1. Calling the Roll.

The meeting was called to order by Mayor Euille, and the Deputy City Clerk called the roll; all the members of City Council were present, except Councilwoman Joyce Woodson, who had an excused absence.

Legislative Director Bernie Caton and State Representative Brian Moran gave an final report of the activities of the 2005 General Assembly and answered questions from City Council.

12. Presentation of the Proposed Annual Operating Budget for FY 2006 (including Schools) and the Proposed Capital Improvements Program for FY 2006-2011 (including the Schools CIP).

City Manager Hartmann presented the proposed Annual Operating Budget for FY 2006 and the Proposed Capital Improvements Program for FY 2006-2011. Assistant City Manager Jinks and Director of the Office of Management and Budget Johnson gave detailed descriptions of the different components of the proposed budget.

New Business Item #1: Director of Transportation and Environmental Services Baier gave an update on the traffic problems occurring on Route 1 as a result of construction from the Woodrow Wilson Bridge Project. Nick Nicholson, Virginia Department of Transportation (VDOT), updated City Council on the steps that VDOT would implement to try to alleviate some of the problems caused by the construction.

13. City Council accepted the following resignations with regret: (a) Michael Gaw, Alexandria Consumer Affairs Commission and (b) James Moore, Alexandria Convention and Visitors Association Board of Governors.

14. City Council made the following appointments: (a) reappointed Kenneth Hill and appointed Lois Lipson as the two citizen members to the Alexandria-Gyumri Sister City Committee; (b) appointed John Bramer, Mary Gregerson and Ruth McKenty as the three citizen members to the Alexandria Beautification Commission; (c) reappointed Dennis Auld as the member designated by the Alexandria Chamber of Commerce to the Alexandria Budget and Fiscal Affairs Advisory Committee; (d) appointed John Chapman as the citizen-at-large to the Alexandria Commission on HIV/AIDS; (e) reappointed Alan Dubow as the business member to the Alexandria Consumer Affairs Commission; (f) reappointed Thomas Clark as the emergency room physician from INOVA Alexandria Hospital and waived the residency requirement and reappointed Martin Brown as the representative of the Alexandria Medical Society who has privileges at INOVA Alexandria Hospital to the Alexandria Emergency Medical Services Council; (g) reappointed Anne Paul as the representative from the Alexandria Historical Society and appointed Robert Watkins, Jr. as the representative from the George Washington Masonic Memorial to the Historic Alexandria Resources Commission; (h) reappointed Alison Decourcey and appointed J. 15. City Council authorized: (1) the submission of the grant renewal application to the Virginia Tobacco Settlement Foundation, in the amount $70,565, to continue services to 275 children aged 3-5 years, to include providing parenting workshops, monitoring the implementation of Al's Pals, a science-based prevention program delivered by 20 trained preschool teachers, and providing consultation to parents and teachers regarding child behavior problems; and (2) the continuation of a full-time bilingual Therapist II (1.0 FTE) in the Department of Mental Health, Mental Retardation and Substance Abuse.

27. Consideration of Proposal to Accept a Safe Haven Grant Award from the U.S. Department of Housing and Urban Development for a Safe Haven Facility at the City Owned- Property at 115 North Patrick Street.

ORAL REPORTS BY MEMBERS OF CITY COUNCIL

(a) Vice Mayor Pepper reported that she, Councilman Smedberg and T&ES Director Baier met with Ralph DiGinero about issues surrounding the Mirant Plant and his potential business with the plant. Vice Mayor Pepper requested that Director Baier give an overview of the meeting with Mr. DiGinero.

Director Baier gave a brief overview of the meeting and recommended that Council stay the course of action it is following concerning the Mirant Plant.

(b) Councilman Smedberg requested that Director Baier give an update on the downwash study and consent order concerning the Mirant Plant.

Director Baier gave an update of the ongoing downwash study and a letter has been sent to Virginia Department of Environmental Quality requesting: (1) clarification of the term "nearby" as it relates to the Mirant case; (2) all of the toxic and noxious gases be part of the parameters of the protocol for Mirant; and (3) the inclusion of the PM2 particles in the protocol. Director Baier reported that Council would receive a written update on the Consent Order about activity at the plant at an upcoming legislative meeting.

(c) Councilman Gaines reported on updated actions to improve regional transportation and coordination during incidents from the Council of Governments Transportation Planning Board.

ORAL PRESENTATIONS BY MEMBERS OF CITY COUNCIL

(a) Councilman Macdonald thanked City Staff, Police and Fire for their help during the last two parades in Alexandria.

(b) Councilman Macdonald encouraged everyone to visit the refurbished Old Town Theater and commended the owner on the restoration.

(c) Councilman Macdonald commended the Police Department on apprehending the individuals that were attacking pizza delivery workers in Alexandria and he reported that the Police would be working with delivery workers on safety methods.

(d) Councilman Macdonald reported that he and City Manager Hartmann visited the construction site at T.C. Williams High School and were impressed with the process and quality of the construction.

(e) Councilman Krupicka reported that Del Ray has received recognition as one of the top five upcoming neighborhoods in the country and will be discussed on television program, "The View" on Thursday, March 10.

(f) Councilman Krupicka inquired whether the open space in front of Chinquapin could be used for overflow parking while construction was taking place at T.C. Williams.

City Manager Hartmann noted that staff would look at the parking and approach the parking from several different avenues to find a viable solution.

(g) Vice Mayor Pepper commended Captain Rodney Masser, Fire Department, for receiving an honor from the Jaycees for helping with the rescue during the helicopter crash into the Potomac River.

ORAL REPORT FROM THE CITY MANAGER

City Manager Hartmann reported that there would be a meeting of the Jones Point Park stakeholders and requested that Director Baier give an overview of the upcoming meeting.

Director Baier reported that there would be a meeting with Parks, Recreation and Cultural Activities of the different stakeholders in the Jones Point Park issue to discuss the current plans for the park and other issues surrounding the proposed plan. Director Baier noted that the meeting would be March 23 at 7:00 p.m., at the Lee Center.

ORDINANCES AND RESOLUTIONS

28. Consideration of a Resolution Opposing Elimination of the Community Development Block Grant Program. [ROLL-CALL VOTE]

WHEREUPON, upon motion by Councilman Gaines, seconded by Vice Mayor Pepper and carried unanimously by roll-call vote, City Council adopted the resolution opposing elimination of the Community Development Block Grant Program and authorized the City Manager to forward it to the City's Congressional Delegation. Resolution No. 2141

WHEREAS, President Bush, in his fiscal year 2006 budget, has proposed the elimination of the Community Development Block Grant program, which has funded a myriad of housing, social service, and economic development programs in this community; and

WHEREAS, in this community and in communities throughout the nation, thirty years of Community Development Block Grant funding has developed a strong network of relationships between this local government, residents and the many non-profit agencies that provide services and help make possible our commitment to our neighborhoods; and

WHEREAS, this community recognizes that the Community Development Block Grant program is a partnership of Federal, state, and local government, business, non-profit and community efforts, and that the services funded by the CDBG program, administered by the local government and often delivered by local non-profit organizations, relies heavily on the dedication of and good will of our combined efforts; and

WHEREAS, this community recognizes all the participants whose hard work and devotion to the neighborhood and their low- and moderate-income residents help insure the quality and effectiveness of the Community Development Block Grant program;

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Alexandria, Virginia opposes the proposed elimination of the Community Development Block Grant Program.

BE IT FURTHER RESOLVED, that this community, along with the housing and service providers and others whose names are appended to this resolution, hereby petition the U. S. Congress to recognize the outstanding work being done locally and nationally through the Community Development Block Grant program, and the program’s vital importance to the community and to the people who live in its lower income neighborhoods, and to strongly oppose any proposal to eliminate the Community Development Block Grant Program; and

BE IT FURTHER RESOLVED, that copies of this resolution be conveyed to the appropriate elected officials of the Federal government and that this community’s name, and the names of its non-profit housing and service providers, be added to the roll of those committed to the preservation and full funding of the Community Development Block Grant program and the maintenance of its essential features.

29. Consideration of a Resolution on the Proposed State Constitutional Amendments Defining Marriage and Reaffirming the City's Human Rights Ordinance. [ROLL-CALL VOTE]

WHEREUPON, upon motion by Councilman Smedberg, seconded by Councilman Gaines and carried unanimously by roll-call vote, City Council approved the resolution on the proposed State Constitutional Amendments defining marriage and reaffirming the City's Human Rights Ordinance. RESOLUTION NO. 2142

WHEREAS, the City of Alexandria Human Rights Ordinance was passed by City Council thirty years ago on March 25, 1975; and

WHEREAS, the City of Alexandria passed an ordinance in 1988 amending the Human Rights Code to protect people from discrimination on the basis of sexual orientation; and

WHEREAS, the City of Alexandria has consistently adopted policies that reflect its commitment to diversity, include all members of the community in city government and protect the civil liberties of all citizens; and

WHEREAS, constitutional amendments at the federal and state level defining marriage as only between a man and a woman intentionally discriminate against lesbians and gay men by denying them access to the protections, benefits and responsibilities extended through civil marriage, such as pensions, social security benefits, tax provisions, health insurance, hospital visitation, inheritance and other family law provisions; and

WHEREAS, such proposed constitutional amendments appeal to Americans’ prejudices and fears rather than to their higher values of equality and justice; and

WHEREAS, the long and honorable history of the United States Constitution, and its role in expanding and protecting human rights through the first ten amendments known collectively as the Bill of Rights and through later amendments, would be tarnished by any amendment that restricts the civil rights of any group of Americans;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alexandria:

1. The Alexandria City Council declares its opposition to any proposed federal constitutional amendment defining marriage as only between a man and a woman; and

2. The Alexandria City Council opposes any attempts by Virginia elected officials to pass similar discriminatory legislation; and

3. The Alexandria City Council reaffirms the City’s Human Rights Ordinance; and

4. The Alexandria City Council urges members of Virginia’s congressional delegation to pursue policies that affirm individual and family rights for all citizens, support local efforts to create inclusive and diverse communities, and create the federal legal atmosphere necessary for equality in civil rights.

WHEREUPON, upon motion by Vice Mayor Pepper, seconded by Councilman Gaines and carried unanimously, City Council adopted the City Council Schedule for the months of March through June, 2005 with the following additions and changes: (a) change the Tuesday, May 24, 2005, 5:30 p.m. work session on the Community Health Assessment and the 7:00 p.m. legislative meeting to Wednesday, May 25, 2005; (b) schedule a reception on April 26, 2005 at 6:00 p.m., to recognize the Alexandria Economic Development Partnership, Inc. for winning the American Planning Association Award for the PTO Project; and (c) change the work session with the Transportation Task Force on Tuesday, April 12, 2005 at 5:00 p.m. to Tuesday, May 10, 2005 at 5:00 p.m. The voting was follows:
