City Attorney Sunderland stated that this had been docketed for public hearing and action; however, 9.06 items are final actions by the Planning Commission, unless the Planning Commission recommends against, in which case 9.06 items come to Council. Our practice had been to bring these to Council for notice and your information, but technically Council does not need to have a public hearing nor a vote on it because the Planning Commission approved it.

Councilwoman Pepper asked if there is an agreement to spend monies for the purchase of this land and if it will be acceptable to the Federal Government that we can use it combined with a park for a school site.

City Attorney Sunderland stated that there is certainly nothing in the conveyance the City received from the Park Service that precludes in any way both the use of the site for a school and the school's use of the parkland for school purposes. He stated that the City will be submitting it to the Park Service once the City approves the park plan for the west end and the east end park, as required by the deed. When the park plan is submitted, the City will indicate that there are plans for a school and will indicate there are plans to have the school use the park on occasion.

WITHOUT OBJECTION, Council received the report from the Planning Commission.
