13. Receipt of the Alexandria Commission for the Arts FY 1995-96 Annual Report.
City Council approved the Consent Calendar as presented with the exception of Item Nos. 12(f) and 13, which were considered under separate motions. The City Manager's recommendations are as follows:
11. City Council received the following resignations with regret: (a) Carol Rudolph from the Alexandria Beautification Commission; (b) Patricia L. Ortego from the Alexandria Commission on Employment; (c) Paul W. Bateman from the Alexandria Early Childhood Commission; (d) Karen Dawley Paul from the Alexandria Public Records Advisory Commission and (e) James A. Yancey from the Alexandria Traffic and Parking Board; and requested the Executive Secretary to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.
12. City Council (a) appointed Lois Kebe as a Tenant from an Affordable Housing Complex to the Alexandria Affordable Housing Advisory Committee; (b) appointed Samuel Gyulnazarian as a Citizen Member to the Alexandria-Gyumri Sister City Committee; (c) appointed David Redding, Jr. as a Member from the Field of Sanitary/Environmental Engineering to the Alexandria Environmental Policy Commission; (d) appointed Michael Jagoe as a Member Nominated by the Alexandria Jaycees to the Alexandria George Washington Birthday Celebration Committee; (e) appointed Angela Freeman as a Representative from Planning District III and Martha Feldkamp as a Representative from the Historic Alexandria Foundation to the Historic Alexandria Resources Commission; (f) WITHOUT OBJECTION, City Council deferred the appointment of a Low-Income Tenant Member to the Alexandria

Landlord-Tenant Relations Board until after Council considers the Resolution decreasing the size of the ARHA Board, with a request that staff report back with respect to the low-income representative on the Landlord-Tenant Relations Board and others, and how do you define low-income; (g) appointed John Fehrenbach as a Representative from the Alexandria Environmental Policy Commission to the Alexandria Recycling Study Subcommittee of the Waste-to-Energy Task Force; (h) appointed Ronnie Catipon as a Parent Member to the Alexandria Social Services Advisory Board; (i) appointed Rosalyn Bellis as a Citizen-at-Large to the Alexandria Task Force to Monitor the Closing of Cameron Station; and (j) appointed Sean Kelly as a Representative from the Alexandria Archaeological Commission to the Alexandria Waterfront Committee.

14. Update on the Report of the City Manager's Ad Hoc Task Force on Stalking/Domestic Violence Issues Related to the Murder of Karen Mitsoff. (#14 6/25/96)
City Council (1) received this Update to the Report of the Ad Hoc Task Force; and (2) included the report and addendum in the legislative package process.

15. Consideration of Submission of a Grant Application to The Virginia Department of Social Services (The Office of Newcomer Services) for Funding for The Refugee Resettlement Program.
City Council (1) approved the application submitted for refugee resettlement program funding; and (2) approved the continuation of one full-time grant-funded position to perform the duties required under this grant program. The grant-funded position would terminate upon the expiration of the grant, and the individual who is to fill this position would be notified of this condition of employment.

16. Receipt of Report by the Board of Zoning Appeals (BZA) Regarding Corner Lot Fences. (#17 9/24/96)
City Council received this report and sent the text amendment back to the Planning Commission to modify the proposal in accordance with direction provided by City Council as follows: (1) supported the BZA recommendation: the fence should not extend forward of the rear corner of the house; (2) supported the BZA recommendation: leave the task with the BZA to hear appeals of administrative approvals of secondary front yard fences; and (3) supported the Planning Commission recommendation: grandfather all fences built since adoption of the zoning ordinance in 1992.

17. Receipt of Report of the Task Force on Old Town Open Space.
City Council (1) received the Report and thanked the members of the Task Force for their work in addressing Old Town open space issues; and (2) referred the recommendations of the Task Force to the Planning Commission for consideration, study and recommendation to Council on any potential zoning ordinance amendments.

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL
(a) Vice Mayor Pepper spoke about the City's first annual Technology Achievement Award which is intended to recognize Alexandria businesses for the development of new technology or innovative application of existing technology. This is being sponsored by the Alexandria City Council, the Alexandria Chamber of Commerce, and the Alexandria Economic Development and Tourism Board of Directors. Nominations should be sent to F&ITS Director Gitajn, 301 King Street. The deadline for nominations is December 3, 1996. The award winning business will be honored during the City's Technology Achievement Week, beginning March 10, 1997.
(b) Councilman Euille announced that the NAACP Annual Banquet will be held on Sunday, October 20, at 7:30 p.m. at the Ramada Inn in Old Town.
(c) Councilman Euille stated that at the Retreat Council Member Walker and he had an item dealing with small business development. They met with the Small Business Development Task Force Committee which is a partnership between the City, the Chamber of Commerce and the NAACP. He stated that they received a memorandum from Emmitt Carlton, who is co-chair of the Task Force Committee, reminding the City that one of the recommendations in their report which we received in June was an emphasis for this City to consider hiring and identifying a permanent staff person to oversee small business development.
City Manager Lawson stated that there is a designated slot with the Economic Development Office for this position. It is something that we strongly support, as does the Council. She suggested that a meeting be set up with Mayor Donley, Councilman Euille, the NAACP and Mr. Flaherty to talk about these issues.
(d) Councilman Euille spoke to a special use permit application that has been filed by Alexandria Toyota.
City Council moved that the staff and Planning Commission be requested to take appropriate action, including study and recommendation of a comprehensive plan and zoning amendment, to enable the Council to vote on the special use permit application in order that Alexandria Toyota may move its dealership operation from its present location to a new location to be accessed from Route 1 near the Four Mile Run as shown on the special use permit application; and that such action, as is necessary, be brought before the City Council at its December public hearing, simultaneous with the special use permit.

(e) Mayor Donley briefed Council on the three-hour tour of the Patent and Trademark Office which he and Councilman Speck participated in today.

18. Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE to Decrease the Requirement for City Registration of Child Care Providers Who Care for a Maximum of Eight to a Maximum of Five Children in Accordance with State Law.

19. Consideration of Resolution to Reduce the Size of the Alexandria Redevelopment and Housing Authority Board of Commissioners. (Mayor Donley). [ROLL-CALL VOTE]
Councilman Euille requested staff to provide Council with more detail with regard to the makeup of boards and commissions that exceed seven members that we currently have in addition to the School Board.
City Council set this resolution for public hearing and consideration at its Saturday, October 19, 1996 Public Hearing Meeting.

20. Consideration of City Council Schedule.
City Council (1) adopted the following meeting schedule for consideration of the FY 1998 budget: (a) Tuesday, March 18, 1997, at 7:30 p.m., Special City Council Meeting, Presentation of the City Manager's proposed FY 1998 Budget; (b) Thursday, March 27, 7:00 p.m., Budget Work Session; (c) Monday, April 7, 7:00 p.m., Budget Public Hearing Meeting; (d) Wednesday, April 16, 7:00 p.m., Budget Work Session with the School Board; (e) Wednesday, April 30, 7:00 p.m., Budget Work Session; and (f) Thursday, May 1, 6:00 p.m., Budget Work Session, and 7:30 p.m., Budget Adoption, and Mayor Donley indicated that the deadline for submitting budget request memoranda to staff will be April 25, and any requests received after that date will not get a response; (2) scheduled a community meeting at George Mason Elementary School, at 7:30 p.m., on Wednesday, November 6.

26. Consideration of a Request from the Washington Metropolitan Area Transit Authority for Comments on the Future of Metrobus Service and the Proposal To Change the Metrobus Cost Allocation Formula. (Mayor Donley and Council Member Walker)
City Council authorized the Mayor to send the proposed letter to the Chairman of the Washington Metropolitan Area Transit Authority in response to the Authority's proposal to change the Metrobus allocation formula and institute a two-year stabilization period for Metrobus service.

25. Convening of an Executive Session to Consult with Legal Counsel and Receive Briefing from Staff Members and Counsel Pertaining to Potential Litigation and to Specific Legal Matters Requiring the Provision of Legal Advice by Counsel, Pursuant to Virginia Code Section 2.1-344(A)(7).
At 10:20 p.m., City Council convened an executive session for the purpose of consulting with legal counsel and receiving a briefing by staff members, consultants or attorneys, pertaining to actual or probable litigation, or pertaining to other specific legal matters requiring the provision of legal advice by counsel, pursuant to Virginia Code section 2.1-344(A)(7).
At 11:12 p.m., City Council reconvened the meeting.
