The City Council had a work session with representatives from INOVA Alexandria Hospital at 6:00 p.m. in the Council Workroom. The agenda was followed.

Kenneth Kozloff, Administrator, presented an overview of the 1999 INOVA Alexandria Hospital operational highlights.

Mayor Donley, Councilman Speck and Fire Chief Hawkins participated in the discussion on the issue of reroute with Mr. Kozloff.




Fire Chief Hawkins was requested to prepare a report on statistics on reroute after the hospital's new system has been in effect for approximately a month comparing activity to another similar period. In addition, Chief Hawkins indicated that he would meet with his supervisors to update them on the hospital's new approach on reroute and to see that the information gets to all of the firefighters and emergency medical technicians. Mr. Kozloff indicated that his staff would be happy to meet with Chief Hawkins and his staff with respect to reroute.

Councilwoman Pepper suggested that an Urgent Care Center be located at Landmark Mall should there be a need for the hospital to look for another site.

Vice Mayor Euille noted that the City needs to relocate and/or build a new Health Department facility. He indicated that we want to ensure ourselves that we have, through visioning, taken a really sincere look at viable options and alternatives to enhance and improve outreach and delivery of health services citywide, but particularly to those neighborhoods that have a higher need. He asked what it is that the hospital can do in terms of health and medical services to be a partner with the City and State to promote and deliver.

Mr. Kozloff indicated that the hospital has a department solely geared to community health which is under the direction of Peggy Cressey who is with the INOVA Health Systems and very interested in learning how to partner with the City.

Jerry Seager, Associate Administrator, presented the 1999 INOVA Alexandria Hospital financial highlights.

There was discussion whether the hospital was getting reimbursed by Medicare, Medicaid or other types of reimbursements for indigent patients.

City Manager Evans gave an overview of what the City is doing and its relationship with the hospital.

Vice Mayor Euille requested that the hospital look into whether or not they have space in its medical office building adjacent to the Burke Library to house a library component for the residents in the area of the former Burke Library.

END OF CONSENT CALENDAR

WHEREUPON, upon motion by Councilman Speck, seconded by Council Member Walker and carried unanimously, City Council approved the Consent Calendar as presented. The City Manager's recommendations are as follows:

5. Received, with regret, the resignation of Susan L. Dawson from the Alexandria Commission on Employment; requested the Executive Secretary for Boards and Commissions to send the appropriate letter of appreciation; and to advertise the vacancy in the usual manner.

6. City Council (a) reappointed John Corrado as a Representative from the Legal Community to the Alexandria Affordable Housing Advisory Committee; (b) appointed Michael Constandy and Susan Woods as Citizen Members to the Alexandria-Gyumri Sister City Committee; (c) reappointed Martha Feldkamp as a Citizen Member to the Alexandria Board of Review of Real Estate Assessments; and (d) reappointed Kenneth Foran as a Representative from the Alexandria Park and Recreation Commission to the Alexandria Waterfront Committee.

7. City Council authorized the City Manager to: (1) submit a grant application, in the amount of $5,000, to the Virginia Commission for the Arts' Local Government Challenge grant program; and (2) execute all necessary documents that may be required.

8. City Council expanded the Home Rehabilitation Loan Program to Citywide participation and requested staff to make the appropriate revisions to the program guidelines, including revisions that may become necessary after implementation of the expansion.

9. City Council: (1) approved the submission of the grant application to the Virginia Department of Criminal Justice Services, for funding in the amount of $109,811, for continued funding for the Sexual Assault Response and Awareness (SARA) Program; (2) approved the continuation of the grant-funded positions to carry out the activities of this grant. These positions include one full-time Social Worker I, one-half of a full-time Social Worker I, and one-half of a full-time Outreach Prevention Specialist for the Office on Women's Sexual Assault Response and Awareness (SARA) Program. These grant-funded positions would terminate upon the expiration of the grant and the individuals who fill these positions would be notified of this condition of employment at the time that they are hired. It should be noted that there are no funds available in the City budget to continue these activities once the grant funds have expired; and (3) authorized the City Manager to execute all documents that may be required.




10. City Council: (1) received the Monthly Financial Report for the period ending February 29, 2000; (2) authorized the capital project allocations and planned expenditures for the capital projects as detailed in the Capital Improvement Expenditure Summary; and (3) delegated to the City Manager, or his designee, authority to award contracts to the lowest responsible bidders for the following projects: (a) study of existing City public pool facilities including existing structures, mechanical and sanitary systems; and (b) installation of rooftop heating, ventilation and air conditioning (HVAC) units at Charles Houston Recreation Center.

11. City Council received the Annual Report from the Alexandria Park and Recreation Commission and thanked the Commission for its efforts on behalf of the City.

12. City Council requested the City Attorney to prepare the necessary ordinance to: (1) provide commission status to the Alexandria Task Force on AIDS (ATFA) establishing an Alexandria Commission on HIV/AIDS; and (2) include in the membership of the commission, in addition to the current members, representatives of the Youth Policy Commission, the Commission for Women, the Alexandria Redevelopment & Housing Authority, the Alexandria Ministerial/Interfaith Association and a Community Physician.

13. City Council introduced and passed the Ordinance on its First Reading; set it for Public Hearing on Monday, April 10, 2000, and Second Reading and Final Passage on Thursday, April 27, 2000.

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilman Speck provided Council with marketing highlights of the statistical charts for the first seven months of FY 2000 given to him by JoAnne Mitchell, Director, Alexandria Convention & Visitors Association.

(b) Councilman Cleveland stated that he had met with the Wakefield-Tarlington Civic Association. The members of the association expressed concern about the new bridge which connects from the east side of Holmes Run to the Ben Brenman Park area at Cameron Station. It should have been lined up with Jenkins Street.



Councilwoman Pepper also spoke to this item and the enormous size of the bridge. She indicated that this should have been constructed at Jenkins Street as Councilman Cleveland had pointed out. She indicated that it interrupts the bike path and it divides the tot lot which is used by the children. She stated the citizens thought that they were getting a pedestrian bridge.

Recreation, Parks and Cultural Activities Director Whitmore explained that the bridges have just gone in and there will be landscaping around them. It will be aesthetically more pleasing. The tot lot is intact. They will move the bike trail.

City Manager Sunderland stated that he and Ms. Whitmore will go to the site Wednesday to see if there is interference with the bike path and interference with the tot lot and see what we can do about that. In addition, he will take a look at the location of the bridge as well as its size. The City Manager will report back to the Council on their findings.

Mayor Donley noted that this is the first time that he and the rest of the Council had heard about this. He requested the City Manager and Ms. Whitmore to take a look at it, and more importantly, he would like some type of neighborhood dialogue so that the neighbors are able to talk with the City Manager about the issue and gain at least some insight as to our thought process in terms of how we would rectify what the final solution may be.

(c) Vice Mayor Euille reminded everyone that the last day to register to vote in the general election for the School Board and City Council is Monday, April 3.

(d) Vice Mayor Euille encouraged those who have not completed their census report form to do so by April 1, and mail them.

(e) Mayor Donley announced that on April 8, from 10 a.m. to 2 p.m., at the YMCA, SCAN is sponsoring "Healthy Kids in Alexandria Day."

ORDINANCES AND RESOLUTIONS (continued)

14. Public Hearing, Second Reading and Final Passage of AN ORDINANCE to amend the noise regulations of the city code to prohibit pile driving except between the hours of 9 a.m. to 6 p.m., Monday through Friday, and 10 a.m. to 4 p.m., Saturday. (#44 3/18/00) [ROLL-CALL VOTE]

The following persons participated in the public hearing on this item:





Scott Price, 100 East Oak Street, representing Clark Construction and the National Association of Industrial and Office Properties, spoke against the ordinance due to unintentional increased costs in Alexandria for their construction by increasing the length of all construction schedules; and

Terry F. Milstead, 5701 Silver Hill Road, Forestville, MD, representing the Washington, D.C., Regional Council of Carpenters, spoke against and stated that pile drivers prefer to work during the cooler hours during the summertime, and noted that during the winter it gets dark at 5 p.m. He stated that there is new technology available for muffling the noise.

There was considerable discussion by the Members of City Council, City Manager Sunderland, Transportation and Environmental Services Director Baier, and Acting City Attorney Pessoa.

The ordinance finally passed reads as follows:
ORDINANCE NO. 4116
AN ORDINANCE to amend and reordain subsection (b) (UNLAWFUL NOISES ENUMERATED), of Section 11-5-4 (NOISES PROHIBITED - ENUMERATION), Chapter 5 (NOISE CONTROL), Title 11 (HEALTH, ENVIRONMENTAL AND SANITARY REGULATIONS), of The Code of the City of Alexandria, Virginia, 1981, as amended, by adding thereto a new subsubsection (19) (PILE DRIVING).
THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:

Section 1. That Subsection (b) of Section 11-5-4 of The Code of the City of Alexandria, Virginia, 1981, as amended, be, and the same hereby is, amended and reordained by adding thereto a new subsubsection (19) to read as follows:

(19) Pile Driving. Notwithstanding any contrary provision of this chapter, no person shall operate, and no person shall permit the operation by any employee, independent contractor or other person of, any pile driving equipment, except between the hours of 9:00 a.m. to 6:00 p.m., Monday through Friday, and 10:00 a.m. to 4:00 p.m., Saturday. The city manager is authorized, in his discretion, to grant relief from the provisions of this section, under the procedures set forth in section 11-5-7. In deciding whether to grant such relief, the city manager shall consider (i) the location at which pile driving is proposed to be conducted, (ii) its proximity to residential areas, business districts, public parks, recreation facilities, historic areas and tourist destinations, (iii) the availability and cost of alternative methods of construction, (iv) the mitigation measures available or proposed, (v) the impact upon the construction project, and upon the public, and (vi) such additional factors as the manager determines may be relevant to avoid undue annoyance, disturbance, injury, or danger to the welfare of residents, business employees and patrons, park patrons, students, tourists and other visitors to the city. For purposes of this subsubsection, pile driving shall mean the driving of piles into the earth through the use of a gravity- or pneumatic-driven hammer or similar device or mechanism, and person shall include any state, or agency, instrumentality or contractor of a state, in addition to the meaning defined in section 11-5-2(30).

Section 2. That this ordinance shall become effective upon the date and at the time of its final passage.

20. Consideration of Convening of an Executive Session to Consult with Legal Counsel Pertaining to Pending Litigation that Involves the City of Alexandria, Pursuant to Virginia Code § 2.1-344(A)(7).

THEREUPON, upon motion by Councilman Speck, seconded by Councilman Cleveland and carried on a unanimous ROLL-CALL vote, City Council adopted the resolution pertaining to the executive session. The voting was as follows:

The resolution reads as follows:
RESOLUTION NO. 1955

WHEREAS, on this 28th day of March 2000, the Alexandria City Council did recess into executive session pursuant to a motion made and adopted in accordance with the Virginia Freedom of Information Act; and

WHEREAS, Section 2.1-344.1 of the Code of Virginia requires a certification by City Council that such executive session was conducted in accordance with Virginia law;

NOW, THEREFORE, BE IT RESOLVED that city council does hereby certify that, to the best of each member's knowledge, only public business matters that were identified in the motion by which the executive session was convened, and that are lawfully exempted by the Freedom of Information Act from the Act's open meeting requirements, were heard, discussed or considered by council during the executive session.

THERE BEING NO FURTHER BUSINESS TO BE CONSIDERED, upon motion by Councilman Speck, seconded by Councilman Cleveland and carried unanimously, at 8:37 p.m., the Regular Meeting of Tuesday, March 28, 2000, was adjourned. The voting was as follows:
