END OF CONSENT CALENDAR

WHEREUPON, upon motion by Councilwoman Woodson, seconded by Vice Mayor Pepper and carried unanimously, City Council approved the Consent Calendar, with the exception of items 13, 15, and 16, which were considered under separate motions. The City Manager's recommendations were as follows:

9. City Council accepted the following resignation with regret: (a) Michael J. Carrasco, Alexandria Community Services Board.

10. City Council made the following appointments: (a) waived the residency requirement and appointed Karyn Miller as the citizen member to the Alexandria-Gyumri Sister City Committee; (b) reappointed Lisa Burnard as the citizen member who is 60 years of age or older and waived the residency requirement and appointed Eileen Longstreet as the individual with leadership experience in a volunteer organization to the Alexandria Commission on Aging; (c) appointed Michael Carrasco and Tanishia Williams-Minor as the two citizen members to the Alexandria Commission on Persons with Disabilities; (d) appointed Cecelia Godfrey as the representative designated by State Senator Patricia S. Ticer to the Alexandria Economic Opportunities Commission; (e) waived the residency requirement and appointed Robert Younes as the health professional member to the Alexandria Public Health Advisory Commission; and (f) appointed Kevin Posey and reappointed Amy Slack and Patrick Warren, Sr. as the three members from the Alexandria Traffic and Parking Board to the Alexandria Transportation Safety Commission.

11. City Council authorized the City Manager to: (1) submit a renewal grant application to the Virginia Department of Environmental Quality for FY 2007 pass-through funding from EPA, in the amount up to $43,730, for the City of Alexandria Air Pollution Control Program; and (2) execute all necessary documents that may be required.

12. City Council approved and authorized the City Manager to execute the three-year and nine-month agreement (April 1, 2006 through December 21, 2009) with L.A. Yachts, Incorporated, allowing it to berth the Potomac Bellein commercial dock space at the City Marina.

14. City Council approved the application for the renewal of the $50,690 Justice Assistance Grant (JAG) grant.

WHEREUPON, upon motion by Councilman Smedberg, seconded by Councilman Macdonald and carried unanimously, City Council: (1) approved the One-Year Action Plan for the Housing and Community Development for FY 2007, which includes the City's application for Federal Fiscal Year 2007 funding for $1,284,295 in Community Development Block Grant (CDBG) monies and $824,947 in Home Investment Partnership Program (HOME) monies; and (2) authorized the City Manager to execute all necessary documents. 30. Consideration of Proposed Revisions to Working Draft of Commonwealth of Virginia FY 2007-2012 6-year Improvement Program For Highways, Rail and Public Transportation.

WHEREUPON, upon motion by Councilman Macdonald, seconded by Councilman Gaines and carried 4-3, City Council approved the letter to the Commonwealth Transportation Board (CTB) requesting certain revisions in the Draft FY 2007-2012 Six-Year Improvement Program (SYIP). The voting was as follows:

ORAL REPORTS BY MEMBERS OF CITY COUNCIL

(a) Vice Mayor Pepper stated that the Commission on Information Technology received a briefing from Deputy City Manager Jinks and Director of Citizen Assistance Boyd about some enacted State legislation and some pending Federal legislation concerning the telecommunications industry. Vice Mayor Pepper reported that the telecommunications tax laws will be revised and customers will be required to pay a 5% communications sales tax, noting that the revenues from the new tax will go to the State ceding some local control. Vice Mayor Pepper also reported cable television franchises may be offered without negotiating a cable television franchise if there is infrastructure available. Vice Mayor Pepper noted that the City may have to assume responsibility for the Public Educational and Governmental channels and total compensation for the use of rights-of-way cannot exceed 5% of the gross revenues. Vice Mayor Pepper stated that Congress is working on legislation that will give the authority to grant franchises to telecommunication companies to the Federal government, removing the control from local government.

(b) Councilman Smedberg stated that at the Northern Virginia Transportation Committee meeting there was a presentation by the interim director of METRO on transportation and mass transit.

(c) Councilman Smedberg requested an update on Mirant and an update on judicial action surrounding that issue.

City Attorney Pessoa updated Council on recent developments with Mirant and plant operations, particularly the plant in Alexandria and stated that the City will oppose the decree agreement in its present form. City Attorney Pessoa reported that the nuisance suit is on track and proceeding with the discovery phase. Council participated in the discussion and asked questions.

(d) Mayor Euille reported that he and Vice Mayor Pepper attended a meeting on the status of the Woodrow Wilson Bridge and went on a boat tour. Mayor Euille noted that the project was on budget and on schedule. Mayor Euille reported that there would be a dedication and opening ceremony on May 18; the bridge will be open to traffic on June 9; and then around July 14 demolition will begin on the Old Woodrow Wilson Bridge. Mayor Euille requested that representatives from the Woodrow Wilson Bridge project be invited to the next legislative meeting to give an update and status report.

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilwoman Woodson announced that the City of Alexandria was featured in the Northern Virginia Magazine.

(b) Councilwoman Woodson reported that she attended a Housing Conference and she noted that she had many ideas that she has shared with staff about how to improve housing in Alexandria. Councilwoman Woodson stated that she hoped these ideas would be discussed at the upcoming Housing conference. Councilwoman Woodson stated that the National League of Cities (NLC) President, Jim Hunt, requested that participating communities pass an inclusionary communities resolution supporting affordable housing. Councilwoman Woodson also encouraged other members to get involved in NLC because the organization lobbies Congress on behalf of communities.

(c) Councilwoman Woodson requested that the City support and pass a resolution on the atrocities in Darfur and send the resolution to the City's Congressional delegation.

(d) Mayor Euille announced that the City of Alexandria was selected as a "Hot City" by Ink Magazine.

(e) Mayor Euille announced that the City of Alexandria has been awarded the Tree City USA distinction for 2005.

(f) Mayor Euille announced that the City of Alexandria has received recognition as being an Arts destination for mid-size cities, ranked no. 12.

(g) Councilman Krupicka requested that Director of Recreation, Parks and Cultural Activities Kincannon update Council on parks in the community and the toys located in the parks.

Director Kincannon stated that there was a meeting with the community about posting signs in the parks concerning the toys and staff was trying to find a medium that works for the community and the citizens. Director Kincannon noted that the primary issue is safety and staff was diligently working on coming to a satisfactory resolution.

(h) Councilman Krupicka requested a memo on the oil spill at Hoofs Run Park and the communication surrounding the incident.

Director Kincannon gave a brief overview of the incident and noted that he would work with the Civic Association to resolve the issue.

(i) Councilman Smedberg stated that the bridge in Windmill Hill Park needed some repairs.

(j) Mayor Euille recognized Deputy Director of Recreation Roger Blakely for all the hard work put into cleaning up Ben Brenman Lake near Cameron Station.

(k) Councilman Krupicka requested that a do not deliver list be established to stop delivery of free newspapers to the citizens who wished to stop delivery.

City Attorney Pessoa stated that he would draft a memorandum for Council to review about the establishment of the do not deliver list. Director Boyd stated that the Washington Examiner will fine the distribution contractor $100 per time they do not honor requests to deliver.
