END OF CONSENT CALENDAR

WHEREUPON, upon motion by Councilwoman Hughes, seconded by Councilwoman Pepper and carried unanimously, City Council approved the consent calendar, with the exception of docket item #11, which was considered under a separate motion. The City Manager's recommendations were as follows:

6. City Council made the following appointments to boards and commissions: (a) appointed Eric Crusius as the attorney representative to the Alexandria Alcohol Safety Action Policy Program; (b) reappointed Jennifer Mitchell as the citizen member who shall be a resident of the City possessing qualifications in land-use, transportation and/or municipal finance, who shall reside east of Quaker Lane to the Alexandria Transportation Commission; (c) reappointed Mary Jane Nugent as the member from the Friends of Alexandria Archaeology to the Archaeological Commission; (d) appointed Theresa del Ninno as the architect member to the Board of Architectural Review - Parker-Gray District; (e) appointed Crystal Davis as the citizen member to the Citizen Corps Council; (f) appointed Frances Burke as the member at large from Planning District II to the Historic Alexandria Resources Commission; and (g) appointed Michael Crawford as the citizen member who shall be a health professional and at the time of appointment derive, or within the previous five years derived their principal income from providing health care, health services or health related activities to the Public Health Advisory Commission.

7. City Council: (1) authorized the submission of a grant application, not to exceed $25,000; and (2) authorized the City Manager to execute all necessary documents that may be required.

8. City Council authorized the City Manager to: (1) submit the grant application to the Allstate Foundation in the amount of $20,000 (due July 29, 2011); and (2) execute all documents that may be required.

9. City Council: (1) approved the submission of a grant application (due June 7, 2011) for an allocation of funds from Virginia Department of Emergency Management (VDEM) totaling $30,000; and (2) authorized the City Manager to execute the necessary documents that may be required.

10. City Council introduced the ordinance, passed it on first reading and scheduled it for public hearing, second reading and final passage on Saturday, May 14, 2011.

In response to questions from Council, Deputy City Manager Jinks stated that there were no special services districts in the City currently and there was no precedent for this matter. Deputy City Manager Jinks noted that the project's financing structure was established before the tax district was contemplated and the rate was known.

Councilwoman Hughes requested that the City Attorney explore other options that would not violate the City's policies.

Finance Director Triggs gave a presentation of the monthly financial report and responded to questions from Council.

16. Consideration of the One-Year Action Plan for Housing and Community Development for FY 2012.

WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilwoman Hughes and carried unanimously, City Council: (1) approved the One-Year Action Plan for Housing and Community Development for FY 2012, which includes the City's application for Federal Fiscal Year 2011 funding for an estimated $1,142,496 in Community Development Block Grant (CDBG) monies and $815,164 in Home Investment Partnership Program (HOME) monies; (2) approved changes to the CDBG and HOME budgets as referenced in Attachment 2; (3) approved the transfer of $330,000 in HOME Program Income from the Affordable Housing Development and Preservation Assistance program (HOME Housing Opportunities Fund) ARHA loan repayment to the Homeownership Assistance Program; and (4) authorized the City Manager to make adjustments to the Action Plan and grant application based on actual grant amounts, and to execute all necessary documents. 17. Receipt of the City’s Proposed Energy and Climate Change Action Plan for 2012-2020 and Setting the Plan for Public Hearing and Consideration.

Transportation and Environmental Services Deputy Director Skrabak gave a presentation on the Energy and Climate Change Action Plan for 2012-2020 and responded to questions from Council about the Plan and some of the initiatives that the City is taking to make Alexandria environmentally efficient.

WHEREUPON, upon motion by Councilman Krupicka, seconded by Councilwoman Pepper and carried unanimously, City Council: (1) received the proposed Energy and Climate Change Action Plan 2012-2020; and (2) scheduled the plan for public hearing on Saturday, May 14, and for final consideration on Tuesday, May 24. 18. Consideration of a Programming Change in Funding Allocated Through the Energy Efficiency and Conservation Block Grant to Support Two Residential Energy Efficiency Initiatives.

Mr. Cochran, Division Chief, Office of Housing, gave a brief overview of the reallocation and he, along with Director of Housing Davis, responded to questions from Council about the status of the Arlandria-Chirilagua Housing Cooperative and the awarding of the reallocated funds to Rebuilding Together Alexandria.

WHEREUPON, upon motion by Councilman Krupicka, seconded by Councilwoman Pepper and carried unanimously, City Council: (1) approved a reallocation of $108,000 in Federal Energy Efficiency and Conservation Block Grant (EECBG) grant funding for an energy efficiency revolving loan fund to serve moderate income Alexandria homeowners; (2) approved a reallocation of $100,000 in Federal EECBG grant funding to Rebuilding Together Alexandria subject to staff returning with a list of candidate projects to perform residential energy efficiency upgrades and consumer education; and (3) authorized the City Manager to execute all necessary documents associated with these activities. ORAL REPORTS BY MEMBERS OF CITY COUNCIL

(a) Vice Mayor Donley congratulated all the organizations involved in a successful Spring For Alexandria community service event this past weekend. Vice Mayor Donley thanked ACT for Alexandria, Volunteer Alexandria, the Alexandria Jaycees and the Alexandria City Government for all their work planning the events of the weekend.

(b) Councilman Smedberg reported that Northern Virginia Transportation Commission's (NVTC) discussions concerning Metro governance is progressing and drafts should be coming forward soon for consideration.

(c) Councilman Smedberg reported that NVTC would be sending a letter/resolution to the Federal government opposing the extensive review that the I-395 ramp near the BRAC-133 project would now have to undergo. Councilman Smedberg noted that he abstained from the vote on the resolution.

(d) Councilman Fannon recognized the recent naming of the Detention Center after the late Deputy Truesdale. Councilman Fannon noted that Sheriff Lawhorne swore in Deputy Truesdale's son as a new deputy sheriff at the occasion. Councilman Fannon also noted that it was National Police Week and welcomed the participants to the area. Councilman Fannon reported that there was a ceremony honoring all the fallen law enforcement officers on Monday at Waterfront Park.

(e) Councilwoman Hughes congratulated everyone for their hard work and participation in Spring For Alexandria and noted that Alexandria in Bloom participants have been hard at work to beautify the City by planting flowers throughout the community.

(f) Councilwoman Hughes reported that Ron Rust would be retiring from the Alexandria Boys and Girls Club after 30 years of service and she requested that he be recognized with a proclamation.

Principal Parking Planner Wilkinson gave a presentation of the proposed parking district for the area impacted by the BRAC-133 facility and she, along with Transportation and Environmental Services Director Baier and Deputy Director Lerner, answered questions about establishing the district and the rules of enforcement for the area.

20. Consideration of a Resolution Recommending that the City Post Signage Recommending that Individuals Refrain from Smoking in City Parks and Bus Shelters.

City Council deferred this item to the Tuesday, May 24 legislative meeting.

21. Consideration of a Resolution Authorizing Application for Revenue Sharing Program Funding From the Virginia Department of Transportation for the Reconstruction of Edsall Road.

WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilwoman Hughes and carried unanimously by roll-call vote, City Council: (1) adopted the resolution to apply for a FY 2011 Revenue Sharing Program funding allocation of $530,000 from the Virginia Department of Transportation for the continued planned reconstruction of Edsall Road; and (2) authorized the City Manager to submit this resolution and enter into any agreements with the State that may be required to receive these funds should the requested allocation be approved. WHEREAS, the City Council of the City of Alexandria desires to submit an application for an allocation of funds of $530,000 through the Virginia Department of Transportation Fiscal Year 2011-12 Revenue Sharing Program; and

WHEREAS, $530,000 of these funds are requested to fund the continued reconstruction of Edsall Road from the western City limits eastward;

NOW, THEREFORE, BE IT RESOLVED THAT, the City Council of the City of Alexandria, hereby supports this application for an allocation of $530,000 through the Virginia Department of Transportation Revenue Sharing Program.

BE IT FURTHER RESOLVED THAT, the City Council of the City of Alexandria hereby grants authority for the City Manager to execute project administration agreements for any approved revenue sharing projects.

22. Consideration of a Resolution to Amend the City of Alexandria Firefighters and Police Officers Pension Plan, the Pension Plan for Firefighters and Police Officers (the Old Plan), the Retirement Income Plan for Deputy Sheriffs, Emergency Rescue Technicians, and Fire Marshals, and the Supplemental Retirement Plan.

WHEREUPON, upon motion by Councilman Smedberg, seconded by Councilwoman Pepper and carried unanimously by roll-call vote, City Council adopted the resolution that includes adoption of seven amendments to four City retirement plans. The voting was as follows:

WHEREAS, the City of Alexandria maintains the “City of Alexandria Firefighters and Police Officers Pension Plan” (the “Fire and Police Plan”); the “City of Alexandria Pension Plan for Firefighters and Police Officers” (the “Old Plan”); the “City of Alexandria Retirement Income Plan for Deputy Sheriffs, Emergency Rescue Technicians, and Fire Marshals” (the “RIP DS Plan”); and the “City of Alexandria Supplemental Retirement Plan” (the “Supplemental Plan”);

WHEREAS, the City of Alexandria desires to adopt and incorporate certain amendments to the above plans as set forth in the attached hereto; and

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ALEXANDRIA, VIRGINIA THAT the Alexandria City Council does hereby recognize, adopt, amend, and approve the Fire and Police Plan, the Old Plan, the RIP DS Plan, and the Supplemental Plan to incorporate the amendments attached hereto and incorporated fully herein by reference; and

BE IT FURTHER RESOLVED THAT this Resolution shall be effective immediately; provided however, that the amendments hereby approved shall be effective as stated in each plan.

23. Consideration of City Council Schedule.

Councilman Smedberg noted that he would be out of town on June 29.

WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilman Krupicka and carried unanimously, City Council: (1) held the evening of Wednesday, June 29 as a carryover from the Tuesday, June 28 legislative meeting if Council needs additional time to complete consideration of the June 28 docket; and (2) noted the following additions to the Council calendar since the April 26 legislative meeting: the annual Emergency Medical Services (EMS) Breakfast hosted by INOVA Alexandria Hospital on Thursday, May 19 at 9 a.m., at the atrium in the hospital; and the annual Bike to Work Day event on Friday, May 20 from 6:30 a.m. to 8:30 a.m., in Market Square. EXECUTIVE SESSION

24. Consideration of Convening a Closed Meeting for the Purpose of Consulting with Legal Counsel Regarding Potential and Pending Litigation and to Discuss Potential Land Acquisition and Disposition.

WHEREUPON, upon motion by Councilwoman Hughes, seconded by Councilman Smedberg and carried unanimously, City Council convened in closed executive session at 9:17 p.m., pursuant to Section 2.2-3711(A)(3) and (7) of the Code of Virginia, for the purpose of discussion and consideration for the acquisition of real property for a public purpose or disposition of publicly held real property in consultation with counsel and briefing by staff pertaining to actual or probable litigation where such consultation in open meeting would adversely affect the negotiating or litigating posture of the public body and for consultation regarding specific legal matters requiring the provision of legal advice. The voting was as follows:

WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the city council that such executive session was conducted in accordance with Virginia law;

NOW, THEREFORE, BE IT RESOLVED, that the city council does hereby certify that, to the best of each member's knowledge, only public business matters that were identified in the motion by which the executive session was convened, and that are lawfully exempted by the Freedom of Information Act from the Act's open meeting requirements, were heard, discussed or considered by council during the executive session.
