9. City Council received the following resignations with regret: (a) Susan B. Crim from the Alexandria Commission for Women; (b) Henry C. 11. City Council received the report of the Public Records Advisory Commission and thanked the Commission for its efforts on behalf of the City.

12. City Council (1) approved the lease of the District Home to a new non-profit entity called Birmingham Green Adult Care Residence; (2) authorized the City Manager to execute all necessary documents pertaining to the lease; and (3) authorized the City's member of the District Home Board to sign initial incorporation papers for the Birmingham Green Adult Care Residence.

13. City Council authorized the City Manager to: (1) submit the grant application to the Virginia Department of Juvenile Justice for FY 1999 funding in the amount of $73,781 for the continuation of services under the Delinquency Prevention and Youth Development Act; (2) approve the continuation of two full-time positions, a Youth Services Program Specialist and a Secretary I, to administer the grant-funded activities should the grant funding be continued. These grant-funded positions would terminate upon the expiration of the grant, and the individuals in these positions have been notified of this condition of employment. It was noted that there are no funds available in the City budget to continue these activities once the grant funds are expended; and (3) execute all documents that may be required.

14. Consideration of Amending the Moderate Income Homeownership Program (MIHP) to Provide a New Homeownership Initiative for Alexandria Law Enforcement Personnel. (Councilman Speck)

City Council (1) approved the establishment of a new component within the existing Moderate Income Homeownership Program (MIHP) operated by the Alexandria Office of Housing with the following provisions: (a) the maximum homeownership assistance loan will be $25,000 (as opposed to $15,000 in the regular MIHP program) to be used for downpayment and/or closing cost assistance for homes purchased in the police-designated target areas; (b) eligible applicants must be City of Alexandria Police Officers or Deputy Sheriffs; (c) purchasers will be required to adhere to all of the sales prices, income, and other requirements of the MIHP program, except that applicants who do not meet VHDA's definition of first-time homebuyers may participate in the program if they secure a non-VHDA first trust mortgage; and (2) allocated $150,000 in Housing Trust Fund monies to be added to the approved FY1999 budget for the existing Moderate Income Homeownership Program to fund this new program for Alexandria Police Officers and Deputy Sheriffs.

15. Consideration of the Alexandria Community Services Board's Plan of Services to Provide Additional State Funded Community Services to Persons with Mental Illness Returning from State Hospitals.

Mayor Donley requested the Community Services Board to monitor the funding situation and report back on the recently amended state statute relative to the Community Services Board and the arrangement that is discussed in the report in terms of these thirty-one individuals coming back to the entire region. He would appreciate any coordination that Dr. Claiborn might be able to provide with our Legislative Director Caton on this issue. He indicated that if the City needs to come up with some kind of statutory change, first he would like it to be made as part of the City's legislative package, and if he knows about it ahead of time he may be able to get the Mayors and Chairs of this region to consider it.

City Council (1) accepted up to $110,725 from the Virginia Department of Mental Health, Mental Retardation and Substance Abuse Services through the Northern Virginia Mental Health Institute (NVMHI) in FY 1998; (2) approved the increase in positions in the Department of Mental Health, Mental Retardation and Substance Abuse by one full-time case manager (grade 13), two full-time residential counselors (grade 10), three (1.63 FTE) benefited part-time counselors (grade 10) and .20 FTE non-benefited residential counselor (grade 10). These grant-funded positions would end upon the expiration of the grant and the individuals who would fill these positions would be notified of this condition of employment; and (3) approved the incorporation of these changes in the Alexandria Community Services Plan of Services.

16. Consideration of the Alexandria Community Services Board Participation as a Sub-Grantee in HIV/AIDS-Related Proposal to The Center for Mental Health Services, U.S. Department of Health and Human Services.

City Council (1) authorized the Board to participate as a sub-grantee in Georgetown University Medical Center's grant application to the Center for Mental Health Services; and (2) if the grant is awarded, approved increasing the number of authorized grant-funded City positions by 1.25 full-time equivalents (FTE), one case manager and .25 FTE administrative technician. The case manager will help the current program meet the demand for services. The administrative technician will assist the department's fiscal staff in responding to the grant's demands for cost and service utilization data.

It was noted that approval of this request (if the grant is awarded) would also maintain the salaries of 2.5 FTE psychological counselors III who are currently supported by the Board's federally-funded HIV/AIDS Mental Health Project which ends August 31, 1998. These grant positions would reside in the Department of Mental Health, Mental Retardation and Substance Abuse and would terminate upon expiration of the grant. All persons who fill these positions will be notified of this condition of employment at the time that they are hired and would sign an agreement of understanding with regard to this condition. It should be noted that there are no funds available in the City budget to continue these activities once the grant funds are expended.

17. Consideration of An Amendment to the City's Community Development Block Grant Program for Rehabilitation of the Alexandria Battered Women's Shelter.

City Council (1) allocated up to $25,000 in current year CDBG monies to provide for the rehabilitation of the roof, kitchen, and bathrooms; interior and exterior painting; and minor carpentry work at the Battered Women's Shelter; (2) approved the transfer of up to $25,000 for the rehabilitation from the following CDBG activities: Homeownership Assistance Program - $23,675 and Program Administration - $1,325; (3) and authorized the City Manager to submit a program amendment to the U.S. Department of Housing and Urban Development (HUD) to amend the current year Community Development Block Grant (CDBG) program to include funding for the rehabilitation of the Battered Women's Shelter.

18. Consideration of Request to Use City Facilities and Personnel for the Alexandria Red Cross Waterfront Festival on June 12, 13 and 14.

WITHOUT OBJECTION, John Drye, Chairman, 1998 Waterfront Festival, answered questions and indicated that the entertainment on Friday night will be Country-Western performer Jodi Messina, on Saturday night will be Aaron Nevel, and on Sunday afternoon the Grass Roots.

City Council approved the use of the following City facilities and personnel for the 17th Annual Alexandria Red Cross Waterfront Festival on June 12, 13, and 14, and set conditions for their use. All City costs associated with the festival are paid for by the Red Cross, and include permits and license fees, facilities and equipment rental fees, and staff fees at the appropriate overtime rates. These fees are estimated to total $34,167 this year, and are not to be waived. The actual fees shall be determined by the City as of June 30, 1998. The Red Cross made a net total of $88,380 on the festival last year after paying $28,839.04 in City fees and costs for permits, licenses, facilities and equipment.

A. Use of parks, equipment and public facilities (Attachment 1):

2. The use of the Torpedo Factory Piers (north and south) and the Founders Park Piers (north and south) at the City Marina for berthing and servicing of visiting ships during festival hours.

3. The use of all available picnic tables.

4. The use of Founders Park (east side of cinder track) during festival hours. This area will be used for passive displays and activities as agreed upon by the Founders Park Civic Association.

5. The closing of the following streets and a section of the bicycle path to vehicular traffic (except Festival and emergency vehicles) from 10:00 a.m. on Friday, June 12, through Sunday, June 14, 10:00 p.m.

Bicycle path between Montgomery and Oronoco Streets;

Madison Street east of Fairfax Street to the Alexandria Schools Rowing Facility;

Pendleton Street east of Fairfax Street to Union Street;

Oronoco Street east of Union Street to the river;

Union Street north of Oronoco Street to Pendleton Street; and,

Montgomery Street east of bike path to the river.

6. A ban on parking on the following streets from 8:00 a.m. on Friday, June 12, until 10:00 p.m. on Sunday, June 14:

Madison Street east of Fairfax Street to the river;

Pendleton Street east of Fairfax Street to Union Street;

Oronoco Street east of Union Street to the river; and,

Union Street north of Oronoco Street to Pendleton Street.

7. A ban on parking on Fairfax Street, east side, from Oronoco Street to Madison Street from 4:00 p.m. on Friday, June 12, until 10:00 p.m., on Sunday, June 14.

B. Permits:

1. To allow the temporary occupancy of public spaces for displays, exhibits, events, demonstrations, sales, trash removal, toilet facilities, amusement rides and other similar activities (The Department of Transportation and Environmental Services issues permit following City Council approval);

2. To allow the on-site sale of food and beer during specified festival hours;

3. To allow the performance of staged musical events in Oronoco Bay Park on Friday, June 12, 6:00 p.m. - 11:00 p.m.; Saturday, June 13, 10:00 a.m. - 10:00 p.m.; and Sunday, June 14, 10:00 a.m. - 7:00 p.m.; (The Red Cross is still determining the types of family entertainment that will be featured);

4. To support a fireworks display to be conducted from a barge in the Potomac River on Friday, June 12 at 10:30 p.m. and Saturday, June 13 at 9:30 p.m. (this support is contingent upon the Alexandria Red Cross obtaining permission to shoot fireworks from the District of Columbia); and,

5. To allow the placement of Red Cross flags by the Red Cross on utility poles from June 10 to June 15, from the 100 block of North Union Street to the 500 block of North Union Street, Oronoco Bay Park, and at the City Marina.

C. Set Conditions For Use:

1. No permits or license fees, facilities or equipment, rental fees, or staff costs required for the Festival shall be waived since the Red Cross raises a substantial amount of money from this festival.

Rental and staff fees shall be billed by the City on or before June 30, 1998, with payment due on or before July 30, 1998 (Attachment 2); and,

All permit fees shall be paid in advance, all insurance requirements shall be met and the park bond shall be posted in advance (Attachment 3).

2. The Red Cross shall be responsible for the restoration of landscaping, grass, sprinkler systems, light poles, and other park amenities at Oronoco Bay Park, and the City Marina area, and all other public rights-of-way as requested by the City. A $2,500 bond shall be posted by the Red Cross by June 8. Additionally, the Red Cross will be assessed a restoration fee to aerate, seed and fertilize the park after the festival, where necessary (Attachment 3).

3. Beer sales will be as follows: On June 12, 6:00 p.m. - 10:00 p.m.; on June 13, 12:00 noon - 9:00 p.m. with the exception of 2:00 p.m. - 4:00 p.m. which will be a two-hour dry period for all alcoholic beverages; and on Sunday, June 14, 12:00 noon - 6:00 p.m. No beer is to be taken from the festival grounds. All beverages sold must be served in plastic cups, including non-alcoholic beverages. No more than two alcoholic beverages may be purchased at any one time by a customer.

Other requirements pertaining to beer sales are as follows:

The Red Cross will obtain and produce a Virginia ABC License and City Banquet License.

The Red Cross will provide T.I.P.S. training, (Training for Intervention Procedures for Servers of Alcohol), for volunteers who will be selling alcoholic beverages during the Festival. These volunteers will not be permitted to consume these beverages while they serve them.

4. Where necessary, the Red Cross shall obtain permission from Federal, State and D.C. Government agencies and provide the City with copies of approvals and permits.

5. The Red Cross shall provide the City with copies of Certificates of Insurance for public liability and property damage of $1,000,000 with the City of Alexandria named as co-insured. The certificates shall cover waterfront docks, fireworks displays, Oronoco Bay Park, beer sales, and rights-of-way approved in this request (Attachment 3).

6. In addition, the Red Cross shall obtain and provide the City with a copy of a Certificate of Insurance for public liability and property damage of $1,000,000 per occurrence/$5,000,000 aggregate, with the City of Alexandria named as co-insured, to cover amusement rides.

7. The Red Cross will supply barricades. The Red Cross will provide personnel to place the barricades and to control each gate to prevent unauthorized motor vehicles from entering the closed streets.

8. The Red Cross will provide the personnel necessary to keep the parks, streets and sidewalks clean at all times. The City will provide a trash truck and personnel for removal and dumping of bagged trash from the Festival site. The Red Cross shall pay all dumping and personnel fees connected with this service (Attachment 2).

9. The Red Cross shall notify and obtain, where possible, letters confirming participation and/or cooperation from the following organizations and groups that will be affected by the Festival and submit such documents to the City for review before this permit is processed:

10. The Health Department must approve all food and beverage concessions prior to their arrival at the site. Adequate toilet facilities must also be provided.

11. The Red Cross shall provide and pay for night security of the Festival grounds and along the waterfront.

12. The Red Cross shall be responsible for all docking fees incurred by visiting ships berthing at the City Marina.

13. The Red Cross shall obtain a three-day banquet license and a three-day business license from the City's Finance Department (Attachment 3).

14. All food sales will be conducted under tents or from booths and wagons located throughout the Festival site. Concessionaires include several Alexandria restaurants and clubs. The Health and Fire Departments will monitor these activities to ensure that all codes are met.

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Council Member Rich commended the letter carriers for the success of their food campaign on Saturday.

(b) Council Member Rich requested Planning and Zoning Director Lynn to expound on the Planning Commission action relative to trailers at Mount Vernon School, and requested that the Council go ahead with its consideration and decision with respect to the new West End school soon so that the School Board can go about proper planning.

Mayor Donley agreed that Council should make that decision prior to adjournment for the summer.

Vice Mayor Euille stated that this is on the City/Schools' next agenda for discussion.





ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL (continued)

(c) Councilman Cleveland noted that on Wednesday, May 16, 1998, at 6:00 p.m. to 8:00 p.m., at The Little Theatre of Alexandria, 600 Wolfe Street, there will be an informal discussion, ArtCHAT, with Members of City Council sponsored by the Alexandria Commission for the Arts, and hosted by the Board of Directors, The Little Theatre of Alexandria.

Mayor Donley requested that the Arts Commission provide a little more coordination when they ask Council to be there.

(d) Councilman Cleveland asked questions of Citizen Assistance Director Boyd with respect to the pending rate increase by Jones Intercable.

(e) Councilwoman Pepper congratulated Vice Mayor Euille for a recent program profiling him on Channel 8. It was a great tribute to one of our own and made us all look good.

(f) Councilwoman Pepper spoke to the successful Aging Expo held on Saturday, May 9.

(g) Councilwoman Pepper announced that a memorial service to recognize Deputy Sheriffs and Police Officers will be held on Thursday, May 14, 1998, at 7:00 p.m., at Baptist Temple Church.
Mayor Donley stated that this has conflicted with the Transportation Coordinating Committee Meeting for the past two years, and asked that this might be scheduled at a different time next year.

(h) Councilman Speck questioned Transportation and Environmental Services Director O'Kane about the new florescent signs that are popping up over the City. He indicated that he thought that they were really effective but Police Officers cannot issue a violation because they do not meet the national standards for road signs. He stated that if a legislative change is needed to remedy this that staff start working on this now and seek clarification.

Mr. O'Kane stated that should these signs prove to be effective that the City should suggest a change to the U. S. Department of Transportation with respect to color of road signs.

(i) Councilman Speck spoke to the inaugural dinner meeting of a new organization in Alexandria designed to sponsor debates and allow discussions on issues of interest to City residents. Named "Agenda: Alexandria", the organization will meet monthly for dinner to hear knowledgeable speakers on issues such as development, transportation, education, taxes, juvenile crime, race relations and the environment, just to name a few. The first meeting will be held on May 18 at 6:30 p.m. at Temple Beth El, 3830 Seminary Road. Anyone interested in attending may call Barbara at 998-0446. Cost per person is $15.

(j) Council Member Walker noted that the City will have a visitor from the Virginia Municipal League in June which is nice to have a presence in Alexandria of the Virginia Municipal League, and in August, the National League of Cities is having one of its leadership training institute seminars in Alexandria. This is nice since it puts Alexandria on the map in a national way, brings people from out of town to our City for special seminars and gives us an opportunity to play host to other people in other cities in the United States.

Passage on First Reading of AN ORDINANCE to amend the city code by (i) authorizing the city's Youth Policy Commission to act as the city's youth services citizen board under Virginia Code section 66-29, (ii) providing that a majority of the commission members must be individuals who are neither elected officials nor employees of a private or public service agency that provides services to the city's youth, and (iii) adding one additional citizen member to the commission.

22. Introduction and First Reading. Consideration. Passage on First Reading of AN ORDINANCE to amend the city code by increasing the membership of the Alexandria Community Policy and Management Team to nine in order to add an additional parent representative.

Passage on First Reading of AN ORDINANCE to amend Section 11-302 of the Zoning Ordinance to provide that, in the case of an appeal to the Board of Zoning Appeals or a revocation of a special use permit, the required written notice shall be provided by the city.

Passage on First Reading of AN ORDINANCE to amend Section 12-200 of the Zoning Ordinance to add new provisions requiring that all nonconforming uses abate within a specified period of time unless a special use permit is approved before that time and providing new rules for the repair of structures housing nonconforming uses.

30. Consideration of City Council Schedule.

City Council (1) scheduled a work session at 6 p.m. in the Council Workroom before Council's Tuesday, June 23 legislative meeting with the Alexandria Task Force on AIDS to discuss the Task Force's Needle Exchange Report; (2) scheduled an evening reception to recognize the citizen volunteers who serve on the City's Boards and Commissions on September 17, 1998, at the Torpedo Factory Art Center; and (3) noted that the following fall events have been added to the Council Calendar: Saturday, October 24, 9 a.m. Cameron Run Regional Park 4th Annual Walk to Fight Breast Cancer; and Friday, November 13, (location and time to be announced) Alexandria 250th Anniversary Celebration Kick-off Gala.
