City Council held a work session with representatives of the Virginia-American Water Company at 6:00 p.m. in the Council Workroom.

City Manager Sunderland spoke briefly on what the representatives would be addressing and made introductions.

Steve Edgemon, VAWC Vice President and Manager, and William Walsh, Operations Manager, provided Council with an overview of the water utility infrastructure and responded to questions posed to them by Members of City Council.

The Meeting was called to Order by Mayor Donley, and the City Clerk called the Roll; all Members of City Council were present.

13. Consideration to Amend the Approval of the Red Cross Waterfront Festival to Extend the Time for the Sale of Beer from 9:00 p.m. to 9:30 p.m. on Saturday Evening for the 2001 Festival.

END OF CONSENT CALENDAR

WHEREUPON, upon motion by Councilman Speck, seconded by Vice Mayor Cleveland and carried unanimously, City Council approved the Consent Calendar as presented with the exception of docket item no. 14 which was considered under a separate motion. The City Manager's recommendations were as follows:

7. City Council received the following resignations with regret: (a) Dale Medearis from the Northern Virginia Regional Commission; and (b) Ruth Lincoln Kaye from the Alexandria Public Records Advisory Commission; and requested the Executive Secretary for Boards and Commissions to send the appropriate letters of appreciation and to advertise the vacancies in the usual manner.

8. City Council (a) reappointed Jacqueline Woodard as a Business Representative From Among Recognized Area Businesses, Including Minority-Owned and Small Businesses to the Alexandria Commission on Employment; and (b) reappointed William Conkey as a Member From Planning District I to the Alexandria Park and Recreation Commission.

9. City Council received the Monthly Financial Report for the period ending January 31, 2001.

10. City Council: (1) authorized the capital project allocations and planned expenditures for the capital projects as detailed in the Capital Improvement Expenditure Summary; and (2) delegated to the City Manager, or his designee, authority to award contracts to the lowest bidder for Slater's Lane improvements.

11. City Council received the Alexandria Sanitation Authority's Financial Report.

12. City Council received the report and thanked the Alexandria Commission for the Arts for its efforts on behalf of the arts and the City.

13. City Council amended the conditions for the festival by extending the time when beer may be sold by 30 minutes from 9:00 p.m. to 9:30 p.m. on Saturday, June 9, at the 2001 Red Cross Waterfront Festival. Staff will evaluate the impact of the time extension after this year's festival to determine if the 9:30 p.m. end to beer sales should be effective for the 2002 and 2003 Red Cross Waterfront Festivals.

14. Consideration of the Contract Between the City and Antonio Mendez for the Captain Rocky Versace Vietnam Veterans Plaza Project.

Councilman Euille posed questions to the staff on this item.

City Manager Sunderland, Assistant City Manager Jinks and City Attorney Pessoa responded to his questions.

WHEREUPON, upon motion by Councilman Euille, seconded by Councilwoman Pepper and carried unanimously, City Council authorized the City Manager to execute a contract with Antonio Tobias Mendez, in substantially the form presented to Council (Attachment 1 to the City Manager's memorandum), enabling Mr. Mendez to create the artwork, order materials and complete the approved project for the Captain Rocky Versace and Vietnam Veterans Plaza at the Mount Vernon Recreation Center. The execution of the contract by the City Manager shall constitute conclusive evidence of his approval, and that of the City Attorney, of any and all changes in the contract presented to Council. Senator Ticer, Delegates Van Landingham and Moran spoke regarding this year's General Assembly Session and responded to questions.

Councilwoman Eberwein requested, regarding the two-thirds vote requirement issue, that she be provided with some information on procedural issues and technical background in order for her to be well informed to lobby with respect to this issue.

Legislative Director Caton provided Council with an overview of the City's legislative package which was before the 2001 General Assembly Session.

17. Consideration of Staff Recommendation on the Report of the Capital Development Office Task Force.

Councilman Speck spoke to this item and the recent concerns raised by some non-profits. He requested the City Manager to arrange, as soon as possible, a meeting with whomever from the non-profit community wants to meet, task force members and staff as appropriate, to see if these concerns can be addressed. If they are addressed, fine. If they can't be addressed, then Council should probably go forward with the public hearing and make a decision after that.

WHEREUPON, upon motion by Councilman Speck, seconded by Councilwoman Eberwein and carried unanimously, City Council publicly thanked the task force for its hard work, and deferred final action on this pending a meeting [with the concerned non-profits, task force members, and appropriate staff] that the City Manager will set up, and then determine whether the Council would proceed with final passage and/or a public hearing. 18. Consideration of Staff Recommendations Regarding the Planning Process for a Community Center at Cameron Station. (#8 2/24/01; #15 2/13/01)

Councilwoman Eberwein requested that the School Board receive a copy of the draft consultant report at the same time that the Council does so that the Board can forward comments to the entire steering committee prior to the completion and the release of the final steering committee report.

WHEREUPON, a motion was made by Councilwoman Pepper, seconded by Vice Mayor Cleveland that City Council approve the City Manager's recommendation that Council defer establishing a task force to plan for a community center in Ben Brenman Park in Cameron Station and, as an alternative, approve staff proceeding with a City-wide assessment of recreation and leisure needs and facilities that would include the following elements: (a) conducting a comprehensive needs assessment of recreation and leisure services, activities and facilities, and a comprehensive plan to address those needs, to be undertaken by staff, a consultant and with the amendment that the steering committee be appointed by the City Council. The Manager has agreed to that recommendation. As the docket states, there are 8 positions to be filled by representatives from 4 commissions, the Chamber of Commerce and 3 citizen representatives--one from each of the 3 Park and Recreation Planning Districts. Council will vote for all 8 representatives. We will advertise for citizen representatives from each of the 3 Park and Recreation Planning Districts, and Council will select them. The Chamber's representative and the 4 commission representatives will be chosen by the chairs of the respective bodies. We will vote on whomever they send. The Manager will be the person who contacts the Chamber and the chairs of the Planning Commission, the Youth Policy Commission, the Park and Recreation Commission, and the Commission on Aging. The City Manager's message to the commission chairs and the Chamber will be to urge them to select a representative who has no predetermined position on City recreational needs--that is, a person who comes without an agenda. This is to ensure as much objectivity as possible; and (b) considering the results of the open space study, which is underway, and determining how the results of that study affect the recreation and leisure needs of the City. Staff would return to the City Council in the spring of 2002, with the results of the City-wide needs assessment and with recommendations, including whether to construct a new community center and, if so, whether it should be located at Ben Brenman Park or elsewhere in the City.

Members of City Council and the City Manager participated in a discussion on this item.

THEREUPON, a motion was made by Councilman Speck, seconded by Councilwoman Eberwein to amend the main motion to retain the three Council appointments, but keep the language that's in the original recommendation with the Manager regarding the other five representatives; which motion FAILED on a vote of 2-to-5. 19. Consideration of the FY 2000 Workforce Utilization Analysis and FY 2000 Applicant Tracking Report.

Councilman Euille directed questions to Affirmative Action Officer Izaguirre and requested that she provide Council with a breakdown of the 217 jobs with respect to which were promotions and which were not.

REPORTS OF BOARDS, COMMISSIONS AND COMMITTEES

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilman Speck requested an update on the CSX overpass on King Street.

Director of Transportation and Environmental Services Baier provided Council with a status report.

(b) Councilman Speck raised issues concerning rush-hour traffic. He asked if there is a willingness to have private contractors be stationed in the area to remove cars in the HOV curb lanes on South Washington Street during the afternoon rush hour? He asked if it is possible to extend the no parking hours from 4 p.m. to 6:30 p.m. on South Washington Street? In addition, he noted that on the north side of Duke Street, between Alfred and Patrick Streets, there is parking allowed on the curb during rush hour. From Patrick to Henry Streets there is no parking allowed. Has the City considered having no parking on the curb lane on the north side of Duke Street, between Alfred and Patrick Streets during afternoon rush hour?

Staff will look into his suggestions and report back.

(c) Councilwoman Pepper encouraged Council Members to attend the COG conference on Economic Growth and Affordable Housing to be held on March 23, 2001, at the National Press Club, Washington, D.C.

(d) Councilwoman Pepper provided Council Members with a copy of the COG Issue Briefing; a copy of which is on file in the office of the City Clerk and Clerk of Council, marked Exhibit No. 1 of Oral (d); 2/28/01, and is incorporated herewith as part of this record by reference.


(e) Councilwoman Pepper complimented Police Chief Samarra and the Community Police Officers who participated in the recent Agenda Alexandria meeting. She announced that there will be a replay of that meeting on our cable station on March 21, and March 23, at 9:30 p.m.

(f) Councilwoman Woodson spoke to the recent article in the Washington Post Virginia Weekly Section concerning the Stabler-Leadbeater Apothecary Museum.

(g) Councilwoman Eberwein reported that the Commission on Aging has partnered with the Alexandria Gazette Packet to produce a monthly page for our senior citizens called "Prime Time." This will be a special section of articles, editorials and events of particular interest to Alexandrians 55 and over.

(h) Councilwoman Eberwein announced that the Alexandria Transit Company has been working with the Alexandria Convention and Visitors Association on the upcoming proposed demonstration project to provide free shuttle service on King Street, on Friday evenings and all day Saturday and Sunday, on 10-minute headways. The buses would be decorated with a distinctive shrink-wrap design.

(i) Councilman Speck complimented the City Manager and staff on the initiation of the Leadership Institute of the City of Alexandria.

(j) Transportation and Environmental Services Director Baier spoke to a new initiative called the New Downtown Manager.

(k) Transportation and Environmental Services Director Baier provided Council with a visual display of the new pilot program of white-on-blue, with ship from City Seal, street signs.

ORDINANCE NO. 4190

AN ORDINANCE adopting supplemental pages for The Code of the City of Alexandria, Virginia, 1981, as amended, and providing for the repeal of ordinances not included therein, except those saved from repeal by this ordinance, and for other purposes.
THE CITY COUNCIL OF ALEXANDRIA HEREBY ORDAINS:

Section 1. That the sections and portions thereof set forth in the supplemental and replacement pages for The Code of the City of Alexandria, Virginia, 1981, each of which pages is identified in the lower left-hand corner by the notation "Supp. No. 60," are hereby adopted as and shall constitute "The Sixtieth Supplement to The Code of the City of Alexandria, Virginia, 1981."

Section 2. That the sections and portions thereof set forth in "The Sixtieth Supplement to The Code of the City of Alexandria, Virginia, 1981" shall be in force and effect on and after the effective date of this ordinance, and all ordinances of a general and permanent nature which were adopted between October 15, 2000 and January 23, 2001, inclusive, and which are not included in such supplement or in The Code of the City of Alexandria, Virginia, 1981, as amended, are hereby repealed, except as otherwise provided in section 3 of this ordinance.

Section 3. That the repeal provided for in section 2 of this ordinance shall not affect any offense or act committed or done, or any penalty or forfeiture incurred, or any contract established or accruing prior to the effective date of this ordinance; nor shall it affect any prosecution, suit or proceeding pending or any judgment rendered prior to said date; nor shall it affect any ordinance adopted after October 15, 2000, which amends the Zoning Ordinance of the City of Alexandria, Virginia, 1992, as amended; nor shall it affect any ordinance saved from repeal by Ordinance No. 1250; nor shall it affect any ordinance listed in appendices A through J, both inclusive, of The Code of the City of Alexandria, Virginia, 1981, or any pages supplemental to such appendices; nor shall it affect any provision of any ordinance adopted between October 15, 2000 and January 23, 2001, inclusive, and which is inadvertently omitted from or erroneously incorporated into "The Sixtieth Supplement to The Code of the City of Alexandria, Virginia, 1981," or any other supplement to the code; nor shall it affect any ordinance adopted after the effective date of this ordinance.

Section 4. That one complete set of pages comprising "The Sixtieth Supplement to The Code of the City of Alexandria, Virginia, 1981," shall be stapled or otherwise permanently fastened together, shall be manually signed on the front sheet by the mayor and the city clerk, and shall be filed in the office of the city clerk and made available to any person desiring to inspect the same. In addition, one complete set of the supplemental and replacement pages of such supplement shall be properly inserted into the copy of The Code of the City of Alexandria, Virginia, 1981, which bears the manual signatures of the mayor and the city clerk, and such code, as amended and supplemented, shall be kept on file in the office of the city clerk and be made available to any person desiring to inspect the same.
