The Meeting was called to Order by Mayor Donley, and the City Clerk called the Roll; all Members of City Council were present except Councilman Speck.

City Council approved the request for $500,000 in grant funding from the Federal Highway Administration, under its Transportation and Community and System Preservation Pilot Program (TCSP), to improve the areas underneath and adjacent to the King Street and Commonwealth Avenue bridge structures that are located in the vicinity of the King Street Metro Station and Union Station.

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilwoman Pepper spoke to the recent launching of SeniorNavigator.com, a subsidiary of Virginia Health Care Foundation.

(b) Vice Mayor Cleveland thanked Superintendent Berg for his assistance in providing transportation for the approximately 500 children who attended the Friday, February 9, Salute to Earl Lloyd Day festivities. Earl Lloyd, a graduate of Parker Gray High School, was the first African American who played in the NBA. He also thanked Frank Meeks, of Domino's Pizza, for providing pizza for the event, and thanked Traverse Gray of Recreation, Parks and Cultural Activities for everything he did for this occasion.

(c) Vice Mayor Cleveland asked the City Manager the status of revising the Master Plan, and to provide Council with a timetable.

City Manager Sunderland stated that at the Retreat he had told Council that he will have a report regarding a "Plan for Planning" in early May.

(d) Councilman Euille congratulated the Mayor on being elected chair of NVTC for 2001.

Councilman Euille noted that he serves with the Mayor on NVTC. In addition, he serves on WMATA. Councilman Euille encouraged citizens to contact him with any concerns and with any ideas they may have to improve and enhance the mass transit system.

(e) Mayor Donley thanked Paul DeMaio, from T&ES, for his presentation to NVTC with respect to a "smart bike" and "smart car" program on which the City of Alexandria is working.

(f) Mayor Donley thanked the Members of Council who were able to go to Richmond to participate in VML Day.






(g) Mayor Donley reported that Vice Mayor Cleveland and he will be meeting on a fairly regular basis with the Chairman and the Vice Chairman of the Alexandria Redevelopment and Housing Authority. He requested staff to contact ARHA to try to come up with some potential dates and times to meet with them. This process is used with the School Board, and they would like to initiate the same kind of relationship with the Alexandria Redevelopment and Housing Authority.

ORDINANCES AND RESOLUTIONS (continued)

21. Consideration of Resolution from the Landlord Tenant Relations Board Regarding the Voluntary Rent Guidelines for 2001. [ROLL-CALL VOTE]

Councilman Euille asked staff to provide Council with an overview of this item.

Melodie Baron, Landlord/Tenant Relations Division Chief, provided the overview and responded to Councilwoman Woodson's questions.

Housing Director Davis also participated in the discussion.

WHEREUPON, upon motion by Councilman Euille, seconded by Vice Mayor Cleveland and carried on a ROLL-CALL vote of 6-to-0, City Council adopted the resolution to maintain the City's Voluntary Rent Guidelines at 5% where the tenant pays utilities and increase the percentage from 7.5% to 9% where the owner pays utilities, as recommended by the Landlord-Tenant Relations Board. The resolution reads as follows:
RESOLUTION NO. 1991

WHEREAS, more than half of the dwelling units in the City of Alexandria are renter-occupied; and

WHEREAS, the Alexandria City Council has continually expressed its concern for the well-being of the City's tenants and landlords through proposed charter changes, legislation, and establishment of the Landlord-Tenant Relations Board; and

WHEREAS, the Alexandria Landlord-Tenant Relations Board has previously expressed its concern to the City Council regarding excessive rent increases;

NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Alexandria, Virginia calls upon the Alexandria Landlord-Tenant Relations Board to monitor and investigate complaints of rent increases in excess of the following guidelines and to conduct a review of the guidelines every six months and forward recommendations to Council at a minimum of every 12 months:

-- If the tenants pay all utilities, not more than five percent cumulatively per year;

-- If all utilities are included in the rental amount, not more than nine percent cumulatively per year;

PROVIDED, however, that Board investigators will recognize and take into account any unusual costs, capital improvements and major repairs to the property (which should be substantiated by the owner), and extraordinary increases (more than 50%) in assessments;

PROVIDED, further, that the landlord may apportion increased real estate taxes in an equitable manner;

PROVIDED, further, that when a landlord converts utilities to a sub-metered or individually metered system, the amounts of monthly rents, plus annualized utility costs, shall remain within these guidelines.

BE IT FURTHER RESOLVED that the Landlord-Tenant Relations Board will report to City Council on the adequacy of the above guidelines in 2002.

22. Consideration of Submission of a Grant Application and Resolution to the Virginia Department of Rail and Public Transportation for FY 2002 Funding for the Continuation of the Alexandria Rideshare Program. [ROLL-CALL VOTE]

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Vice Mayor Cleveland and carried on a ROLL-CALL vote of 6-to-0, City Council adopted the resolution and authorized the City Manager to: (1) submit the grant application and the resolution to the Virginia Department of Rail and Public Transportation for funding, in the amount of $140,080, for the continuation of the City's ridesharing service, ALEXANDRIA RIDESHARE; (2) approve the continuation of two full-time grant-funded positions (Transit Specialist I and Transit Services Assistant I) to administer the ongoing ALEXANDRIA RIDESHARE program. Continuation of these positions is contingent upon continuation of funding from the Virginia Department of Rail and Public Transportation or other non-City sources; and (3) execute all necessary documents that may be required under this program. The voting was as follows:

RESOLUTION NO. 1992

BE IT RESOLVED by the City Council that the City Manager is authorized, for and on behalf of the City of Alexandria, hereafter referred to as the PUBLIC BODY, to execute and file an application to the Department of Rail and Public Transportation, Commonwealth of Virginia, hereafter referred to as the DEPARTMENT, for a grant of financial assistance in the amount of $140,080 to defray the costs borne by the PUBLIC BODY for continuation of the ALEXANDRIA RIDESHARE program and to accept from the DEPARTMENT grants in such amounts as may be awarded, and to authorize the City Manager to furnish to the DEPARTMENT such documents and other information as may be required for processing the grant request.

The City Council certifies that the funds shall be used in accordance with the requirements of Section 58.1-638.A.4 of the Code of Virginia, that the PUBLIC BODY will provide funds in the amount of $35,020, which will be used to match the state funds in the ratio as required in such Act, that the records of receipts of expenditures of funds granted the PUBLIC BODY may be subject to audit by the DEPARTMENT and by the State Auditor of Public Accounts, and that funds granted to the PUBLIC BODY for defraying the expenses of the PUBLIC BODY shall be used only for such purposes as authorized in the Code of Virginia. The undersigned duly qualified and acting as City Clerk of the PUBLIC BODY certifies that the foregoing is a true and correct copy of a Resolution, adopted at a legally convened meeting of the City Council held on the 13th day of February 2001.

Paul DeMaio, Rideshare Coordinator, provided Council with an overview of this project and responded to questions posed to him by Council Members.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilwoman Woodson and carried on a ROLL-CALL vote of 6-to-0, City Council adopted the resolution and authorized the City Manager to: (1) submit a grant application and resolution to the Virginia Department of Rail and Public Transportation for funding, in the amount of $16,500, for promotional assistance for a carsharing demonstration project; and (2) execute all necessary documents that may be required under this program. 36. Consideration of Update Report on Items Before the 2001 General Assembly Session.

Legislative Director Caton gave City Council an update of the items before the General Assembly, and responded to questions directed to him by Council.

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Councilman Euille and carried unanimously by all those present, City Council approved the following as recommended by the City Council's legislative subcommittee: (a) adopted the positions on legislation that has been introduced in the 2001 General Assembly Session as noted in attachment 1 of the memorandum dated February 12, 2001; and (2) supported legislation that would authorize a referendum for the imposition of an additional sales tax in Northern Virginia, only if the sales tax revenues would be divided equally between transportation and education. The voting was as follows:

New Business Item No. 1: City Manager Sunderland reported to City Council that the City is about to enter into a contract with the Child Welfare League of America for it to bring in a team to take a look at the Department of Human Services' performance and its conduct in the Katelyn Frazier case. This is a solid, reputable group that is coming in to conduct an evaluation and a review of documents, of actions, of judgments and of personnel over the next sixty days. He noted that they will make some findings and some recommendations. He stated that his intent is to have this group prepare a report and to make it public. The City Manager indicated that he expects them to begin work in the very short term with a report coming forward in sixty to ninety days.
