OPENING
The Meeting was called to order by Mayor Donley, and the City Clerk called the Roll; all Members of Council were present with Councilwoman Pepper arriving at 9:40 a.m.
2. Public Discussion Period.
(a) Patrick Jones, 957 Pegram Street, representing the Polk School PTA and the Polk Playground Committee, spoke to the efforts to build a new playground at Polk School, and requested Council's support for a recommendation from the Park and Recreation Commission to redirect some of the CIP funds originally designated to design a playground at Jones Point. The Commission requested that Council redirect these monies to the Polk Playground Fund in a one-for-two match, up to a total of $10,000. Mr. Jones further asked Council to seriously consider contributing a total of $20,000 with the understanding that the Playground Committee will raise the other $40,000; a copy of his update is on file in the office of the City Clerk and Clerk of Council, marked Exhibit No. 1 of Item No. 2(a), and is incorporated herewith as part of this record by reference.
Mayor Donley asked staff to report back on what the status is of the Park and Recreation Commission's recommendation mentioned by Mr. Jones. Once staff responds to the Park and Recreation Commission's recommendation to Council, then Council will consider it.
(b) Alan Rudd, 2121 Jamieson Avenue, representing the Eisenhower Civic Association, spoke against the location of PTO at Carlyle.
(c) Patti Hulvershorn, 2121 Jamieson Avenue, representing the Eisenhower Civic Association, spoke against the location of PTO at Carlyle.
(d) Alan Kamerow, 2121 Jamieson Avenue, representing the Eisenhower Civic Association, spoke against the location of PTO at Carlyle.
(e) Kirk Lippold, 2121 Jamieson Avenue, representing the Eisenhower Civic Association, spoke against the location of PTO at Carlyle.
(f) Lillie Finklea, 1210 Franklin Street, representing the Southwest Quadrant Civic Association, spoke against the location of the PTO at Carlyle.
(g) John Chapman Gager spoke.
WITHOUT OBJECTION, Mrs. Alan Rudd addressed a question posed by Councilwoman Pepper earlier with respect to the height of the building already included in the Master Plan for this site.
Planning and Zoning Director Lynn noted that LCOR, developer for the PTO at Carlyle, has not come forward because of new requirements asked for by the General Services Administration which has provided another thirty-day extension.
(h) WITHOUT OBJECTION, Councilman Speck, as a point of personal privilege, spoke to Friday's editorial in the Alexandria Journal. He indicated that this is the ninth editorial in the last fifteen months that specifically castigates the City Council actions regarding employee compensation and why that is the sole reason that the City's finances are in such difficulty, and specifically identified by Council's action on October 14, the budget appropriations made for the soccer and baseball as an example of Council being misguided.
Councilman Speck asked the City Manager, at the next Labor Management meeting, if this matter could be brought up to ask those who are affected by this and participated in this to speak to this issue in the way that they are allowed in this free and open democracy that we have and try to point out to the editor that the facts are not as he states them, and to frankly have other people speaking to this issue other than Council continuing to say that's not the case.
Council Member Rich asked that there be no organized campaign by the City Manager on this request.

City Attorney Sunderland requested that Council add a new condition with respect to the effective date of the special use permit.

Bernadette L. Johnson-Lewis, 317 Evans Lane, speaking on behalf of the applicant, spoke in support.
There was a discussion about the issue of loitering in this area. The applicant was asked to be especially wary of people hanging out in front of his restaurant due to the major loitering problem at the Laundromat next door, and encouraged him to contact the City should he need its assistance.
The applicant indicated he will and is monitoring his property for loitering.

Sally Campbell, 5249 Duke Street, #308, representing Northern Virginia Family Services -- Healthy Families, spoke; a copy of Ms. Campbell's statement is on file in the office of the City Clerk and Clerk of Council, marked Exhibit No. 4 of this item; and
William J. Nagle, 116 Gibbon Street, representing Hospice of Northern Virginia, spoke in support of a grant for Hospice of Northern Virginia.
Mayor Donley suggested that Hospice tailor its application to fit under the goal of self-sufficiency in order to get an award.
Council Member Walker spoke to the overall item and noted that it's a good idea to bring in both our State Delegation and Congressman Moran to particularly talk about the Youth Commission and what our goals are and what direction we are heading. She indicated that school involvement is really crucial. The schools working with Council to come up with the unfulfilled needs in the community is an important step. The schools should be open longer to allow the schools to used by people in the community.
Council Member Walker also spoke to the health needs of our community and suggested that a commission should look at the health needs of the community. She indicated she would like to see something done with respect to some sort of a continuum of health care throughout the community.

The Applicant shall provide evidence of an arrangement for 18 off-street parking spaces for use by patrons in the evenings to the satisfaction of the Director of Planning and Zoning. The applicant shall maintain a daytime parking arrangement with the garage located at 1101 King Street and shall post signs directing patrons to its availability, which can be modified with the approval of the Director of Planning and Zoning; condition #12 was amended to read: 12. Live entertainment shall be permitted to provide background ambient music to dining patrons on the first floor only; condition #16 was amended to read: 16. No music or amplified sound shall be audible at the property line; deleted condition #21; and amended condition #23 to read: 23. ORDINANCE NO. 4021
AN ORDINANCE authorizing the owner of the property located at 1600 West Abingdon Drive, and the owner's successors in title, to establish and maintain an encroachment into the public right-of-way at 1600 West Abingdon Drive, in the City of Alexandria, Virginia.
WHEREAS, Potowmack Crossing Condominium is the owner of the residential property located at 1600 West Abingdon Drive in the City of Alexandria, Virginia (the "Property"); and
WHEREAS, Potowmack Crossing Condominium desires to establish and maintain, and has applied for, an encroachment into the right-of-way at 1600 West Abingdon Drive, which encroachment shall consist of a sign that, at its base, is approximately (i) 3 feet, 4 inches deep, (ii) 10 feet, 6 inches long, and (iii) 6 feet tall; and is located in the public right-of way approximately 17 feet at its closest point to the corner of West Abingdon Drive and Slaters Lane; and
WHEREAS, the requested encroachment will not obstruct or narrow the public sidewalk adjacent to it, and the public right-of-way in front of 1600 West Abingdon Drive will not be impaired significantly by the requested encroachment; and
WHEREAS, this encroachment has been approved by the Planning Commission of the City of Alexandria at one of its regular meetings subject to certain conditions; and
WHEREAS, it has been determined by the City Council of the City of Alexandria that this encroachment is not detrimental to the public interest; therefore,
THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:
Section 1. That Potowmack Crossing Condominium and its successors in title (hereafter collectively the "Owner") be, and the same hereby is, authorized to establish and maintain an encroachment into the public right-of-way at 1600 West Abingdon Drive in the City of Alexandria, said encroachment consisting of a sign that, at its base, is approximately (i) 3 feet, 4 inches deep, (ii) 10 feet, 6 inches long, and (iii) 6 feet tall; and is located in the public right-of way approximately 17 feet at its closest point to the corner of West Abingdon Drive and Slaters Lane, all as more particularly shown on the partial site plan and design and construction drawings attached hereto, until the encroachment is removed or destroyed or the authorization to maintain it is terminated by the city; provided, that this authorization to establish and maintain the encroachment shall not be construed to relieve Owner of liability for any negligence on its part on account of or in connection with the encroachment and shall be subject to the provisions set forth below.
Section 2. That the authorization hereby granted to establish and maintain the encroachment described in Section 1 shall be subject to and conditioned upon Owner maintaining at all times and at its own expense liability insurance, covering both bodily injury and property damage, with a company authorized to transact business in the Commonwealth of Virginia and with minimum limits as follows:
Bodily Injury: $1 million each occurrence
$1 million aggregate
Property Damage: $1 million each occurrence
$1 million aggregate
This liability insurance policy shall identify the City of Alexandria and Owner as named insurers and shall provide for the indemnification of the City of Alexandria and Owner against any and all loss, liability and costs related thereto, including attorneys’ fees, occasioned by the establishment, construction, placement, existence, use or maintenance of the encroachment. Evidence of the policy and any renewal thereof shall be filed annually with the city attorney's office. Any other provision herein to the contrary notwithstanding, in the event that this policy of insurance lapses, is canceled, is not renewed or otherwise ceases to be in force and effect, the authorization herein granted to establish and maintain the encroachment shall, at the option of the city, forthwith and without notice or demand by the city, terminate. In that event, Owner shall, upon notice from the city, remove the encroachment from the public right-of-way, or the city, at its option, may remove the encroachment at the expense and risk of Owner. Nothing in this section shall relieve Owner of her obligations and undertakings required under this ordinance.
Section 3. That by accepting the authorization hereby granted to establish and maintain the encroachment and by so establishing and maintaining the encroachment, Owner shall be deemed to have promised and agreed to indemnify and hold harmless the City of Alexandria from any and all loss and
liability (including attorneys' fees and litigation expenses) arising by reason of the establishment, construction, placement, existence, use or maintenance of the encroachment.
Section 4. That nothing in this ordinance is intended to constitute, or shall be deemed to be, a waiver of sovereign immunity by or on behalf of the City of Alexandria or any of its officers or employees.
Section 5. That the authorization herein granted to establish and maintain the encroachment shall be terminated whenever the City of Alexandria desires to use the affected public right-of-way for any purpose whatsoever and, by written notification, demands that Owner remove the encroachment. Said removal shall be completed within sixty days of the date of the notification and shall be accomplished by Owner without cost to the city. If Owner cannot be found, or shall fail or neglect to remove the encroachment within the time specified, the city shall have the right to remove the encroachment, at the expense of Owner, and shall not be liable to Owner for any loss or damage to the structure of the encroachment caused by the removal.
Section 6. That this ordinance shall be effective upon the date and at the time of its final passage.

THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:
Section 1. That Section 12-302 of the City of Alexandria Zoning Ordinance be, and the same hereby is, amended by adding thereto a new subsection (J), to read as follows:
(J) Any general auto repair use permitted as an accessory use to a franchised automobile dealership pursuant to section 2-118, which is subsequently not permitted because the franchised dealership ceases to operate, or the repair use ceases to be accessory to such dealership, may, with the approval of a special use permit, be allowed to continue as a noncomplying use.
Section 2. That Section 12-302 of the City of Alexandria Zoning Ordinance, as amended by this ordinance, be, and the same hereby is, reordained as part of the City of Alexandria Zoning Ordinance.
Section 3. That this ordinance shall become effective upon the date at the time of its final passage, and shall apply to all applications for land use, land development or subdivision approval provided for under the City of Alexandria Zoning Ordinance which are on such date pending before any city department, agency or board, or before city council, or on judicial review; shall apply to all such applications which may be filed after such date, and shall apply to all other facts and circumstances subject to the provisions of the City of Alexandria Zoning Ordinance, except as may be provided in Article XII of the Zoning Ordinance.
