Hoffman Family, by Jerry Emrich, attorney: Appeal from the decision of the City
Attorney and Director of Planning and Zoning that the Hoffman properties do not have
a vested right to the zoning ordinance regulations, including conceptual design plan
approvals and special use permit approvals, applicable to the Hoffman Properties prior
to the adoption of the Eisenhower East Small Area Plan and related zoning ordinance
amendments.

granted, the Board of Zoning Appeals will be granting a special exception from section
12-102(A)of the zoning ordinance relating to physical enlargement of a noncomplying
