END OF CONSENT CALENDAR

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Gaines and carried unanimously, City Council approved the Consent Calendar, with the exception of docket items #14, #19, #20 and #21, and considered them under separate motions. The City Manager's recommendations were as follows:

9. City Council accepted the following resignations with regret: (a) Sara C. Donahue, Alexandria Commission for Women; (b) Laurie J. MacNamara, Alexandria Commission on Information Technology; and (c) Adam R. Pearlman, Alexandria Consumer Affairs Commission.

10. City Council made the following appointments: (a) appointed Linda Greenway and Craig Romm as the two citizen members to the Alexandria-Caen Exchange Committee; (b) appointed Brian Ekeland as the representative of the Alexandria Business Community to the Alexandria Citizen Corps Council; (c) waived the residency requirement and appointed Arline Ostolaza as the representative of older persons to the Alexandria Commission on Aging; (d) appointed Lynda Noggle as the citizen-at-large and waived the residency requirement and appointed Amy Bell as the representative from such organizations as employment agencies, organized labor, rehabilitation agencies, community-based organizations, economic development agencies and the public employment service to the Alexandria Commission on Employment; (e) appointed George Hagen as the member representing the Alexandria School Board to the Alexandria Commission on Information Technology; (f) appointed Merry Dawson Bown as the representative of the Alexandria Commission on Aging to the Alexandria Commission on Persons with Disabilities; (g) appointed Cecil Powell as the member-at-large to the Alexandria Early Childhood Commission; (h) reappointed Susanne Carnell and Maria Wasowski as the two members representing the Potomac East Area (Northeast and Inner City) to the Alexandria Potomac Yard Design Advisory Committee; (i) appointed Andrew Jennison as the citizen member to the Alexandria Public Records Advisory Commission; (j) appointed Dana Clark as the parent member to the Alexandria Social Services Advisory Commission; and (k) appointed Curtis Wagner, Jr. as the representative from the Alexandria Seaport Foundation to the Alexandria Waterfront Committee.

11. City Council approved the submission of the grant application totaling $5,000 to the Warren E. Isman Education Grant to send five Hazmat Specialists to an educational conference and authorized the City Manager to execute all the necessary documents that may be required.

12. City Council approved the submission of an electronic grant application totaling $11,400 to the Virginia Office of Emergency Services to purchase advanced life support (ALS) training mannequins for the Fire Department and authorized the City Manager to execute all the necessary documents that may be required.

13. City Council approved the receipt of $154,135 in Federal Early Head Start dollars which the Department of Human Services will use to make payments to family child care providers on behalf of the Campagna Center Early Head Start program.

15. City Council (1) approved the submission of the grant application to the Department of Social Services (DSS) for funding in the amount of $22,500 that would result in funding for a part-time position for the Office on Women; (2) approved the aquisition of one part-time Outreach and Prevention Specialist for the Office on Women. This grant-funded position would terminate upon the expiration of the grant and the individual who fills this position would be notified of this condition of employment at the time that they are hired, and would sign an agreement of understanding with regard to this condition; and (3) authorized the City Manager to execute all documents that may be required.

16. City Council scheduled the public hearing on the site selection recommendation for the new Alexandria Police facility for Saturday, October 15, 2005 and docketed action of the site selection for its October 25 legislative meeting.

17. City Council (1) approved the submitted grant application to the Virginia Department of Criminal Justice Service (DCJS) for funding in the amount of $41,070 for continued funding for the Office on Women's Hispanic Outreach Services Project; (2) approved the continuation of one full-time Hispanic Outreach Specialist position; and (3) authorized the City Manager to execute all documents that may be required.

18. City Council passed the ordinance on first reading and scheduled it for public hearing, second reading and final passage on October 15, 2005.

14. Consideration of Proposed Change in the Route of the 2005 Scottish Christmas Walk Parade.

WHEREUPON, upon motion by Councilwoman Macdonald, seconded by Vice Mayor Pepper and carried unanimously, City Council approved the changes in the 2005 parade route for the Annual Scottish Walk Parade scheduled for December 3, 2005. The Campagna Center, the City's Special Events Committee and the King Street Metro Enterprise Team (KSMET), which after their merger with the Old Town Business Association now represents Old Town businesses, all support this recommendation. The Traffic and Parking Board unanimously approved the changes in the parade route at its meeting on September 26, 2005. The voting was as follows:

26. Report on the Alexandria Community Partnership Fund For Human Services and Coordination With the Children's Fund and the Youth Fund and Recommended Community Partnership Fund Priorities for FY 2007.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Smedberg and carried unanimously, City Council received the report on the Community Partnership Fund (CPF) and staff's coordination of the CPF with the Children's Fund and the Youth Fund and docketed for public hearing and final action the FY 2007 priorities for the Community Partnership Fund, including the community input on priorities received this summer on October 15, 2005. 27. Consideration of Proposed Uses and Allocation Process for Dedicated Affordable Housing Revenues.

City Council deferred action on this docket item and requested staff seek further advice from the Affordable Housing Advisory Committee. City Council also requested that a work session be set with the Affordable Housing Advisory Committee in the near future.

REPORTS AND RECOMMENDATIONS FROM BOARDS, COMMISSIONS AND COMMITTEES

ORAL REPORTS BY MEMBERS OF CITY COUNCIL

(a) Vice Mayor Pepper gave an update on the ongoing Mirant situation and she reported that the City has filed suit against Mirant, seeking an injunction requiring Mirant to cease operations. Vice Mayor Pepper noted that Mirant has requested permission from the Federal Aviation Administration to increase the height of the stacks at the plant.

(b) Councilman Smedberg also gave an update on the Mirant situation and requested an update from staff on the modeling and how the State and the Environmental Protection Agency would reconcile the model Mirant used to resume operations. Councilman Smedberg requested information on the Trona system Mirant is investigating for use and how it might potentially be as harmful as current operations at the Mirant plant.

(c) Councilman Gaines stated that he serves as the Mayor's representative to the King Street Gardens Park Foundation and requested that Mr. Jinks, Assistant City Manager, provide information in the near future about a $15,000 proffer from an upcoming development in the area and how the Foundation could possibly access the monies.

(d) Councilman Gaines reported that the Upper King Street Task Force was concerned about traffic and specifically pedestrian safety on Duke Street and Diagonal Road and had discussed how to get pedestrians to utilize the tunnel.

(e) Councilman Krupicka reported that he attended the Local Emergency Planning Commission meeting and he complimented the Health Department on the guide it complied on emergency preparedness and requested that staff make the guides available to the public.

(f) Councilman Krupicka reported that CONAADA has finished its helicopter studies report for the region and he will share that information with anyone interested.

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilwoman Woodson reported that the National Association for the Advancement of Colored People (NAACP) will be hosting its awards dinner on October 22, 2005 at 6:30 p.m. at the Mark Center Hilton.

(b) Councilwoman Woodson requested an update on the Winkler Properties and the upcoming sale of the properties and the affect this may have on affordable housing stock in Alexandria.

(c) Councilwoman Woodson noted her concern about the increase in the energy prices and how citizens will be affected this winter. Councilwoman Woodson requested that staff compile ideas for energy savings and make the information available to citizens.

(d) Vice Mayor Pepper reported that the Alexandria Historical Resources Commission and the Historic Alexandria Foundation held an informative work session on the maintenance of the historic properties in the City.

(e) Mayor Euille, Mr. Jinks, Assistant City Manager and Ms. Davis, Director, Office of Housing, gave an update on the upcoming sale of Winkler Properties and how it will affect the housing stock in the City.

(f) Councilman Gaines requested an update on the house at 325 Duke Street.

(g) Councilman Gaines requested a status update on how the Health Department plans to handle the upcoming flu season and distribution of shots.

(h) Councilman Gaines reported that he and others members of Council attended the Alexandria Redevelopment and Housing Authority construction training graduation, which had ten participants. Councilman Gaines commended the graduates and the sponsors of the program on a job well done.

(i) Councilman Macdonald reported on the work session on historic properties in Alexandria and the need to preserve those properties and assess the financial value of preserving the buildings.

(j) Councilman Macdonald noted that the monthly crime report published by the Police Department is informative and he pointed out that there appears to be a rise in certain crimes in the City, particularly robberies, aggravated assault and burgularies. Councilman Macdonald requested information on strategies that are used to reduce some of these crimes. Councilman Macdonald noted that the crime report highlighted some of the troubled traffic intersections in the City and he hoped that the City would be working to reduce the danger at those intersections.

(k) Councilman Krupicka reported that Art on the Avenue was successful and enjoyable for all who attended this year.

(l) Councilman Krupicka reported that the Del Ray's Halloween parade will be held on October 30 at 1:30 p.m. Councilman Krupicka reported that costumes will be collected for underprivileged children at various businesses on Mount Vernon Avenue.

(m) Councilman Krupicka reported on the historic properties work session and he noted that the session was proactive and thought-provoking.

(n) Councilman Krupicka reported that JobLink is in the process of creating a program for auto mechanics training in the City.

ORAL REPORT FROM THE CITY MANAGER

City Manager Hartmann reported that on Thursday, October 20, 2005, there will be a community workshop in the Atrium of the Patent and Trade Office at 600 Dulaney Street focusing on community planning and community involvement featuring Ed McMahon, Senior Resident Fellow at the Urban Land Institute and national authority on sustainable development, land conservation and urban design.

City Manager Hartmann reported that next month there will be another presentation on Walkable Communities with Dan Burton at the same location.

28. Introduction and First Reading. Consideration. Passage on First and Second Reading of an Ordinance to Adopt Supplement Number 76 of the City Code.[ROLL-CALL VOTE]

ORDINANCE NO. 4422

AN ORDINANCE adopting supplemental pages for The Code of the City of Alexandria, Virginia, 1981, as amended, and providing for the repeal of ordinances not included therein, except those saved from repeal by this ordinance, and for other purposes.
THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:

Section 1. That the sections and portions thereof set forth in the supplemental and replacement pages for The Code of the City of Alexandria, Virginia, 1981, each of which pages is identified in the lower left-hand corner by the notation "Supp. No. 76," are hereby adopted as and shall constitute "The Seventy-Sixth Supplement to The Code of the City of Alexandria, Virginia, 1981."

Section 2. That the sections and portions thereof set forth in "The Seventy-Sixth Supplement to The Code of the City of Alexandria, Virginia, 1981" shall be in force and effect on and after the effective date of this ordinance, and all ordinances of a general and permanent nature which were adopted between January 25, 2005, through May 14, 2005, inclusive, and which are not included in such supplement or in The Code of the City of Alexandria, Virginia, 1981, as amended, are hereby repealed, except as otherwise provided in section 3 of this ordinance.

Section 3. That the repeal provided for in section 2 of this ordinance shall not affect any offense or act committed or done, or any penalty or forfeiture incurred, or any contract established or accruing prior to the effective date of this ordinance; nor shall it affect any prosecution, suit or proceeding pending or any judgment rendered prior to said date; nor shall it affect any ordinance adopted after January 25, 2005, which amends the Zoning Ordinance of the City of Alexandria, Virginia, 1992, as amended; nor shall it affect any ordinance saved from repeal by Ordinance No. 1250; nor shall it affect any ordinance listed in appendices A through J, both inclusive, of The Code of the City of Alexandria, Virginia, 1981, or any pages supplemental to such appendices; nor shall it affect any provision of any ordinance adopted between January 25, 2005, through May 14, 2005, inclusive, and which is inadvertently omitted from or erroneously incorporated into "The Seventy-Sixth Supplement to The Code of the City of Alexandria, Virginia, 1981," or any other supplement to the code; nor shall it affect any ordinance adopted after the effective date of this ordinance.

Section 4. That one complete set of pages comprising "The Seventy-Sixth Supplement to The Code of the City of Alexandria, Virginia, 1981," shall be stapled or otherwise permanently fastened together, shall be manually signed on the front sheet by the mayor and the city clerk, and shall be filed in the office of the city clerk and made available to any person desiring to inspect the same. In addition, one complete set of the supplemental and replacement pages of such supplement shall be properly inserted into the copy of The Code of the City of Alexandria, Virginia, 1981, which bears the manual signatures of the mayor and the city clerk, and such code, as amended and supplemented, shall be kept on file in the office of the city clerk and be made available to any person desiring to inspect the same.

Section 5. This ordinance shall become effective upon the date and at the time of its final passage.

29. Consideration of City Council Schedule.

WHEREUPON, upon motion by Councilman Krupicka, seconded by Vice Mayor Pepper and carried unanimously, City Council adopted the City Council Schedule for the months of October 2005 through June 2006, with the following additions and changes: schedule a work session with the Board of the Alexandria Convention and Visitors Association (ACVA) on Monday, November 7 at 7:00 p.m., in the Council work room and received the revised calendar which includes: the 12th Annual Homeownership Fair at 9:30 a.m. on Saturday, April 8 at George Washington Middle School, 1005 Mount Vernon Avenue. City Council also removed the reopening celebration for the apothecary museum, which will be rescheduled for a later date. The voting was as follows:
