City Manager Sunderland presented his Budget Message.

11. City Council received the 2003 Annual Report of the Board of Zoning Appeals (BZA) and thanked the BZA for its efforts on behalf of the City.

12. City Council received the FY 2002-2003 Annual Report of the Consumer Affairs Commission and thanked the Commission for its efforts on behalf of the City.

13. City Council authorized the allocation of Housing Trust Fund Monies to Alexandria Christmas in April Rebuliding Together, Inc.

14. City Council authorized the City Manager to (a) submit a renewal grant application for funding to continue the Domestic Violence Intervention Project and (b) execute all necessary documents that may be required.

City Council received the report of the Legislation from the 2004 General Assembly Session from Legislative Director Caton.

26. Presentation of First Night Alexandria Annual Report for 2003.

City Engineer Baker provided an update on the Duke Street Concourse Project.

REPORTS AND RECOMMENDATIONS FROM BOARDS, COMMISSIONS AND COMMITTEES

ORAL REPORTS BY MEMBERS OF CITY COUNCIL

(a) Vice Mayor Pepper requested that Mr. Custard, Environmental Health Director and the representatives from the Virginia American Water Company report on the lead levels in Alexandria's water supply. Vice Mayor Pepper requested that the community be notified that the drinking water supply in Alexandria is safe.

Mr. Custard, Environmental Health Director, Bill Walsh, Vice President and Manager, Virginia American Water Company and Bill Henchek, Virginia American Water Company, gave a status update on the water quality in Alexandria.

(b) Vice Mayor Pepper inquired about the increase of water rates in Fairfax and how that will affect Alexandria.

In response, Mr. Walsh stated that the rates would be affected in Alexandria and he would meet with Fairfax County on the subject.

(c) Mayor Euille requested that the City Manager give a brief overview of the Second Presbyterian situation. Mayor Euille noted that there will be a work session between City Council and the Planning Commission in the near future to discuss the Second Presbyterian site.

City Manager Sunderland reported that the Planning Commission would review the subdivision and site plan in May and there would be a presentation for Council and the Planning Commission scheduled. City Manager Sunderland reported that Council would receive a report from the Open Space Steering Committee that would contain recommendations on easements and acquisitions area in May. He recommended that Council receive the Open Space Steering Committee's comprehensive report on open space before making a decision on the Second Presbyterian site.

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Vice Mayor Pepper reported that Eakin-Youngentaub started sales of the units at the former Samuel Madden Homes site and there was concern expressed for way the sales were handled. Vice Mayor Pepper stated that this activity would not be tolerated, particularly from experienced developers.

(b) Vice Mayor Pepper gave out copies of an article on emergency systems in Arlington and Blacksburg and requested a report from Mr. Penn, Director of Emergency Management.

Mr. Penn gave a brief description of the emergency notifications systems available in Alexandria.

(c) Vice Mayor Pepper saluted Paul and Cheryl Darby for their community service work in Alexandria distributing coats to children at local elementary schools.

(d) Mayor Euille congratulated Councilman Krupicka and his wife, Lisa, on the birth of their new daughter, Gillian.

(e) Councilman Macdonald reported that the St. Patrick's Day parade was a success and thanked all the City staff who helped make successful.

(f) Councilman Macdonald reported that he attended an Interstate Commission on the Potomac River Basin meeting today and discussed how Alexandria can reduce pollution that affects the Chesapeake Bay.

(g) Councilman Macdonald reported on a home visit with Healthy Families in Alexandria and stated that he wants to work more with families in Alexandria.

(h) Councilman Macdonald stated that when new buses are purchased, they are should be the cleanest and quietest buses the City can afford.

(i) Councilman Macdonald requested that staff look into the possiblity of exploring the creation of a Parks Appreciation Day.

(j) Councilman Macdonald thanked City staff for putting together a great community meeting on Second Presbyterian at Bishop Ireton High School.

(k) Councilman Smedberg reported on a survey performed by his intern, Fernando Villaroel, examining pedestrian survey and he distributed copies of the survey results to Council.

(l) Councilman Gaines stated that there was a Request for Proposal for
Neighborhoods Partnership Grants available and the deadline for submission was March 18.

Ms. Taylor, Budget Analyst, gave a brief overview of the program.

(m) Councilman Krupicka noted that there was a Martin Luther King, Jr. Memorial Quilt in the Vola Lawson Lobby created by Alexandria Volunteer Bureau Youth Program. Councilman Krupicka reported that after it is removed from City Hall, the quilt will be donated to the Black History Resource Center.

(n) Councilman Krupicka encouraged everyone to ride a DASH bus this week during its anniversary.

ORAL REPORT FROM THE CITY MANAGER

City Manager Sunderland reported that: (a) Saturday would be the first closed captioned meeting of Council on television; (b) there would a groundbreaking ceremony at Samuel Madden Homes at 10:30 a.m., March 10, 2004; (c) the Alexandria Conventions and Visitors Bureau reported that Alexandria hotels has experienced a 6% higher hotel occupancy and generated an increase of 11% in revenue per hotel room; and (d) there would be a new red light camera installed at Duke Street and West Taylor Run Parkway.

RESOLUTION NO. 2099

WHEREAS, the Alexandria City Council may initiate the amendment of the Alexandria Zoning Ordinance whenever it determines that public necessity, convenience, general welfare or good zoning practice requires an amendment; and

WHEREAS, the current provisions of the Zoning Ordinance which establish civil penalties for the violation of special use permit conditions provide an insufficient deterrent to repeat violations; and

WHEREAS, providing adequate deterrence of repeat violations of special use permit conditions represents good zoning practice that is important to the public necessity and convenience and the general welfare; and

WHEREAS, the current provisions of the Zoning Ordinance for the administrative approval of changes in the ownership of uses subject to special use permit regulation are unnecessarily restrictive; and

WHEREAS, providing procedures for the administrative approval of changes in the ownership of uses subject to special use permit regulation, which properly balance the public interest in maintaining the protections of the special use permit process, while minimizing unnecessary burdens on business subject to such regulation, represents good zoning practice that is important to the public necessity and convenience and the general welfare;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alexandria:

Section 1. That the public necessity, convenience, general welfare or good zoning practice requires consideration of a Text Amendment to increase the civil penalties for repeat violations of special use permit conditions, and to streamline the process for administrative approval of changes in ownership of uses subject to special use permit regulation.

Section 2. That the City council does hereby initiate such Text Amendment, and refer the same to the Planning Commission for public hearing and consideration in the manner provided by law.

AN ORDINANCE adopting supplemental pages for The Code of the City of Alexandria,
Virginia, 1981, as amended, and providing for the repeal of ordinances not included therein, except those saved from repeal by this ordinance, and for other purposes.
THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:


Section 1. That the sections and portions thereof set forth in the supplemental and replacement pages for The Code of the City of Alexandria, Virginia, 1981, each of which pages is identified in the lower left-hand corner by the notation "Supp. No. 72," are hereby adopted as and shall constitute "The Seventy-Second Supplement to The Code of the City of Alexandria, Virginia, 1981."

Section 2. That the sections and portions thereof set forth in "The Seventy-Second Supplement to The Code of the City of Alexandria, Virginia, 1981" shall be in force and effect on and after the effective date of this ordinance, and all ordinances of a general and permanent nature which were adopted between June 15, 2003, through September 13, 2003, inclusive, and which are not included in such supplement or in The Code of the City of Alexandria, Virginia, 1981, as amended, are hereby repealed, except as otherwise provided in section 3 of this ordinance.

Section 3. That the repeal provided for in section 2 of this ordinance shall not affect any offense or act committed or done, or any penalty or forfeiture incurred, or any contract established or accruing prior to the effective date of this ordinance; nor shall it affect any prosecution, suit or proceeding pending or any judgment rendered prior to said date; nor shall it affect any ordinance adopted after June 15, 2003, which amends the Zoning Ordinance of the City of Alexandria, Virginia, 1992, as amended; nor shall it affect any ordinance saved from repeal by Ordinance No. 1250; nor shall it affect any ordinance listed in appendices A through J, both inclusive, of The Code of the City of Alexandria, Virginia, 1981, or any pages supplemental to such appendices; nor shall it affect any provision of any ordinance adopted between June 15, 2003, through September 13, 2003, inclusive, and which is inadvertently omitted from or erroneously incorporated into "The Seventy-Second Supplement to The Code of the City of Alexandria, Virginia, 1981," or any other supplement to the code; nor shall it affect any ordinance adopted after the effective date of this ordinance.

Section 4. That one complete set of pages comprising "The Seventy-Second Supplement to The Code of the City of Alexandria, Virginia, 1981," shall be stapled or otherwise permanently fastened together, shall be manually signed on the front sheet by the mayor and the city clerk, and shall be filed in the office of the city clerk and made available to any person desiring to inspect the same. In addition, one complete set of the supplemental and replacement pages of such supplement shall be properly inserted into the copy of The Code of the City of Alexandria, Virginia, 1981, which bears the manual signatures of the mayor and the city clerk, and such code, as amended and supplemented, shall be kept on file in the office of the city clerk and be made available to any person desiring to inspect the same.

Section 5. This ordinance shall become effective upon the date and at the time of its final passage.

31. Consideration of City Council Schedule.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Gaines and carried unanimously, City Council adopted the schedule of Council's regular City Council meetings for March 2004 through June 2004, with the following additions and changes: reschedule the March 23 work session with the Public Health Advisory Commission (staff will update Council); schedule a work session on taxicab matters at 5:30 p.m. before the March 23 Tuesday legislative meeting; received the revised calendar which includes the next work session on Council's draft Vision and Strategic Plan on Saturday, March 20 from noon to 5:00 p.m. in the Fire Training Rooms 2 and 3 at Lee Center, 1108 Jefferson Street; a breakfast meeting with representatives of INOVA Alexandria Hospital on Friday, April 23 at 8:00 a.m. in the Hospital Board Room; and the City's Bike to Work Day on Friday, May 7, from 6:45 a.m. to 9:00 a.m. at Market Square.
