END OF CONSENT CALENDAR

WHEREUPON, upon motion by Councilman Krupicka, seconded by Vice Mayor Pepper and carried unanimously, City Council approved the Consent Calendar, with the exception of item 11(e) and considered it under separate motion. The City Manager's recommendations were as follows:

10. City Council accepted the following resignations with regret: (a) William Dickinson, Alexandria Citizen Corps Council; (b) Oliver Boehm and Patrick Traylor, Alexandria Environmental Policy Commission; and (c) Philip C. Brooks, Alexandria Historical Restoration and Preservation Commission.

11. City Council made the following appointments: (a) waived the residency requirement and appointed Robert Breiner as the representative of a health care provider to the Alexandria Commission on Aging; (b) appointed Louise Harrison as the citizen member who must have a disability to the Alexandria Commission on Persons with Disabilities; (c) reappointed Francis Hoang as the citizen member to the Alexandria Emergency Medical Services Council; (d) reappointed Paul Wilson as the business representative designated by the Alexandria Chamber of Commerce to the Historic Alexandria Resources Commission; and (f) appointed Robert Wavra as the citizen member to the Alexandria Social Services Advisory Board.

12. City Council authorized the City Manager to: (1) submit the grant application to the Virginia Department of Social Services for funding, in the amount of $168,907 for Fiscal Year 2007; (2) approved the continued funding for the existing grant-funded, full-time Social Worker I position (1.00 FTE); approved the continued funding for the existing grant-funded full-time Outreach/Prevention Specialist position (1.00 FTE); approved the continued funding for the existing part-time Social Worker I position (.75 FTE City/.25 grant) which was increased to full-time with grant funds; and approved continued funding for the part-time (.75 FTE) Volunteer Developer. It should be noted that there are no monies available in the City budget to continue these activities once the grant funds are expended. These grant-funded positions would terminate upon the expiration of the grant and the individuals who fill these position would be notified of this condition of employment; and (3) execute all documents that may be required.

13. Council approve the following FY 2006 transfers of Community Development Block Grant (CDBG) monies: from Fair Housing Testing to Applications for Federal Programs - $5,293 and from Program Administration to Applications for Federal Programs - $3,807 for a total of $9,100.

14. City Council: (1) approved the grant submission and, if awarded, accept up to $300,000 in Substance Abuse and Mental Health Services Administration (SAMHSA) funds per year for three years, beginning in FY2007; (2) approved the hiring of 3.0 FTE staff, including one Therapist Supervisor and two Therapist IIs; and (3) authorized the City Manager to execute all documents that may be required.

15. City Council authorized the City Manager to: (1) submit the grant application to the United States Department of Agriculture for continued funding and an estimated reimbursement amount of $112,000 for program expenses; and (2) execute all necessary documents that may be required.

16. City Council passed the ordinance on first reading and scheduled it for public hearing, second reading and final passage on April 22, 2006.

REPORTS AND RECOMMENDATIONS OF THE CITY MANAGER FOR DISCUSSION

22. Consideration of a Request to Hold a Race in Honor of Kelley Swanson in the Del Ray Area on Saturday, June 3.

WHEREUPON, upon motion by Councilman Krupicka, seconded by Vice Mayor Pepper and carried unanimously, City Council permitted an exception to the Major Events Policy to allow the Kelley Cares 5K Run/Walk scheduled for June 3, 2006, sponsored by the Kelley Cares Committee. The Rosemont Citizens Association, the Del Ray Citizens Association and the Potomac West Business Association support this recommendation. In addition, over 200 signatures have been collected in support of the event in the Del Ray area. The voting was as follows:

23. Consideration of Funding Application for the Acquisition of Arbelo Apartments by RPJ Housing Development Corporation.

WHEREUPON, upon motion by Councilman Krupicka, seconded by Vice Mayor Pepper and carried unanimously, City Council approved a loan of $3.5 million (the total purchase price is $6 million) to RPJ Housing Development Corporation for the acquisition of the 34-unit Arbelo Apartments, as follows:

1) The loan will be funded with previously authorized City general obligation bonds (with debt service to be paid from the Affordable Housing Initiatives account).

2) The loan would be authorized to be financed from the expected proceeds of the planned June 2006 City general obligation bond sale, with the City making a general cash advance prior to the bond sale.

3) The loan will be an interest only loan at 2 percent interest, with the interest (and, when possible, principal) to be repaid on a residual receipts basis, beginning not later than fifteen years after permanent financing has closed.

4) The property shall remain affordable to households at 60% of median income for the length of RPJ's ownership, but in no event less than 20 years, or until the City's loan is repaid. It is understood that RPJ's goal is to achieve 100% affordability over time, through attrition.

5) In the event RPJ elects to sell the property, RPJ shall offer the right of first refusal to the City, or its designee.

REPORTS AND RECOMMENDATIONS FROM BOARDS, COMMISSIONS AND COMMITTEES

ORAL REPORTS BY MEMBERS OF CITY COUNCIL

(a) Vice Mayor Pepper reported that she and Councilman Smedberg co-chair the Mirant Community Monitoring Group and the Group passed a resolution at their last meeting concerning the operations at the Mirant Plant and the introduction of Trona. Vice Mayor Pepper noted that the Group received a report that did not answer the questions about the use of Trona on public health and on April 3, 2006, the Mirant Community Monitoring Group passed a resolution urging the City Council to oppose Trona use at Mirant until valid health studies showing no adverse health affects from Trona were completed. Vice Mayor Pepper also reported that the Mirant Community Monitoring Group requested that the Mayor send a letter to the Governor concerning the matter at the Mirant Plant.

(b) Councilman Smedberg noted that Trona was an experimental chemical and the use of the chemical is also experimental. Councilman Smedberg stated that Trona has a greater impact on particulate matter 2.5 pollution.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Smedberg and carried unanimously, City Council approved the resolution from the Mirant Community Monitoring Group and requested that the Mayor forward the resolution to the Governor with a cover letter. The voting was as follows:

(c) Councilman Smedberg stated that Elizabeth Chimento received information that the letter of petition submitted to the Federal Aviation Administration (FAA) by Ms. Chimento and Poul Hertel was not accepted for administrative reasons.

Ms. Chimento explained the rejection of the petition and participated in a discussion with City Council about the petition process.

City Attorney Pessoa noted that the FAA had timely received the City's letter of petition with the indication to grant reconsideration was discretionary. Mr. Pessoa would follow up with outside counsel and the FAA expert.

(d) Councilman Krupicka stated the Committee on Noise and Aviation for Dulles and Reagan National Airports (CONANDA) Committee, which he chairs, would be endorsing a letter asking the FAA to review the issues of aircraft safety grounds relating to general aviation and helicopter traffic. Councilman Krupicka noted that CONANADA believes the stack height change at Mirant might impede the ability for general aviation to fly around Reagan National Airport.

(e) Mayor Euille reported that he has raised the issue of safety around Mirant with the General Manager of the Washington Airport Authority at a recent meeting and sought the support of the Authority and other elected officials in fighting the FAA.

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Vice Mayor Pepper introduced Elizabeth Lamb, an eighth grade student at St. Stephens/St. Agnes Middle School, attending the meeting to satisfy leadership requirements for Cadet Scouts.

(b) Mayor Euille thanked Councilman Gaines and Councilman Krupicka for the successful Gang Prevention Summit sponsored by the City.

(c) Mayor Euille reported that the 6th Annual Youth Summit on Race and Cultural Diversity was well attended by over 250 students.

(d) Mayor Euille reported that the Inner City Walking Tour was held last Saturday, April 1 and gave Council and staff a chance to observe and interact with the community and hear about the things that needed improvement. Mayor Euille noted that there were plans to hold future Walking tours in Arlandria and/or the West End in the fall.

(e) Mayor Euille thanked Director of Housing Davis and the Housing staff for having a successful Homeownership Fair for the community.

(f) Mayor Euille reported that the American Basketball Association (ABA) was interested in identifying a venue in the City for playing games. Mayor Euille referred the discussion to Mr. Chesley, Deputy Director, Parks, Recreation and Cultural Activities, for an explanation and an update of the negotiations with the ABA.

Mr. Chesley gave a brief presentation on the ABA proposal to hold games at George Washington Middle School next season and responded to questions and concerns from members of Council.

(g) Councilman Smedberg requested a response from Transportation and Environmental Services (T&ES) about the numerous complaints from residences about the noise from the Woodrow Wilson Bridge construction.

Director of Transportation and Environmental Services Baier and Woodrow Wilson Bridge Environmental Manager Mike Baker gave a brief update on the construction at the Woodrow Wilson Bridge and how the noise in the future would be managed. Mr. Baker noted that the Woodrow Wilson Bridge Project plans to have all night demolition work of the Old Route 1 ramp on Thursday, April 13 and Friday, Saturday and Sunday April 21 -23 and there would be 5,000 flyers distributed to area residents to explain the work and to advise the residents about the necessity of working at night. Mr. Baier and Mr. Baker responded to questions and concerns from Council.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Smedberg and carried unanimously by roll-call vote, City Council approved the ordinance to adopt Supplement Number 79 of the City Code. The voting was as follows:

ORDINANCE NO. 4439

AN ORDINANCE adopting supplemental pages for The Code of the City of Alexandria, Virginia, 1981, as amended, and providing for the repeal of ordinances not included therein, except those saved from repeal by this ordinance, and for other purposes.

THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:

Section 1. That the sections and portions thereof set forth in the supplemental and replacement pages for The Code of the City of Alexandria, Virginia, 1981, each of which pages is identified in the lower left-hand corner by the notation "Supp. No. 79," are hereby adopted as and shall constitute "The Seventy-Ninth Supplement to The Code of the City of Alexandria, Virginia, 1981."

Section 2. That the sections and portions thereof set forth in "The Seventy-Ninth Supplement to The Code of the City of Alexandria, Virginia, 1981" shall be in force and effect on and after the effective date of this ordinance, and all ordinances of a general and permanent nature which were adopted between November 12, 2005 through January 21, 2006, inclusive, and which are not included in such supplement or in The Code of the City of Alexandria, Virginia, 1981, as amended, are hereby repealed, except as otherwise provided in section 3 of this ordinance.

Section 3. That the repeal provided for in section 2 of this ordinance shall not affect any offense or act committed or done, or any penalty or forfeiture incurred, or any contract established or accruing prior to the effective date of this ordinance; nor shall it affect any prosecution, suit or proceeding pending or any judgment rendered prior to said date; nor shall it affect any ordinance adopted after November 12, 2005, which amends the Zoning Ordinance of the City of Alexandria, Virginia, 1992, as amended; nor shall it affect any ordinance saved from repeal by Ordinance No. 1250; nor shall it affect any ordinance listed in appendices A through J, both inclusive, of The Code of the City of Alexandria, Virginia, 1981, or any pages supplemental to such appendices; nor shall it affect any provision of any ordinance adopted between November 12, 2005 through January 21, 2006, inclusive, and which is inadvertently omitted from or erroneously incorporated into "The Seventy-Ninth Supplement to The Code of the City of Alexandria, Virginia, 1981," or any other supplement to the code; nor shall it affect any ordinance adopted after the effective date of this ordinance.

Section 4. That one complete set of pages comprising "The Seventy-Ninth Supplement to The Code of the City of Alexandria, Virginia, 1981," shall be stapled or otherwise permanently fastened together, shall be manually signed on the front sheet by the mayor and the city clerk, and shall be filed in the office of the city clerk and made available to any person desiring to inspect the same. In addition, one complete set of the supplemental and replacement pages of such supplement shall be properly inserted into the copy of The Code of the City of Alexandria, Virginia, 1981, which bears the manual signatures of the mayor and the city clerk, and such code, as amended and supplemented, shall be kept on file in the office of the city clerk and be made available to any person desiring to inspect the same.

Section 5. This ordinance shall become effective upon the date and at the time of its final passage.

25. Consideration of City Council Schedule.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Gaines and carried unanimously, City Council received the revised calendar which includes the following additions: an open house for the Department of Human Services' new Child Assessment and Treatment Center for Health (CATCH) on Thursday, April 27, from 3:00 to 6:00 p.m. at 4480 King Street (the Health Department building), and the 8th Annual Bike to Work Day on Friday, May 19 at Market Square.

The reception sponsored by the Youth Policy Commission to honor youth as part of the annual National Youth Service Day observance will not be held before Council's legislative meeting on Tuesday, April 25 as planned. (The reception has been rescheduled for Thursday, May 18 at 6 p.m. in the Vola Lawson Lobby of City Hall.) The voting was as follows:
