OPENING
The Meeting was called to Order by Mayor Donley, and the City Clerk called the Roll; all Members of City Council were present, with Vice Mayor Euille arriving at 9:45 a.m.
2. Public Discussion Period.
(a) Alan N. Rudd, 2121 Jamieson Avenue, #1801, representing the Eisenhower Civic Association, spoke to reasons why the PTO should not be located at Carlyle.
(b) Sally Bjorge, 2121 Jamieson Avenue, #901, representing the Eisenhower Civic Association, spoke to reasons why the PTO should not be located at Carlyle.
(c) Jane Starkey, 2121 Jamieson Avenue, #1903, representing the Eisenhower Civic Association, also spoke against having the PTO located at Carlyle.
(d) Kirk Lippold, 2121 Jamieson Avenue, #1007, representing the Eisenhower Civic Association, supported PTO coming to Alexandria, but it should be located at the Eisenhower Metro Site and not Carlyle.
(e) Jonathan Rak, 11320 Random Hills Road, Fairfax, representing LCOR, spoke to the benefits of locating the PTO at Carlyle.
(f) John Chapman Gager spoke.
New Business Item No. 1: Council Member Rich requested that City Council interview the applicants for the upcoming vacancy on the Alexandria Redevelopment and Housing Authority Board of Commissioners. It was decided that Council would interview the applicants starting at 5:15 p.m. on Tuesday, September 22, 1998, prior to the work session at 6:00 p.m.

WHEREUPON, upon motion by Council Member Rich, seconded by Councilwoman Pepper and carried unanimously, City Council approved the Action Consent Calendar with the exception of docket item nos. 6, 7, 11, 10, and 13, which were considered under separation motions. 18. City Council approved the recommendation of the Planning Commission and approved this request, subject to compliance with all applicable codes, ordinances and staff recommendations; and approved the City Manager's recommendation as follows: (1) approved the addition and deletion of the properties listed on pages 2 and 3 of the memorandum dated August 11, 1998, to the currently approved List of Blighting Influences in Potomac East and Potomac West; (2) approved, pursuant to the provisions of Section 9.06 of the City Charter, the possible acquisition for rehabilitation/redevelopment and resale to low- and moderate-income persons or for resale "As Is" to the private market for rehabilitation/redevelopment of the five Potomac East and Potomac West properties to be added to the List; and (3) authorized the City Manager to enter into contracts for the purchase of properties on the Blighting Influences List if it becomes necessary to acquire such properties because of the failure of the owners to comply with the program's guidelines.

The following person participated in the public hearing on this item:
Larry Stansbury, 6101 Edsall Road, #1503, representing Alexandria Knolls West Condominium Homes, expressed concern that a long-standing street, Edsall Road, disappears into another community without any physical barrier that prevents it.
Mayor Donley indicated that Edsall Road most likely ends at Pickett Street.
Councilwoman Pepper noted that the Cameron Station West Park has an Edsall Road address so her guess is that it comes in further than Pickett and there are no street signs there to help. She requested staff to look into this and get back to Mr. Stansbury with the information.

SPECIAL USE PERMIT #98-0051 -- 2922 DUKE STREET -- SKYHILL SHELL STATION -- Public Hearing and Consideration of a request for a special use permit to allow a storage trailer and to change the plans of the Subway restaurant; zoned CG/Commercial General. The following person participated in the public hearing on this item:
R. P. Kapani, 2922 Duke Street, applicant, requested that the trailer be allowed to remain at its site since it has been there for approximately twenty-eight years. He indicated that it would not be feasible to take it out without damaging the building.
Mayor Donley asked questions of Planning and Zoning Director Lynn.
Mr. Lynn indicated that it is not obtrusive but the only issue is that it does not comply with our policy. He stated that it could be removed through the adjacent property to a driveway if the applicant can get his neighbor to permit him to drive out there. It appears that it may not be that difficult.
Mayor Donley asked that staff work with Mr. Kapani to look at the logistics of Mr. Lynn's suggestion, and requested that the staff work with the adjoining property owner to allow the applicant the encroachment onto his property in order to get the trailer out of there. If that doesn't work, we would have to consider something a little more permanent which may be Mr. Kapani's suggestion that it be allowed to stay because it is probably the least obtrusive trailer in the City and was probably there without anybody knowing about it.
WHEREUPON, upon motion by Councilwoman Pepper, seconded by Council Member Walker and carried unanimously, City Council approved the recommendation of the Planning Commission and approved the request, subject to compliance with all applicable codes, ordinances and staff recommendations and the amended Condition #20, and with the request that staff work with the applicant on trying to find an effective way of moving the trailer. The following person participated in the public hearing on the item:
Tony Traish, 6728 Franconia Road, Springfield, VA, representing the applicant, requested that the applicant be permitted to keep the pylon sign and pole, and asked that Condition #5 be deleted.
Members of Council participated in the discussion on this item.
Council Member Walker spoke to design guidelines for Duke Street and suggested that we begin some improvements particularly in the commercial area.
Councilwoman Pepper indicated that some years ago Council asked for a Duke Street study to see what could be done to improve its appearance, and noted that there is a mechanism in place with respect to improvements along this commercial strip and asked staff to move forward.
WHEREUPON, upon motion by Vice Mayor Euille, seconded by Councilwoman Pepper and carried on a vote of 6-to-1, City Council approved the recommendation of the Planning Commission, as amended, and approved the request, subject to compliance with all applicable codes, ordinances and staff recommendations, and deleted Condition #5, with the request that the applicant cooperate with the City in terms of design guidelines as they are promulgated by staff. Councilman Speck spoke to Condition #16 as it relates to employee parking, and requested the City Clerk, when this meeting concludes, to go back to the verbatim of Council's discussion last spring when he thought we had a clarification on the language that we wanted to use consistently as it related to employee parking, i.e., that the employer require its employees who drive to use off-street parking.
WHEREUPON, upon motion by Councilman Speck, seconded by Vice Mayor Euille and carried on a vote of 6-to-0, City Council approved the recommendation of the Planning Commission, as amended, and approved the request, subject to compliance with all applicable codes, ordinances and staff recommendations, and amended Condition #16 to read: 16. The following persons participated in the public hearing on this item:
Judy Noritake, 605 Prince Street, chair, Alexandria Park and Recreation Commission, spoke in support of removal of the pilings and referring the name of Windmill Hill to the naming committee for consideration. She spoke to potential runoff pollution problems caused by the current dog walk area in the park and suggested that the City might want to consider moving it. Ms. Noritake also suggested that the City may want to apply for a Section 319 Nonpoint Source Program Watershed Restoration Grant to move the current dog area to another section of the park; copies of material presented by Ms. Noritake are on file in the office of the City Clerk and Clerk of Council, marked collectively as Exhibit No. 3 of this item;
Sharon Newsome, 108 Gibbon Street, objected to some of the landscaping plans with respect to trees on Union Street at Pommander Park;
Peter T. Nelson, 3114 Circle Hill Road, spoke in support of project to develop Old Town Yacht Basin;

Joanne Tomasello, 511 North Pickett Street, spoke in support and noted that the issue of enforcement of fecal pickup needs to be looked at for the entire City.
Councilman Cleveland noted that the Four Mile Run pollution problem was from a neighboring apartment building and not from dogs.
Council Member Walker suggested that the cleanup after pets should be worked on at all parks. She spoke about the activities of the Alexandria Waterfront Committee.
Vice Mayor Euille suggested expanding the patrol of the park.
Mayor Donley requested staff to look to see if we can identify how much of a problem the current dog exercise area is at this location, and asked staff to get more information about some of the ideas staff is looking at right now, i.e., the stainless steel receptacle which goes right into the sanitary sewer as opposed to other containers to see if we can try to let this dog exercise area stay where it is. If it is a serious issue, we need to be consistent in terms of allowing elements to enter into the eco-system.

AN ORDINANCE to amend and reordain Section 11-402 (ADMINISTRATION), under Section 11-400 (SITE PLAN), of Division B (DEVELOPMENT APPROVALS), Article XI (DEVELOPMENT APPROVALS AND PROCEDURES), of the City of Alexandria Zoning Ordinance (TA NO. 98-0011).
THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:
Section 1. That Section 11-402 of the City of Alexandria Zoning Ordinance, be, and the same hereby is, amended to read as follows:
Sec. 11-402. Administration. The director has the duty and responsibility to administer and enforce the provisions of this section 11-400 and the authority to establish rules and regulations to do so. To the extent delegated herein, other department directors shall have the duties and responsibilities provided and the authority to establish rules and regulations to administer such responsibilities. The director or the head of any other department referred to in this section 11-400 may delegate in writing to an employee under his supervision any of the functions hereunder for which the director or such department head is responsible. These provisions of section 11-400 are included here for administrative convenience; they derive from section 9.33 of the charter and are technically not part of the zoning ordinance for purposes of section 9.12 of the charter.
Section 2. That in preparing the codification of this ordinance the city attorney be, and he hereby is, directed to make conforming amendments throughout the Zoning Ordinance, and to The Code of the City of Alexandria, 1981, as amended, as appropriate.
Section 3. That this ordinance shall become effective upon the date at the time of its final passage, and shall apply to all applications for land use, land development or subdivision approval provided for under the City of Alexandria Zoning Ordinance which are on such date pending before any city department, agency or board, or before city council, or on judicial review; shall apply to all such applications which may be filed after such date, and shall apply to all other facts and circumstances subject to the provisions of the City of Alexandria Zoning Ordinance, except as may be provided in Article XII of the Zoning Ordinance.

Kirk S. Lippold, 2121 Jamieson Avenue, #1007, spoke against;

Robert T. Jordan, 2121 Jamieson Avenue, #1209, representing the Eisenhower Civic Association, spoke against.
Council Member Walker requested that staff provide civic associations with a copy of the guidelines. The City Manager will promulgate the guidelines to civic groups and any changes that are worked out will be brought back to Council and Council will amend the guidelines at that time.
Vice Mayor Euille requested that the guidelines be referenced as part of the ordinance.
WHEREUPON, upon motion by Vice Mayor Euille, seconded by Councilwoman Pepper and carried on a ROLL-CALL vote of 6-to-1, City Council finally passed the ordinance, as amended, on its Second Reading and Final Passage by amending four lines up from the bottom in Sec. 9-2-7, following the word public, insert the following: "in accordance with guidelines approved by the City Council, ...". The voting was as follows:

The ordinance finally passed as amended reads as follows:
ORDINANCE NO. 4020
AN ORDINANCE to amend and reordain Section 9-2-5 (MINIMUM HEIGHT LIMITS) and Section 9-2-7 (LANDING AT OTHER THAN ESTABLISHED AIRPORT), of Chapter 2 (AIRCRAFT), Title IX (LICENSING AND REGULATION) of The Code of the City of Alexandria, Virginia, 1981, as amended.
THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:
Section 1. That Section 9-2-5 of The Code of the City of Alexandria, Virginia, 1981, as amended, be, and the same hereby is, amended, to read as follows:
Sec. 9-2-5 Minimum height limits.
Except when taking off or landing at an established landing field or airport, or at a location authorized by the city manager pursuant to section 9-2-7, no person shall fly or permit any aircraft to be flown within the city, except at a height sufficient to permit a reasonably safe emergency landing, which in no case shall be less than 1,000 feet; provided, that the provisions of this section may be deviated from when special circumstances render a departure necessary to avoid immediate danger or when such departure is required because of stress of weather conditions or other unavoidable cause.
Section 2. That Section 9-2-7 of The Code of the City of Alexandria, Virginia, 1981, as amended, be, and the same hereby is, amended, to read as follows:
Sec. 9-2-7 Landing at other than established airport.
Except in case of emergency, or as authorized by the city manager, no person shall land any aircraft in the city, except upon a regularly established airport. Any authorization provided by the manager pursuant to this section shall be for a helicopter landing only, shall be based upon a determination that the landing is in the interest of the city and consistent with the safety of the public, in accordance with guidelines approved by the city council, and shall be accompanied by any terms and conditions deemed necessary by the manager to protect the public safety and welfare, including the provision of insurance, a bond or other form of security.
Section 3. That this ordinance shall become effective upon the date and at the time of its final passage.
