END OF CONSENT CALENDAR

WHEREUPON, upon motion by Councilwoman Pepper, seconded by Vice Mayor Donley and carried unanimously, City Council approved the consent calendar. The City Manager's recommendations were as follows:

6. City Council accepted the following resignations with regret: (a) Hurbert Herre, Alexandria Convention and Visitors Association Board of Governors; (b) Michael Crawford, Commission on Employment; (c) Jon Mahaingappa, Commission on Persons with Disabilities; (d) Jessica Bayliss Brown, Environmental Policy Commission; (e) J. Glenn Eugster, Public Records Advisory Commission; and (f) Jim Larrison, Sanitation Authority.

7. City Council made the following appointment to boards and commissions: (a) appointed Olivia Bambara as the one student member who resides in the City and attends high school in the City to the Commission for the Arts; (b) appointed Carl Glad as the one citizen member to the Commission on Employment; (c) reappointed Paul Prevost as the one citizen member to the Emergency Medical Services Council; (d) appointed Jeanne Theismann as the one representative of the broadcast/print media to the Local Emergency Planning Committee; and (e) reappointed Charles Ziegler as the one citizen member to the Public Records Advisory Commission.

8. City Council appointed Acting Office of Management and Budget Director Morgan Routt to the City of Alexandria Firefighters and Police Officers Pension Board to serve in the place of Acting City Manager Bruce Johnson as a management representative until Mr. Johnson returns to his position of Chief Financial Officer. At that time, Mr. Routt will once again become the alternate representative of City management.

9. City Council: 1. approved the submission of a grant application (due June 20, 2011); and 2. authorized the Acting City Manager to execute the necessary documents that may be required.

10. City Council authorized the City Manager to: 1. submit a non-competitive grant application to the Virginia Department of Environmental Quality, Litter Prevention and Recycling Program, for funding in the approximate amount of $19,332 for the adopt-a-park litter control program (the exact amount to be determined by the Virginia Department of Environmental Quality by September 30, 2011); and 2. execute all necessary documents that may be required.

11. City Council received the report of the design proposal and scheduled it for public hearing and consideration on Saturday, June 25, 2011.

12. City Council received the results of the fair housing tests conducted in FY 2011 for discrimination in rental housing on the basis of familial status.

13. City Council introduced the ordinance, passed it on first reading and scheduled it for public hearing, second reading and final passage on Saturday, June 25, 2011.

REPORTS AND RECOMMENDATIONS OF THE CITY MANAGER FOR DISCUSSION

25. Consideration of a Resolution Supporting Legislation to Provide for a Slower Transition of Workers into the Washington Headquarters Service Building at the Mark Center. [ROLL-CALL VOTE]

WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilwoman Pepper and carried 6-0 by roll-call vote, City Council: 1. Approved the resolution which endorses legislation relating to BRAC-133 and requests Senators Warner and Webb to support the legislation; and 2. directed staff to provide copies of the resolution to Senators Warner and Webb, Congressman Moran and the chairs of the Senate Armed Services and Senate Appropriations Committee. The resolution reads as follows:

RESOLUTION NO. 2457

Supporting legislation to provide for a slower transition of workers into the
Washington Headquarters Service Building at the Mark Center

WHEREAS, the Washington Headquarters Service is being relocated to the Mark Center as a result of the recommendations of the 2005 federal Defense Base Closure and Realignment Commission; and

WHEREAS, the first of 6,400 employees are scheduled to report to the new Washington Headquarters Service office building at the Mark Center, near the intersection of I-395 and Seminary Road, beginning in August; and

WHEREAS, there is insufficient public transportation available to workers at the Mark Center site; and

WHEREAS, a number of future road improvements are planned for the area around the Mark Center to ease anticipated traffic congestion; and

WHEREAS, none of these improvements will be completed prior to the move-in, which is scheduled to be completed by the end of 2011; and

WHEREAS, provisions have been included in H.R. 1540 (the 2012 National Defense Authorization Act, which has now passed the U.S. House of Representatives) that could allow for a slower transition of workers into the new Mark Center site; and

WHEREAS, the first of these provisions will give the Secretary of Defense the ability to delay the implementation of up to seven of the BRAC sites nationwide for a year; and

WHEREAS, the second of these provisions will temporarily place a limit of 1,000 on the number of parking spaces that can be used in the Mark Center garage, which should substantially lessen the congestion impacts from the project in the short term by forcing the Department of Defense to limit the number of employees who initially occupy the Mark Center building; and

WHEREAS, these two provisions are expected to significantly lessen some of the traffic congestion problems that will occur if all 6,400 employees move into the building this year; and

WHEREAS, it is in everyone’s interest to make this transition of the Washington Headquarters Service and other Department of Defense agencies to its new building as smooth as possible, and to limit additional traffic congestion to the greatest extent possible; and

WHEREAS, these two legislative proposals will help accomplish those objectives, and will be beneficial for all affected parties—residents in the area, those who already work at the Mark Center, and commuters who will spend additional time on I-395 and other roads, especially the Department of Defense employees who are being transferred to the BRAC-133 building; and

WHEREAS, these two proposals will be under consideration by the United States Senate; and

WHEREUPON, a motion was made by Councilman Smedberg and seconded by Vice Mayor Donley that City Council will not hold a public hearing on June 28 and will postpone any action until September 2011, when it will hold a public hearing on the matter.

Council asked that at its next legislative meeting it lay out a process by which it can facilitate a discussion of the hard questions about how it manages the existing realities on those sites, how does it think about ways to expand open space and cultural and arts uses, and how it looks at ways to engage in public/private partnerships to potentially allow them to achieve additional attributes to the waterfront that people are looking for. In terms of the work group to work over the summer, they need to flush it out in terms of who will be on it and how many in order to have fair representation and balance. Staff was asked to draft something to bring back at the June 25 meeting.

WHEREUPON, upon motion by Councilwoman Hughes, seconded by Councilwoman Pepper and carried unanimously, City Council: 1. received the work group report, which recommends the establishment of a new 25 member commission, the Alexandria Children, Youth and Families Collaborative Commission, with high level City and community representatives who would have responsibility for making recommendations to City Council and the School Board on policy for youth, prenatal to 21 years of age; 2. thanked the members of the Work Group for their work on behalf of the City and School Division; 3. passed the ordinance on first reading and scheduled it for public hearing, second reading and final passage on Saturday, June 25. The ordinance establishes the new commission and abolishes the Alexandria Early Childhood Commission and the Youth Policy Commission; 4. thanked the members of the ECC and the YPC for their dedicated service; and 5. requested staff to work with the Work Group to make initial recommendations regarding the new commissions' proposed membership. Councilman Krupicka encouraged staff to bring back recommendations for how it can start looking at rebuilding the program on traffic calming, especially speeding, pedestrian safety, sidewalk and related issues, and specifically for staff to outline for Council that list of projects that it already knows neighbors have raised concerns about.

WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilwoman Pepper and carried 6-0-1, City Council: 1. authorized the transfer of ownership of the City-assisted Arbelo, Lacy Court, and Longview Terrace Apartments from RPJ Housing (RPJ) to the Alexandria Housing Development Corporation (AHDC) and approved the assumption by AHDC of RPJ's outstanding loans from the City, with the understanding that a plan for permanent financing will be developed and presented for Council consideration by the end of the calendar year; 2. authorized the reservation of up to $574,000 of affordable housing funds for disbursement as needed to enable AHDC to cover its due diligence and transactional costs, along with a reserve to cover any unforeseen capital or operating needs for up to 12 months, until permanent financing is secured; and 3. authorized the City Manager to provide a comfort letter, as described herein, to AHDC's first trust lender, BB&T, and to execute all other necessary documents. City Council asked Ms. Davis, when she is doing a summary report on the RPJ, to also update Council on this project and how it is going forward.

WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilwoman Pepper and carried unanimously, City Council: 1. increased the approved allocation from up to $3.0 million to up to $4.8 million of the originally planned $6.4 million amount previously identified for the purchase by ARHA of individual housing units to satisfy the outstanding agreement to provide 16 replacement housing units for the James Bland redevelopment, subject to the terms and conditions previously approved on February 22; and 2. rescind the previous authorization related to the long term payment by the City of condominium fees for the 16 units, as ARHA has indicated that it no longer needs City assistance with such fees under ARHA's revised plans. WHEREUPON, upon motion by Councilwoman Pepper, seconded by Vice Mayor Donley and carried unanimously, City Council agreed to a release of the Declaration of Restrictive Covenants and Deed of Easement, in the event of foreclosure, or deed in lieu of foreclosure, so that ARHA can close on its permanent financing for Quaker Hill with the Virginia Housing Development Authority (VHDA) as the new first trust lender, with the understanding that the City's interest in the property as affordable housing will remain protected through a right to assume, cure and/or purchase or pay-off VHDA's loan (including through a designated entity) in the unlikely event of a default. (a) Councilwoman Hughes noted the death of Sylvester Lorenzo Shannon, a Vietnam War Veteran and long-standing Northern Virginia resident, and she sent her condolences to the family.

(b) Councilwoman Hughes said she received a letter from Gwen Lewis about the concerned citizen network, which is a group that has made a request for supplemental funding in the amount of $10,000 to extend the funding on a program from the ACPS called RARE. She asked for the sense of Council for docketing the item for consideration on June 28.

Acting City Manager Johnson noted that there are no undesignated contingent reserves in FY 2012, so to come up with funds for something like this Council would have to designate part of a surplus, but that won't be known until September/October. He said there is no source right now for this request in the contingent reserves.

Mayor Euille suggested this be forwarded to staff so staff can reflect on it and bring it back to Council at the appropriate time.

(c) Councilwoman Hughes said that at the National Press Club on Thursday, there are some organizations who will come together to talk about asthma prevention and treatment, and she will be speaking to the group.

(d) Councilwoman Pepper said that this Saturday, the T.C. Williams senior students will be graduating, and there will be the all-night graduation party in the evening and they would love to have volunteers.

(e) Mayor Euille noted that on Thursday, June 23, the WMATA Board of Directors will be approving their FY2012 operating and CIP budget, it is a $1.4 billion budget that will maintain current fares, no rail, bus or paratransit service decrease changes, and the budget will be balanced with the $66 million subsidy coming from the Compact members.

(f) Mayor Euille said that on Saturday, June 25, the Northern Virginia Housing Opportunity Expo will be taking place from 10 a.m. to 4 p.m. at T.C. Williams High School. This will be a regional sponsored event.

(g) Councilman Krupicka acknowledged that Stacy Hoeflich, a teacher at John Adams Elementary School, was named the 2011 Virginia history teacher of the year.

(h) Councilman Krupicka said that at its last Council meeting, Council passed a resolution to encourage making playgrounds smoke-free, and the question has come from the Public Health Advisory Commission related to Alexandria's birthday party and the question is is it possible to delineate or encourage people who want to smoke to do it in certain areas, so other people who are allergic or who have children aren't near the smoke.

Mayor Euille noted that the request has gone to Parks and Recreation for its consideration.

(i) Councilman Krupicka said Council received a number of emails over the last couple of weeks about the bikeshare program that is going on in D.C. and Arlington and is very successful. He said as he understands it, there are grant monies available to help bring the program into Alexandria, and a decision needs to be made about whether it will try it out and he asked what is the process to come to closure on the decision.

Acting City Manager Johnson said it will be brought to Council in the Fall for Council's consideration.

(j) Councilman Smedberg passed out the brochure that advertises the position of City Manager and the advertisements will be rolled out over the next week or two.

RESOLUTION NO. 2458

WHEREAS, legislation (S. 883) is pending in the U. S. Congress to establish the National Liberty Memorial at an unspecified site in the monumental Core of Washington, D.C., to African Americans of the Revolutionary war era with funds donated by citizens of the United States and nations around the world who are inspired by their struggle for liberty; and

WHEREAS, from 1775 to 1783 over 5,000 slaves and free persons, including 500 Virginians -- among them Benjamin Whitmore, Joseph Longdon, John Pipisco and William Lee of Alexandria -- advanced Independence and universal liberty by serving as soldiers and sailors in the Continental Army, Navy, and local militias while countless others performed patriotic acts as civilians; and

WHEREAS, from as early as 1848, when historian William C. Nell and others petitioned the Massachusetts legislature for a memorial to Crispus Attucks, and 1908, when Virginians Giles B. Jackson and Webster Davis observed, “Monuments innumerable have been erected to white soldiers who fought in the Revolution. Only a few kind words have been said for the colored soldiers,” there has been a consciousness over 158 years that those patriots deserve a national memorial; and

WHEREAS, finally, between 1984 and 1988, Congress approved Public Law 98-245 honoring the role of the black soldiers, patriots, run-away slaves and freedom petitioners and authorized a black patriots memorial at a prominent site near the Lincoln Memorial with the enactment of Public Laws 99-558 and 100-265; and

WHEREAS, the original founder of the project, and one compelled to resurrect it, Maurice A. Barboza, has been a resident of Alexandria since 1995 and prior to that, from 1972 to 1974, began researching his own Revolutionary War heritage while a resident of Northern Virginia and later aided his aunt in overcoming resistance to be able to join the National Society Daughters of the American Revolution and discovered books, news articles and documents at libraries in the area to establish the worthiness of the memorial; and

WHEREAS, in the past 25 years since the memorial was first authorized, scores of African Americans have traced their heritage to the Revolutionary War; hundreds of prominent books and articles reaffirm the worthiness of the history, including “Forgotten Patriots,” published in 2008 and containing the names of over 5,000 unsung heroes, including six patriots from Alexandria;

NOW, THEREFORE, BE IT RESOLVED, that the Alexandria City Council urges Congress to enact S. 883; and

BE IT FURTHER RESOLVED, that copies of this resolution be provided to Congressman Jim Moran, Senator Jim Webb and Senator Mark Warner, to apprise them of the City’s support of this legislation.

WHEREUPON, upon motion by Vice Mayor Donley, seconded by Councilwoman Hughes and carried unanimously, City Council: 1. received the updated City Council calendar for June-August which has the following additions: The Inova Alexandria Hospital 50th anniversary celebration of the "Alexandria Plan" at 11:00 a.m. on Friday, June 24 at the Inova Alexandria Hospital auditorium; and the time for the 28th annual National Night Out has been established from 5:00 p.m. to 10:00 p.m. on Tuesday, August 2; 2. Noted the following changes to the tentative City Council calendar for September 2011-June 2011. The calendar will be adopted by Council in September: Addition of the October 2-4 Virginia Municipal League Conference at the Ramada Plaza West Richmond in Henrico County; change of the date of the first legislative meeting in November from Tuesday, November 8 (election day) to Wednesday, November 9; addition of the tentative date for the dedication of the new Police Department headquarters and Department of Emergency Communications Building on Wednesday, November 9 from 10:00 a.m. to noon; and addition of the annual work session on the City's proposed legislative package with the State legislative delegation before Council's Tuesday, November 22 legislative meeting.

City Council noted that the June 28 legislative meeting would begin at 6:00 p.m. and there would be no work session prior to the meeting. The work session items will be postponed to the second meeting in September.

Councilwoman Hughes said she would be leaving town on June 29 to give a talk in Houston on June 30.
