There was a City Council Work Session with the Alexandria Commission on Employment, at 6:30 p.m., in the City Council Workroom. Mayor Donley and Councilman Euille made introductory remarks.

John L. Williams, Chair, introduced members of ACE, and gave an overview of the ACE's ordinance functions and supporting activities. Members of Council participated in the discussion.

Lindsay Hutter, Member, presented the 1996/7 Goals and Objectives of the Commission. Members of Council participated in the discussion.

City Council asked that staff provide the Commission with the Economic Watch which is provided to the City Manager's Economic Round Table. The Commission will review the information and suggest other information which may be helpful. The Commission will provide any comments on the impact of the information with respect to job efforts.


The Commission will pursue national associations as to how they might relate to Alexandria youth and their careers. It was suggested that a 501(c)(3) organization be set up for the summer jobs program. They will explore the City's role in the private sector. It was suggested that there be a liaison with the schools.

The Commission will report back at a future work session with Council.

The work session was concluded at 7:35 p.m.

New Business Item No. 1: Councilman Speck had challenged Councilman Euille at the Saturday, February 22, 1997 Public Hearing Meeting, indicating that he would raise $1000 of the $1800 the Nannie J. Lee cheerleaders still needed to fulfill their trip for competition at Myrtle Beach, if Councilman Euille would raise the $800. Councilman Speck, on behalf of the Robert S. Rixse Foundation, presented Jackie Hayes, Coach of the Nannie J. Lee Recreation Center Cheerleaders, with a check for $1,000. Councilman Euille presented a check for $800 to help with the trip.

29. Consideration of Resolution to Establish the Ad Hoc City of Alexandria 250th Anniversary Celebration Committee. [ROLL-CALL VOTE]

WHEREUPON, upon motion by Councilman Speck, seconded by Council Member Walker and carried on a unanimous ROLL-CALL vote, City Council adopted the resolution establishing a 23-member Alexandria 250th Anniversary Commission to plan commemorative activities to celebrate the 250th Anniversary of the founding of the City. The resolution reads as follows:
RESOLUTION NO. 1819

WHEREAS, the City of Alexandria will celebrate the 250th anniversary of the founding of the City in the year 1999; and

WHEREAS, 1999 is also the 200th anniversary of the death of George Washington; and

WHEREAS, the City of Alexandria was George Washington's hometown; and
WHEREAS, the City Council finds and determines that it is appropriate to establish a commission with diverse membership in order to afford all parts of the community an opportunity to plan events to celebrate these anniversaries, which events will be of interest to all citizens of the City;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF ALEXANDRIA, VIRGINIA:

Section 1. Creation, Composition and Organization

(a) There is hereby established an ad hoc commission known as the City of Alexandria 250th Anniversary Commission.

(b) The commission shall consist of 23 members to be appointed by the City Council. The composition of the commission shall be as follows:

(1) three residents of the City of Alexandria;
(2) one member designated by the Alexandria School Board;
(3) two members representing the arts, one from the fine arts and one from the performing arts;
(4) one member designated by the Historic Alexandria Resources Commission;
(5) one member designated by the Alexandria Convention and Visitors Association Board of Governors;
(6) one member designated by the Alexandria Chamber of Commerce;
(7) one member designated by the Alexandria Archaeological Commission;
(8) one member designated by the Alexandria Society for the Preservation of Black Heritage;
(9) one member designated by Bienvenidos;
(10) one member designated by the Alexandria Park and Recreation Commission;
(11) one member designated by the Alexandria Seaport Foundation;
(12) one member designated by the Alexandria Library Board;
(13) one member designated by the George Washington Birthday Celebration Committee;
(14) one member designated by the Alexandria Public Records Advisory Commission;
(15) one member designated by the Alexandria Waterfront Committee;
(16) one student member designated by the Alexandria Youth Services Commission;
(17) one member designated by the Friendship Veterans Fire Engine Association;
(18) one member designated by the American Legion;
(19) one senior citizen member; and
(20) one member from the retail business community, with background in product design and retail sales.

(c) The term of the Commission shall be one year, it being the intent of the Council to extend the term for two successive one-year periods, pursuant to Section 2-4-8(b) of the City Code.

(d) Members of the commission shall be appointed in the manner proscribed in Title 2, Chapter 4, Article A of the City Code; provided, that a member who is the representative of an organization shall be nominated by the organization and confirmed by City Council. The members appointed shall serve until the expiration of the term of the commission, including any extensions thereof; provided, that a member who is the representative of an organization shall cease to be a member at such time that such member shall cease to be a member in good standing of the organization for which such member serves as representative, and that any vacancies shall be filled for the remainder of the term of the commission, and any extensions thereof.

Section 2. Functions; Powers and Duties

(a) The functions of the commission shall be as follows:

(1) Solicit public input about the community's desires for celebrating the 250th anniversary of the founding of the City and the 200th anniversary of the death of George Washington.

(2) To plan activities, special events, re-enactments, exhibitions, lecture series, publications, musical and theatrical performances, and other celebrations to involve all community organizations and citizens in recognizing the 250th anniversary of the founding of the City, and the 200th anniversary of the death of George Washington, so that such activities can begin in January 1999.

(3) Sponsor activities and events for such celebrations.

(4) Identify non-City resources to support these activities and events.

(5) Develop public/private partnerships to increase the number of activities and events so that all citizens in all parts of the City are involved in the celebrations.

(6) Recommend for approval by City Council a logo/design to be used on commemorative items and to be used to identify all activities and events; and

(7) Assist in the development of commemorative objects for sale.

(b) The commission is empowered to adopt rules and regulations in regard to procedure and other matters so long as same are not inconsistent with the city code including, but not limited to, the establishment of committees through which it may carry on its functions and purposes.

(c) The Mayor shall appoint from among the members a convener of the commission, who shall serve as chair pro tem until such time as a commission chair, vice-chair and secretary shall be elected by the commission.



(d) The City Manager shall appoint such staff to provide administrative and logistical support to the commission as the Manager shall deem necessary and appropriate, subject to the availability of funds and staff.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Council Member Walker and carried unanimously, City Council approved the Consent Calendar as presented, with the exception of Docket Item Nos. 24 and 26, which were considered under separate motions. The City Manager's recommendations are as follows:

8. City Council received the following resignations with regret: (a) Carol Molla Van Horn from the Alexandria Commission for Women; (b) J. Lawrence Robinson from the Alexandria Convention and Visitors Association Board of Governors; (c) John E. Kloch from the Alexandria Economic Opportunities Commission; and (d) Carol Molla Van Horn from the Alexandria Human Rights Commission; and requested the Executive Secretary to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

10. City Council authorized the City Manager to: (1) submit a grant application in the amount of $5,000 to the Virginia Commission for the Arts' Local Government Challenge grant program; and (2) execute all necessary documents that may be required.

11. City Council authorized the City Manager to submit the grant application to the Institute of Museum and Library Services for $9,670 and execute all necessary documents that may be required. It was noted that there are no funds available in the City budget to continue these activities once the grant funds are expended.

12. City Council declared as vacant one of the two positions on the Environmental Policy Commission for a member from the field of environmental sciences and authorized the Executive Secretary for Boards and Commissions to advertise the vacancy.

13. City Council (1) approved the addition of representatives to the Alexandria Waterfront Committee for the Alexandria Convention and Visitors Association and the Alexandria Seaport Foundation; and (2) requested that the City Attorney prepare an amendment to the ordinance which establishes the Alexandria Waterfront Committee to increase its size from 12 representatives to 14 representatives.

14. Receipt of Staff Report on Proposal for Strict Enforcement of the City's Fair Share Policy (Revised Version of Previous Proposed Housing Moratorium). (Council Member Rich)

Council Member Rich spoke to this item. The reason for asking for a two-year period for strict enforcement of the fair share policy is to give us some time to (1) work with other jurisdictions to see if we can persuade them to do more of what they ought to be doing in the first place, and (2) to work with HUD with regard to how we distribute particularly Section 8 housing in the City which significantly impacts only a few communities. At the end of the two-year period, we would re-evaluate where we are.

Council Member Walker expressed concern of providing enough time for community input before Council makes a final decision.

Councilman Speck stressed that there be enough time for a full and detailed discussion of this item to make sure we are establishing correct policy.

Mayor Donley stated that Council try to receive the comments by the April 12 public hearing, and Council can make a determination at that time depending upon the level and volume of the testimony and comments about whether Council has received sufficient comment from the public.

Councilman Speck stated that what we know to be part of the problem doesn't have clearly defined advocacy groups. Before we adopt this policy, he wants to be sure that we have explored all of the nuances and dimensions of it.

WITHOUT OBJECTION, Eva Poling, 913 South Alfred Street, and Hollis Wickman, president, Old Town/Hunting Creek Civic Association, addressed the Council on this issue and suggested that something be done legislatively to assist the victims should this ever happen again.

Council Member Rich requested staff to work with the affected householders, the neighbors, and the civic association over the summer to come up with some specific proposals that can be in our legislative package for consideration.

Vice Mayor Pepper also suggested that they work with the City's legislative representatives.

Fire Department staff have reviewed this report and they find the State Corporation Commission (SCC) report to be consistent in all respects with the findings and conclusions of the investigation conducted by the Alexandria Fire Department. Principally, the explosion was caused by the accidental introduction of natural gas at high pressure into the house at 802 Green Street, resulting from the failure of Washington Gas Light Company to install a pressure regulator at the gas meter serving 802 Green Street. The SCC report does not recommend changes in State or local law or federal procedures at this time. The voting was as follows:

17. Consideration of Application to the U.S. Department of Justice for Funds for the COPS Universal Hiring Program.

Council Member Walker asked since it is very clear that after three years the local government will absorb the full cost of the grants program, that during this time that some kind of measurements be developed to make sure we are really doing the right thing and are headed in the right direction or if we have to add more things or go in a little bit different direction. This information would help Council to make a decision in three years.

Mayor Donley stated that if this grant application is denied, he would like to request that staff bring forward a request for additional funding for the gang-related officer to assist not only in the activities here in the City, but also to be part of the Washington Metropolitan Gang Task Force to develop the networks.

Chief Samarra will advise Council when this grant is approved or denied.

Vice Mayor Pepper stated that she would be interested in also looking at the RPO for Hampton Courts.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Council Member Walker and carried unanimously, City Council (1) authorized the City Manager to submit the grant application, which would help address several law enforcement concerns identified by City Council members over the past year. The grant would increase the authorized strength of the Police Department by 3 officers (1 school resource officer, 1 gang investigator, and 1 residential police officer to be located in The Hampton Court Apartments on North Armistead Street); and (2) designated $73,770 of FY 1997 contingent reserves for the City share of this grant in its first year. Councilman Euille directed questions to Management and Budget Director Godwin with respect to the AIDS position funded in last year's budget.

Councilman Euille announced that he has agreed to be an advisory board member to a new initiative called Northern Virginia HIV Consortium at the Northern Virginia Planning District Commission.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Cleveland and carried unanimously, City Council: (1) authorized the Alexandria Community Services Board to submit a grant application to the Center for Mental Health Services; and (2) approved exceeding the budget cap on the number of full-time grant-funded City positions.

Approval of this request (if the grant is awarded) could increase the number of grant-funded City positions by up to a maximum of 3 full-time equivalent Psychological Counselors III. These grant-funded positions would reside in the Department of Mental Health, Mental Retardation and Substance Abuse and would terminate upon the expiration of the grant. All persons who fill these positions will be notified of this condition of employment.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Council Member Walker and carried unanimously, City Council (1) approved the following adjustments to the FY 1997 Office of Housing Budget to meet the required Community Development Block Grant (CDBG) Public Service Ratio: (a) Reduced CDBG funding for the Eviction Assistance and Furniture Storage Program in the Department of Human Services (DHS) by $35,000 and returned these monies to the Office of Housing to be allocated to the Potomac West Business Assistance Loan Program on the March 11th docket; and (b) replaced the $35,000 in CDBG funding by transferring $35,000 in General Fund monies from the Office of Housing to the Department of Human Services; and (2) approved the transfer of $20,000 in FY 1997 CDBG monies from the Transitional Apartment Program to the Eviction Assistance and Furniture Storage Program in the Department of Human Services. WHEREUPON, upon motion by Council Member Walker, seconded by Councilman Speck and carried unanimously, City Council waived repayment of the following with regard to the City's loan of $1,320,000 to the Robert Pierre Johnson Housing Development Corporation for the construction of the Stevenson Court Condominium project in order to provide $29,142 toward an increased marketing budget: (1) the remaining budgeted interest, which is estimated at $4,142. The total budgeted interest on the loan is $72,600, of which City Council in October 1995, approved a waiver of up to $68,458 for additional construction expenses and a five percent contingency. (Staff expects that the maximum interest waiver will be required.); (2) $25,000 from the principal of the construction loan, reducing the amount to be repaid from $1,320,000 to $1,295,000. 23. Receipt of Federally Required Local Analysis of Impediments to Fair Housing Choice and Staff Response to Recent Testing by the Fair Housing Council of Greater Washington.

Mayor Donley requested staff to send a letter to the Fair Housing Council and the Council of Government informing them of the City's progress in this area and that the City's results are dramatically lower, indicating that we test in a variety of situations, and that we have taken steps to address those particular problems that were uncovered by our fair housing testing which have included training, counseling, etc.

Council Member Rich stated that the need to address the Section 8 concentration is critical.

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Council Member Rich announced that the City's Americorps in Alexandria, "Service to Alexandria", was interviewed by NBC News yesterday morning and were going to be on this evening's 7:00 news.

(b) Council Member Rich announced an article about a notable neighbor which appeared in The Alexandria Gazette. The notable neighbor is Eddie Silverman who is helping to organize challenger baseball in the City, which gives children with physical and mental disabilities an opportunity to play baseball.

(c) Councilman Speck requested staff to pursue why the Washington Post's Sunday TV section contains so little information about the City's listings; however, much about Arlington's; a copy of the cable listings is on file in the office of the City Clerk and Clerk of Council, marked Exhibit No. 1 of Oral (c).

(d) Councilman Speck distributed a copy of a letter that he received regarding the Woodrow Wilson Bridge; a copy of which is on file in the office of the City Clerk and Clerk of Council, marked Exhibit No. 1 of Oral (d). Staff was requested to draft a reply letter, in consultation with Councilman Speck, which could be sent by the Council. He indicated the importance of highlighting the items that Council agreed with on the bridge replacement.

(e) Councilman Cleveland spoke to the new development of Townes of Cameron Parke near the Metro yard in Eisenhower Valley. They start at $190,000.

(f) Vice Mayor Pepper spoke to the full-page ad marketing the City as a technology city which appeared in Washington Business on Monday.

(g) Vice Mayor Pepper spoke to a recent memorandum received from Ralph Thompson and Florence Price of the Ripening to Vintage Foundation requesting more City space from which the senior computer classes can be offered.



(h) Councilman Euille noted that the City's RPO program was mentioned in a recent article in the Washington Post. Alexandria has one of the best RPO programs in the nation which is highly successful and the City is getting national recognition.

(i) Mayor Donley announced that the first cut has taken place for the new Patent Trade Office. There are four sites still in the running, three of which are in Alexandria.

(j) Mayor Donley requested that Legislative Director Caton prepare a legislative initiative in coordination with the other Northern Virginia jurisdictions to require that handguns be secured and locked up by their owners.

WHEREUPON, upon motion by Councilman Speck, seconded by Councilman Cleveland and carried unanimously, at 10:10 p.m., City Council convened an executive session at this time for the purpose of: discussing appointment and assignments of specific public appointees, pursuant to Virginia Code § 2.1-344(A)(1), and consulting with legal counsel pertaining to the following litigation involving the City, pursuant to Virginia Code § 2.1-344(A)(1): Alexandria Country Club Apartments v. City Council of Alexandria, a case pending in the Circuit Court for the City of Alexandria, which involves a challenge to the real estate tax assessments of the Oakwood Apartments for tax years 1993 and 1994. The voting was as follows:

Donley "aye" Rich "aye"
Walker "aye"

THEREUPON, upon motion by Councilman Speck, seconded by Vice Mayor Pepper and carried on a vote of 6-to-0, at 10:25 p.m., City Council reconvened the meeting. The voting was as follows:

Pepper "aye" Euille out of room
Donley "aye" Rich "aye"
Walker "aye"

WHEREUPON, upon motion by Councilman Speck, seconded by Council Member Rich and carried on a vote of 6-to-0, City Council authorized the City Attorney to settle the suit identified in the motion to convene this evening's executive session in accordance with the terms and conditions recommended by the City Attorney in the executive session. The voting was as follows:

Donley "aye" Euille out of room
Walker "aye"

THEREUPON, upon motion by Councilman Speck, seconded by Council Member Rich and carried a unanimous ROLL-CALL vote, City Council adopted the resolution pertaining to the executive session. The voting was as follows:

The resolution reads as follows:
RESOLUTION NO. 1820

WHEREAS, on this 11th day of March, 1997, the Alexandria City Council did recess into executive session pursuant to a motion made and adopted in accordance with the Virginia Freedom of Information Act; and

WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by City Council that such executive session was conducted in accordance with Virginia law;

NOW, THEREFORE, BE IT RESOLVED that city council does hereby certify that, to the best of each member's knowledge, only public business matters that were identified in the motion by which the executive session was convened, and that are lawfully exempted by the Freedom of Information Act from the Act's open meeting requirements, were heard, discussed or considered by council during the executive session.
