gave a summary of the recommendations.

There was considerable discussion on this item. Members of Council, Deputy City Manager Steele, Child Care Coordinator Farrell and Human Services Acting Director Chis participated in the discussion.

14. Receipt of the Youth Services Study Report.

There was considerable discussion on this item. Members of City Council, Deputy City Manager Steele, and City Manager Lawson participated in the discussion.

Council Member Walker requested staff to make sure our programs fit and are not grant driven, as well as making sure that there is not separation of the groups of children.

Councilman Euille and Council Member Rich requested staff to disseminate the report widely throughout the community, including the religious community, softball, baseball and soccer associations. Copies should be made available in the City Clerk's Office, Citizen Assistance Office, and Human Services.

Mayor Donley requested assurance that there be a goal to foster continued athletic involvement as the kids grow older and get into high school.

Councilman Euille encouraged the City Manager to do a press release.

Environmental Health Director Pritchett explained what action should be taken on this item.

WHEREUPON, upon motion by Councilman Cleveland, seconded by Councilman Euille and carried unanimously, City Council (a) approved implementation by the Alexandria Health Department of an electronic inspection system developed by the FDA for the 1997 Model Food Code. This new system is anticipated to have start-up costs of $22,676 for the purchase of laptop computer equipment for inspectors, which will be absorbed within the Health Department FY 1997 General Fund Budget; and establish a new fee for food establishment construction plan review in the amount of $135, which would be equal to the current fee in Arlington and Fairfax Counties. At present, no fee is charged for this service. This plan review process is performed by Health Department staff, and is anticipated to generate $11,745 annually in revenue to the General Fund. (b) The ordinance was deferred to the September 9 Legislative Meeting. The voting was as follows:

16. Consideration of the Renaming of the Ramsay Nature Center to the Jerome Ford Nature Center.

There was considerable discussion on this item. Members of City Council, City Manager Lawson and Recreation, Parks and Cultural Activities Director Robinson participated in the discussion.

City Manager Lawson will have staff contact the National League of Cities, the State and Federal governments, and neighboring jurisdictions to see if they have a protocol or policy for naming buildings.

Councilman Speck requested staff to move on this as quickly as possible.

WHEREUPON, upon motion by Councilman Speck, seconded by Council Member Rich and carried unanimously, City Council, rather than the naming of an entire building in recognition of a long and distinguished career and particularly in response to the efforts that Buddie made for this facility, Council requested that an appropriate, well-designed commemorative plaque acknowledging and recognizing his unique contributions to that facility, be placed in the entrance area that everyone sees as they come in, and that the building continue until such time that we have a protocol for naming buildings that we are comfortable with, and that we ask the Manager not to bring these items before us as docketed items. ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Mayor Donley congratulated the City Manager on becoming a grandmother for the second time, her first grandson.

(b) Mayor Donley requested Transportation and Environmental Services Director O'Kane to brief Council on the recent power outage in Alexandria.

Mr. O'Kane gave a status report on the outage which occurred on Sunday in Alexandria and southern Arlington.

Director of Citizen Assistance Boyd spoke to a power outage at Parkfairfax from 10:00 p.m. Sunday until 1:55 a.m. Monday.

(c) Mayor Donley spoke to the success of the Community Meeting held at Landmark Mall on June 4. He thanked Councilman Speck for bringing it forward, the citizens for participating, and staff for its support. He indicated that he would like to hold these meetings at a minimum of twice a year.

Councilman Speck suggested that we have a portable timer.

Vice Mayor Pepper also noted what a success the event was.

(d) Vice Mayor Pepper indicated that Ben Brenman is progressing from by-pass surgery. He is still in the cardiac intensive care unit at Alexandria Hospital and is receiving no visitors at this time. He is holding his own and improving little by little.

(e) Councilman Speck asked staff when Council will be receiving a report on the crossing of the double yellow line on the streets of Old Town.

City Manager Lawson indicated that Council will receive a memo within the next week.

(f) Councilman Speck spoke to a recent meeting with people from Arlandria with respect to encouraging the employers at the Potomac Yards complex to hire Alexandria residents. He spoke to the classic synergy that exists between employer, education and training. He wondered, as this major retail complex is being developed, whether it would not be possible to find a way to encourage representatives from those organizations in consort with City resources, educational resources, CET resources, and other training aspects to come together and talk in an ongoing way about what they are going to be looking for and needing, making sure that we are both educating and training and vice versa, so that we really can create that linkage that could be so constructive for the community.

Members of City Council and City Manager Lawson participated in the discussion.

Councilman Euille has a meeting on this on June 26, with Ron King and Joe Pettiford.

Councilman Speck stated that part of this is to get, since we know a lot of the retailers that are going to be located there, their Human Resources people in here early starting to talk about, not right before the announcement of we are hiring, but now, what kinds of people are you going to be hiring, what kinds of skills are they going to be looking for, what can we do now to get our residents in a position where they are competitive, where they are the preferred applicants and hirees because we've really worked to get them trained and educated in the things for which they are going to be hired. This is the time to do it, now.

(g) Councilman Cleveland spoke to Joan Gaskins' Clothes Closet for mothers and people who are on Welfare and returning to work. She is in need of more space in the Potomac West area.

33. Consideration of a Resolution to Set the Annual Charge for the Residential Refuse Collection Fee. [ROLL-CALL VOTE]

WHEREAS, under section 2.06 of the city charter, City Council has the authority to establish fees to be charged for services provided by the city; and





WHEREAS, under city code section 5-1-34(a), City Council is required, from time to time, to set by resolution the annual fee that is to be paid by the owners of required user property,” as defined in section 5-1-2(12b) of the city code, for the city’s collection and disposal of solid waste, ashes and yard debris from their properties during the fiscal year; and

WHEREAS, in Resolution No. 1798, adopted June 25, 1996, City Council set the annual fee for such collection and disposal services at $158.00; and

WHEREAS, City Council has now determined that it is necessary and desirable to increase the annual fee for such collection and disposal services to $160.00;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF ALEXANDRIA, VIRGINIA:

1. That, beginning in fiscal year 1998, the annual charge for the collection and disposal of solid waste, ashes and yard debris from required user properties shall be $160.00 per household, with each single-family, two-family and row dwelling in the city, and each separate dwelling unit in a building or structure in the city that contains four or fewer dwelling units, constituting a “household.”

2. That the annual fee established by Section 1 above shall apply to collection and disposal services provided by the city during fiscal year 1998 and, unless and until revised by City Council, to such services provided during subsequent fiscal years.

3. That the annual fee for the collection and disposal of solid waste, ashes and yard debris from required user properties in fiscal year 1997 shall be $158.00 per household, and, accordingly, that the fee for the second half of fiscal year 1997 shall be $79.00.

4. That this resolution shall be effective on the date and at the time of adoption.

34. Consideration of a Resolution to the Virginia Department of Transportation for Regional Surface Transportation Program Funds for Pedestrian Improvements in the King Street Metrorail Station Area. [ROLL-CALL VOTE]

BE IT FURTHER RESOLVED that the City Council of the City of Alexandria hereby agrees to pay its share of the total costs for the pedestrian improvement project in accordance with Section 33.1-44 of the Code of Virginia, and that, if the City of Alexandria subsequently elects to cancel this project, the City of Alexandria hereby agrees to reimburse the Virginia Department of Transportation for the total amount of the costs expended by the Department through the date the Department is notified of such cancellation.

WHEREAS, the State of Virginia has joined the competition for the incentive funds and has decided to pass any incentive award on to those local governments that join with them in the “Partners in Prevention” initiative in a proportionate share equal to that jurisdiction's share of the total statewide reduction of out-of-wedlock births; and

WHEREAS, Alexandria is 12th in the State in the composite ranking of the number and percentage of out-of-wedlock births from 1991 through 1995; and

WHEREAS, Alexandria becomes a Partner in Prevention with the State by adopting a formal resolution of participation in the initiative and by submitting a plan to reduce out-of-wedlock births; and

WHEREAS, Alexandria wishes to become a Partner in Prevention with the State;

NOW, THEREFORE, BE IT RESOLVED that the City Council, on behalf of the City of Alexandria, Virginia, will become a Partner in Prevention with the Commonwealth of Virginia and hereby recommends that the Alexandria Health Department develop a public-private partnership of Alexandria organizations and citizens to educate the community about the relationship between unintended pregnancies and the health risks of infants, children and women when pregnancies are unplanned.

WHEREAS, a SHARE Federal Shelter Grant application for a grant under this program has been prepared; and

WHEREAS, Vola Lawson, City Manager, can act on behalf of the City of Alexandria and will sign all necessary documents required to complete the grant transaction; and

WHEREAS, a dollar-for-dollar match, under the SHARE Federal Shelter Grant guidelines will be provided;

RESOLUTION NO. 1833

WHEREAS, the 1996 General Assembly amended section 14.1-7 of the Code of Virginia (1950), as amended, to authorize local governing bodies to establish the basis for the reimbursement of expenses incurred by persons traveling on the locality's business, where no part of the reimbursement is made by the Commonwealth; and

WHEREAS, Virginia Code section 14.1-7 provides that the rate of reimbursement per mile for private transportation shall not exceed the standard rate deductible as a business expense pursuant to the Internal Revenue Code of 1986, as amended (“IRC”), and the regulations promulgated thereunder; and

WHEREAS, the city’s Administrative Regulation 6-17, entitled “Official Travel and Reimbursed Expenses,” effective as of February 12, 1993, sets forth the bases and rates at which persons traveling on city business will be reimbursed, and sets forth a rate of reimbursement for private transportation which does not exceed the standard rate in the IRC and its regulations;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF ALEXANDRIA, VIRGINIA:

1. That all persons traveling on city business shall be reimbursed for expenses in accordance with A.R. 6-17, including as it may hereafter be amended in a manner consistent with section 2 of this resolution.

2. That the per mile reimbursement provided by the city for private transportation shall never exceed the standard rate deductible as a business expense under the IRC and the regulations promulgated thereunder.

3. That this resolution shall be effective on the date and at the time of adoption.

38. Consideration of a Resolution Authorizing the Issuance of Alexandria Industrial Development Authority Bonds for the Association for Supervision and Curriculum Development (ASCD). [ROLL-CALL VOTE]

WHEREUPON, upon motion by Council Member Rich, seconded by Councilman Cleveland and carried on a unanimous ROLL-CALL vote, City Council adopted the resolution as recommended by the Alexandria Industrial Development Authority at its meeting and public hearing on May 13, 1997. The voting was as follows:

The resolution reads as follows:
RESOLUTION NO. 1834
WHEREAS, the Industrial Development Authority of the City of Alexandria (Authority), has considered the application of the Association for the Supervision and Curriculum Development (ASCD) requesting the issuance of the Authority's revenue bonds in an amount not to exceed $16,000,000 (Bonds). The proceeds of the Bonds will be used to assist in the financing of ASCD’s acquisition, construction, and equipping of an approximately 84,000 square foot headquarters building and an accompanying parking garage with approximately 200 parking spaces (Project) to be located at 1703 North Beauregard Street, in the City of Alexandria, Virginia; and

WHEREAS, Section 147(f) of the Internal Revenue Code of 1986, as amended (the Code), and Section 15.1-1378 of the Code of Virginia of 1950, as amended (The Virginia Code), provide that the governmental unit having jurisdiction over the user of private activity bonds and over the area in which any facility financed with the proceeds of private activity bonds is located must approve the issuance of the bonds; and

WHEREAS, the Authority issues its bonds on behalf of the City of Alexandria, Virginia (City); the Project is to be located in the City and the City Council of the City of Alexandria, Virginia (Council), constitutes the highest elected governmental unit of the City; and

WHEREAS, following the Public Hearing held by the Authority on May 13, 1997, the Authority has recommended that the Council approve the issuance of the Bonds; and

WHEREAS, a copy of the Authority's resolution approving the issuance of the Bonds, subject to the terms to be agreed upon, a certificate of the Public Hearing and a Fiscal Impact Statement have been filed with the Council;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF ALEXANDRIA, VIRGINIA:

1. That Council approve the issuance of the Bonds by the Authority in a principal amount not to exceed $16,000,000 for the benefit of ASCD, as required by Section 147(f) of the Code and Section 15.1-1378.1 of the Virginia Code, to permit the Authority to assist in the financing of the project.

2. The approval of the issuance of the Bonds does not constitute an endorsement to a prospective purchaser of the Bonds of the creditworthiness of the Project or ASCD, and as required by Section 15.1-1380 of the Virginia Code, the Bonds shall provide that neither the City nor the Authority shall be obligated to pay the Bonds or the interest thereon or other costs incident thereto except from the revenues and moneys pledged therefor, and neither the faith and credit nor taxing power of the Commonwealth of Virginia nor any political subdivision thereof, including the City and the Authority, shall be pledged thereto.

3. Pursuant to the limitations contained in Temporary Income Tax Regulations Section 5f.103-2(f)(1), this resolution shall remain in effect for a period of one year from the date of its adoption.

4. This resolution shall take effect immediately upon its adoption.

39. Consideration of the City Council Schedule.

For the Retreat, staff was requested to limit its presentations to approximately five minutes, and to have the material to City Council and the public well in advance of the Retreat.

Councilman Speck stated that he will be out of town on October 18, and Council had no problem with changing the public hearing to October 25. Councilman Speck will also be unable to attend the November 25 Legislative Meeting. Councilman Euille spoke of a function that Council may want to attend on September 9.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Council Member Walker and carried unanimously, City Council approved the Council Schedule and (1) rescheduled the Work Session with the Alexandria Commission on Employment to 6:00 p.m. before the Tuesday, September 23 Council Meeting; and (2) set the date for Council's fall Retreat on Saturday, November 1, and reserved possibly Friday night, October 31. A revised calendar will come forward June 24. The voting was as follows:
