City Council held a Work Session with the Planning Commission to discuss development along Washington Street and other planning issues.

Mayor Donley made opening remarks, and Planning Commission Chair Hurd spoke to the principal issues that should be considered regarding development along Washington Street.

Planning and Zoning Director Lynn spoke to this issue. Staff to the BAR Smith made a slide presentation of Washington Street buildings that illustrate the current guidelines.

Members of Council, Members of the Planning Commission, Planning and Zoning Director Lynn and City Manager Lawson participated in the discussion.

City Manager Lawson and Planning and Zoning Director Lynn will take a look at the Planning staff resources and report back with a recommendation with respect to the composition of a seven-member task force. The task force would review issues regarding the Washington Street design guidelines both in terms of definition and in terms of potential incentives regarding the redevelopment of some of the properties. The possible composition of the task force could include representatives of the Planning Commission, Board of Architectural Review, civic groups, landowners, real estate community, and the Chamber of Commerce.





There was discussion on transportation and land use. During the planning process of new development, there should always be representatives from both Planning and Transportation departments present. There is a need to get people out of their cars. It was noted that there is a need for pedestrian pathways at the side of every building so that people can get to a bus or transit.

The possible acquisition of available open space and the possible establishment of a task force to look at the available open space were discussed. It was noted that there is a Planning Commission subcommittee on open space which has requested the Planning staff to provide it with an inventory of all open space in the City. The Park and Recreation Commisson also has an Open Space Committee. The issue of funding was also addressed.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Council Member Walker and carried on a vote of 6-to-0, City Council approved the Consent Calendar as presented. The City Manager's recommendations are as follows:

City Council received the following resignations with regret: (a) Linda Hester from the Alexandria Social Services Advisory Board; and (b) Robert Morrison from the Alexandria Youth Policy Commission; and requested the Executive Secretary for Boards and Commissions to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

Vice Mayor Euille arrived during oral presentations.

(a) Councilman Cleveland thanked Vice Mayor Euille for the T-shirts.

(b) Councilman Cleveland requested a list of all of the organizations that might be affected by the proposed admissions tax.

(c) Councilman Cleveland noted that T.C. Williams High School and Francis Hammond Middle School ranked among the top 25 schools in Virginia showing the most improvement in the passing grades for SOLs. He congratulated those who made it possible.

(d) Council Member Walker presented the Members of Council with a ride guide which will allow them to go from their home to City Hall any morning during the week and arrive by 8:00 a.m. WMATA has a new on-line search service which allows you to type in your address and it tells you how to get to where you want to go. The address is: www.wmata.com.

Councilman Cleveland noted that his wife has used this service.

(e) Councilwoman Pepper announced a new program that's being offered in the City by the Retired Senior Volunteer Program (RSVP). The new program is called Virginia Senior Environment Corps. She spoke to the open house held today at the Masonic National Memorial. An organizational meeting will be held on October 13 at 10:00 a.m. at the Campagna Center. If you are interested in doing something with the environment, she encouraged people to call them.

(f) Mayor Donley thanked the Members of the Council, School Board Members, and all of the citizens who attended the forum which was held on Thursday, September 23, on adolescent pregnancy.

(g) Mayor Donley announced that the City is inviting nominations for its Fourth Annual Technology Achievement Award. The Alexandria Technology Achievement Week and the technology achievement award are sponsored by the City, the Chamber of Commerce and the Economic Development Partnership. It is to recognize a local business that has developed new technology or the innovative use of existing technologies. The deadline for submitting nominations is November 5. Alexandria Technology Achievement Week will be held March 13-17, 2000. (h) Vice Mayor Euille reported on the mosquito problem which he brought up last meeting. He indicated that the Health Department is still investigating and requesting some assistance from the State Health Department. They will be distributing information pamphlets. He thanked staff for responding in that regard.

(i) Vice Mayor Euille presented the Members of City Council with official T-shirts to welcome them all back to a challenging session. In addition, he expressed his thanks and appreciation to all of the Members for all that they bring to the Council and for their commitment, dedication and work on behalf of the citizens.

ORDINANCE NO. 4073

AN ORDINANCE adopting supplemental pages for the Zoning Ordinance of the City of Alexandria, Virginia, 1992, as amended, and providing for the repeal of ordinances not included therein, except those saved from repeal by this ordinance, and for other purposes.
THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:

Section 1. That the sections of the Zoning Ordinance of the City of Alexandria, Virginia, 1992, as amended ("Zoning Ordinance"), and the portions thereof, set forth in the supplemental and replacement pages for the Zoning Ordinance, each of which pages is identified in the lower left-hand corner by the notation "Supp. No. 19," are hereby adopted as and shall constitute "The Nineteenth Supplement to the Zoning Ordinance of the City of Alexandria, Virginia, 1992."

Section 2. That the sections of the Zoning Ordinance, and the portions thereof, set forth in "The Nineteenth Supplement to the Zoning Ordinance of the City of Alexandria, Virginia, 1992," shall be in force and effect on and after the effective date of this ordinance, and all ordinances amending the text of the Zoning Ordinance which were adopted between December 13, 1998, and June 12, 1999, inclusive, and which are not included in such supplement or in the Zoning Ordinance are hereby repealed, except as otherwise provided in section 3 of this ordinance.

Section 3. That the repeal provided for in section 2 of this ordinance shall not affect any offense or act committed or done, or any penalty or forfeiture incurred, or any contract established or accruing prior to the effective date of this ordinance; nor shall it affect any prosecution, suit or proceeding pending or any judgment rendered prior to said date; nor shall it affect any provision of any ordinance amending the Zoning Ordinance which was adopted between December 13, 1998, and June 12, 1999, inclusive, and which is inadvertently omitted from or erroneously incorporated into "The Nineteenth Supplement to the Zoning Ordinance of the City of Alexandria, Virginia, 1992"; nor shall it affect any ordinance adopted after June 12, 1999.

Section 4. That one complete set of pages comprising "The Nineteenth Supplement to the Zoning Ordinance of the City of Alexandria, Virginia, 1992," shall be stapled or otherwise permanently fastened together, shall be manually signed on the front sheet by the mayor and the city clerk, and shall be filed in the office of the city clerk and made available to any person desiring to inspect the same. In addition, one complete set of the pages comprising such supplement shall be properly inserted into the copy of the Zoning Ordinance of the City of Alexandria, Virginia, 1992, which bears the manual signatures of the mayor and the city clerk, and such code, as amended and supplemented, shall be kept on file in the office of the city clerk and be made available to any person desiring to inspect the same.

Section 5. That this ordinance shall become effective upon the date and at the time of its final passage.

12. Consideration of a Resolution Providing Local Governing Body Approval of ARHA Issuance of Tax-Exempt Bonds to Finance the Acquisition and Rehabilitation of Parkwood Court Apartments in Alexandria. [ROLL-CALL VOTE]

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Council Member Walker and carried on a unanimous ROLL-CALL vote, City Council: (1) adopted the resolution approving the issuance, by the Alexandria Redevelopment and Housing Authority (ARHA), of up to $11 million in tax-exempt bonds to CRS Alexandria Housing Corporation, for the acquisition and rehabilitation of Parkwood Court Apartments, a rental complex in Alexandria; and (2) authorized the Clerk of Council to complete the proposed Certificate of Resolution. The resolution reads as follows:
RESOLUTION NO. 1934

WHEREAS, CRS Alexandria Housing Corporation, a Virginia nonprofit nonstock corporation, described in Section 501(c) (3) of the Code (the "Borrower”), has requested the Alexandria Redevelopment and Housing Authority (the “Issuer”), to undertake the financing of the acquisition and rehabilitation of a 189-unit multi-family rental housing development, known as Parkwood Court Apartments located at 101 North Ripley Street, Alexandria, Virginia (the “Project”), through the issuance of its revenue bonds in an amount not to exceed $11,000,000 (the “Bonds”); and

WHEREAS, the Issuer has held a public hearing on issuance of the Bonds on August 30, 1999, in accordance with Section 15.2-4906 of the Code of Virginia of 1950, as amended (the “Virginia Code”), and in accordance with Section 147(f) of the Internal Revenue Code of 1986, as amended (the "Internal Revenue Code”); and WHEREAS, the Issuer has requested the City Council (the “City Council”) of the City of Alexandria, Virginia (the “City”), to approve the issuance of the Bonds to comply with Section 15.2-4906 of the Virginia Code and Section 147(f) of the Internal Revenue Code; and WHEREAS, a copy of the Issuer’s August 30, 1999, resolution approving the issuance of the Bonds, a fiscal impact statement and a reasonable detailed summary of the comments made at the August 30, 1999, public hearing have been presented to the City Council;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF ALEXANDRIA, VIRGINIA:

1. The City Council hereby approves the issuance of the Bonds by the Issuer for the benefit of the Borrower, to the extent required by Section 15.2-4906 of the Virginia Code and to the extent required under Section 147(f) of the Internal Revenue Code.





2. Approval of the issuance of the Bonds, as required by Section 147 (f) of the Code and Section 15.2-4906 of the Virginia Code, does not constitute an endorsement of the Bonds or the creditworthiness of the Borrower. As required by Section 15.2-4909 of the Act, the Bonds shall provide that neither the City nor the Authority shall be obligated to pay the Bonds or the interest thereon or other costs incident thereto except from the revenues and moneys pledged therefor, and neither the faith and credit nor the taxing power of the Commonwealth of Virginia, the City or the Authority shall be pledged thereto.

3. This resolution shall take effect immediately upon its adoption.

13. Consideration of a Resolution Exempting Applicants Replacing Omega Sprinkler Heads from City Building Permit Fees as Permitted by the State. [ROLL-CALL VOTE]

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Cleveland and carried on a unanimous ROLL-CALL vote, City Council: (1) rescinded Resolution No. 1881, that resolution Council adopted in 1998, to set building permit fees; and (2) adopted the resolution adopting a new building permit fee schedule. The only proposed fee change is the exemption of permit fees for the replacement of Omega sprinkler heads, as set forth in Section 4(b) of the new resolution. The voting was as follows:

RESOLUTION NO. 1935

WHEREAS, section 8-1-29(a) of The Code of the City of Alexandria, Virginia, 1981, as amended, provides that all fees for permits, inspections and certificates required by the Virginia Uniform Statewide Building Code shall be as established by resolution of the city council; and

WHEREAS, Resolution No. 1881, adopted by city council on June 24, 1998, which incorporated an attached fee schedule, is the most recent establishment of such fees by the council; and

WHEREAS, city council has determined that the fee schedule set forth in Resolution No. 1881 is in need of amendment and adjustment to eliminate the fee charged for the replacement of defective Omega sprinkler heads manufactured by the Central Sprinkler Company between 1983 and 1986;


NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF ALEXANDRIA, VIRGINIA:

1. That the fee schedule attached hereto, entitled "City of Alexandria, Virginia, Code Enforcement Bureau, Fee Schedule," dated September 28, 1999, is deemed to contain fair and appropriate fees to be paid by persons seeking various permits, inspections and certificates, and other services, from the city's Code Enforcement Bureau;

2. That said fee schedule shall be, and hereby is, approved and incorporated by reference in this resolution, and shall, until amended or rescinded, set forth the fees to be charged for various permits, inspections and certificates that are required by the Virginia Uniform Statewide Building Code and are issued by the city's Code Enforcement Bureau, as well as for other services that are performed by the bureau;

3. That Resolution No. 1881, adopted on June 24, 1998, shall be, and hereby is, rescinded; and

4. That this resolution shall be effective on the date of its adoption, and the attached fee schedule shall, from that date on, be in full force and effect.

FEE SCHEDULE

The following is a description of the fees to be charged for various permits and certificates issued by, and for various services performed by, the Alexandria Code Enforcement Bureau. No permit or certificate may be issued, nor service rendered, until the applicable fee has been paid in full. Permits remain the property of the City of Alexandria from time of issuance until time of expiration.

1. CONSTRUCTION FEES:

EXCEPTION: Minimum permit fee for non-residential tenant improvements for spaces 1500 square feet and less is $75.00 unless construction affects structural members, structural loads or arrangement of means of egress, in which case, the fee shall be calculated at $0.12 per square foot. Category to be determined by the building official.

g. BUILDING CODE MODIFICATION FEE: The fee to process an application for a modification to the Uniform Statewide Building Code shall be $100.00.






l. FEE FOR PLAN REVISIONS AND AMENDMENTS: Applicants will be charged for all plan reviews subsequent to the initial plan review due to revisions or amendments in the plan, and for all changes to approved plans. A flat rate fee of $50.00 per trade discipline (i.e., plumbing, electrical, mechanical, structural and fire protection) will be assessed for new commercial & multifamily construction plan revisions/amendments. A flat fee of $25.00 per trade discipline will be assessed for commercial alteration and single family residential plan revisions/amendments.

n. FIRE HYDRANT FLOW RATE TESTING FEE: The fee for fire hydrant flow rate testing shall be $200.00

3. ELEVATOR PERMIT AND INSPECTION FEES:

Elevator, escalator, dumbwaiter, chairlift, manlift, and moving walkway inspection and permit fees are based upon the award of annual contracts to qualified third party elevator inspection services. The fees to the consumer are calculated at one hundred per cent (100%) of the actual cost to the City of Alexandria plus five percent (5%) as administrative fees.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Vice Mayor Euille and carried unanimously, City Council: (1) received the updated Council Calendar; (2) determined to begin the public hearing on the FY 2001 Budget, which is scheduled for Monday, April 10, at 4:30 p.m.; (3) added to the Council Calendar the Commission for Women Annual Salute to Women Awards Banquet on Monday, March 20, at the Holiday Inn Hotel and Suites located at 625 First Street, with a reception at 6:30 p.m. and the dinner and awards ceremony at 7:00 p.m.; changed the October 12 legislative meeting to Wednesday, October 13, at 7:30 p.m., and rescheduled the canceled Volunteer reception to Thursday, November 18 from 6:30 p.m. to 8:30 p.m. at the Torpedo Factory.
