OPENING

The Meeting was called to Order by Mayor Donley, and the City Clerk called the Roll; all Members of City Council were present.

The Invocation was pronounced by Reverend Stewart Perry, Pastor for Baptist Temple Church.

New Business Item No. 1: Mayor Donley recognized Waldemar Socha, President of Zory, and Katarzyna Opoka-Rynkiewicz, head of planning and architecture, who are visiting from Zory, Poland.

New Business Item No. 2: Without Objection, Councilman Speck recognized representatives from the Senior Citizens Employment and Services, and Dr. Pera presented Members of Council with a copy of The Alexandria Calendar 2000.




3. Passage on First Reading of AN ORDINANCE to amend the city code by (a) proscribing certain conduct in city parks and city park areas where prohibited by official sign, (b) authorizing the city manager to post official signs prohibiting such conduct, (c) establishing rules for the location and adequacy of such signs and (d) providing for the imposition of criminal penalties upon persons engaging in the prohibited conduct.

END OF CONSENT CALENDAR

WHEREUPON, upon motion by Vice Mayor Euille, seconded by Council Member Walker and carried unanimously, City Council approved the Consent Calendar as presented with the exception of docket item nos. 8(c) and 8(f), which were considered under separate motions:

7. City Council received the following resignations with regret: (a) Kaprice Gettemy-Chambers from the Alexandria Commission on Employment; and (b) R. Mark McLindon from the Alexandria Commission on Information Technology; and requested the Executive Secretary for Boards and Commissions to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

8. City Council (a) appointed C. Peter Schumaier as a Member nominated by the Alexandria Transit Company to the Ad Hoc Alexandria Year 2000 Census Complete Count Commission; (b) appointed M. Kathleen Connolly as a Citizen Member to the Alexandria-Gyumri Sister City Committee; (d) appointed Walter Hill as a Consumer/Family Member to the Alexandria Community Services Board; (e) appointed Sheila Street as a Representative of the Alexandria Chapter of the Northern Virginia Family Day Care Association to the Alexandria Early Childhood Commission; (g) appointed Mollie Abraham as a Representative of the Alexandria Commission for Women to the Alexandria Human Rights Commission; and (h) reappointed William Kuehnle as a Representative from the Old Town Civic Association to the Alexandria Waterfront Committee.

9. City Council authorized the City Manager to: (1) submit a grant application to the Virginia Department of Criminal Justice Services (DCJS) for funding, in the amount of $164,809, under the Comprehensive Community Corrections Act (CCCA-PSA). Due to the short turn around time provided by DCJS, the grant application was forwarded to DCJS in accordance with the October 25 deadline, contingent upon City Council's approval at its November 9 legislative session; (2) approve the creation of three full-time grant-funded positions, to deliver the services to be provided under this grant program. These grant-funded positions would terminate upon the expiration of the grant and the individuals filling these positions will be notified of this condition of employment and sign an agreement of understanding with regard to this condition; and (3) execute all documents that may be required.

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilman Cleveland noted that there will be two Civil Rights at the End of the Millennium Lectures. One will be at the Johnson Center Cinema, at the George Mason University on Thursday, November 18, at 3:30 p.m. and the topic will be African-Americans and the Story of American Freedom. The second will be held Thursday evening at 8:00 p.m. at the Harris Theater.

(b) Councilman Cleveland indicated that he was called by a reporter who told him that he had offended someone at the Retreat. He stated that if he did offend someone he apologizes.

(c) Councilman Speck noted that as a follow-up from the discussion at the Council Retreat on Saturday that staff had prepared a motion for Council consideration with respect to residential uses in Eisenhower Valley.

(d) Councilwoman Pepper announced that Veterans' Day is Thursday, November 11, and City offices and facilities will be open, but our City schools will be closed Thursday and Friday.

(e) Councilwoman Pepper reminded everyone that the Animal Welfare League of Alexandria is having its big fundraising dinner and silent auction this Saturday, November 13, at the Holiday Inn Hotel Suites on First Street.

(f) Councilwoman Pepper announced for those who were unable to attend the recent Community Conversation on Y2K that a repeat of the presentation will be shown every Saturday night at 9:00 p.m. from now until Christmas on Jones Cable.

She also noted that another Y2K event will be held on Monday, November 15 from 10:00 a.m. to Noon for seniors at the Lee Center.

(g) Council Member Rich announced that the Student Forum on Race and Culture will be held on Wednesday, November 10, from 10 a.m. to Noon, at the Episcopal High School Field House located at 3900 West Braddock Road. The public is invited and encouraged to attend.

(h) Mayor Donley took this opportunity to announce that we will, as a City, be recognizing and honoring our City Manager Vola Lawson for her 29 years of service. The City Council will host a community reception honoring Vola on Sunday, February 13, 2000, from 2:00 p.m. to 6:00 p.m. at T. C. Williams High School.

(i) Mayor Donley announced that City Manager Lawson has been selected by Washingtonian Magazine as one of the Washingtonians of the year in 1999. She will be honored at a luncheon at the Willard Hotel in January.

(j) Mayor Donley spoke to a draft letter to Governor Gilmore urging his continued support for the Healthy Families program in the City of Alexandria. He requested that a copy of the proclamation approved tonight be an addendum to this letter. He requested to include as part of the letter that the Alexandria Youth Policy Commission endorses this letter. Mayor Donley requested that a copy of the final letter be sent to members of our legislative delegation.



Vice Mayor Euille noted that Council Member Walker and Senator Ticer serve on the Alexandria Healthy Families Development Committee helping to promote the Healthy Families initiative in the City but also helping to fund-raise on its behalf. He indicated that they are in the midst of a $100,000 fundraising campaign to help subsidize the monies that the Healthy Families program has received in the past and present not only from the state but also from the City of Alexandria.

Councilman Cleveland stated that he would be glad to usher this down to Richmond to see what he can do in the social services division as well as with the Governor.

Mayor Donley suggested that Councilman Cleveland also speak with Sally Campbell to give him more information.

RESOLUTION NO. 1938

WHEREAS, the Industrial Development Authority of the City of Alexandria ("Authority"), has considered the application of the Alexandria Country Day School ("School") requesting the issuance of the Authority's revenue bonds in an amount not to exceed $5,000,000 ("Bonds") to assist the School in financing (1) renovating and upgrading the School’s existing 65,000 square foot educational facility (the “Facility”); (2) renovating the existing fourth floor of the Facility to include classroom and administration space; (3) expanding the gymnasium and athletic facilities; (4) constructing a science and technology center, including classrooms, laboratories and auditorium space; (5) related capital improvements to the Facility, all according to the School’s plan of financing; and (6) refunding the outstanding principal amount of the Authority’s $2,000,000 Educational Facilities Revenue Bonds (Alexandria Country Day School Project), Series 1992, issued August 13, 1992 to finance certain costs of purchase and renovation of the Facility ("Project") located at 2400 Russell Road, in the City of Alexandria, Virginia, and has held a public hearing on October 12, 1999;

WHEREAS, Section 147(f) of the Internal Revenue Code of 1986, as amended (the "Code"), provides that the governmental unit having jurisdiction over the issuer of private activity bonds and over the area in which any facility financed with the proceeds of private activity bonds is located must approve the issuance of the bonds;

WHEREAS, the Authority issues its bonds on behalf of the City of Alexandria, Virginia ("City"); the Project is located in the City and the City Council of the City of Alexandria, Virginia ("Council"), constitutes the highest elected governmental unit of the City;

WHEREAS, the Authority has recommended that the Council approve the issuance of the Bonds; and

WHEREAS, a copy of the Authority's resolution approving the issuance of the Bonds, subject to the terms to be agreed upon, a certificate of the public hearing and a Fiscal Impact Statement have been filed with the Council.
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF ALEXANDRIA, VIRGINIA:

1. The Council approves the issuance of the Bonds by the Authority for the benefit of the School, as required by Section 147(f) of the Code and Section l5.2-4906 of the Code of Virginia of 1950, as amended ("Virginia Code"), to permit the Authority to assist in the financing and refinancing of the Project.

2. The approval of the issuance of the Bonds does not constitute an endorsement to a prospective purchaser of the Bonds of the creditworthiness of the Project or the School.

3. Pursuant to the limitations contained in Temporary Income Tax Regulations Section 5f.103-2(f)(1), this resolution shall remain in effect for a period of one year from the date of its adoption.

4. This resolution shall take effect immediately upon its adoption.

30. Consideration of a Lease by the City of Property at Tavern Square.

WHEREUPON, upon motion by Vice Mayor Euille, seconded by Councilwoman Pepper and carried unanimously, City Council authorized the City Manager to execute, on behalf of the City, and to deliver the lease, in substantially the form presented to the Council with such changes as are approved by the City Manager and the City Attorney. The execution of these documents by the City Manager shall constitute conclusive evidence of her approval, and that of the City Attorney, of any and all changes from the documents made available to the City Council. The proposed lease is for fifteen years from March or April 2000 to March or April 2015 for the 14,143 square foot, two-story building located at 130-132 North Royal Street.
