OPENING

1. Calling the Roll.

The meeting was called to order by Mayor Euille, and the City Clerk called the Roll; all the Members of City Council were present, except Vice Mayor Macdonald and Councilman Smedberg, who were absent with excused absences.

2. Public Discussion Period.

(a) Bert Ely, 200 S. Pitt Street, gave a status update on the relocation of the George Mason Post Office branch and noted how slowly the postal service is moving on the relocation, noting the public hearing it held last May in which they said they would be issuing an RFP for new space in August, and that has not yet been issued. Mr. Ely said the lease expires in just four and a half months on March 31 and he was concerned that the Post Office would not be relocated by then and it would be detrimental to the central Old Town area if they lost that station. He encouraged Council to follow it more closely.

Mayor Euille noted that docket item #14 had been deferred at the request of the appellant.

(b) Charles M. Howe, 914 Juniper Place, said in the Beatley Library, there are two spaces that are cement block columns and he said it doesn't belong and asked if something more is going to be done to it. Mr. Howe said when he was putting up and taking down signs, he was in condo canyon--the area of Holmes Run Parkway, Van Dorn Street and Duke Street, by North Paxton Street, and on the left is officially a park - Cloud's Mill Race, which is a grist mill, which came into existence in 1813, and on the plaque on the property, it says that the community around the mill race was known as Triadelphia, so he suggested that the City officially designate that condo canyon "Triadelphia."

(c) Pat Troy, 310 Wolfe Street, resident, businessman and on the Board of the Alexandria Convention and Visitors Association, but not speaking on their behalf, asked Council to give a little bit of free parking at Christmas to welcome visitors and shoppers into the City, Friday and Saturday, for eight days. He asked Council to do something to welcome visitors for the holiday season into the City.

Mayor Euille said they would take the request into consideration.

The following participated in the public hearing on this item:

(a) Ellen Dagne, 1405 Roundhouse Lane, #302, representing the Old Town Village Condominium Association Board of Directors, said the board received notice of the special use permit on November 16 and it was brought to their attention at the annual meeting, where they do not conduct any new business so they were not able to have a discussion of the special use permit. She said they would like the opportunity to articulate their position to Council, however, they are not ready to do it at this time and she asked that the item be delayed for some period of time.

In response to a request from Mayor Euille, Acting Director of Planning and Zoning Josephson explained the process for notifying residents of the special use permit and noted that the Old Town Village Condominium Association was notified in October of this application, along with the posted signs, and notification in the newspaper. He noted that they also attempted to notify the association of the request.

Mayor Euille noted that proper and required legal notification did occur.

Mayor Euille asked that a representative from the Church appear and asked if what impacts by Council closing the public hearing today and acting November 28 and not acting today would have on the center.

Bill Porter, Chief Administrative Officer of Shiloh Baptist Church, said they have a series of activities, inspections and corrective actions that have been scheduled that are dependent upon Council acting on the special use permit today. If this is delayed, all those actions are delayed and the ability to get the Agape Christian Academy in the facility will be delayed.

Mr. Josephson said it would cause a delay in their being able to proceed and staff has been working with them for the past couple of months to resolve getting them from their temporary location to the permanent location. Mr. Josephson said staff did contact and speak directly to the president of the Old Town Village Condo Association in October.

WHEREUPON, upon motion by Councilman Gaines, seconded by Councilman Krupicka and carried unanimously, City Council closed the public hearing. The voting was as follows:

A MOTION WAS MADE by Councilman Gaines, seconded by Councilman Krupicka, for approval of the Planning Commission recommendation.

Mr. Hunt, Urban Planner, Planning and Zoning, in response to a question from Councilman Krupicka about the traffic concerns, noted the drop off and pick up locations and the available parking and said the cars should move pretty smoothly.

Mayor Euille asked Ms. Dagne if she had any alarming issues from the Association that she wanted to bring forward.

Ms. Dagne, speaking again, noted the concerns with the traffic at Duke Street, West Street and Jamieson Avenue and said it is a nightmare and extremely dangerous. She said the Association cannot get in and out of their community and to add on top of that potentially 120 families coming into the church, she asked where the cars will go. She noted the issue of noise control and pollution.

In response to a question from Councilman Krupicka, Mr. Josephson said they did speak with the applicant on the arrangement of the pick up and drop off and staff felt the plan was sufficient.

Mayor Euille said there are some traffic management solutions that can be resolved between staff, the church, school and the community and he requested that it be taken into consideration.

Councilman Krupicka said he was going to ask that they add Mayor Euille's last comment as a formal direction to staff as part of the motion, but it looks like it is on the list.

Councilwoman Pepper spoke about needing to have a condition about monitoring the coming and going of the children and noted that there is a one year review of this application.

REPORTS AND RECOMMENDATIONS OF THE CITY MANAGER

12. Public Hearing to Consider the City's Legislative Package for the 2007 General Assembly Session. (Adoption is scheduled for November 28, 2006.) (#14, 10/24/06)

The following persons participated in the public hearing on this item:

(a) John Ates, 2702 Central Avenue, member of the Human Rights Commission, said they asked two years ago for the Registrar of Voters to provide information on the e-slate voting mechanism to ensure fairness, accessibility, accuracy, and public integrity in the process. He said the Commission has adopted a resolution that is enclosed in the legislative package that Council support the on-going efforts at the State level.

(b) Andrew Rivera, 205 Clifford Avenue, spoke about requiring a paper trail for the recording of electronic voting systems and spoke about decreasing barriers to voting and reinfranching felons and formal offenders to ensure that local boards of elections work toward enfranchising voters in the registration process, and at the end of the day, they want to be able to make sure all the votes are counted. He said a recorded paper ballot alongside the electronic voting equipment should be explored as an option. He said the General Assembly and the Council can do something to show voters confidence in Alexandria.

(c) Chet Avery, 16 E. Linden Street, speaking as a member of the Human Rights Commission, from the Alexandria Commission on Persons with Disabilities, said the Commission became involved in the selection of this technology around 2002 and they selected several machines and hundreds of people tried out the machine and Council purchased the machines. He said there have been nine voting activities from 2004 to the present and there have been no problems. He said the paper trail incurs other problems and if it wants to go in that direction, then a consideration is that paper trail has to be accessible to persons with disabilities. He said the system the City purchased is a very effective system and it secures the voting rights of people in Alexandria.

(d) Lois Kelso Hunt, 310 Park Road, speaking on behalf of the League of Women Voters, said the Board wished to support: 1A, preservation of structures in historic districts, 1G, monitoring and enforcement for opacity violations with respect to air emissions, 2A, statewide transportation funding, including Metro and VRE and related issues, 2B, homestead exemptions, 2C, funding to clean up the Chesapeake Bay, 2D, smoking in restaurants, 2G, child day care funding, 2I, red light cameras, 2J, electric utility deregulation, 2K, increasing the minimum wage - the Virginia Fair Wage Act, 2L, the Virginia Housing Trust Fund, 2O, increased state funding for court system employees, 2P, payments to foster care parents, and 2S, housing discrimination based on source of income, and they agreed with the staff positions on ones to be proposed.
