12. Other Business.

On a motion made by Mr. Dunn, and seconded by Mr. Robinson the Planning
Commission voted to follow the present practice which is staff determines
when a case is docketed and the Planning Commission reserves the right to defer
for additional study and review. The motion carried on a vote of 6-0.

Reason: At the beginning of the hearing, Ms. Fossum expressed concern
regarding the Virginia Paving Asphalt Plant application. She requested that this
issue not be docketed for hearing until questions regarding the plant's violations have
been answered, and until a full report has been issued for at least 30 days. Ms.
Fossum was also concerned that there has not been enough opportunities for
community involvement. Mr. Dunn suggested that the case be docketed for June

and then deferred if further review is necessary. Mr. Josephson summarized
Virginia Paving's request and staff's review of the plant over the past year. He
indicated that delays in bringing the case forward are a result of studies that have
been conducted by the applicant and the City. Mr. Josephson added that both
Virginia Paving and staff have tried to be responsive to community concerns. Other
Commissioners shared Ms. Fossum's concerns but felt that, as matter of process, the
decision to docket the case should be left up to staff, and that the Planning
Commission could defer the case if necessary

The Planning Commission public hearing was adjourned at 8:30 p.m.
