There was a City Council Work Session with the Budget and Fiscal Affairs Advisory Committee, at 6:00 p.m. in the City Council Workroom. Mayor Donley and City Manager Lawson made introductory remarks.

Reginald Foster, Chair of BFAAC, made opening remarks, and went through the 1996-1997 proposed Work Plan for the Budget and Fiscal Affairs Advisory Committee. Members of City Council, City Manager Lawson, Financial and Information Technology Services Director Gitajn and Management and Budget Director Godwin participated in the discussion.

The Meeting was called to order by Mayor Donley and the City Clerk called the Roll; all Members of City Council were present except Council Member Walker.

The Invocation was pronounced by Reverend Rosemari G. Sullivan, Director of The Church of Saint Clements.

18. Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE to Decrease the Requirement for City Registration of Child Care Providers Who Care for a Maximum of Eight to a Maximum of Five Children in Accordance with State Law.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Euille and carried on a vote of 5-to-0, City Council approved the Consent Calendar as presented with the exception of Docket Item Nos. 12(f) and 13, which were considered under separate motions. The City Manager's recommendations are as follows:

11. City Council received the following resignations with regret: (a) Carol Rudolph from the Alexandria Beautification Commission; (b) Patricia L. Ortego from the Alexandria Commission on Employment; (c) Paul W. Bateman from the Alexandria Early Childhood Commission; (d) Karen Dawley Paul from the Alexandria Public Records Advisory Commission and (e) James A. 12. 12.(f) Consideration of Uncontested Appointment to the Alexandria Landlord-Tenant Relations Board, 1 Low-Income Tenant Member.

Mayor Donley requested that this item be deferred until City Council considers Docket Item No. 19.

Councilman Speck asked questions of Executive Secretary for Boards and Commissions Boyd and Housing Director Davis, with a request that staff report back with respect to the low-income representative on the Landlord-Tenant Relations Board and others, and how do you define low-income.

WITHOUT OBJECTION, City Council deferred the appointment of a Low-Income Tenant Member to the Alexandria Landlord-Tenant Relations Board until after Council considers the Resolution decreasing the size of the ARHA Board.

13. Receipt of the Alexandria Commission for the Arts FY 1995-96 Annual Report.

15. Consideration of Submission of a Grant Application to The Virginia Department of Social Services (The Office of Newcomer Services) for Funding for The Refugee Resettlement Program.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Cleveland and carried unanimously by all those present, City Council (1) approved the application submitted for refugee resettlement program funding; and (2) approved the continuation of one full-time grant-funded position to perform the duties required under this grant program. The grant-funded position would terminate upon the expiration of the grant, and the individual who is to fill this position would be notified of this condition of employment. 16. Receipt of Report by the Board of Zoning Appeals (BZA) Regarding Corner Lot Fences. (#17 9/24/96)

WHEREUPON, a motion was made by Councilman Euille, seconded by Vice Mayor Pepper to receive this report and to send it to the Planning Commission for consideration of a text amendment.

There was discussion by the Members of City Council and the Director of Planning and Zoning with respect to Council direction on the following three items:

WITHOUT OBJECTION, City Council supported the BZA recommendation that the fence should not extend forward of the rear corner of the house. This was accepted as a friendly amendment to the main motion.

WITHOUT OBJECTION, City Council supported the BZA recommendation to leave the task with the BZA to hear appeals of administrative approvals of secondary front yard fences. This was accepted as a friendly amendment to the main motion.

It was suggested by Councilman Euille and Vice Mayor Pepper to include the Planning Commission recommendation to grandfather all fences built since adoption of the zoning ordinance in 1992.

WHEREUPON, a motion was made by Council Member Rich and seconded by Councilman Cleveland to approve the BZA recommendation to require that anyone who had put up a fence illegally be required to apply for approval to retain the fence or, if approval is not granted, to remove the fence; which motion FAILED on a vote of 2 "ayes" to 4 "nays". The voting was as follows:

Therefore, the City Council included a friendly amendment to the main motion to include the Planning Commission recommendation to grandfather all fences built since adoption of the zoning ordinance in 1992.

THEREUPON, Council returned to the main motion made by Councilman Euille, seconded by Vice Mayor Pepper and carried unanimously by all those present, City Council received this report and sent the text amendment back to the Planning Commission to modify the proposal in accordance with direction provided by City Council as follows: (1) supported the BZA recommendation: the fence should not extend forward of the rear corner of the house; (2) supported the BZA recommendation: leave the task with the BZA to hear appeals of administrative approvals of secondary front yard fences; and (3) supported the Planning Commission recommendation: grandfather all fences built since adoption of the zoning ordinance in 1992. WHEREUPON, upon motion by Councilman Speck, seconded by Councilman Cleveland and carried on a vote of 5-to-0, City Council (1) received the Report and thanked the members of the Task Force for their work in addressing Old Town open space issues; and (2) referred the recommendations of the Task Force to the Planning Commission for consideration, study and recommendation to Council on any potential zoning ordinance amendments. ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Vice Mayor Pepper spoke about the City's first annual Technology Achievement Award which is intended to recognize Alexandria businesses for the development of new technology or innovative application of existing technology. This is being sponsored by the Alexandria City Council, the Alexandria Chamber of Commerce, and the Alexandria Economic Development and Tourism Board of Directors. Nominations should be sent to F&ITS Director Gitajn, 301 King Street. The deadline for nominations is December 3, 1996. The award winning business will be honored during the City's Technology Achievement Week, beginning March 10, 1997.

(b) Councilman Euille announced that the NAACP Annual Banquet will be held on Sunday, October 20, at 7:30 p.m. at the Ramada Inn in Old Town.

(c) Councilman Euille stated that at the Retreat Council Member Walker and he had an item dealing with small business development. They met with the Small Business Development Task Force Committee which is a partnership between the City, the Chamber of Commerce and the NAACP. He stated that they received a memorandum from Emmitt Carlton, who is co-chair of the Task Force Committee, reminding the City that one of the recommendations in their report which we received in June was an emphasis for this City to consider hiring and identifying a permanent staff person to oversee small business development.

City Manager Lawson stated that there is a designated slot with the Economic Development Office for this position. It is something that we strongly support, as does the Council. She suggested that a meeting be set up with Mayor Donley, Councilman Euille, the NAACP and Mr. Flaherty to talk about these issues.

(d) Councilman Euille spoke to a special use permit application that has been filed by Alexandria Toyota. Members of City Council, Planning and Zoning Director Lynn and Assistant City Attorney Pessoa also participated in the discussion.

WHEREUPON, upon motion by Councilman Euille, seconded by Vice Mayor Pepper and carried unanimously by all those present, City Council moved that the staff and Planning Commission be requested to take appropriate action, including study and recommendation of a comprehensive plan and zoning amendment, to enable the Council to vote on the special use permit application in order that Alexandria Toyota may move its dealership operation from its present location to a new location to be accessed from Route 1 near the Four Mile Run as shown on the special use permit application; and that such action, as is necessary, be brought before the City Council at its December public hearing, simultaneous with the special use permit. 19. Consideration of Resolution to Reduce the Size of the Alexandria Redevelopment and Housing Authority Board of Commissioners. (Mayor Donley). [ROLL-CALL VOTE]

WHEREUPON, upon motion by Councilman Cleveland, seconded by Councilman Euille and carried unanimously by all those present, City Council (1) adopted the following meeting schedule for consideration of the FY 1998 budget, as amended: (a) Tuesday, March 18, 1997, at 7:30 p.m., Special City Council Meeting, Presentation of the City Manager's proposed FY 1998 Budget; (b) Thursday, March 27, 7:00 p.m., Budget Work Session; (c) Monday, April 7, 7:00 p.m., Budget Public Hearing Meeting; (d) Wednesday, April 16, 7:00 p.m., Budget Work Session with the School Board; (e) Wednesday, April 30, 7:00 p.m., Budget Work Session; and (f) Thursday, May 1, 6:00 p.m., Budget Work Session, and 7:30 p.m., Budget Adoption, and Mayor Donley indicated that the deadline for submitting budget request memoranda to staff will be April 25, and any requests received after that date will not get a response; and (2) scheduled a community meeting at George Mason Elementary School, at 7:30 p.m., on Wednesday, November 6. 26. Consideration of a Request from the Washington Metropolitan Area Transit Authority for Comments on the Future of Metrobus Service and the Proposal To Change the Metrobus Cost Allocation Formula. (Mayor Donley and Council Member Walker)

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Euille and carried unanimously by all those present, City Council authorized the Mayor to send the proposed letter to the Chairman of the Washington Metropolitan Area Transit Authority in response to the Authority's proposal to change the Metrobus allocation formula and institute a two-year stabilization period for Metrobus service. WHEREUPON, upon motion by Councilman Speck, seconded by Councilman Cleveland and carried unanimously by all those present, at 10:20 p.m., City Council convened an executive session for the purpose of consulting with legal counsel and receiving a briefing by staff members, consultants or attorneys, pertaining to actual or probable litigation, or pertaining to other specific legal matters requiring the provision of legal advice by counsel, pursuant to Virginia Code section 2.1-344(A)(7).
